Findings:
Revision from July 29, 2010 Subdivision Committee Meeting: As a result of comments received
during the Subdivision Committee the applicant has slightly revised the proposed subdivision to
remove a block of lots that were in the vicinity of areas that may have the potential to be considered
wetlands. The overall number of single family lots has been reduced from 67 to 58.
Property: The subject property is located approximately 1.3 miles south of the intersection of
Highway 16 East (Huntsville Road) on the west side of Deadhorse Mountain Road. The overall site
contains approximately 95.91 acres. The property is undeveloped agricultural pasture land,
surrounded by rural residential and agricultural land uses. The western portion of the property is
bounded by the West Fork of the White River.

Proposal: The applicant requests preliminary plat approval for the first phase of a single family
residential subdivision. This first phase would result in the development of 58 single family lots on
approximately 19.14 acres. The remaining approximately 77 acres would be placed in an
undeveloped out -lot planned to be developed with Phase II, or in land dedicated for City parkland.
After utilities have been installed to serve each lot and the proposed streets have been constructed,
the applicants will be able to proceed with a final plat application.

Water and Sewer System: Water and sewer lines would be extended to serve the development.
Adjacent Master Street Plan Streets: Dead Horse Mountain Road (minor arterial)
Right-of-way to be dedicated: 42.5' from centerline right-of-way along the project's Dead Horse
Mountain Road frontage. Dedication of 50' right-of-way width for interior streets and stub -outs and
20' right-of-way for alleys.
Access: Two access points to the site are provided from Dead Horse Mountain Road to the east. To
ensure future connectivity in compliance with the City's Access Management Ordinance, a street
stub -out is provided to the north, three stub -outs to the west, and three stub -outs to the south.
Street Improvements: Staff recommends, at a minimum, the following street improvements:
a. 14 feet pavement, curb and gutter, storm drainage, and 12 -foot wide multi -use asphalt
trail to be constructed along the project frontage for Dead Horse Mountain Road
adjacent to all lots except for Lot #'s 60-61; 67, and 1, where a 5 -foot sidewalk is
required.
b. Payment of an assessment for the contribution to a traffic signal at the intersection of
State Highway 16 East/Stone Mountain Road in the amount of $6,418.03. A
spreadsheet showing the rationale behind the recommended numbers is attached.
c. Construction of intemal streets, sidewalks, and pedestrian trail as indicated on the
plat.
d. Street lights are required at all street intersections and spaced approximately 300 feet
apart.

Public Comment: At the July 15, 2010 and July 29, 2010 Subdivision Committee meetings several
adjacent property owners discussed concerns with this development including issues such as traffic,
land use compatibility, and impacts to natural resources including a pond, springs, and the potential
for wetlands and historic resources.
Recommendation: Staff recommends approval of PPL 10-3616 (Riverwalk 1) with the following
conditions of approval:

1. Planning Commission determination of street improvements. Staff recommends completion
of the following street improvements prior to the final plat for Phase I of the development:

SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (07-29-10).
2 Planning Commission determination of a waiver from Chapter 170.02 Adopted Drainage
Criteria Manual (Section 5.4.3), requiring that the limits of maximum ponding elevations
are no closer than 100' horizontal from any building and greater than 2' below the lowest
sill or floor elevation of any building. The applicant proposes to retain the existing pond
on Lot 8, and incorporate it as an amenity into the subdivision. The applicant's request
discusses that the adjacent streets to the south and west provide adequate separation
between homes and the pond, and that existing natural vegetation along the east side of
the pond will prevent easy access from Lot 7 and will not create a safety hazard
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (07-29-10).
3. The applicant shall dedicate right-of-way in the following amounts:
• 42.5' from centerline right-of-way along the project's Dead Horse Mountain Road
frontage
• 50' and 20' right-of-way width, respectively for interior streets, stub -outs, and alleys.
4. Revise the plat to address the following items:
• Add dimensions on the plat in several locations indicating the width of the right-of-
way for the alleys and streets, and the width of the right-of-way to the north and south
of the entry island on Street 'A'.
• The lot numbering appears to skip some numbers 63 and 72, renumber accordingly.
5. Prior to final plat a property line adjustment is required to be recorded to create a legal lot of
record for phase 1, or the entire 95.91 acre parcel is required to be included in the subdivision
and the undeveloped out -lot labeled as such on the plat.
6. Future right-of-way signs shall be installed at all street stub -outs prior to final plat.
7. Addresses and approved street names are required to be shown on all lots at final plat.
8. Curb cuts shall not be permitted on Dead Horse Mountain Road.
9. Parkland dedication. The Parks and Recreation Advisory Board reviewed this project at the
April 2, 2010 meeting and recommended accepting approximately 2.65 acres of trail corridor
and credit for the trail construction and banking the excess parkland dedication.
a. The deeds for parkland shall be filed of record prior to final plat.
b. Provide a copy of the deed for the park land to the City Land Agents for review.
c. Label the trail corridor as park land dedication on the plat.

d. Label the acreage of all park land dedication areas on the plat.
e. Drainage from the east through the park land dedication area is being discussed as an
option. Park staff does not recommend accepting the drainage at this time.
10. Conditions of approval from the Urban Forester in the landscape and tree preservation reports
are included in the official conditions of approval.
11. Conditions of approval from the City Engineering staff in the attached memo are included in
the official conditions of approval.

12. All signage shall be reviewed and approved by the Planning Department prior to installation.
Freestanding signage is not permitted within utility easements, unless otherwise approved by
all utility companies.
13. All street names and addresses shall be approved by the 911 coordinator.
14. Plat Review and Subdivision comments (to include written staff comments provided to the
applicant or his representative, and all comments from utility representatives - AR Western
Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
15. Staff approval of final detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review process
was reviewed for general concept only. All public improvements are subject to additional
review and approval. All improvements shall comply with City's current requirements.
16. All overhead electric lines under 12Kv shall be relocated underground. All proposed utilities
shall be located underground.
17. Impact fees for fire, police, water, and sewer shall be paid in accordance with City ordinance.
18. Preliminary Plat approval shall be valid for one calendar year.

General Conditions:
1. All designs are subject to the City's latest design criteria (water, sewer, streets and drainage). Review
for plat approval is not approval of public improvements, and all proposed improvements are subject to
further review at the time construction plans are submitted.
2. Provide a master residential lot grading plan (MRLGP) to ensure positive drainage of each lot at time of
development. Utility easements shall be graded to MRLGP prior to final plat.
a. Add note to final plat the site development will follow the master residential lot grading plan.
3. Prior to grading and drainage permit, bonds in the amount of 100% of the total cost to install the
approved erosion and sediment control plan to ensure the continuation of the proper maintenance of
the plan. The bond shall remain in place until permanent stabilization has been achieved for the
development site.
4. Water and sewer impact fees will apply for the additional impact to the system. The fees will be based
on the proposed meter size and will be charged at the time of meter set.
5. The wastewater lift or pumping station must be on land deeded as a separate lot to the City of
Fayetteville, not by plat.
Special Comments:
1. A Floodplain Development Permit is required for the proposed construction within the FEMA regulated
floodplain. Contact Sarah Wrede 575-8208.
2. Based on the justification presented by the applicant in the letter dated, August 2, 2010, Engineering
supports the applicants request to allow structures within 100 ft of the 100 yr water surface of the exiting
pond as required by the Drainage Manual. Specifically applicable to lot 7 to allow for the structure to be
placed where permitted by proposed building setbacks for this lot. The remaining lots affected within
100 ft are separated by the proposed public street and should be allowed to be constructed within the
platted proposed setback of each lot.
Plan Comments:
1. Extend public storm sewer to lots where "springs" are located on the plans.
2. Move sanitary sewer manhole east to line up with the common lot line of 1 and 2 to provide legal
service to lot 1.

3. Revise termination method of the waterline at phase line locations to allow for expansion of water

VARIANCE REQUEST
Dear Commissioners:
Please accept this letter as our official request for a variance to the provision in the City of
Fayetteville Drainage Manual which requires a 100 -ft horizontal separation between the 100 -yr
water surface extents and the nearest structure. It is our understanding the intent of this provision
is to provide for public safety. The homesites surrounding the existing pond will be adequately
separated by a street and sidewalk, with the exception of Lot 7. The area between the pond and
Lot 7 is wet with poor soils, which would discourage direct pedestrian access. Therefore, we do
not believe the proposed development would create any hazardous conditions for the general
public.

To Whom It May Concern:
On behalf of the Owner, McDonald Real Property Invest III, LLC, please accept this
letter as our official request for preliminary plat approval for Riverwalk Subdivision,
Phase 1, located approximately 1.3 miles south of Hwy 16 along the west side of Dead
Horse Mtn Rd. The scope of the project reflects the development of 67 residential single
family lots encompassing approximately 21.8 acres.
The subject property is required to dedicate for a master trail corridor, which has been
incorporated into the subdivision design. The master trail corridor, for the most part, will
be located along the main road traversing the property from the primary entrance. The
intent of our design is to utilize the existing paved access road as the community trail. It
will be located within a strip of land to be dedicated to City Parks and Recreation as part
of our park land dedication requirements. Additional land was donated to extend the trail
to the river along the western boundary of the property. The Tots for which are
contiguous to the trail are rear loaded from a public alley to avoid numerous driveway
cuts and promote a pedestrian friendly environment along the street.
Regional water and sewer improvements are nearing completion and will provide
adequate capacity to this development. It is our request to limit improvements along
Dead Horse Mtn Rd to those directly associated within the Phase 1 boundary. The
phasing of the property from north to south, along with expected traffic patterns heavily
loaded northbound from the entrance, support the reasoning for limiting the
improvements to the Phase 1 frontage only.

The request is for approval of a conditional use permit to allow a sidewalk vendor cart that is 5 -foot
wide when the maximum is 3 -foot, and to permit a sidewalk vendor in an alternate location.

BACKGROUND:
Fayetteville Unified Development Code (UDC): The Fayetteville UDC Section 178.03 (attached)
permits sidewalk vendors on public sidewalks in certain locations with wide sidewalks. The locations
where street vending is allowed as a permitted use are: (1) on the north and west sidewalks in front of
the Walton Arts Center along West Avenue and Dickson Street, and (2) inside of the Fayetteville
Square. The UDC also specifies maximum size limitation of sidewalk vendor carts at six feet (6') by
three feet (3') and five feet (5') tall. The UDC also allows for alternate locations and sizes for the
sidewalk vendors to be approved by the Planning Commission by conditional use permit.
Proposal: The applicant is requesting a conditional use permit for the following:
1. Alternate sidewalk vendor location. The applicant proposes to obtain a sidewalk
vendor permit on the outside of the Fayetteville Square, at the southwest comer of
Center Street/Block Avenue in the location indicated on the site plan.
2. Larger size cart than permitted by right. The applicant proposes a sidewalk vendor
cart that is five foot (5') by five foot (5') area and nine feet (9') tall, as indicated in
the submitted floor plan and rendering/photo of the cart. This alternative -sized cart is
proposed at the southwest corner of Center Street/Block Avenue, and at the north and
west sidewalks in front of the Walton Arts Center along West Avenue, as indicated in
the site plans.
Property Description and Site Details: Both proposed locations are in the City right-of-way in the
Downtown area on public sidewalks.
• The site at Center Street/Block Avenue is adjacent to the north side of the Bank of
Fayetteville, in a concrete landscape "bump out" adjacent to a street tree. The

sidewalk in this location is approximately 16 feet wide and the cart is five feet wide
set off the curb 2 feet, leaving an approximately 8.5 -foot wide sidewalk area on
Center Street exclusive of the sidewalk vendor for pedestrians.
The site in front of the Walton Arts Center is on West Avenue on a section of
sidewalk that is approximately 24 feet wide. The five-foot cart would be set
approximately three feet off of the retaining wall on the Walton Arts Center site,
leaving an approximately 16 -foot wide sidewalk area exclusive of the sidewalk
vendor for pedestrians.
Public Comment: Staff has not received any public comment.
RECOMMENDED MOTION #1: ALTERNATIVE LOCATION AT CENTER
STREET/BLOCK AVENUE:
Staff recommends approval of the request as proposed by the applicant with the following
conditions of approval:

1. This permit is limited to the operation of a sidewalk vendor permit at the corner of
Center Street/Block Avenue as indicated on the plans submitted by the applicant.
2. In order to prevent customers lining up and potentially blocking the heavier flows of
pedestrian traffic at the intersection of the Block Avenue/Center Street or impeding
entry into the Bank of Fayetteville, the applicant shall direct customers to line up to the
west of the cart down Block Avenue, away from the intersection. This shall be provided
by directional signage on the cart or trash receptacle that is clearly visible to
pedestrians.
3. Prior to first day of operation, the applicant shall contact the Planning Division and
schedule an inspection of the cart location, in order to verify that the minimum distance
requirements from the cart to the entrance of the Bank of Fayetteville is maintained,
and to verify that directional signage for the customer line is adequate.
4. The Zoning and Development Administrator (ZDA) may administratively approve the
renewal of this conditional use permit in this alternate location as part of the annual
renewal of the sidewalk vendor permit required by UDC Section 178.03(C). The ZDA's
renewal of this alternative location is subject to a valid complaint and is valid only for
the subject applicant.
5: The applicant shall comply with all other requirements of UDC Section 178.03, with the
exception that the size of the cart may be larger than the dimensions required in the
UDC, if approved by the Planning Commission.

3. Grant a conditional use with such conditions and safeguards as are
appropriate under this chapter; or
4. Deny a conditional use when not in harmony with the purpose and intent of
this chapter.
C. A conditional use shall not be granted by the Planning Commission unless and until:
1. A written application for a conditional use is submitted indicating the section
of this chapter under which the conditional use is sought and stating the
grounds on which it is requested.
Finding: The applicant has submitted a written application requesting a conditional use
permit for the alternative sidewalk vendor location and larger sized sidewalk
vendor cart.
2. The applicant shall pay a filing fee as required under Chapter 159 to cover the
cost of expenses incurred in connection with processing such application.
Finding: The applicant has paid the required filing fee.
3. The Planning Commission shall make the following written findings before a
conditional use shall be issued:
(a.) That it is empowered under the section of this chapter described in the
application to grant the conditional use; and
Finding: The Planning Commission is empowered under § 178.03(F) to grant the
requested conditional use permit.
(b.) That the granting of the conditional use will not adversely affect the
public interest.
Finding: In staff's opiniou granting the requested conditional use should not adversely
affect the public interest, as the there is adequate room on the sidewalks along
both West Avenue and Center Street to accommodate the proposed 5' x 5'cart
and provide safe area for pedestrians and lines of sight for vehicles on adjacent
roadways. The sidewalk on West Avenue would have approximately 16 feet
clear of the cart for pedestrians. The sidewalk on Center Street would have
approximately 8.5 feet clear of the cart for pedestrians. The clearance on both
streets provides adequate space for pedestrian access and mobility. Staff
recommends that on Center Street the applicant direct customers to line up west
of the cart, away from the intersection to ensure that pedestrian flow around the
Bank of Fayetteville and the intersection of Center Street/Block Avenue is not
impeded.
(c.) The Planning Commission shall certify:
