BACKGROUND
Property Description: The subject property is located at 1754 North Janice Avenue, one block
west of Garland Avenue, and contains approximately 0.36 acre with one single-family dwelling
and accessory structures. Surrounding land use is single-family residential.
Background: The original Lot Split (LSP 08-3104) request was approved by the Subdivision
Committee on October 2, 2008 for the creation of an additional single-family residential lot
containing approximately 0.14 acre. Approval of the request was contingent upon extension of a
public,sewer main to serve the created property, in accordance with City code.
Proposal: The applicant requests a one-year extension for the approval of the Lot Split to expire
on October 2, 2010, stating financing issues. The Planning Division received the applicant's
extension request on November 2, 2009, within the required 18 month time limit Should this
extension be granted, the lot split must be recorded with the Washington County Assessor's
Office before the one-year extended deadline.
RECOMMENDATION
Staff recommends approval of ADM 09-3468, the requested extension to LSD 08-3104
(McGowan), with the following conditions:
1. The applicant shall be allowed until October 2, 2010 to record the approved Lot Split.
2. All other conditions of approval LSP 08-3104 shall remain applicable.
DISCUSSION
The City of Fayetteville Unified Development Code (UDC) Section 166.20(B)(2) gives the
Planning Commission authority to extend approval of lot split one additional year within 18
months of the original approval. In order to extend this approval, the applicant must: (1) request

the extension prior to the one year time limit, and (2) show good cause why the tasks could not
reasonably be completed within the normal one year. If the one year extension is granted, it is
within this time that the applicant shall receive all permits and approvals as required by City,
State, and Federal regulations to start construction of the development or project.
(1) The applicant has submitted the extension request to the Planning Division on November
2, 2009, prior to the 18 month time limit ending on April 2, 2010.
(2) The applicant has stated that financing reasons have delayed this project, and additional
time is needed before the conditions of approval can be met in order to record the plat.

LSP 08-3104: Lot Split (MCGOWAN, 365): Submitted by BATES & ASSOCIATES for
property located at 1754 N. JANICE AVENUE. The property is zoned RSF-4, SINGLE
FAMILY - 4 UNITS/ACRE and contains approximately 0.36 acres. The request is to divide the
subject property into two tracts of 0.22 and 0.14 acres.

Findings:
Property Description: The subject property is located at 1754 North Janice Avenue, one block
west of Garland Avenue, and contains approximately 0.36 acre with one single-family dwelling
and accessory structures. Surrounding land use is single-family residential.
Proposal: The applicant proposes to subdivide the subject property into two lots, Lot A,
containing 0.22 acre and Tract B, containing 0.14 acre.
Board of Adjustment: On October 6, 2008 the applicant will request lot area variance approval
from the Board of Adjustment to allow for the creation of Lot B with a lot area of approximately
6,138 square feet, which is indicative of the RSF-7 zoning district. Lot B will comply with all
other bulk and area requirements of the RSF-4 zoning district.
Right-of-way dedication: The applicant shall dedicate 25' from centerline on Janice Street (a
Local Street) and 42.5' from centerline on West Deane Street (a Minor Arterial).
Water/Sewer: Both Lots have access to public water service. Lot A has access to sanitary sewer
and Lot B does not. The applicant shall extend public sanitary sewer to Lot B and any necessary
easements and/or right-of-way shall be approved by the Engineering Division and the Water and
Sewer Division prior to recordation of the lot split.
Access: Both lots have frontage for direct access on West Deane Street. The existing house is
currently accessed from Deane Street. The existing driveway shall serve as a shared drive for
Lots A and B and shall be dedicated as an access easement on the lot split plat. No additional
curb cuts shall be permitted onto Deane Street.
Public Comment: Staff has not received public comment.

Recommendation: Staff recommends approval of LSP 08-3104 subject to the following
conditions of approval:
1. The applicant shall remove the shed located on proposed Lot B prior to recordation of
the Lot Split.
2. Aerial imagery shows a structure, east of the garage, not shown on the plat. This
structure shall be removed prior to recordation of the lot split.
3. The applicant shall extend public sanitary sewer to Lot B and any necessary
easements and/or right-of-way shall be dedicated prior to recordation of the lot split.
4. The existing driveway shall serve as a shared drive for Lots A and B. No additional
curb cuts shall be permitted. The existing drive shall be dedicated as a shared access
easement on the lot split plat.
5. Parks fees in the amount of $960 per single family dwelling will be due at the time of
building permit.
6. All new addresses shall be approved by the GIS Division.
7. Should the Board of Adjustment deny the lot area variance request for Lot B, the lot
split shall be considered null and void.
8. Plat Review and Subdivision comments (to include written staff comments provided
to the applicant or his representative, and all comments from utility representatives -
AR Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
9. This lot split must be filed of record within one year from the date of approval or the
approval is rendered null and void.
10. Impact fees for water, sewer, police, and fire shall be paid in accordance with City
ordinance.

Planning Commission,
This letter is in regards to the lot split located at 1754 N. Janice Ave. Fayetteville, AR 72703. I'm
asking for a one-year extension on this lot split. I was unable to refinance the current home on the
property; therefore I couldn't split the lot because I didn't have my banks approval. I'm trying to
refinance the existing home on the lot we have created for it. If I can get my bank to confirm they will
do this I can proceed with filing the lot split.

BACKGROUND
Property Description and History: The subject property is located at the northeast corner of Zion Road
and Veterans Park entry drive and contains approximately 8.58 acres. On May 6, 2008 the City Council
approved C-PZD 08-2894 (Park Centre) for the construction of approximately 100,500 sq. ft. of office,
retail, and restaurant space and 15 residential units. In moving forward with the design and construction
of this project the applicant has identified a need to revise the building elevations.
Request: The applicant requests major modification to the Planned Zoning District zoning criteria and
Large Scale Development plan to revise the approved building elevations. The applicant has submitted a
packet containing the previously approved building elevations and the proposed elevations, and a copy of
the previously approved site plan is attached to this staff report. As indicated in the applicant's letter
request, the following is a list of proposed changes to the building elevations:
• The office building has more articulation and utilizes brick panels, glass, and metal.
• The retail facade now consists mostly of brick and stucco in lieu of metal panels.
• The retail facade has several steps in the facade vertically and horizontally to break up the long
facade into more a neighborhood center scale.
• The retail building has a covered walkway from end to end for patrons.
DISCUSSION
The proposed modifications to the approved Park Centre Commerical Planned Zoning District have been
determined a major modification to the approved Large Scale Development and a modification to the
architectural design standards of the Planned Zoning District zoning criteria. Staff finds the proposed
changes in building materials and overall appearance meet the architectural design standards for
commerical structures listed in Fayetteville Unified Development Code Section 166.14 (C). The proposed

changes do this by not providing large blank, unarticulated wall surfaces and by providing a recurring,
unifying theme and well -articulated elevations. The proposed change to utilize more masonry materials
will transition well with the natural setting of Veteran's Park to the north and the tree preservation areas
onsite. The changes to breakup the scale of the buildings into smaller segments have resulted in building
facades that are more human scale. These changes are consistent with the intent of the previously
approved C-PZD to provide for a retail, office, and mixcd use development with Large areas of tree
preservation and connection to Veteran's/Lake Fayetteville Park.
RECOMMENDATION
Recommended Motion: Staff recommends the Planning Commission forward ADM 09-3467 (Park
Centre C-PZD Amendment No. 1) to the City Council with a recommendation for approval with the
following conditions of approval:
1. Planning Commission determination of commerical design standards and recommendation on
changes to the architectural design standards of C-PZD 08-2894 (Park Centre). Staff finds
that the proposed changes in building materials and overall appearance meet the
architectural design standards for commericial structures listed in Fayetteville Unified
Development Code Section 166.14 (C). The proposed changes do this by not providing large
blank, unarticulated wall surfaces and by providing a recurring, uniing theme and well -
articulated elevations. These changes are consistent with the intent of the previously
approved C-PZD to provide for a retail, office, and mixed use development with large areas
of tree preservation and a new connection to Veteran's/Lake Fayetteville Park.
After approval of the revised elevations the applicant shall submit two copies of the revised
Park Centre C-PZD booklet to the Planning Division, to officially document the change in
zoning criteria.

Dear Mr. Gamer:
The owners of the Park Centre development are moving forward with design and construction
documents to bid and hopefully construct the office and retail center. We have "re -studied" the
exterior appearance and have prepared revised exterior elevations and renderings of the buildings. I
believe that the revised schematics are far better that the previously submitted design and would like
to obtain a revision to accept this as the design for Park Centre. The following is a list of the
improvements that we have made:
• The office building has more articulation and utilizes brick panels, glass, and metal, which
will blend well with the natural surroundings and frame views of the landscape from within
the building.
• The retail facade now consists mostly of brick and stucco in lieu of metal panels
• The retail facade has several steps in the facade vertically and horizontally which breaks up
the long facade. The scale is more appropriate to a neighborhood center.
• The retail building has a covered walkway from end to end for patrons
• The exterior materials of all structures are timeless and enduring materials, which should
look great for many years to come.

Recommendation: Staff recommends approval of LSP 09-3455 with the following
conditions:
Conditions of Approval:
1. Planning Commission determination of a variance of Chapter 177.04(D)(1) to waive the
requirement for five (5) feet of landscaped area between the property line and the parking
lot. Staff finds that the intent of this requirement for 5 feet of landscaped area is to
provide a buffer and additional greenspace between separate developments. Approval of
the lot split would allow the subject property to remain as one multi -building
development under separate ownership. Staff recommends approval of the variance,
finding that enforcing this requirement in an existing development in order to create
property lines for separate ownership of land within the development would create a
financial hardship and is not in line with the intent of the ordinance.

RE: STADIUM CENTRE LSP — VARIANCE REQUEST
To Whom It May Concern:
Please accept this letter as our official request for a waiver from Chapter 177.04 (D) with
regard to parking lot landscape requirements. The code states that all parking lots shall
have five feet (5') of landscaped area between the property line and parking lot. Due to
the proposed lot configuration, some interior property lines are located within the existing
parking lot. The proposed property lines obviously will not change the existing or
proposed use of the project as a whole. Additionally, the proposed parcels will not
reduce the amount of greenspace.existing on site.
