The following items will be considered: Approval of minutes from the February 12,2001 meetings. New Business: 1. LS 01-4.00: Lot Split (Reed Trust, pp 640)was submitted by David E. Lashley on behalf of Mary Pauline Reed Trust for property located at 2283 S. School. The property is zoned C-2, Thoroughfare Commercial and contains approximately 3.01 acres. The request is to split into two tracts of 2.49 acres and 0.51 acres. 2. LS 01-5.00A & 5.00B: Lot Split (Hudak,pp 143)was submitted by Jacki & David Hudak for property located at 4250 Sassafras Hill Road. The property is in the Planning Area and contains approximately 11.67 acres. The request is to split into three tracts of 1.26 acres, 4.31 acres and 5.37 acres. � 3. RZ 01-4.00: Rezoning(Myer, pp 208 & 209)was submitted by Geoffrey Bates of Crafton, Tull, & Associates on behalf of Paul Myer of Myer Multi-Family Development for property located west of Hwy 112 and north of 71 By-Pass. The property is zoned A- 1,Agricultural and contains approximately 19.05 acres. The request is to rezone to R-O, Residential Office. 6. RZ 01-5.00: Rezoning(Myer, pp 208 & 209)was submitted by Geoffrey Bates of Crafton, Tull, & Associates on behalf of Paul Myer of Myer Multi-Family Development for property located west of Hwy 112 and north of 71 By-Pass. DATE: February 22,2001 Project: LS 01-4.00: Lot Split (Reed Trust, pp 640)was submitted by David F. Lashley on behalf of Mary Pauline Reed Trust for property located at 2283 S. School. The property is zoned C-2, Thoroughfare Commercial and contains approximately 3.01 acres. The request is to split into two tracts of 2.49 acres and 0.51 acres. Findings: This property is located approximately 500 feet south of the Cato Springs Road and School Avenue intersection. Due to the current C-2 zoning there are no minimum frontage requirements. Currently,three structures exist on the property. One on the northern proposed lot and two on the southern proposed lot. Recommendation: Approval subject to the six (6) conditions listed below. Conditions of Approval: I. Sidewalk construction in accordance with current standards to include a six foot sidewalk with a ten foot greenspace prior to stamping and filing lot split. The applicant is requesting to contribute money in lieu of the required sidewalk. (See recommendation from Chuck Rutherford) 2. Pursuant to the Master Street Plan, 55 feet of right-of-way from Centerline is required to be dedicated on School Street. The applicant is unable to dedicate the 55feet along the entire tract due to location of a structure. Lesser dedications of the Master Street Plan are required to obtain City Council approval. 3. Dedication of right of way along School Avenue shall be by warranty deed. 4. All existing structures on both tracts shall be connected to the public system prior to lot split approval. In addition,the existing structure on the northern tract must connect directly into the public sewer system and the service line contained entirely on the northern tract or a private easement provided on the southern tract. 5. Discussion at the Subdivision Committee meeting included right of way dedication requirements, sidewalk improvements, and the sewer service situation. The Subdivision Committee forwarded the Lot Split to the full Planning Commission"subject to the four staff conditions for the full Planning Commission to consider the lesser dedication of right-of-way on the Master Street Plan and to also consider making a plat notation that should the money in lieu of sidewalk ordinance be passed by the City Council and become an ordinance that be an option available to this applicant." RECEIPT OF NOTICE, —SUBSECTION B. APPLICATION OF PROVISIONS BE IT ORDAINED-BY-THE-CITY COUNCIL-OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That 171.12 Property Owner to Construct Sidewalk Upon Receipt of Notice, Subsection A., Receipt of Notice, Subsection B. Application of Provisions, of the Code of Fayetteville, shall be deleted and the following inserted in its stead: 171.12 Property Owner to Construct Sidewalk Requirement highway for which a sidewalk is required by City's Master Street Plan shall construct a sidewalk along said street or highway- 1. Property Owner to Construct Property owner to construct sidewalk per specification 171.13. 2. Contribution in Lieu of Construction If physical characteristics of the site or if construction of the sidewalk would create an isolated section(of sidewalk) which would not provide an immediate benefit, then a cash contribution in lieu of construction may be taken. A. A cash contribution in lieu of construction shall be made according to the following formula: $3.00 per square foot for 4" thick sidewalk or$4.00 per square foot for 6" thick sidewalk. The Sidewalk and Trails Coordinator shall review the contribution formula yearly and make recommendations to the City Council following such review. E. In the event the Developer and the Sidewalk and Trails Coordinator are unable to agree on construction or cask the developer and the Sidewalk and Trails Coordinator shall make separate recommendations to the Sidewalk and Trails Conunittee who shall determine the issue. F. AD money received under this subsection shall be deposited in an interest bearing account. Said money together with interest, shall be expended within three calendar years of the last date of the calendar year in which it was received. G. The Developer does not have the discretion to pay a cash contribution in lieu of construction. B. Application of Provisions 1. New Structure. On which a new structure is being built. 2. Existing Residential Structure. On which an existing residential structure is being modified so as to increase the number of dwelling units located therein or to change the use to a nonresidential use.
