THE PLANNING COMMISSION
A meeting of the Fayetteville Planning Commission will be held Tuesday,May 29,2001 at
5:30 p.m. in the City Administration Building, 113 West Mountain Street,Room 219,
Fayetteville, Arkansas.
The following items will be considered:
Approval of minutes from the May 14,2001 meeting.
Consent Agenda:
1. VA 01-4.00: Vacation (Wedington Place Phase H,Lots 4A& 4B , pp 401)was
submitted by Robert Brown of Development Consultants, Inc., on behalf of Wedington
Place Senior Apartments, LLLP for property located on Lots 4A & 413 of Wedington
Place Phase II. The property to be vacated is zoned R-2, Medium Density Residential
and contains approximately 0.74 acres. The request is to vacate one drainage easement
and one utility easement.
New Business:
2. VA 01-5.00: Vacation (University of Arkansas,pp 483) was submitted by Edward
Connell of the City of Fayetteville on behalf of University of Arkansas for property
located east and north of 10 N. Garland Avenue, between Lots 17-24 McIlroy's
University Addition and Lots 400-402 of Oak Park Place Addition. The property is
zoned R-1, Low Density Residential and contains approximately 0.409 acres. The
request is to vacate undeveloped street right of way.
3. LSD 01-12.00: Large Scale Development(City of Fayetteville, Lewis Street Soccer
Field, pp 406) was submitted by the Parks & Recreation Division on behalf of the City of
Fayetteville for property owned by the University of Arkansas located at 1515 North
Lewis Avenue. The property is zoned P-1, Institutional and contains approximately 27
acres. The request is to develop 7.73 acres with parking for soccer fields.
4. CU 01-13.00: Conditional Use (Islamic Center, pp 521) was submitted by Fadil
Bayyari on behalf of the Islamic Center of NW Arkansas for property located at 1420 W.
Center Street. The property is zoned R-2, Medium Density Residential and contains
approximately 0.67 acres. The request is build a 9,264 square foot Islamic Center(use
unit 4) with 14 parking spaces on-site.
5. CU 01-14.00: Conditional Use (Central United Methodist Church, pp 484) was
submitted by Dave Jorgensen of Jorgensen & Associates on behalf of Central United
Methodist Church for property located at 346 N. St. Charles. The property is zoned R-O.
Residential Office and contains approximately 0.30 acres. The request is for a church
(use unit 4, cultural & recreational facility) in a R-O district.
6. LSD 01-14.00: Large Scale Development(Central United Methodist, pp 484)was
submitted by Dave Jorgensen of Jorgensen& Associates on behalf of Central United
Methodist Church for property located at 346 N. St. Charles. The property is zoned R-O,
Residential Office and contains approximately 0.30 acres. The request is to build 31
additional parking spaces.
7. AD 00-46.00: Administrative Item to Amend the Definition of a Family in the UDO.

Telluride Drive, Lots 4A & 4B, Wedington Place Addition, Phase II. The request is to vacate a
20'wide drainage easement and a 20' wide utility easement as shown and described on the attached

The requested easement vacations are due to the building configuration that was approved for the
Wedington Place Senior Apartments Large Scale Development. The existing utilities will be
relocated to newly dedicated easements.

Project: VA 01-05.00: Vacation (University of Arkansas, pp 483) was submitted by Ed
Connell, City Land Agent, for property located at 10 North Garland Avenue, Lots 400-402, Oak
Park Place Subdivision. The request is to vacate the undeveloped 40' wide right of way to the east
and north of the above address and Lots 17-24 McIlroy's University Addition. See the attached

The University of Arkansas has recently purchased all tracts of land adjacent to this undeveloped
street right-of-way. In exchange for this right-of-way vacation the University has agreed to
provide "the City with a credit in the amount of$26,700.00 to be used by the City only in any
future land negotiation between the two parties...."

Undeveloped ROW Vacation
The University of Arkansas has purchased the property at 10 N. Garland Avenue (previous fraternity)and have
plans to utilize the building for residential purposes. This property is designated as Lots 400-402 of Oak Park
Place Subdivision to the City of Fayetteville and is surrounded by city road rights of way, most of which have not
been developed over many years(originally platted in 1927). With the renovation of the building at this address,
the U of A is in need of additional parking area in the rear of the building and have asked the city to consider
letting them utilize some of the undeveloped road right of way for this purpose.
As shown in the attached diagram, there exists an undeveloped or"proposed"roadway from Hannon Ave. to
Garand Ave. which separated J. H. McIlroy `s University Addition from the Oak Park Place Addition.
Additionally, an undeveloped platted roadway exists between lots 400-402 and lots 17-24 of J. H. McIlroy
University Addition. The U of A is owner of lots 12-24 and lots 400-402 of the (McIlroy's) University
Subdivision and lots 120-124,pt of lots 124-126, and all of lots 127-129 of Oak Park Place. The probability of
the City wanting to extend a street through to Maryland Street or Garland Avenue is very remote. Nothing is
called for on the Master Street Plan.
In an cooperative effort with the U of A, it is proposed that road rights of way that adjoin the subject property on
the East and North be vacated in favor of the U of A since they own property on both sides. This vacation would
allow the university to implement their requested parking lot expansion.
The City, in implementing this vacation, would like to receive financial credit from the U of A for such land, to
be used by the city as a warrant in future negotiations on land exchange between the parties. An estimate of the
land value is approximately $1.50/ ft' or $65,000/acre. With the area of vacation being 0.409 acre,the U of A
should grant or recognize that the City has a warrant or credit in the amount of$26,700.00 to be used by the
City only in any land negotiations between the two parties. This should be made a condition of the vacation.
The City and the U of A are currently considering a land exchange involving acreage along Lewis Ave./Mt.
Comfort Rd.(27 acres) and City property(10 acres) along Razorback Road. The above figure is but a small
portion of that overall difference but every little bit helps. The City does not have any utilities witbin the-- *o
be vacated and does not intend to retain such rights. Planning Commission

At the moment, much of this unimproved roadway, from Harmon Ave West to the area of consideration, is full
of trash and debris. The area of the right of way, which is to be unaffected by the subject vacation, has a
problem with wild bird (Starlings, etc.)roosting which is causing a distinct health problem Some of the
adjoining U of A property has the same problem and the U of A has asked the City to cooperate with them in an
effort to resolve the situation. At this point,the Health Dept. has not been called but complaints have come in
from residents along California Blvd. The City is thankful that the U of A acquired the property where this
house is located as the city has had many problems with the previous owner.
It is noted that it is probably in the City's best interest to vacate the entire unimproved right of way from
Harmon Ave. to Garland. At this point, however, the University would not petition for this latter vacation since
they are trying to acquire Lots 117, 118 and 120 of the Oak Park Place S/D. Once those lots are purchased,
they will probably request vacation. While the U of A is owner of Lots 100, 101 & 102 of the Oak Park Place
S/D, they do not own Lots 1 thru 10 of the J. H. McIlroy's University Addition. There is roughly 1050 linear
feet, at 40 foot width, on that portion of the remainder right of way after vacation. This amounts to almost one
(1) acre or approx. $63,000.
By copy of this vacation request, the City Attorney is hereby requested to prepare an agreement between the
City and the University of Arkansas which addresses the financial matter stated above. It is firmly believed that
the vacation of the proposed undeveloped(for 74 years)road right of way will benefit both the University and
the City, while maintaining a possible extension of West Center Street in the future. The area needs to be
maintained.
This memorandum is submitted for your review before a formal request for vacation is presented to the Planning
Commission and/or City Council. If you have any questions or if additional information is required, give me a
call at 415. If you approve the submission of this vacation request, please sign or initial this memorandum and
return to the sender.

The University recently purchased the property with the address of 10 North Garland Avenue

driveway, landscaping and extension of a parking area. The University is agreeable to providing

Undeveloped Road ROW Vacation
Via the attached letter,the University of Arkansas is requesting the vacation of part of a street area where the
university is owner of lands on both sides. This land is located East of and Northeast of 10 North Garland
Ave. and consists of a 40 foot wide right of way which has never been developed in the 74 years since it was
prescribed by plat of J. H. McIlroy's University Addition and Oak Park Place Addition. The land being
requested for vacation at this time amounts to 0.409 acres. There is another 1.00 acre of the same
undeveloped road area which may be vacated at a future date. It is the intent of the University to utilize a
small portion of the vacated area for extending a parking lot behind the building at 10 N. Garland Ave(Lots
400-402 of the Oak Park Place S/D).
These platted,but undeveloped, streets have never entered into the City's plan for the extension of Center
Street over the past 74 years. Much of the area behind Lot 24 of the McIlroy University S/D has been used
by the University for landscaping for years,while the area adjoining Lots 400-402 has been used by the
residences of the building for parking purposes. Once vacated,the University shall assume the responsibility
of maintaining these areas.
As noted in the attached internal memorandum, dated March 20, 2001,the City would like to receive financial
credit from the U of A for the lands being vacated,to be used by the City as a warrant in future negotiations
on land exchange between the parties. Currently, the City is utilizing a major portion of a 27.7 acre tract of
land, owned by the U of A farm and located East of Lewis Ave. and North of Mt. Comfort Road, for soccer
fields. This tract of land also includes approximately 4.5 acres South of Mt. Comfort Rd. and North of Hefley
Street. This tract of land (27.7 acres)was recently appraised by Belote &Associates at $675,400. The

soccer fieivision, are used under the terms of a lease agreement with the
University and includes their use of a 10 acre tract of City property on Razorback Rd., South of 6° Street,
was appraised at $325,000 in yr. 2000 and the University
along with other city services. The City property
would like to obtain title to such parcel..

noted that the University is contemplating a request to annex the University farm properties into the city, an
action, if approved , could go a long way toward reducing the differences in the value of the two pieces of
property. All of the above topics are in the early stages of discussion.
It is in the interest of both the City and the University to work in a cooperative effort so that the goals of each
entity can be achieved. The vacation of the undeveloped road right of way is but a small portion of that
cooperation.
All utility companies and City Divisions were advised, on March 21, 2001, as to the intention to vacate the
subject road right of way. As of this date, only the attached responses have been received. Based on
telephone conversations with these utilities, no one seems to have a problem with this vacation.
Please entertain a motion to approve this vacation, along with a recommendation to the City Council. Your
consideration is appreciated,both by the U of A and the City.

Project: LSD 01-12.00: Large Scale Development(City of Fayetteville,Lewis Street
Soccer Fields, pp 406)was submitted by the Parks& Recreation Division on behalf of the City
of Fayetteville for property owned by the University of Arkansas located at 1515 North Lewis
Avenue. The property is zoned P-1,Institutional and contains approximately 27 acres. The
request is to develop 7.73 acres with parking for soccer fields.
Findings: Currently there are four existing soccer fields and 134 parking spaces at this
complex. The applicant is requesting to add two additional soccer fields and 263 parking spaces.
There are no.large trees on the site. There is a neighborhood zoned R-1 located to the east of this
property. Existing vegetation as well as the proposed berm along the cast side of this parking lot
will serve as a buffer to this neighborhood. The Parks and Recreation Division has provided a
letter explaining the need for additional spaces. Based on this letter outlining the number of
occupants at this facility, staff is in support of the addition of the 263 parking spaces for a total of
397 parking spaces based on the ratio of 1 space for every four occupants. The Parks and
Recreation Division held an additional public neighborhood meeting on May 22 to receive
additional public input from the neighborhood.
Recommendation: Approval subject to the conditions listed below.
Conditions of Approval:
1. Planning Commission determination of the requested variance of interior landscaping
requirements. The applicant is requesting not to provide landscaped islands for the
parking spaces around the edges of this lot. The requirement is for 1 landscaped island for
every 12 parking spaces. The proposal is to add additional trees around the perimeter.See
letter from Kim Hesse, Landscape Administrator.
2. Planning Commission determination of the requested variance allowing for a greater
driveway width than that allowed by code. The applicant is requesting a driveway width
of 27 feet. The maximum allowed is 24 feet. Staff is in support of the requested variance.
3. There shall be no disturbance of existing tree lines along the east and north sides of the

property.
4. The City Parks and Recreation Division shall plant additional junipers along the northern
property line to provide a vegetative screen adjacent to the residential homes.
5. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives-AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications)
6. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review
process was reviewed for general concept only. All public improvements are subject to
additional review and approval. All improvements shall comply with City's current
requirements.
7. Sidewalk construction in accordance with current standards to include a minimum ten
foot greenspace with a minimum six foot sidewalk.
8. Large Scale Development approval to be valid for one calendar year. If construction
occurs in phasing, there will be a five year expiration for total completion.
Background:
The proposed Large Scale Development was reviewed at the April 18, 2001 Technical Plat review and
the May 3, 2001 Subdivision Committee meeting.
Discussion at the Subdivision Committee meeting included screening, schedule of play, and the variance
request from the parking lot islands.
The Subdivision Committee forwarded the Large Scale Development to the full Planning Commission
subject to all staff comments.

RE: Lewis Soccer Complex Parking Lot Project
The Parks and Recreation Division requests two variances for the Lewis Soccer Complex
Parking Lot project. The first variance is to construct the driveway from Mt. Comfort Street into
the parking lot at 27 feet instead of the 24 feet required in order to provide a safer turning radius
for the vehicles.
The second request is for a variance of the interior landscaping of the parking lot to allow for tree
and landscaping behind the curb in the green area. This will allow for more parking spaces that
are needed to serve the soccer program. There will be 15 trees planted in the islands within the
parking lot. Parks and Recreation staff will plant more trees than required by ordinance around
the perimeter of the parking lot. These trees will provide a natural buffer between the parking
lot, soccer complex and the street.
We estimate a need for 264 parking-spaces to accommodate the increasing growth in our soccer
program. Currently,there are 134 parking spaces at the Lewis Street Soccer Complex.During
the 2000-2001 soccer season, approximately 1,700 participants comprised on 100 teams utilized
this parking facility and a few smaller lots which are located in the area. The lack of parking at
the soccer facilities has created an undesirable experience and unsafe conditions for the patrons.
Soccer parents are being forced to park on the grass and in non-designated parking areas.The
new parking lot combined with the existing lot will provide an additional 264 parking spaces
creating a grand total of 398 parking spaces at the Lewis Soccer Complex. In addition, a bike
rack will be provided to accommodate at least 7 spots for bikes.
It is estimated for 2001-2002 with the addition of new field space,Parks and Recreation will be
able to have a maximum of 316 soccer participants utilizing the Lewis Soccer Complex at any
given time. Sixteen additional individuals will work at the facility as concessionaires and
officials. It is estimated each player brings at most an average of 4 spectators.
316 participants + 1264 spectators+ 16 staff= 1,596/4= 399 parking spaces
{ordinance state 1:4 parking spaces per occupants)
During the 2001-2002 season,Parks and Recreation Division will continue to schedule with an
approximate thirty-minute time gap between games. This time gap has helped to relieve parking
congestion at all of the soccer facilities.

SUBJECT: Lewis Soccer Field Parking Variance request - Interior Landscaping
I support the variance request to relocate some of the interior trees required by the
ordinance to be placed adjacent to the parking lot in the location indicated on the plans
The landscape requirements that were written for the parking lot ordinance were written in
such a way as to provide mitigation to the heat island affect paved areas have within the
city. Per the requirements of the ordinance as it relates to this type of parking lot design,
one tree is to be placed within an island every twelve spaces within a row of parking. Trees
that are specified to be planted in landscape islands are medium sized species with a
canopy spread of 30'to 50' in diameter. Larger tree species planted in these sized islands
do not have the room to mature and are therefore not recommended in island locations.
In variance requests such as this l evaluate the mitigating affects of placing large tree
species, with a canopy of 50' to 80' diameter, directly adjacent to a row of paved spaces
at a ratio of one tree per eight spaces. At this ratio and with larger tree species, shade
would be covering more of the paved area than with the ordinance as it is written. With this
variance,eight large species shade trees will be planted versus five medium species shade
trees. I have included a rough sketch to graphically support this statement.
I feel that with this variance we are actually getting a better product. I support these types
of variances for perimeter parking rows only and not for double loaded parking rows or rows
in the center of a parking lot.

I am writing to address noise issues related to the proposed development of the Lewis Street
soccer complex. I own the property at 1505 Deane Street, abutting the northeast comer of the
proposed development area. I understand that the existing soccer fields provide a valuable
community center and I am not against further development in principle. However, I feel very
strongly that significant actions must be taken to control increased noise from these fields.
Activity on the current fields already causes a lot of noise and further development of this
complex will only make matters worse. I am requesting that two contingent conditions be
added to the development plan.
1. As part of the initial development of the Lewis complex, a line of juniper trees was
planted along the north perimeter to muffle noise reaching neighbors along that side.
I want this line of junipers extended to the northeast comer. Further,I would like
Parks and Recreation to evaluate the feasibility of constructing a berm, similar to the
one planned for part of the east perimeter, along the north perimeter.
2. Currently,there is no city ordinance regarding how early in the morning these fields
can be used. It is common for people to begin playing on these fields,with the
associated yelling and cheering, as early as 7:00am.on Sundays. I want a city
ordinance limiting use of these fields to no earlier than 9:00am on Sundays.
Again, I understand the importance of community centers like these soccer fields and I support
their development as long as sufficient consideration is given to adjacent property owners.

As a former administrator of the City Planning Department and as a neighbor to the
Lewis Street Soccer Complex, I've very grateful that you and Mayor Coody have returned to
the previous practice of holding city projects by the same standards to which private
development projects are accountable. A
To begin, it is my understanding that the man who left this property to the University
of Arkansas did so with a clause in his will precluding its future development. I don't know if
the City has looked into this matter and considered what constitutes development. I think
some legal research would be advisable.
Some years back, the neighborhood got wind that the Hanna administration was B
moving forward with the Soccer Complex and did not intend to involve the neighborhood in
the process. We were rather upset. We managed to finagle an informal meeting in which o
we were overrun by soccer enthusiasts. For one thing, we were not pleased that the City
intended to relax by half the one hundred foot or yard setback requirement, but had very
little say in the matter. The City did promise to abide by the landscape screening p
requirement. Instead of screening the entire perimeter of the project, however, the City did
a spotty job.
As a neighbor to the soccer complex, most of the problems I encounter are caused
by poor design and the relaxation of the setback requirements. This sends balls and
children trespassing over my fence and into my yard and at risk of physical injury from my W
dog. The use of the soccer complex is very intensive with extremely high noise volumes at
times. Of greatest concern to me is that lights may some day be installed, extending 00
significantly the hours of play and the amount of noise and disruption created for the w
adjacent R-1 neighborhood. v

The Fayettevillcl3ark-s and Recreation Division hosted a pub]ic inecting on Tuesday,May 2Z 2001 a15:30
p.m.at Lewis SoccerComplex located at 15 15 N.Lewis Avenue in Fayetteville,Arkansas.The meeting
was held to solicit input on the development of an additional parking lot and expansion ofplayim;fields.
Parks and Recreation Advisory Board members present included Bob Shoulders,Kyte Cook,M keHill,
and Gail Eads.Sta ff present were Connic Ednlonston,Eric Schuldt,Tcrry Gulley,Tracic Evans,and City
EnginecrJim heavers.
Plans for a 256-space Lurking lot was presented which included the required amount of acccssiblo spaces
[Ref.Chapter 172 of Unified Development Ordinance)and bicycle parking racks[Ref.Ord,No.
42931.A sidewalk parallel to Mi.Com foil Road will be constructed along the property tine.Mr.Beavers
encouraged residents to lobby with Chuck Rutherford, City Sidewalk Coordinator, to continue the
sidewalk eastward.Ms. Edmonston discussed landscapingplans and methods to shelter the packing lot
from residential areas[i.e.constriction ofa berm].When asked about existingparking,Mr.Beavers stated
there appeared to be 134 current parking spaces.Additionally,a regulation-size and a smallersoccer field
are also proposed.The Fayetteville Parks and Recreation Division soccer program has experienced an
explosion ofgrowlh and accommodations rout be addressed.Thisproject will be presented to the Planning
Commission on May 29, 2001. Construction is expected to begin during the month of July.
Mr.Guticyexplained plans for planting more boundary trees.Ms.Joycellichards,A neighborhood-esident,
expressed concerts about the amount of lilterbeing left behind.She suggested soccer coaches instructing
their players to pick up trash before leaving the playing area.
