On September 12, 2005 the Planning Commission approved PPL 05-1608 Waterbrook Phase I and on October 10, 2005 approved PPL 05-1669 Waterbrook Phase II for a residential subdivision with 117 single family lots.The applicant received permits for construction of the infrastructure of the Waterbrook subdivision from the City Engineering Division on April 18,2006.City ordinance requires a final inspection within three years of approval. Proposal: The construction permits expired on April 18,2009.The applicant requests to extend the approval of the construction permits for two years from the three-year expiration date,to expire on April 18,2011.The Planning Division received the applicant's extension request on April 15,2009, prior to the expiration date. Should this extension be granted, the final plat approval for the Waterbrook development is required to be approved before the two-year extended deadline.If the final plat is not approved prior to April 18, 2011, all of the approved plans for the project shall be rendered null and void. RECOMMENDATION Planning Staff recommends approval of ADM 09-3285,the requested extension for the construction permits for PPLs 05-1608 and 05-1699 (Waterbrook Subdivision),with the following conditions: 1. In order to extend this approval, the applicant must: (1) request the extension prior to the one year time limit, and (2) show good cause why the tasks could not reasonably be completed within the normal three year time limit. If the two year extension is granted,it is within this time that the applicant shall receive final inspection/final plat approval of the subdivision. (1) The applicant submitted the extension request to the Planning Division on April 15, 2009, prior to the three-year time limit ending on April 18, 2009. (2) The applicant has stated that they have completed approximately 90% of the infrastrcuture for the subdivision and that the economic downturn has caused financial difficulties that have delayed the completion of the project. Mountain Fayetteville, AR 72701 RE: Waterbrook subdivision—Grading Permit Extension To City of Fayetteville Planning Commission This letter is to request an extension of the grading permit for the Waterbrook Subdivision. Pursuant to Chapter 166:20 part C. section 2, which allows a petition to the Planning Commission for a two year extension. The Waterbrook Subdivision was approved for a grading permit on April 18`h 2006. Approximately 90% of infrastructure has been installed. Additionally the water and sewer systems have been tested and passed by both the City of Fayetteville and Arkansas State Health Department. The last major item for construction concerns the connection to State Highway 16. The project has not been completed within the construction time allowance due to financial difficulties caused by the economic down turn in the economy.
