Showroom Drive. The request is to vacate two portions of a utility easement within the Auto Park Complex. See the attached maps and legal descriptions for the exact locations of the requested alley vacation. No objections from the adjacent property owners have been submitted to the City. The applicant has submitted the required notification forms to the utility companies and to the City. The results are as follows: Ozarks Electric -No objections. Southwestern Electric Power Company-Not applicable Arkansas Western Gas -No objections, "Existing 3"gas line may need to be relocated to accommodate building expansion. Landers Auto will be responsible to pay all costs of relocation and provide acceptable easement." SW Bell—No objections. Cox Communications-No objections. Relocation of the sewer line is not recommended due to the additional utilities and the location of the gas pump. Parking Provided: 32 Parking Required: 32 Existing Development: Vacant Surrounding Zoning: A-1 (east), C-1, C-2 (west),A-1 (north), R-O (south) Surrounding Land Use: Vacant(east), Gas Station(west),Vacant(north),Vacant (south) Right-of-way being dedicated: 55 feet from c/1 along Highway 265 and Joyce along the south boundary. 35 feet from c/1 along Joyce on the eastern boundary. The applicant proposes to widen the west side of Joyce Street to 14 feet from center line from the proposed driveway south to where Joyce Street turns west. Staff recommends that the west side of Joyce St. be widened to 14 feet from center line and underground drainage be installed for the entire east side of the property excluding the intersection with Highway 265. Staff has requested on numerous occasions for additional information in order to provide rational nexus calculations. 2. Planning Commission determination of compliance of Commercial Design Standards. A determination for the use of the unpainted concrete precision block walls will need to be made (please see attached waiver request). Staff has recommended throughout the development review process to incorporate the architectural design elements that are shown on the southwest elevation to the other three sides of the building. This building has three sides that directly face a public street. The northeast elevation is also visible from the public street. §166.14 SITE DEVELOPMENT STANDARDS AND CONSTRUCTION AND APPEARANCE DESIGN STANDARDS FOR COMMERCIAL STRUCTURES. D.Design Elements Guidelines for Commercial Structures. 1. The elements to avoid or minimize include: a. Unpainted concrete precision block walls. b. Square "boxlike" structures. c. Metal siding which dominates the main facade. d. Large blank, unarticulated wall surfaces. e. Large out of scale signs with flashy colors 3. Cross access shall be constructed to the north property line. 4. Plat Review and Subdivision comments (to include written staff comments provided to the applicant or his representative, and all comments from utility representatives -AR Western Gas, SWBT,Ozarks, SWEPCO, Cox Communications) 5. Staff approval of final detailed plans, specifications and calculations (where applicable) for grading, drainage, water, sewer, fire protection, streets(public and private), sidewalks, parking lot(s) and tree preservation. The information submitted for the plat review process was reviewed for general concept only. All public improvements are subject to additional review and approval. All improvements shall comply with City's current requirements. 6. Sidewalk construction in accordance with current standards to include 6 feet wide along Joyce Blvd. and Highway 265. 7. Prior to the issuance of a building permit the following is required: a. Grading and drainage permits b. Separate easement plat for this project that shall include the tree preservation area. C. Completion of all required improvements or the placement of a surety with the City(letter of credit,bond, escrow)as required by§158.01 " Guarantees in Lieu of Installed Improvements to guarantee all incomplete improvements. Further, all improvements necessary to serve the site and protect public safety must be completed, not just guaranteed,prior to the issuance of a Certificate of Occupancy Background: The project was reviewed at the July 31, 2002 Technical Plat Review and the August 15,2002 Subdivision Committee Meeting. Discussion at the Subdivision Committee meeting included commercial design standards, street improvements and the standard conditions of approval. The Subdivision Committee forwarded the Large Scale Development to the full Planning Commission subject to all staff comments. Infrastructure: L Water. An 8"water line will be extended to serve this development from the intersection of Joyce and Highway 265. 2. Sanitary Sewer: Sanitary sewer is not accessible within 300 feet of the development. A septic system is proposed for the site. 3. Streets. Existing 4. Grading and Drainage. A preliminary grading plan and drainage report have been submitted and reviewed for general compliance. A final review and approval will be necessary before construction can begin. Revised plans were submitted this morning. Landscape plans are being submitted directly to Kim, and Mel is providing explanatory justification for not widening Joyce Street north of the proposed driveway and to other engineering comments directly to Matt. Conditions to Address/Discuss: 1. Planning Commission determination of required improvements to Joyce Street. The applicant proposes to widen the west side of Joyce Street to 14 feet from center line from the proposed driveway south to where Joyce Street turn west. Staff will make a recommendation to Agenda Session. The Developer, Andy Bethell, has ask that Mel to present justification for the submitted proposal. The Developer does not intend to widen Joyce Street north of the proposed driveway nor to close the open drainage ditch(install storm sewer piping). The drainage system south of the driveway entrance has been routed along the west side of Joyce Street as requested by Matt(will not pass through detention). The piping south of the driveway is the way the drainage system and detention was originally designed and agrees with the drainage report submitted for Tech Plat review. A final drainage report, construction drawings and details will be submitted to engineering staff for final review after the resolve of current issues and Planning Commission approval. The developer, Andy Bethell, would appreciate the opportunity to address the Planning Commissioners at their August 26's meeting to present his prospective on this issue. 2.
