The assessments were paid by CDC when the plat for these lots was filed. I understand that there is a question of whether the cost of the assessments was built into the lot purchase price paid by the current owners. I would like to respond to that question at this time-Unlike a residential subdivision where the lots are platted prior to a sale, in a commercial subdivision, we try to configure the lots to the buyers' needs prior to submitting the application for platting. Lots 1 and 2 of Wedington Place were the first two lots to be subdivided. Prior to making the application for the subdivision of these two lots,we worked with the buyers to determine the size and configuration of a lot that would address the needs for their respective uses. When we made the application for subdivision of Lots 1 and 2, we had already negotiated a price with the buyers based on the area and location of the lots. The price had been agreed to prior to the sewer assessment being imposed during the platting process, and the.refore was a cost of the We to CDC, and was not included in the price paid by the buyer. The sewer assessment was a cost to CDC and should be refunded to CDC. Thank you for the opportunity to address this issue. Howe, City Clerk Marilyn Moore, City Attorney David Malone, and Directors Swartz,_McFerran, Melton, Lancaster, Starr. Absent at Roll Call but later entering: Director Dunn. Absent: Director Jones. Representatives of the Press were present. L-118 The Mayor reported that the purpose of the meeting was to adopt a Land Use Plan; adoption of a comprehensive ordinance regulating and establishing the use of land and the use and location of buildings and structures; regulating the bulk of buildings and structures.and determining the .area of yards, courts and other places surrounding them; regulating and restricting the density of use; dividing the City of Fayetteville into districts for such purposes; adoption of an official zoning regulation of said City. showing boundaries and the class of such districts; establishing a Board of Adjustments; and providing penalties for the violation of its provisions; and the transaction of such other business as may properly come before the. Board of Directors. The Mayor reported that all Directors had been notified of the special meeting in person at the last special meeting of the Directors on June 22, 1970 and by U. The motion was seconded by Director Dunn and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordi- nance open for discussion. After a discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nay" none. Representatives of Donrey Advertising Company. appeared before the Board of 2-119 Directors to protest the restrictions on billboard advertising that the new ' zoning ordinance, 1747, would impose. The Mayor requested the Planning Commission to study the protest and recommend a decision. The Mayor reported that the Master Street Plan and Subdivision Regulations 3-119 would be considered at the next regular meeting on July 6, 1970. Mayor Melton reported that a special meeting of the Board of Directors would 4-119 be held at 7:30 p.m. July 13, 1970 in the Directors Room in the City Admini- stration Building to consider a special report from Black and Veatch. There being no further business, Director Dunn moved to adjourn. The motion was seconded by Director McFerran and passed unanimously, whereupon the Mayor declared the meeting adjourned.
