ADM 15-5079: Administrative Item (617 N. COLLEGE AVE./RENO'S MOBILE
VENDOR, 445): Submitted by RENELIUS SIME for property located at 617 N. COLLEGE.

0.42 acres. The request is for a one year mobile vendor permit.

Renelius Sims, applicant, described the business operation.

Commissioner Hoskins asked how long he had been open.
Sims stated since September under a 6-month permit.
Commissioner Hoskins asked staff if improvements could be required.
Fulcher stated not for this type of permit.
Commissioner Hoffman asked if the applicant planned to open a brick and mortar location.
Sims stated yes.
Motion:
Commissioner Selby made a motion to approve ADM 15-5079 as recommended by

ADM 15-5077: Administrative Item (2600 W. JUDGE CUMMINGS RD./MT. KESSLER
PARK, 602): Submitted by CITY STAFF for property located at 2600 W. JUDGE
CUMMINGS RD. The property is zoned P-1, INSTITUTIONAL and contains approximately
600 acres. The request is for a Major Modification to LSD 14-4819 (Regional Park).
Andrew Garner, City Planning Director, gave the staff report.
Alison Jumper, Parks Department, discussed the project and was present for questions.
No public comment was presented.
Commissioner Brown asked staff why they need to change the master plan of the park.
Can't you just phase the improvements to go along with different phases?
Jumper discussed that the original large scale development showed a full street
improvement to the park entry road with the first phase so this modification requires review
by the commission.
Garner discussed that the full road improvements could be required with future phases of
the park build-out.
Commissioner Brown asked about parking along the park entry road.
Jumper discussed no parking signs that would be installed along the street.
Commissioner Hoffman asked if the monies for the park project being delegated to the
larger road being moved elsewhere or if this request is due to cost overruns.
Jumper discussed that it is related to cost overruns. When the bids came in they were more
than anticipated.
Commissioner Hoskins discussed that in the private realm if we have cost overruns we
just have to do it. I think we need to leave it as presented before. I understand that we have
cost overruns and we have to live with them. I am not for this.
Blake Pennington, Assistant City Attorney, discussed that the same requirements apply
for both a private and public development and should be applied to this request.
Commissioner Autry discussed that this will be a great addition to the city. This is just
phase 1. Eventually all this will take place. Let's get it started at this point.
Commissioner Chesser asked about the amount of cost overrun.
Jumper indicated that the savings for this road reduction is about $150,000.00.
Commissioner Chesser indicated that he is inclined for more information to be provided and
would be more in line with tabling to get a better idea of the cost estimates.

Commissioner Cook agreed with previous commissioner's statements that this should be
done. But maybe we can say that this road can be fully built out prior to the final phase. I
would be support of that.
Garner confirmed that the request could be conditions for the road to be built prior to the
final plat.
Motion:
Commissioner Cook made a motion to approve ADM 15-5077 with the condition that
the full street improvements be completed as originally approved prior to the final
phase of the park. Commissioner Autry seconded the motion. Upon roll call the motion
passed with a vote of 6-3-0. Commissioners Hoskins, Chesser, and Noble voted "no".
Commissioner Brown requested that the parks department leave the master plan as it is
right now. We want everyone in the city to be impressed with the effort and the developers
along that street to see the efforts into the park project

ADM 15-5030: Administrative Item (360 ARKANSAS AVEJSIGMA PHI EPSILON, 483):
Submitted by KSQ ARCHITECTS for property located at 360 ARKANSAS AVE. The
property is zoned RMF-40, RESIDENTIAL MULTI FAMILY, 40 UNITS PER ACRE and
contains approximately 0.20 acres. The request is for variances of the parking lot
dimensions and greenspace requirements.
Andrew Garner, City Planning Director, gave the staff report.
Phil McKnight, applicant, discussed the reasons for the request. He discussed the intent
to preserve existing trees on the property. He thanked City staff for working with them.
No public comment was presented.
Commissioner Brown asked about the wooden fence along the northern property line and
conversations with the adjacent neighbor.
Phil McKnight, applicant, indicated that, no, they have not been in discussions with the
neighbor. This meeting was the first step.
Commissioner Chesser asked about obtaining the neighbor's permission to build the
driveway adjacent to the property line.
Garner confirmed that it is city policy for a developer to be required to obtain the adjacent
property owner's permission when grading within five feet of the property line.
Motion:
Commissioner Chesser made a motion to approve ADM 15-5030 as recommended by
staff. Commissioner Selby seconded the motion. Upon roll call the motion passed with
a vote of 9-0-0.

VAR 15-5084: Variance (3561 N. COLLEGE AVE./RAISING CANE'S, 213): Submitted by
KEN'S SIGNS for property located at 3561 N. COLLEGE AVE. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and contains approximately 0.98 acres. The request is
for a variance of the neon lighting requirements.
Jesse Fulcher, Senior Planner, read the staff report.
Melanie Hancock, applicant, described the variance request. This is a highly competitive
market for restaurants. The lighting makes the building more aesthetically appealing.
No public comment was presented.
Commissioner Hoffman stated he was more concerned with Fayetteville's standards than
that of a national chain.
Commissioner Hoskins asked where the additional lighting would be placed.
Hancock stated that it would fill in the south elevation.
Commission Hoskins stated that hardship is a matter of perspective. This owner is making
a significant investment to develop this site, so the look and brand of the building is very
important.
Commissioner Bunch asked when the Chili's restaurant building was done.
Fulcher stated before the lighting ordinance was adopted.
Commissioner Chesser stated that Fayetteville's requirements should be above a national
chain's requirements. They can change to be in this market. I don't see a hardship here.
Commissioner Autry stated the south side of the building is the least visible. Tough to
support this request.
Commissioner Bunch asked if the trees on the south side would be removed.
Fulcher stated no.
Commissioner Bunch stated that the best visibility is from the north. Don't see a reason to
approve this variance.
Commissioner Hoskins stated the south side will be very visible to the customers, but
probably not to drivers on College.
Motion:
Commissioner Chesser made a motion to deny VAR 15-5084. Commissioner Autry
seconded the motion. Upon roll call the motion passed with a vote of 5-4-0.
Commissioners Hoskins, Brown, Noble, and Selby voted "no".

RZN 15-5053: Rezone (WEST OF 4195 W. PERSIMMON ST./MCBRYDE, 478):
Submitted by BLEW & ASSOCIATES for property located WEST OF 4195 PERSIMMON

SUBJECT: VAR 15-5091: Variance(65 W. ROCK ST./CITY PARKING FENCE, 523):
Submitted by CITY STAFF for property located at 65 W. ROCK ST. The
property is zoned DG, DOWNTOWN GENERAL and contains
approximately 0.55 acres. The request is for a variance of the downtown
fence height requirements.
RECOMMENDATION:
Staff recommends approval of ADM 15-5091 with conditions.
BACKGROUND:
The subject property is located at the southeast corner of Rock Street and Block Avenue and is
developed with two City owned parking lots. The upper lot is accessed from Rock Street and the
lower lot is accessed from Block Avenue. The Police Department uses the upper lot for parking
and storage of police vehicles and equipment. The lower lot is used by non-uniformed city
employees.
DISCUSSION:
Request: The applicant is requesting a variance of Chapter 166.21(E)(6)(b)(i), which limits fence
height in the front yard to a maximum of 42-inches within the Downtown Master Plan boundary.
In order to properly secure the Police Department lot, City staff is requesting approval to construct
an 8-foot tall decorative iron fence (see example photos).The fence will only be located around
the upper lot.
RECOMMENDATION:
Staff recommends approval of VAR 15-5091 with conditions.
Conditions of Approval:
1. Planning Commission determination of a variance of Chapter 166.21(E)(6)(b)(i), which limits
fence height in the front yard to a maximum of 42-inches. Staff finds in favor of the request,
finding that a variance is necessary for the Police Department to properly secure their
vehicles and equipment. The new secure lot will also allow non-evidentiary items to be
separated from the existing evidence lot at the city shop. This is an essential change to
maintain Department accreditation.

2. The fence shall be constructed in the configuration as proposed as a welded ornamental
steel fence with a minimum 5/8-inch diameter pickets and 4-inch maximum spacing between
pickets.
3. With the exception of the fence height, the new fence shall meet all other requirements of

Re: Fence Height Variance Request
The Police Department is requesting a variance from the maximum height restrictions of
the Downtown Fence Code.
The Police Department is in need of a secure lot adjacent to our building for the parking
and storage of department vehicles, trailers and other equipment. Our parking lot on the
southeast comer of Block Ave and Rock Street is currently unsecured and completely open to
vehicular and pedestrian traffic.
Most of the additional vehicles and trailers have been housed in a secure lot at the City
Shop. Access to our vehicles at the City Shop takes extra time and, in some cases, additional
personnel to shuttle vehicles back and forth. In addition,this lot is also used for the storage of
seized and evidentiary vehicles. Due to our accreditation requirements,access to evidentiary
items must be limited to only those personnel assigned to Property/Evidence. To meet this
standard would require us to relocate non-evidentiary items to another location.
In order to properly secure this lot,we are requesting variance from the 4' maximum fence
height restriction on the sides of this lot that face Block Street and Rock Avenue. The proposed
fence would be an 8',welded ornamental steel fence, 4"standard pickets with adornment tips
(photos attached of similar fence at Rogers and Bentonville Police Departments).

SUBJECT: LSP 15-5065: Lot Split (4705 E. WOODSEDGE RD./LINER, 297):
Submitted by JORGENSEN & ASSOCIATES for property located at 4705
E. WOODSEDGE RD. The property is in THE FAYETTEVILLE PLANNING
AREA and contains approximately 5.00 acres. The request is a variance to
create a 1-acre and 4.00-acre tract without street frontage.
RECOMMENDATION:
Staff recommends approval of ADM 15-5065 with conditions.
BACKGROUND:
The subject property is located on Woodsedge Road, just south of E. Mission Boulevard and
approximately one mile east of the Fayetteville City limits. The property is developed with an
existing single-family home with driveway access to Woodsedge Road. The existing property
does not have the required 75 feet of street frontage for lots in the Fayetteville Planning Area and
only adjoins Woodsedge Road at the northeast corner of the property with the existing driveway
crossing an adjacent parcel to the east.
The proposed 1-acre tract is located on the north end of the property and is an open field with
moderate grade between 5 and 10%. South of the existing home the grades increase drastically
to 20 and 30%.
DISCUSSION:
Request:The applicant is requesting approval to create a second property without 75 feet of street
frontage as required for lots in the Planning Area. Both properties would have access to
Woodsedge Road through access easements and public water service is available at the street.
Individual septic systems will be utilized by both lots and an approval letter from the Washington
County Health Department has been provided for the new lot.
RECOMMENDATION:
Staff recommends approval of ADM 15-5065 with conditions.
Conditions of Approval:
1. Planning Commission determination of a variance of Chapter 166.05(A)(3), which requires
all lots in the Planning Area to have direct street frontage in accordance with Washington
County's lot and block standards, which requires 75 feet of lot width. Staff finds in favor of

the request finding the 1-acre lot to be compatible with surrounding properties and of
sufficient size to allow the use of an individual septic system.
2. Prior to recordation of the plat, the application shall revise the survey to show the new water
meter at the northeast corner of the 1-acre tract, so the new water service does not cross
the neighbor's property. The existing service line may remain in the current location.
3. The applicant shall receive approval from Washington County Planning prior to recordation.
4. Impact fees shall be paid prior to receiving a plumbing permit.
5. Lot split approval is valid for 1 year from the date of approval. The lot split must be filed of
record within one year of approval.

Area
(A) Required Infrastructure Improvements and
Subdivision Regulations Outside the City.
(1) Within One Mile of City Limits. On and off-
site improvements and subdivision
regulations for development outside the City
limits and within one mile of the City are the
same as for those developments within the
City limits, with the exception of park land
dedication requirement which is not required.
(2) Beyond One Mile of City Limits. On and off-
site improvements and subdivision
regulations for development outside one mile
of the City limits shall meet Washington
County standards.
(3) All lots in the Planning Area shall have direct
frontage to a public street, with the minimum
frontage required by Washington County
pursuant to residential Lot and Block
Standards.
(B) Developments Outside City Developed to all
Inside the City Standards. If the City Council
grants access to the City's sewer system
pursuant to §51.115. (C) and the
owner/developer agrees to petition for annexation
as soon as legally possible and develop the
subdivision in accordance with all city
development requirements including payment of
all impact fees, the bulk and area requirements
for this subdivision shall conform to those within
the RSF-4 Zoning District or as otherwise
designated by the City Council rather than those
within the planning area.
