Kit Williams, City Attorney, asked the applicant if he would like to table the request. Bauer stated yes, but that he would appreciated any feedback from the Commission. Commissioner Chesser stated he was interested in what was being proposed before providing feedback. Commissioner Winston stated he liked the idea of maintain some multi-family units. Williams asked the applicant to explain the concept more. Bauer stated they would maintain townhouses along Happy Hollow Road and would want to change the architectural requirements. No public comment was presented. Commissioner Chesser asked about the double-frontage lots. Andrew Garner, City Planning Director, stated that the lots and streets were already platted. Commission Chesser asked for staff's opinion of maintaining the townhouse units. Fulcher stated that the PZD already allows these units. Motion: Commissioner Chesser made a motion to table RZN 14-4618 to the 3-10-14 meeting. Commissioner Winston seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. SELLERS RD.MINDSOR, 513): Submitted by BLEW AND ASSOCIATES for property located at 6350 WEST SELLERS ROAD. The property is zoned RSF-2, RESIDENTIAL SINGLE-FAMILY, 2 UNITS PER ACRE and contains approximately 34.44 acres.The request is to rezone the property to RSF-4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE. Quin Thompson, Current Planner, read the staff report. Glenn Newman, Staff Engineer, stated that he was present to answer questions, and outlined the City determination that the future development would be required to connect to public sewer. Andrew Garner, City Planning Director, said that the primary concern of the [Planning] Commission is to make a recommendation to the City Council about the compatibility of the request with adjacent zoning and land use, and with the Future Land Use Map. He said that cost of infrastructure should not be considered in a rezoning request. Buckley Blew, Applicant, said that the project has remained partially complete for seven years because the zoning makes development unfeasible. He said his client needs RSF-4 zoning in order to create narrower lots and slightly increased density, approximately 2.25 units per acre in order to make the project work. He said that development will improve the quality of the stream environment, and that the site would not be developed until the property is rezoned. He stated that his client would be willing to offer a Bill of Assurance limiting the number of lots to 79. No public comment was presented. Kit Williams, City Attorney, reminded the Commission that any Bill of Assurance cannot be considered until it has been provided. Mark Hoffman, Neighbor, said that RSF-4 zoning allows too much density for the area, and he added that the lower density that was being suggested by the applicant sounded 'better'. He said that traffic is bad, and that any development would make that worse, so he hoped the Commission would consider street improvements as a part of the project. Tracy Hoskins, Commissioner, asked staff to describe the adjacent, incomplete Amberwood subdivision PZD density. Garner said that the Amberwood PZD was a 'conservation' type subdivision with small lots around large, centralized, shared open areas. Hoskins asked staff if it would be possible for the applicant to seek RSF-2 zoning with variances for lot width. Garner replied that it would be difficult to approve such a large number of variances. Hoskins said that RSF-4 density is not needed to make the project feasible, but that the lot widths allowed under RSF-4 were required. Planning Commission March 10,2614 Agenda Item 1 02-24-14 Minutes Page 5 of 10 Kyle Cook, Commissioner, said that he could not support the request, and that it should be tabled for two weeks. Porter Winston, Commissioner, said that he had concerns about the condition of the stream bank, and asked if the applicant had plans to improve the stream. William Chesser, Commissioner, asked if street improvements would be considered at the time of development. Garner replied that they would. Williams added that any required improvements must meet the constitutional test of `rough proportionality'. Motion: Commissioner Cook made a motion to table RZN 14-4619 to the 3-10-14 meeting. Planning Commission March 10,2614 Agenda Item 1 02-24-14 Minutes Page 6 of 10 ADM 13-4602 Administrative Item (UDC AMENDMENT CHAPTER 161.32 PLANNED ZONING DISTRICT and CHAPTER 166.06 PLANNED ZONING DISTRICT): Submitted by CITY PLANNING STAFF for revisions to the Unified Development Code, Chapter 161.32 and 166.06. The proposal is to categorize the zoning and development requirements of a Planned Zoning District application into the appropriate zoning and development chapters of the Unified Development Code. Jesse Fulcher, Senior Planner, asked the City Attorney to provide the legal background. No public comment was presented. Kit Williams, City Attorney, discussed the issues that arose during a lawsuit filed after the approval of a Planned Zoning District. Staff was asked to re-write the PZD ordinances to separate the zoning and development criteria. Fulcher further explained the code changes. Commissioner Chesser asked about enforcing development standards once the zoning was in place. Williams stated that the PZD may or may not come forward with a development proposal. The zoning and development reviews will be separate. The large scale will have to comply with the approved zoning standards. Commissioner Chesser expressed some concerns with the proposal, in grating a PZD in perpetuity. Fulcher stated that staff would have concerns if there wasn't a development proposal tied to the PZD zoning standards. Andrew Garner, City Planning Director, stated that the development proposal will be a part of any PZD and they will be tied together. A zoning and land use application will have a concept development plan that will be binding. Williams stated an applicant can present a bare-bones PZD, but it may not be approved without sufficient details. Commissioner Hoskins stated that these were great changes and never understood why the zoning expired. Don't expect to see as many PZD's in the future with all of the form based zoning districts available. Commissioner Winston stated he had similar concerns, didn't like the expiration date with PZD's and the sites siting with no development rights. Commissioner Chesser asked if these changes impacted existing PZD's. Williams stated no. Commissioner Hoskins asked about projects that were still valid. Commission Hoskins discussed amending the motion to make the ordinance retroactive. Commissioner Cook stated he had concerns with making it retroactive. Fulcher stated that we would have to research all of the existing PZD's to determine how the ordinance might affect them. Williams stated that this would complicate the ordinance. It's not too onerous for an owner to come back with a request to extend the PZD. Commissioner Honchell likes the way it is written now. Great job with changes. Motion: Commissioner Hoskins made a motion to forward ADM 13-4602 to City Council with a recommendation for approval as proposed. Commissioner Autry seconded the motion. BACKGROUND: Property Description: The property is located on 1.18 acre of undeveloped land across the street from Ramay Junior High School east of Sang Avenue. Water and Sewer System: Water service is not available to the property. The applicant is in the process of extending a water main to provide service. Sewer service is available to the property. Right-of-way to be dedicated:An additional 7' of right-of-way must be dedicated for a right-of-way totaling 29.5' from centerline. Street Improvements: Sang Avenue is an improved collector street approximately 30 feet wide curb to curb with sidewalk on the west side of the street adjacent to Ramey Junior High. This street has been striped and signed with bike lanes south of the project site. Staff recommends the following improvements to Sang Avenue in accordance with the Master Street Plan. The bike lane striping and signage to the south of Mitchell Street should be continued from where it ends, transitioning through the intersection at Mitchell Street to either a shared motorist and cyclist lane and/or a bike lane with signage through the extent of the project site. The exact pavement striping details to be approved by the City Trails Coordinator, Planning and Engineering prior to construction. On street parking to be provided along the project's Sang Avenue frontage within the existing pavement width. Adequate transition including curb bump- outs and possibly pavement lane striping should be provided on both ends of the project site, as approved by City Engineering prior to construction. On-street parking to be striped along the project frontage with approximately 9 feet of greenspace between the curb and a new 5-foot sidewalk at the back of the Master Street Plan right-of-way. In addition, street trees are required at a spacing of one tree every 30 feet and street lights every 300 feet where they do not exist. Tree Preservation: The site contains 100%tree canopy. The minimum preservation requirement under the RMF-24 zoning district is 20%;the project will retain 23.93%of existing canopy, meeting tree preservation requirements. Parks and Recreation: Money in lieu of parkland dedication is required for 10 units at $560/unit ($5600.) Parking Summary: Parking spaces are required at the ratio of one per bedroom. The project contains 30 bedrooms; 30 parking spaces are required, 33 are provided. 2 Motorcycle/scooter spaces are required; two are provided. 1 bicycle parking rack is required; two are provided.
