Commissioner Cabe requested all cell phones to be turned off and informed the audience that listening devices were available. Upon roll call all members were present. RUPPLE RD./DAUGHERTY, 361): Submitted by ROBERT R. DAUGHERTY for property located at 2143 NORTH RUPPLE ROAD. The property is zoned R -O, RESIDENTIAL OFFICE and contains approximately 4.57 acres. The request is to change the nonconforming use to another nonconforming use. Jesse Fulcher, Current Planner, presented the staff report. Bob Daugherty, applicant, stated that the trailer had been removed and agreed with all condtions. Commissioner Chesser asked staff if the neighbors had been contacted. Fulcher stated that the owner had made contact with the neighbors. Commissioner Cook asked to add a new condition of approval (#11), no storage of materials on the north side of the building. Commission Hoskins stated that he met with the owner and neighbors and they were concerned with materials being visible from the street. Commissioner Chesser stated that the elevation of the site and road made screening difficult and that the owner shouldn't be punished for this site characteristic. Commission Cabe stated that he was okay with the fence location as proposed. Motion: Commissioner Chesser made a motion to approve CUP 11-4013 finding in favor of all conditions and adding Condition #11: "No materials shall be stored on the north side of the building." Commissioner Winston seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 0.70 acre. The applicant requests variances of the I-540 Design Overlay District standards and landscape standards to allow 15' of green space for a new parking lot when 25' is required, to group required street trees away from the new parking/display areas, and to use metal building panels on the exterior of the building. Andrew Garner, Senior Planner, presented the staff report. Kim Fugitt, applicant, discussed the reasons for the variance requests. No public comment was presented. Commission Chesser stated agreement with the applicant and agreed with all of the determinations. Motion: Commissioner Chesser made a motion to approve ADM 12-4046 finding in favor of all conditions. Tim Brisiel, applicant, discussed the project including the conditions of approval he is offering. Evan Neihues, applicant's designer, discussed the program of the project including the outdoor living spaces and the intent behind the design of the development. No public comment was presented. Commissioner Hoskins asked about water and sewer provision. Garner discussed the public water and sewer is required for every cottage and will likely be developed through the central portion of the development into the common green. Commissioner Hoskins asked about doing this project as a PZD versus a CUP. Garner discussed the different applications that could have been used for this project. Commissioner Hoskins asked about off-site drainage easements. Tim Brisiel, applicant, discussed that he has talked to the neighbor and they are okay with some sort of drainage easement. Commissioner Hoskins asked about the timing for the easement. Garner discussed that it would be required at the time of development review and is not needed now when only the use is being approved. Commissioner Griffin discussed concerns with maintenance of the common areas and parking for each unit. Tim Brisiel, applicant, discussed the POA's responsibility to maintain the common areas and that he was not sure whether or not there would be assigned spots. Commissioner Chesser discussed that he was in favor of the cottage ordinance and was in favor of allowing cottage development by right. Commissioner Hoskins asked about City enforcement of the various amenities being offered by this development. Garner discussed that many of the amenities being offered would be inspected and approved by the Planning Division prior to occupancy of the first cottage in this development. Commissioner Hoskins seconded the motion. Commissioner Cabe discussed the excitement and uncertainty of this first cottage development. He discussed concern with the density and the lack of connection with the existing homes to the west of the development. He applauded the applicant for coming back to the commission over and over and feels like this is a very converted effort. Commissioners Chesser and Hoskins discussed concerns with drainage. Tim Brisiel, applicant, discussed that they would do a full-blown drainage report at the next stage of development of this project. Upon roll call the motion passed with a vote of 9-0-0. The request is to amend the approved R-PZD 06-1883 Abshier Heights to architecturally design one of the multi -family buildings with brick instead of stone on the rear of the building. Planner: Andrew Gamer BACKGROUND Property Description: On April 4, 2006 the City Council granted approval of R-PZD 06-1883 Abshier Heights on 4.11 acres of land with frontage on Abshier Drive and Hillcrest Avenue, with a maximum of 24 dwellings units in six buildings, at a density of 5.8 dwelling units per acre. All work interior to the site, the street improvements adjacent to the property, and a multi -family building at 269-299 E. Noble Lane has been completed. Architectural Requirement: Ordinance No. 4850 established the Abshier Heights R-PZD zoning. Section 5 of this ordinance referred to a list of requirements for the project. One of these requirements was that the rear facade of the buildings facing Abshier Drive and Hillcrest Avenue would include partial stone facades. Proposal: The applicant is in the process of finalizing construction plans for the multi -family building at 307-337 E. Noble Lane. The applicant requests a change in the PZD approval to use brick on the side of this new building facing Abshier Drive and Hillcrest Avenue, instead of stone. Public Comment: The applicant has been in personal communication with many of the neighbors with contact information provided by City staff. Staff has received inquiries by some of the neighbors about this current proposal and did not receive any objections. The applicant has also agreed to notify the adjacent property owners in writing of the City Council meeting date for this administrative request. Staff agrees with the applicant's rationale that the stone seems architecturally out of place with the design of the buildings. Examples include planter boxes with stone facades; house numbers re -styled and moved to the lower portion of the front of the house near planter boxes; changes in paint palette in the natural earth tones; enlarged window shapes and styles in the latest drawings presented to the neighborhood — all to create a more natural, "softer" feel in line with the traditional character of the existing neighborhood. 3. Speed bumps to be built/installed on Hillcrest, Abshier, Lakeridge and Oakwood by Developer and City with 50/50 cost share with up to four speed tables. 4. A permanent, WRITTEN plan for maintaining the park and greenspace throughout the development included in the homeowner's association agreements and/or covenants for those who purchase the town homes. The association agreements or covenants must be worked out in consultation with the above-mentioned neighborhood representatives throughout the process and approval. Additionally, new neighbors in the development must be aware that Lade Lucille and surrounding property is a private entity and is not available for their use for swinuning, fishing, picnicking, etc. (only accessible by property owners in Lake Lucille/Clay Yoe subdivision). 5. Additional trees and shrubs are to be planted along Hillcrest and Abshier to fill in gaps and ensure that the tree buffer is maintained and expanded. Trees and shrubs are needed to fill in both high and low gaps and present an attractive, natural appearance to neighbors in the development and across Hillcrest and Abshier. 6. Core and soil sample testing will be conducted due to grade and incline, instability of land because of natural springs and previous construction difficulty in area with USA Drug. 7. We respectfully request that City Planning division allow that no bridges or steps leading form the town homes to Abshier or l liltcrest will be constructed. This would only encourage street parking and exacerbate traffic problems. The only steps in the development that are agreeable to the neighbors are those from the pocket park/viewing area to the parking area for the E. Fay Jones' home as designated on plans. Trees and/or shrubbery will be planted at the back of the development to screen the development's residents from the shopping center. These also should include plantings to fill in high and low gaps and present an attractive, natural appearance consistent with a high quality development. 9. No parking signs to be installed along Hillcrest & Abshier on the development side, with no parking allowed on either side of these two streets. 10. Landscape design, and any newly planted trees and shrubbery will, as closely as possible, be in accordance with E. Fay Jones' written/drawn design plans for the property from the U. of A. Mullens Library, Special Collections (neighbors have this document) (i.e. species of trees, placement, etc.). 11. Above-mentioned neighborhood representatives will see sample/rendering of mailbox design and of the sign for the development and provide input for approval, prior to installation. 12. Construction will be limited to daylight hours only. 13. We respectfully request that if this development, PZD 06-1883, Abshier Heights, is not executed, that the City require that this property revert back to RSF-4 (R-1), not its current zoning of record, C-2. 14. Noble Lane— Administrative Item Change Building Material From Stone to Brick in PZD This parcel is currently under contract for purchase from the Bank of Fayetteville for the exclusive use of Bart Bauer, and/or his assigns. The proposed building currently approved in this PZD calls for a small amount of stone on the side and rear of the building. I am requesting that the Planning Commission allow me to replace the stone with brick. 1 feel this will not affect the aesthetics or value of the site in any way. In fact, because of the back patio screens on the building, the stone seems to be architecturally out of place. Even if the stone were to add some kind of value to the site, between the grade change, heavy foliage and patio screens, the stone is nearly impossible to see from E. DEANE ST./LEGACY VENTURES, 365): Submitted by APPIAN DESIGN GROUP for property located at 1637 WEST DEANE STREET. The property is zoned RSF-4, RESIDENTIAL SINGLE-FAMILY, 4 UNITS PER ACRE and contains approximately 0.88 acre. The request is to allow Cottage Housing Development, Use Unit 44, for five new single-family cottages. Planner: Andrew Gamer Findings: Background: This item was tabled at the February 13, 2012 Planning Commission meeting because the architectural design of the five cottages did not meet the minimum requirements. The applicant has revised the design of the cottages to meet the ordinance. The applicant has also submitted a document signed by an adjacent property owner giving indication of this property owner's willingness to work with the applicant on a drainage easement through their property. Property: The subject property is located at 1637 Deane Street, just east of Lewis Avenue. The site is zoned RSF-4, Residential Single Family Four Units/Acre and contains a single family residence on approximately 0.88 acre. The surrounding zoning and land use is listed in Table 1. On May 9, 2011 the Planning Commission approved CUP 11-3825 for the creation of a 0.35 -acre tandem lot. The lot split to create three lots was finalized and recorded and three single family homes were constructed on the three lots. A fourth home has also been constructed on the remaining 0.88 -acre tract, the subject property. On September 26, 2011 the Planning Commission denied another conditional use permit request to create another tandem lot on the subject property. February 27, 2012 Planning Commission CUP 124023 Legacy Ventures Agenda Item 3 Page 1 of 72 Proposal: The applicant proposes to develop the 0.88 -acre site under the recently adopted Cottage Development Ordinance. The proposal would retain the existing home in addition to five new cottages. The applicant has provided a detailed development submittal with site plans, floor plans, and 3D renderings of the overall proposal. In addition, the applicant has submitted a booklet in which they propose pictures and development details that they wish to be included as conditions of approval with their development. All of these materials are attached to this packet. Public comment: Staff has received a combined letter from Joyce Richards and Rebecca Bryant discussing issues with development on this site and a letter from Ronald Chioldi opposed to the development (see attached). RECOMMENDATION: Staff is in favor of this project, finding that although it is a different pattern of development than the surrounding predominant single family residences, it is compatible and would meet the intent of the Cottage Housing ordinance by providing innovation and variety in housing. With the conditions of approval that have been signed and guaranteed by the owner/applicant, staff feels like this will be a high quality project. Additionally, staff feels this proposal is highly consistent with the overriding land use plan of the City (City Plan 2030), specifically the goal #1 to make infill our highest priority. See the findings throughout this staff report for further discussion. RECOMMENDED MOTION: Staff recommends approval of CUP 12-4023 (Deane Street Cottages) subject to, the following conditions of approval: Conditions of Approval: 1. Planning Commission determination of compatibility. Stafffinds that while the proposed cottage development is a different pattern of development, it is compatible with the surrounding land uses and would provide variety and innovation in housing. 2. The project shall be required to go through site improvement plan (SIP) review prior to submittal of construction or building permits to ensure compliance with all Unified Development Code requirements. If the site is proposed to be subdivided it will also be required to go through the preliminary plat (PPL) process either concurrently with or after SIP review. 3. The images and diagrams offered by the applicant in their "Owner Guarantee for Conditions of Approval" booklet, signed by the owner, shall be included as official conditions of approval, herein. 4. To enforce the "Owner Guarantee for Conditions of Approval", at the time of SIP and PPL review the applicant shall submit the following: a. A landscape plan showing landscape plantings and specifications of all amenities, including but not limited to, the outdoor fireplace, gathering area, benches, bike racks, covered parking, pedestrian connections, and fencing indicated in the booklet. b. Architectural renderings, floorplans, and elevations consistent with the architectural details in the booklet that are consistent with the site plan submitted for development review.
