Pamela Cantrell on behalf of Dramis Hardwood Floors for property located at 2275 S.
School. The property is zoned C-2, Thoroughfare Commercial. The request is for a
refund of sidewalk funds put in escrow.

Commission determination of disposition of funds in escrow account collected through an

property owned by Ermel Fox and located at 1860 W. 6h Street. The property is zoned
C-2, Thoroughfare Commercial and contains approximately 1.11 acres. The request is for
additional parking for a proposed restaurant.

6. RZN 02-21.00: Rezoning(Dixie Development,pp 251)was submitted by Dixie
Development on behalf of Fern Younkin Revocable Trust for property located at 10
Bishop Drive and 35 Appleby Road. The property is zoned A-1, Agricultural and
contains approximately 17.39 acres. The request is to rezone to R-O, Residential Office.
7. RZN 02-22.00: Rezoning (Shackelford,pp 558) was submitted by Tom Shackelford for
property located at 2975 Old Farmington Road. The property is zoned A-1,Agricultural
and contains approximately 1.5 acres. The request is to rezone to R-1, Low Density
Residential.
8. RZN 02-8.00: Rezoning (Nickell, pp 445/446)was submitted by Bob Hill of Nickle-Hill,
Group on behalf of J.C. &Alma Nickell for property located at 867 N. College Avenue.
The property is zoned R-O, Residential Office and contains approximately 0.29 acres.
The request is to rezone to C-2, Thoroughfare Commercial.
9. RZN 02-18.00, 19.00, & 20.00: Rezoning(Mill District, pp 522/523) Mill District
Rezoning Proposal was submitted by Shelli Rushing with the City of Fayetteville on
behalf of the Mill District Neighborhood Organization for three areas located between
Center Street and Prairie Street and between West Avenue and University Avenue. Area 1
is zoned I-1,Light Industrial and a small portion is zoned C-1 Neighborhood Commercial
and contains approximately 4.40 acres. Area 2 and Area 3 are zoned I-1 Light Industrial.
Area 2 contains approximately 7.50 acres and Area 3 contains approximately .49 acres.
The request is to rezone Area l and Area 2 to R-O,Residential Office and Area 3 to C-3,
Central Commercial.
All interested parties may appear and be heard at the public hearings. A copy of the proposed amendments and other
pertinent data are open and available for inspection in the Office of City Planning(575-8264),City Administration

Re: Hamstring Creek Basin Sewer Assessment Refund
Dear Sara,
We would like to take this opportunity to request that the assessments for Lots 1. and 2 of
Wedington Place subdivision be refiwded to Clary Development Corporation(CDC).
The assessments were paid by CDC when the plat for these lots was filed.
I understand that there is a question of whether the cost of the assessments was built into
the lot purchase price paid by the current owners. I would like to respond to that question
at this time-Unlike a residential subdivision where the lots are platted prior to a sale, in a
commercial subdivision, we try to configure the lots to the buyers' needs prior to
submitting the application for platting. Lots 1 and 2 of Wedington Place were the first
two lots to be subdivided. Prior to making the application for the subdivision of these
two lots,we worked with the buyers to determine the size and configuration of a lot that
would address the needs for their respective uses. When we made the application for
subdivision of Lots 1 and 2, we had already negotiated a price with the buyers based on
the area and location of the lots. The price had been agreed to prior to the sewer
assessment being imposed during the platting process, and the.refore was a cost of the We
to CDC, and was not included in the price paid by the buyer. The sewer assessment was
a cost to CDC and should be refunded to CDC.

CUP 02-22.00: Conditional Use (EOA,Inc.,pp 563) was submitted by Kathleen Randall on
behalf of EOA,Inc. for property located at 1225 Wood Avenue. The property is zoned R-2,
Medium Density Residential and contains approximately 2.0 acres. The request is for an
educational center(use unit 4).
RECOMMENDED MOTION:
Staff recommends approval of the conditional use subject to the following conditions:
1. No more than 25 children to be served by the Center.
2. A minimum of two parking spaces shall be provided plus parking for employees
on the largest shift. One of such spaces shall be ADA accessible.
3. Dumpsters located on the property shall be properly screened and the location to
be reviewed by Planning and Solid Waste.
4. Screening of the play area shall be provided in accordance with §166.10.
5. All signs shall meet the regulations of Chapter 174 Signs of the UDO.
6. Provide 2,000 square feet of designated outdoor play area with 75 feet separation
from adjacent structures.
7. When funding for paving has been acquired,request parking lot permit prior to
paving.
8. Outdoor play space, screening,dumpster location to be shown on site plan for
building permit applicable to renovate the structure. If no building permit is
required for the renovation work,Planning staff shall review a site plan with the
Certification of Zoning Compliance application prior to occupation of the
structure.
9. Any outdoor lighting installed in the future shall be shielded and directed
downward and away from adjacent properties.
10. Compliance with Building Safety and Fire Department inspection requirements.
11. The conditional use shall expire one year from approval date if no action has
been taken to implement the conditional use.
12. Install a 4' wide sidewalk prior to occupancy.

WHEREAS, the City Planning, Commission has had under study a report
prepared by Jame Vissier, Planning Consultant, ]mown as "General Plan
1970-1990, Volumes I and II" having incorporated therein a proposed zoning
district map for the City of Fayetteville, Arkansas, and
WHEREAS, public hearings were held by the City Planning Commission
Thursday, February 19, 19709 and Friday, February 20, 1970, fifteen (15)
days after said plans were placed on display in the office of City Planning
and after a notice was published in the Northwest Arkansas Times, a news-
paper of general circulation, and
WHEREAS, after the public hearings and after further considerations
and revisions of said plane by the Planning Commission, the Planning
Commission voted on May 21, 1970, to make a recommendation to the Heard
of Directors on "General Plan 1970-1990, Volumes I and II" incorporated
with a proposed soning district map for the City of Fayetteville, Arkansas.
Now, THEREFORE, BE IT RECOWNM BY THE CITY PLANNING COMMISSION TO
THE BOARD OF DIRECTORS OF THE CITY OF FAYETTWVIL E, ARKANSAS:
SECTION 1. That "General Plan 1970-1990, Volume I and II" with
revisions made by the Planning Commission be adopted as guidelines for
future development and planning for the City of Fayetteville, Arkansas.
SECTION 2. That ordinances be enacted for the purpose of adopting
Volume II of General Plan 1970-1990 which includes the following:
(a) Land Use Map for the City of Fayetteville, Arkansas.
(b) Master Street Plan for the City of.Fayetteville, Arkansas.
(c) . Capital Improvements Program for the City of Fayetteville, Arkansas.
(d) Zoning Regulations for the City of Fayetteville, Arkansas.
(e) Zoning District Map for the City of Fayetteville, Arkansas.
(f) Subdivision Regulations for the City of Fayetteville, Arkansas.

MINUTES OF A SPECIAL MEETING OF THE BOARD OF DIRECTORS
June 29, 1970 '
The Board of Directors of the City of Fayetteville, Arkansas, met in special
session on Monday, June 29, 1970, in the Directors Room in the City Administration
Building at 7:30 p.m.
Present: City Manager Wesley M. Howe, City Clerk Marilyn Moore, City Attorney
David Malone, and Directors Swartz,_McFerran, Melton, Lancaster, Starr.
Absent at Roll Call but later entering: Director Dunn.
Absent: Director Jones.
Representatives of the Press were present.
L-118 The Mayor reported that the purpose of the meeting was to adopt a Land Use Plan;
adoption of a comprehensive ordinance regulating and establishing the use of land
and the use and location of buildings and structures; regulating the bulk of
buildings and structures.and determining the .area of yards, courts and other places
surrounding them; regulating and restricting the density of use; dividing the
City of Fayetteville into districts for such purposes; adoption of an official
zoning regulation of said City. showing boundaries and the class of such districts;
establishing a Board of Adjustments; and providing penalties for the violation of
its provisions; and the transaction of such other business as may properly come
before the. Board of Directors.
The Mayor reported that all Directors had been notified of the special meeting in
person at the last special meeting of the Directors on June 22, 1970 and by U. S
Mail.
?-118 Director Jones was unable to attend but has waived notice of the Special Meeting.
WAIVER OF NOTICE OF SPECIAL MEETING of
FAYETTEVILLE CITY BOARD OF DIRECTORS
Comes now the undersigned, being a duly elected, qualified and acting member
of the Board of Directors of the City of Fayetteville, Arkansas, and speci-
fically waives notice of a special meeting of the Fayetteville Board of
Directors to be held in the Directors Room of the City Administration Building:,
Fayetteville,, Arkansas, at 7:30 o'clock p.m. , on June 29, 1970.

%-118 The City Manager reported that the Planning Commission had adopted a Planning
Area Map. The Planning Commission also recommended to the Board of Directors
that the Land Use Plan map be adopted.
Director Dunn entered at this time.
-118 The City Attorney introduced, and at the request of the Mayor,read a proposed
resolution in its entirety adopting the Land Use Plan and the general plan
following page 92, Volume I, of said plans with revisions by the City Planning
Commission as the Land Use Map for the City of Fayetteville. ,
Director Lancaster moved that the Resolution be adopted.
The motion was seconded by Director Starr, .and upon roll call the following
vote was recorded: "Aye" Swartz, McFerran, Melton, Lancaster, Starr, and-Dunn. ,
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the

The City Attorney introduced, and at the request of the Mayor, read a proposed 1-119
ordinance in its entirety for the first time entitled, "A COMPREHENSIVE ORDI-
NANCE REGULATING AND RESTRICTING THE USE OF LAND AND THE USE AND LOCATION OF
O BUILDINGS AND STRUCTURES; REGULATING THE BULK OF BUILDINGS AND STRUCTURES AND
DETERMINING THE AREA OF YARDS, COURTS AND OTHER PLACES SURROUNDING THEM;
REGULATING AND RESTRICTING THE DENSITY OF USE; DIVIDING THE CITY OF FAYETTE-
VILLE INTO DISTRICTS FOR SUCH PURPOSES; ADOPTING AN OFFICIAL ZONING MAP OF
SAID CITY SHOWING BOUNDARIES AND THE CLASSIFICATION OF SUCH DISTRICTS; ESTAB-
LISHING A BOARD OF ADJUSTMENT; AND PRESCRIBING PENALTIES FOR THE VIOLATION OF
ITS PROVISIONS."
Director Swartz moved that the rule be suspended and that the Ordinance be
placed on second reading.
The motion was seconded by Director McFerran and passed unanimously. The
Ordinance was then read for the second time.
Director McFerran moved that the rule be further suspended and that the Ordi-
nance be placed on third and final reading.
The motion was seconded by Director Dunn and passed unanimously. The Ordinance
was then read for the third and last time. The Mayor then declared the Ordi-
nance open for discussion. After a discussion, the Mayor asked the question,
"Shall the Ordinance pass?" Upon roll call the following vote was recorded:
"Aye" Swartz, McFerran, Melton, Lancaster, Starr, and Dunn.
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the
Ordinance passed.
Ordinance No. 1747 is on page 126 of Ordinance and Resolution Book 1.
Representatives of Donrey Advertising Company. appeared before the Board of 2-119
Directors to protest the restrictions on billboard advertising that the new
' zoning ordinance, 1747, would impose. The Mayor requested the Planning
Commission to study the protest and recommend a decision.
The Mayor reported that the Master Street Plan and Subdivision Regulations 3-119
would be considered at the next regular meeting on July 6, 1970.
Mayor Melton reported that a special meeting of the Board of Directors would 4-119
be held at 7:30 p.m. July 13, 1970 in the Directors Room in the City Admini-
stration Building to consider a special report from Black and Veatch.
There being no further business, Director Dunn moved to adjourn. The motion
was seconded by Director McFerran and passed unanimously, whereupon the Mayor
declared the meeting adjourned.

FPL 96-11 (Coyote Trail Subdivison)
Project: AD 01-4911: Administrative Item (Coyote Trail Subdivision,pp 285)was
submitted by City Staff on behalf of E.H. Sonneman and Sara Sonneman-Agee for property
located west of Deane Soloman Road and south of Coyote Trail. The request is to dispose of the
assessment for the offsite sewer improvements in the amount of$3,200.00 plus interest that was
assessed to the residential subdivision.
Findings: The final plat for the Coyote Trail Subdivision,(FPL 96-11)was approved by the
Subdivision Committee on August 1, 1996 for a 16 lot residential subdivision.One of the
Conditions of Approval stated that there was a requirement of$200.00 per lot for sewer
improvements. This assessment was collected on January 2, 1997. Find attached a copy of the
Conditions of Approval from the August 1, 1996 Subdivision Committee Meeting. Also
attached is a listing of the current property owners within this subdivision. The records show that
the original developers of the subdivision do not currently own any of the 16 lots.
Staff Recommendation: None.
§158.05 OFFSITE IMPROVEMENTS/DELAYS
A. Proportionate Share.
2. If the off-site improvement is not constructed within five years from the date of the first
payment into the escrow account by a developer,the Planning Commission shall hold a public hearing,after
notification to all affected property owners,to determine the disposition of all money in the escrow account.
Following the public hearing,the Planning Commission may:
a. Determine that the off-site improvement is still necessary and feasible and can be built
within a reasonable time,in which case the escrow account shall be continued for a period
specified by the Planning Commission: or
b. Determine that the off-site improvement is not necessary,or will not be feasible,or that
insufficient development has occurred to render the improvement likely in the foreseeable
future,in which case the Planning Commission shall either:

The next item was a final plat for Coyote Trail Subdivision submitted by WBR Engineering on behalf of Charles and
Sara Agee for property located west of Deane Soloman Rd_and south of Coyote Trail. The property is zoned R-1-5,
Moderate Density Residential, and contains approximately_.65 acres with 16 proposed lots designated for two-
family dwellings.
Ms.Little advised the subdivision was complete. She noted the sidewalk did not go all the way around the cul-0e-
sac and advised the requirement was that sidewalks went the length of the cul-de-sac. She also noted the street lights
had not yet been installed.
Mr.Rudasill,WBR Engineering,stated the payment for the street lights would be made immediately and then the
street lights would be installed.
Ms.Little advised the applicant needed to notify Perry Franklin,Traffic,they were ready for the street signs to be
placed. She also noted there was a requirement of$200.00 r lot for sewer im roveme and the parks fees were

Jim Beavers advised there were a few minor things which needed to be completed but the subdivision could be
approved subject to completion. He also noted they would need a letter of credit on improvements to Deane
Soloman and the sidewalks. He stated the preliminary plat had been approved subject to the subdivision being
screened from Deane Soloman Road. He pointed out there was existing vegetation which could be used as
screening.
Mr.Rudasill advised the vegetation would remain.

Project: AD 01-49N: Administrative Item(Silverthorne Subdivision,pp 474)was
submitted by City Staff on behalf of John Deweese and Mike Schmidt for property located west
of Double Springs Road and Dot Tipton Road. The request is to dispose of the assessment for
the offsite sewer improvements in the amount of$11,800.00 plus interest that was assessed to the
residential subdivision.
Findings: The final plat for the Silverthorne Subdivision(FPL 01-03)was approved by the
Subdivision Committee on March 29,2001 for a 59 lot residential subdivision. One of the
Conditions of Approval required a"sanitary sewer assessment in the amount of$11,800.00 (59
lots @$200.00 per lot) for a fixture force main exiting from Lift Station No. 7 in the Hamestring
Creek Basin." This assessment was collected on May 14,2001. Find attached a copy of the
Conditions of Approval from the March 14, 2001 Technical Plat Review. Also attached is a
listing of the current property owners within this subdivision. The records show that the original
developers of the subdivision currently own 6 of the 59 lots (one of the developers owns an
additional 10 lots and the other developer owns an additional 7 lots).
Staff Recommendation: None.
