New Business:
VAR 15-4978: Variance (315 ROCK STREET/ROCK STREET APTS., 523): Submitted by
MODUS STUDIOS for property located at 315 ROCK STREET. The property is zoned DG,
DOWNTOWN GENERAL and contains approximately 0.29 acres. The request is for a
variance to several site design standards.
Jesse Fulcher, Senior Planner read the staff report.
No public comment was presented.
Chris Baribeau, applicant, discussed the project and the variance requests. They will
dedicate sufficient right-of-way for an 8'sidewalk on Locust, but would like to leave the existing
sidewalk in place. The 5' sidewalk sections runs from Archibald Yell to Dickson.
Commission Chesser stated that the improvements should be made as properties
redevelop. Is there a reason why the new sidewalk shouldn't be installed now?
Baribeau stated there are some topographical challenges, and the existing sidewalk will
provide more greenspace in front of the buildings.
Commissioner Honchell stated he agreed with the applicant. The 5' sidewalk runs the whole
way, and this property is really on the periphery of downtown.
Commissioner Winston agreed. The sidewalk runs the entire street and the uses are
predominantly residential.
Commissioner Cook asked about City projects meeting the Master Street Plan.
Commissioner Hoskins asked when the City built the sidewalk on Locust.
Fulcher stated it was 5-6 years ago. The City just finished South Street and it was built to
Master Street Plan requirements.
Commissioner Hoskins stated that there needs to be some lee-way on these types of
projects, when there is a new 5' sidewalk in both directions.

Commissioner Winston made a motion to approve variances #1-4 for VAR 15-4978.
Commissioner Autry seconded the motion. Upon roll call the motion passed with a
vote of 9-0-0.

Commissioner Winston made a motion to approve variance #5 for VAR 15-4978.
Commissioner Selby seconded the motion. Upon roll call the motion passed with a
vote of 7-2-0. Commissioners Chesser and Cook voted "no".

VAR 15-4979: Variance (495 W. DICKSON STREET/WALTON ARTS CENTER, 484):
Submitted by POLK, STANLEY, WILCOX ARCHITECTS for property located at 495 W.

approximately 4.17 acres. The request is for a variance of the Downtown Design Overlay

RZN 15-4942: Rezone (3010 W. OLD FARMINGTON RD./NALL-BEDFORD, 557):
Submitted by VICKI BEDFORD for property located at 3010 W. OLD FARMINGTON RD. The
property is zoned R-A, RESIDENTIAL AGRICULTURE and contains approximately 4.84
acres. The request is to rezone the property to RSF-8, RESIDENTIAL SINGLE FAMILY, 8
UNITS PER ACRE.
Quin Thompson, Current Planner, read the staff report and outlined the comments of a
neighboring property owner who expressed opposition to the request in an e-mail.
No public comment was presented.
Vicki Bedford, applicant, said that she would like to rezone for future sale, and noted that
a developer is not required to build the maximum density [RSF-8] under the proposed
zoning.
William Chesser, Commissioner, said that he does not consider RSF-8 is not a dense
zoning, and agreed with staff that it is appropriate in this location.
Porter Winston, Commissioner, said that he agreed with the staff recommendation, noting
that the property is near 1-49.
Kyle Cook, Commissioner, said that he felt the request was for the appropriate density,
noting the nearby R-PZD zoned developments with higher densities.
Motion:
Commissioner Chesser made a motion to forward RZN 15-4942 to City Council with a
recommendation of approval. Commissioner Cook seconded the motion. Upon roll call
the motion passed with a vote of 9-0-0.

property located at 4782 N. COLLEGE AVE. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and contains approximately 17.15
acres. The request is for a Mobile Vendor Annual Permit.
RECOMMENDATION:
Staff recommends approval of ADM 15-4980 with conditions.
BACKGROUND:
The subject property is located west of Lake Fayetteville at 4618 N. College Avenue and contains
approximately 17 acres. The majority of the site is undeveloped open space that is cleared pasture
and is known as Mae Farm. The site extends south all the way to the east of the Locomotion
Family Fun Park and all the way to the centerline of Clear Creek. The western portion of the site
that fronts onto College Avenue/Lake Fayetteville Road contains a used car lot and is zoned C-
2, Thoroughfare Commercial and the majority of the undeveloped open space is zoned R-A,
Residential Agricultural. The open space has been used in the past for a golf driving range. Over
the past five years the property owner has utilized the northwestern part of the property along
Lake Fayetteville Road for mobile vending businesses. The applicant has also received various
conditional use permits for special events including outdoor markets on the property. The
surrounding land use and zoning is listed in Table 1.

The applicant, Taqueria Leo's obtained an outdoor mobile vending permit to operate as a mobile
vendor on private property on August 22, 2014. The permit was valid for six months and will expire
on February 22, 2015.

DISCUSSION:
Request: The applicant requests a Mobile Vendor Annual Permit to operate their Mexican food
trailer on the subject property for a year. The applicant has submitted a site plan, menu, and photo
of their trailer for review.
RECOMMENDATION:
Staff recommends approval of ADM 14-4980, finding that the business meets the minimum
requirements and intent of Chapter 178.04, which states: The purpose is to facilitate and control
the ability of mobile vendors and mobile vendor courts to operate on private property while
ensuring such use is compatible with nearby properties, fosters an aesthetically appealing
streetscape and does not create a dangerous traffic condition.
Conditions of Approval:
1. The permit shall be valid for 365 days from the date of approval of the Mobile Vendor Six
Month Permit, to allow this business to remain in its current location until August 22, 2015.
2. In accordance with Federal ADA law and City Code (UDC Section 178.04.D.8), the trailer
for this vendor does not meet ADA compliance, therefore the general public are not
permitted to access/dine in the interior of the trailer.

(A) Purpose. The purpose of this section is to facilitate and control the ability of mobile vendors
and mobile vendor courts to operate on private property while ensuring such use is compatible
with nearby properties, fosters an aesthetically appealing streetscape and does not create a
dangerous traffic condition.
(C) Mobile Vendor Annual Permit. Mobile vendors are allowed to locate for one year in the
same location with approval of the Planning Commission as an administrative item. After the
one year period has expired the mobile vendor may move to another location or may request
a one year renewal from the Planning Commission.

(1) An annual mobile vendor permit may be issued by the Planning Commission after making
the following determinations:
(a) All of the requirements of 178.04(D) have been met. (See attached UDC section)
Finding: The applicant has complied with all requirements of 178.04(D).
(b) The applicant has established that the operation of the mobile vendor will foster an
aesthetically appealing streetscape and will not create a dangerous traffic condition.
Finding: The subject property has been utilized for several years for mobile vending and
maintains a clean and orderly appearance. To the knowledge of staff this
business has operated from this location for several months without creating
dangerous traffic conditions. Access into this site from the existing driveway on
Lake Fayetteville Road will continue as it has for several years.
(c) The mobile vendor business shall not match or duplicate the primary food or beverage
offerings sold by permanent businesses located upon property immediately adjacent
to and on the same side of the street as the proposed mobile vendor, unless the mobile
vendor predates the aforementioned permanent businesses.
Finding: The business does not match or duplicate offerings of adjacent permanent
businesses. The immediately adjacent businesses on the same side of the street
include Lewis and Clark Outfitters to the north and Southtown Sporting Goods
to the south (retail stores).

UDC Chapter 178.04: Outdoor Mobile Vendors Located On Private Property
(A) Purpose. The purpose of this section is to facilitate and control the ability of mobile vendors
and mobile vendor courts to operate on private property while ensuring such use is compatible
with nearby properties, fosters an aesthetically appealing streetscape and does not create a
dangerous traffic condition.
(B) Mobile Vendor Six Month Permit. Mobile vendors are allowed to operate on a temporary basis
for a maximum of six months in one location during a calendar year with administrative
approval of the Planning Division. Mobile vendors utilizing a six month permit may request to
relocate to a different site at least one quarter mile (1,320 feet) from the original location after
this—six month period has expired. However, a new mobile vendor application shall be
reviewed and approved by the Planning Division for every new location. This permit will expire
six months from the date issued and the mobile vending unit shall be removed from the
property. The mobile vendor owner also has the option of requesting an annual permit from
the Planning Commission at or before the end of their initial six month permit time period.
(1) A six month permit for a mobile vendor business shall be approved and issued
administratively by the Planning Division after making the following determinations:
(a) All of the requirements of 178.04(D) have been met.
(b) The applicant has established that the operation of the mobile vendor will foster an
aesthetically appealing streetscape and will not create or worsen a dangerous traffic
condition.
(c) The mobile vendor business shall not match or duplicate the primary food or beverage
offerings sold by permanent businesses located upon property immediately adjacent
to and on the same side of the street as the proposed mobile vendor, unless the mobile
vendor predates the aforementioned permanent businesses.

(D) Mobile Vendor Permit Requirements. All mobile vendors located on private property with Six
Month or Annual Mobile Vendor Permits shall meet the following requirements and submittals
prior to approval:
(1) Each application for a permit to conduct a mobile vendor business on private property
shall be accompanied by a$100 permit review and processing fee. Mobile vendor permits
shall be issued to the owner of the mobile vendor vehicle.
(2) Application for a permit to conduct a mobile vendor business shall include the following
items in a format acceptable to the Planning Division:
(a) Name, address, contact information and signature of both the property owner and the
mobile vendor requesting to locate on private property.
(b) A valid copy of all necessary permits required by State and County health authorities
which shall be conspicuously displayed at all times during the operation of the
business.
(c) Proof of application for remittance of HMR tax to the City of Fayetteville, when
applicable.
(d) A detailed site plan roughly drawn to scale showing the location of the property lines,
each mobile vendor location, building setback lines, vehicle parking spaces, the
sidewalk location and any proposed dining or sitting areas.
(e) Written authorization, signed by the property owner or legal representative of record,
stating that the mobile vendor is permitted to operate on the subject property for a
specified period of time.
(3) The mobile vendor has the responsibility to dispose of all wastes in accordance with all -
applicable laws. Mobile vendors are not permitted to dispose of their trash in public trash
receptacles.
(4) The mobile vendor permit issued shall not be transferable in any manner.
(5) The mobile vendor permit issued shall be conspicuously displayed at all times during the
operation of the mobile vending business.
(6) The proposed use must be a permitted use-by-right within the underlying zoning district.
(7) Mobile vendors shall maintain compliance with parking lot requirements for the existing
business and the proposed mobile vendor business. The number of required parking
spaces is determined by the use and size of the proposed mobile vendor business and by
the use and size of the existing business. The use of parking for a mobile vendor may not
reduce the number of spaces below the minimum required for other uses occurring on the
property. The location of the mobile vendor shall not impede traffic flow or create a
dangerous traffic condition, as determined by Planning Division upon review of the site
plan.
(8) Mobile vendors shall comply with the Federal Americans with Disabilities Act (ADA)
requirements if the public has access to the interior of any mobile vending unit.

SUBJECT: VAC 15-4948: Vacation (3215 N. NORTH HILLS DRIVE/WRMC
WOMEN'S CLINIC, 250): Submitted by USI CONSULTING ENGINEERS
for property located at 3251 N. NORTH HILLS DR. The property is zoned
P-1, INSTITUTIONAL and contains approximately 0.27 acres. The request
is to vacate portions of existing utility easement.
RECOMMENDATION:
Staff recommends forwarding VAC 15-4948 to the City Council with a recommendation for
approval.
BACKGROUND:
Property and background:This site is located in the southwest portion of the Washington Regional
Medical Clinic (WRMC) campus which contains 61.45 acres and is zoned P-1, Institutional. On
January 29, 2015 the Fayetteville Subdivision Committee approved a large scale development on
this portion of the site for a 104,895 square foot women's medical clinic and parking garage (LSD
14-4893). There are existing easements and utilities located under the proposed building site.
The surrounding zoning and land use is listed in Table 1.

attached plans in order to develop the proposed women's clinic addition to the hospital.

Please find enclosed submittal items as a request to vacate existing Utility Easement on the
Washington County Regional Medical Center property along North Hills Drive.
A Large Scale Development has been submitted and is being considered in the current planning
review cycle. The request is for the vacationing of easement within the proposed building and
overhang footprint. The waterline within the Easement Area 1 will be rerouted along the driveway
and new easement recorded under a separate document. The sewer line will become private for
the portion under the proposed expansion.
The waterline at Easement Area 2 is not within the current easement area. Therefore the current
easement is being vacated and a new 20-foot wide easement will be recorded under a separate
plat with this project.
