Minutes for August 5, 2013
Opening:
The regular meeting of the Parks and Recreation Advisory Board was
called to order by Terry Lawson at 5:30 p.m. in Room 111 at the City
Administration Building at 113 West Mountain Street in Fayetteville,
Arkansas.
Present:
Parks and Recreation Advisory Board members McKnight, Leonard,
Lamb, Lawson, Maxwell, and Paul were present. Proffitt arrived later.
Meldrum and Watson were absent. Staff members Edmonston,
Humphry, Spann, Jumper, and Thomas were in attendance.
AGENDA:
1. Approval of July 1, 2013 PRAB Meeting Minutes
PRAB Motion: Maxwell motioned to accept the minutes as written,
and Leonard seconded it. Motion passed 6-0-0 by voice vote.
2. Regional Park Donation Presentation by Jim Cherry
Cherry presented a check in the amount of $425 to Edmonston to
be put toward the new soccer fields at the Regional Park.
3. BGSO Monthly Report: Byron Humphry, Parks Maintenance
Superintendent
The BGSO board met on July 23. Their 2013 audit is complete,
and they should be sending a copy of the audit to Parks. Their
membership is at an all time high of 1,358 members. During this
meeting, they discussed their master plan. It will probably be
October before they can present it to PRAB.

4. Trail Naming for Clear Creek and Scull Creek Trails: Matt
Mihalevich, Trails Coordinator
Staff Recommendation: To approve the proposed names of
trail. According to the City's Facility Naming Policy, the item
is tabled until the next PRAB meeting in order to allow for
public input. If approved by PRAB, the naming of the trails
will be presented to City Council for final approval.
Mihalevich said this was presented and voted on by the Active
Transportation Committee before coming to PRAB. They supported
it. The names tentatively chosen for the trails are named after the
creeks that are near them. The proposal is for the Scull Creek Trail
to keep that name up to the Clear Creek Trail so it won't be
confusing. He added that part of the Razorback Regional
Greenway was in the area and that Fayetteville is overseeing the
construction of the trails in our area.
Lawson said it made sense to associate the trail name with the
creek so it would be easier for emergency responders.
Maxwell wanted to know what the city of Johnson was saying
about the name for that portion of the Clear Creek Trail.
Mihalevich said they already call it Clear Creek.
Doug McKinney, a citizen, asked how soon they would be open.
Mihalevich replied that they are just putting a railing on a piece of
it, so that section would be done in a couple of weeks. Most of it is
already paved. One area is very challenging because of the slope.
The whole project should be done by the end of the year.
McKinney said that he has been seeing work going through the
fairgrounds to under Porter Road. He wanted to know what the
intention was for that area.
Mihalevich said it will cross Shiloh and eventually go the whole
west side of 540.
Lawson asked if the map was on Accessfayetteville.
Mihalevich replied that it was. He said there is an overall map as
well as maps of the construction projects.

McKnight asked if there were any plans to connect the trail going
under 540 to neighborhoods.
Mihalevich replied that it's an important sidewalk connection. He
said he has talked to Transportation about it, and they have put it
on their list.
PRAB Motion: McKnight motioned to table the naming of the
trails until the September meeting to allow time for public input
according to the Naming Parks and Trails Policy. Paul seconded
the motion. Motion passed 7-0-0 by voice vote.
5. Special Bond Election: See attached City Council Agenda Item
for August 6th meeting.
Edmonston said the bonds go before Council tomorrow night. If it
passes, it will be on the November 12 ballot. The voters will have 3
questions. Question 1 will ask if the bonds on the Town Center
should be refinanced. Question 2 will ask if 6.9 million should be
approved for the expansion of the Walton Art Center. The final
request will ask if 3.5 million should be approved for improvements
to the Regional Park. The first question has to be approved in order
for questions 2 and 3 to be approved. Otherwise, nothing can be
done. These bonds won't cost the taxpayer any more money.
McKnight asked if Parks will end up with the 3.5 million.
Jumper replied that Phase I, which includes the great lawn and
soccer fields, already have money in the bank. If the Regional Park
bond passes, that will be added money. Some of the baseball could
be covered.
Paul asked if there have been any other offers for the Mt. Kessler
land.
Edmonston said she wasn't aware of anything.
Paul asked if this was the first time this bond was on the ballot.
Edmonston said it was on the HMR tax ballot a few years ago. It
was called a penny for parks.
McKnight asked if Edmonston had heard of any resistance to
improving the WAC.
Edmonston said no, she hadn't heard of anything.

Maxwell wanted to know if people might wonder why the WAC
needs to expand, and vote accordingly.
Edmonston said she didn't know.
Paul asked if the HMR tax currently services the debt for the Town
Center bonds, and if it was all on the AMP.
Edmonston said yes.
Lawson asked if Phase 2 was baseball and phase 3 softball and
other things.
Jumper said yes.
Lawson wanted to know if the concession stand and restrooms
were included in Phase 1.
Jumper said yes. She added that those amenities would be shared
with baseball.
Edmonston said that the money would also pay for two different
parking lots.
Lamb asked who was paying for the landfill.
Jumper said ADEQ. She said they'll be recapping it. They will also
regrade the site and bring in clay and topsoil.
Lamb asked what it would be used for.
Jumper said passive recreation such as trails and disc golf.
Paul asked if it would be safe for families to go there.
Jumper said yes.
Edmonston said that when Parks started looking at this piece of
property, an application was made for post closure trust funds.
She said this allowed us to remediate the landfill. She added that
Fayetteville will be the first city to receive the post closure trust
funds from the state.
Paul asked if there was grant money available to repurpose
landfills.

Edmonston said she didn't know, but probably. She added that
many parks have been built on landfills.
6. Other Business:
Edmonston said that because of the Labor Day holiday on
September 2, PRAB will meet on the following Monday, September
9.
Mihalevich passed out new trail maps. He said it would be updated
every year.
Paul asked when he could ride under MLK.
Mihalevich said half of the tunnel is built. He said the sections are
12 feet wide and 10 feet tall. The drainage is really good. The
estimate for the project was 1.6 million, but the bid came in at 1.4
million
Steve Snyder, a member of the OORC, asked Byron if the Botanical
Gardens, in their meeting, mentioned having a user group meeting
before completing the master plan.
Humphry said they are going to involve them at some point. They
plan to have their members meeting in September.
Paul wanted to know what happened with the split softball leagues
with the City and the school system.
Span said he got mixed reviews. A lot of people were not happy
with the school organization.
Paul wanted to know what the plan was for next year.
Spann said the school plans to continue with their organization.
Maxwell asked if there was a big difference between the two
organizations.
Spann said there wasn't much difference. The school's program
focuses more on technical skills, and Parks softball leans more
heavily toward the recreational aspect.
Paul asked if both Parks and the schools organization had fast
pitch softball.

Spann said yes.
Leanne Van Winkle-Gissler , the director of the Fayetteville Senior
Center, stood up and introduced herself. She said she was on the
agenda for September, and just wanted to give everyone a senior
center newsletter to look over.
Paul asked if the new disc golf course at Walker was open yet.
Humphry said, with intensive labor, they had made it to hole 3.

The meeting was adjourned at 6:15 p.m.

11 PUBLIC FUNDS TO SUPPORT OR OPPOSE BALLOT MEASURES;
12 AND FOR OTHER PURPOSES.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code § 7-1-103(a)(3), concerning certain
24 misdemeanor offenses, is amended to read as follows:
25 (3)(A) It shall be unlawful for any public servant, as defined
26 in § 21-8-402, to use any office or room furnished at public expense to
27 distribute any letters, circulars, or other campaign materials unless such
28 office or room is regularly used by members of the public for such purposes
29 without regard to political affiliation. It shall further be unlawful for any
30 public servant to use for campaign purposes any item of personal property
31 provided with public funds.
32 (B) As used in subdivision (a)(3)(A) of this section,
33 "campaign materials" and "campaign purposes" refer to:
34 (i) the The campaign of a candidate for public
35 officei and

3 SECTION 2. Arkansas Code Title 7, Chapter 1, Subchapter 1 is amended
4 to add an additional section to read as follows:
5 7-1-111. Use of public funds to support or oppose ballot measure.
6 (a) As used in this section:
7 (1) "Governmental body" means the same as defined in § 21-8-402;
8 (2) "Public funds" means funds, moneys, receivables, grants,
9 investments, instruments, real or personal property, or other assets,
10 liabilities, equities, revenues, receipts, or disbursements belonging to,
11 held by, or passed through a governmental body; and
12 (3)(A) Except as provided in subdivision (a)(3)(B) of this
13 section, "public servant" means an individual who is:
14 (i) Employed by a governmental body:
15 (ii) Appointed to serve a governmental body; or
16 (iii) Appointed to a governmental body.
17 (B) "Public servant" does not include:
18 (i) An elected official; or
19 (ii) A person appointed to an elective office.
20 (b) It is unlawful for a public servant or a governmental body to
21 expend or permit the expenditure of public funds to support or oppose a
22 ballot measure.
23 (c) This section does not:
24 (1) Limit the freedom of speech of a public servant or government
25 body, including without limitation verbal expressions of views supporting or
26 opposing a ballot measure;
27 (2) Prohibit a governmental body from expressing an opinion on a
28 ballot measure through the passage of a resolution or proclamation;
29 (3) Prohibit the incidental use of state resources by a public
30 servant, including without limitation travel costs, when speaking at an event
31 in which a ballot measure is discussed if the subject matter of the speaking
32 engagement is within the scope of the official duties and responsibilities of
33 the public servant; or
34 (4) Prohibit the dissemination of public information at a
35 speaking engagement and the incidental use of state resources in the analysis
36 and preparation of that public information if the subject matter of the

1 public information is within the scope of the official duties and
2 responsibilities of the public servant.
3 (d)(1) Except as provided under subdivision (d)(2) of this section, a
4 violation of this section is a Class A misdemeanor.
5 (2)(A) A public servant who is found guilty or pleads guilty or
6 nolo contendere to a violation under this section is ineligible to hold any
7 office, employment, or appointment in a governmental body.
8 (B) If a public servant is found guilty or pleads guilty
9 or nolo contendere to a violation under this section while employed by a
10 governmental body, he or she shall be removed from employment immediately.

12 SECTION 3. Arkansas Code § 7-9-402(9), concerning the definition of
13 "person" applicable to disclosure for matters referred to voters, is amended
14 to read as follows:
15 (9)(A) "Person" means any individual, business, proprietorship,
16 firm, partnership, joint venture, syndicate, business trust, labor
17 organization, company, corporation, association, committee, or any other
18 organization or group of persons acting in concert.
19 (B) "Person" includes
20 body an elected official using public funds to expressly advocate the
21 qualification, disqualification, passage, or defeat of any ballot question or
22 the passage or defeat of any legislative question; and

24 SECTION 4. Arkansas Code § 7-9-406(c), concerning financial reports or
25 contributions and expenditures, is amended to read as follows:
26 (c)
27 expending public funds in excess of five hundred dollars ($500) for the
28 purpose of expressly advocating the qualification, disqualification, passage,
29 or defeat of a ballot question or the passage or defeat of a legislative
30 question shall file with the commission financial reports as required by §§
31 7-9-407 — 7-9-409.

33 SECTION 5. Arkansas Code § 7-9-407 is amended to read as follows:
34 7-9-407. Financial report — Information.
35 A financial report of a ballot question committee, a legislative
36 question committee, an individual person, ^ pub' ^ or a governmental

1 body an elected official, as required by § 7-9-406, shall contain the
2 following information:
3 (1) The name, address, and telephone number of the committee,
4 individual person, public ccrvant, or governmental body elected official
5 filing the statement;
6 (2)(A) For a committee:
7 (i) The total amount of contributions received
8 during the period covered by the financial report;
9 (ii) The total amount of expenditures made during
10 the period covered by the financial report;
11 (iii) The cumulative amount of those totals for each
12 ballot question or legislative question;
13 (iv) The balance of cash and cash equivalents on
14 hand at the beginning and the end of the period covered by the financial
15 report;
16 (v) The total amount of contributions received
17 during the period covered by the financial statement from persons who
18 contributed less than fifty dollars ($50.00), and the cumulative amount of
19 that total for each ballot question or legislative question;
20 (vi) The total amount of contributions received
21 during the period covered by the financial statement from persons who
22 contributed fifty dollars ($50.00) or more, and the cumulative amount of that
23 total for each ballot question or legislative question;
24 (vii) The name and street address of each person who
25 contributed fifty dollars ($50.00) or more during the period covered by the
26 financial report, together with the amount contributed, the date of receipt,
27 and the cumulative amount contributed by that person for each ballot question
28 or legislative question; and
29 (viii) The name and address of each person who contributed
30 a nonmoney item, together with a description of the item, the date of
31 receipt, and the value, not including volunteer service by individuals.
32 (B) For an individual person:
33 (i) The total amount of expenditures made during the
34 period covered by the financial report; and
35 (ii) The cumulative amount of that total for each
36 ballot question or legislative question.

1 (C) For a public servant or governmental body using public
2 funds:
3 (i) The total amount of expenditures made during the
4 period covered by the financial report; and
5 (ii) The cumulative amount of that total for each

7 (3) The name and street address of each person to whom
8 expenditures totalling one hundred dollars ($100) or more were made, together
9 with the date and amount of each separate expenditure to each person during
10 the period covered by the financial report and the purpose of the
11 expenditure.

13 SECTION 6. Arkansas Code §§ 7-9-412 — 7-9-414 are repealed.

Subject: Trail Naming Request
On July 10th, 2013 the Fayetteville Active Transportation Advisory Committee unanimously approved a motion
to forward the following trail name recommendations to the Fayetteville Parks and Recreation Advisory Board
for review and public comment according the park and trail facilities naming policy.
Clear Creek Trail
This 2.25 mile long trail will extend west from Lake Fayetteville along Clear Creek to Ball Street (see map
below). The trail is planned to be completed by late 2013. In the future, this trail will likely extend on west
along Clear Creek to the Willow Creek Women's Hospital. The name "Clear Creek Trail" is consistent with the
practice of naming trails after the creek which they follow.
Scull Creek Trail
This 3/4 mile long trail extends north along Scull Creek and Mud Creek to meet Clear Creek Trail near Ball St
(see map below). The Active Transportation Advisory Committee agreed that the name "Scull Creek Trail"
should be extended north to Clear Creek Trail for continuity even though it will technically follow a section of
Mud Creek before the confluence with Clear Creek. The continuation of the "Scull Creek Trail" name was
favored to avoid confusion with the current "Mud Creek Trail" which extends east from Scull Creek Trail south
of Joyce Blvd.

Large Scale Development
Please see the enclosed preliminary site plan for the Harvey's Hill project.
We are seeking to provide money in lieu of parkland dedication for the above mentioned project, and
would like for this project to be heard at the September 9th PRAB meeting.
Currently, 175 units are proposed with this development. Per the money in lieu fee structure, it is
understood that approx. $ 98,000 would need to be paid to the City prior to the signing of any final plat
or the issuance of building permits.
The large scale development plans associated with the Harvey Hill project are planned to be submitted
to the City later in September.
