New Business:
LSD 11-3903: Large Scale Development (2530 W. WEDINGTON DR./KUM & GO, 402): Submitted by
CET ENGINEERING for property located at 2530 WEST WEDINGTON DRIVE. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and contains approximately 1.54 acres. The request is for a gas station
and convenience store containing approximately 4,958 square feet.
Jesse Fulcher, Current Planner, gave the staff report, recommending approval of the large scale and denial of
the access to Wedington.
Erin Rushing, applicant, stated that the main issue was access to Wedington. They tried to acquire the
property to the west and obtain an access easement, but weren't able. The access has been to the east side of
the property. The fueling station needs access to Wedington, but AHTD won't allow a different standard on
the restricted right-in/right-out driveway.
Commissioner Chesser asked staff if they would support a right -in only drive.
Fulcher stated that a design would need to be presented. Staff hasn't seen a design for the right-in/right-out
that we can support.
Commissioner Chesser stated that he might support a right -in only with a more restrictive design and asked
if there was another design.
Rushing stated he hadn't seen one.
Commissioner Hoskins asked the applicant if the project was dead without the access to Wedington.
Rob Wadley, applicant, stated that the store needs access to Wedington, especially with the short signal
length for south bound traffic on Futrall.
Kit Williams, City Attorney, asked the applicant if they had thought about adding a second south bound lane
on Futural.
Wadley stated that Kum and Go must have access on Wedington. The state only has one design.
Commissioner Winston stated that he could support a right -in but not a right -out, since you exit into a
dedicated turn lane for the on ramp. This requires drivers to cross over to go west.
Glenn Newman, Staff Engineer, stated that that state wouldn't likely increase the signal length for Futrall,
since Wedington was the primary street. The state has indicated to us that they would accept a more restrictive
design.
Commission Porter asked the applicant if they wanted more time to work with the state on the design.
Wadley, stated that they would talk with the owner and state.
Commissioner Chesser stated that he was concerned with the right -out, but might support the right -in.

CUP 11-3945: Conditional Use Permit (4618 N. COLLEGE AVE./FREEDOM FAIR, 096): Submitted
by JEFF OLAND for property located at 4618 NORTH COLLEGE AVENUE. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and R -A, RESIDENTIAL -AGRICULTURAL and contains
approximately 17.55 acres. The request is for a one -day fair, Use Unit 2, City-wide uses by conditional use, in

CUP 11-3947: Conditional Use Permit (1444 E. STEARNS ST.BELLAFONT LOT 2,175): Submitted by
JORGENSEN AND ASSOCIATES for property located at 1444 EAST STEARNS STREET. The property is
zoned C-3, CENTRAL COMMERCIAL and contains approximately 1.55 acres. The request is for parking in
excess of that permitted in Chapter 172, Parking and Loading.
Andrew Garner, Senior Planner, gave the staff report.
Justin Jorgensen, applicant, withdrew the conditional use request for additional parking but requested the
variance for the driveway onto Vantage Drive as shown.
No public comment was presented.
Commissioner Earnest asked for clarification about the request.
Garner discussed that the driveway onto Vantage Drive requires Planning Commission approval, but since the
applicant has withdrawn the request for an increased number of parking spaces over the ordinance, the parking
issue does not need to be considered by the commission.
Motion:
Commissioner Chesser made a motion to approve the variance to permit the curb cut as proposed by the
applicant at 1444 East Stearns Street. Commissioner Bunch seconded the motion. Upon roll call the motion
passed with a vote of 8-0-0.
There being no further business, the meeting was adjourned at 6:12 PM.

BACKGROUND:
The applicant originally intended to place the leasing trailers at the intersection of 11th Street and
West Avenue. However, changes to the final site design and grading plan required the applicant
to relocate the leasing compound to the northwest corner of the site adjacent to Government
Avenue.
Property Description: The subject property is located south of Martin Luther King Jr. Boulevard
and west of South School and was formally used as the Washington County Sale Barn. The
approximately 12.16 -acre project boundary has frontage onto South School, 11th Street, Dunn
Avenue, National Street, and Government Avenue. The Fayetteville City Council rezoned the
entire property to CS, Community Services on July 19, 2011.

Proposal: The property owner has submitted a large site improvement plan (LSIP) for a new
student housing development on the subject property. The applicant is proposing to install
temporary buildings on the property to be utilized while the project is under construction. One
building will serve as a leasing office and the other will be a model trailer providing a mock-up

of a standard housing unit.
Typically the Planning Commission would review a conditional use and development proposal
concurrently. However, the Community Services zoning district allows administrative approval
of a development. Therefore, the conditional use permit is being submitted separately.
Request: The applicant requests approval of a conditional use permit to allow for a temporary
leasing facility (Use Unit 2, City-wide uses by conditional use).
Public Comment: Staff has not received public comment.
RECOMMENDED MOTION: Staff recommends approval of CUP 11-3918 with the
following conditions of approval:
1. The temporary structures shall be removed within 30 days of the club house
receiving a temporary certificate of occupancy.
2. Hours of operation shall be limited to the following.
a. Monday — Friday: 10:00 a.m. to 8:00 p.m.
b. Saturday: 10:00 a.m. to 6:00 p.m.
c. Sunday: 12:00 p.m. to 6:00 p.m.
3. Outdoor lighting shall comply with the Outdoor Lighting Ordinance.
4. Evergreen shrubs shall be planted between Government Avenue and the parking
lot.
5. Prior to opening the temporary facilities, the applicant shall submit an application
for a Business License to the Planning Division for review and approval.
6. Signage shall be reviewed and approved by a separate sign permit application prior
to installation. Off-site signs are prohibited.
7. The applicant shall coordinate with the Solid Waste Division to determine the
appropriate waste disposal for this temporary facility.

163.02. AUTHORITY; CONDITIONS; PROCEDURES.
B. Authority; Conditions. The Planning Commission shall:
1. Hear and decide only such special exemptions as it is specifically
authorized to pass on by the terms of this chapter.
2. Decide such questions as are involved in determining whether a
conditional use should be granted; and,
3. Grant a conditional use with such conditions and safeguards as are
appropriate under this chapter; or
4. Deny a conditional use when not in harmony with the purpose and intent
of this chapter.
C. A conditional use shall not be granted by the Planning Commission unless and
until:
1. A written application for a conditional use is submitted indicating the
section of this chapter under which the conditional use is sought and
stating the grounds on which it is requested.
Finding: The applicant has submitted a written application requesting a conditional
use pernilt to allow for a temporary leasing facility (Use Unit 2, City-wide
uses by right) in the CS zoning district.
2. The applicant shall pay a filing fee as required under Chapter 159 to cover
the cost of expenses incurred in connection with processing such
application.
Finding: The applicant has paid the required filing fee.
The Planning Commission shall make the following written findings before a
conditional use shall be issued:
(a.) That it is empowered under the section of this chapter described in
the application to grant the conditional use; and
Finding: The Planning Commission is empowered under § 161.19(B)(2) to grant the
requested conditional use permit.
(b.) That the granting of the conditional use will not adversely affect
the public interest.
Finding: Temporary sales and leasing offices, like construction trailers, are unique in
that they are only utilized while a new project is being constructed. As part

of a standard development project, these facilities should not adversely affect
the public interest. The applicant has indicated in their submittal that the
buildings will be removed once they receive a certificate of occupancy on the
club house building, and staff has included a conditional of approval
requiring the same.
(c.) The Planning Commission shall certify:
(1.) Compliance with the specific rules governing individual
conditional uses; and
Finding: There are no specific rules governing this individual conditional use request.
(2.) That satisfactory provisions and arrangements have been
made concerning the following, where applicable:
(a.) Ingress and egress to property and proposed
structures thereon with particular reference to
automotive and pedestrian safety and convenience,
traffic flow and control and access in case of fire or
catastrophe;
Finding: Access to the temporary facility is being provided through a curb -cut on
Government Avenue, which will also serve as the northern entrance to the
site once the project is complete. The curb -cut and temporary parking area
will be paved to provide parking for 3 employees and an expected 10 clients
per hour. Government Street is a low volume residential street and will
provide safe and convenient access to the subject property.
(b.) Off-street parking and loading areas where required,
with particular attention to ingress and egress,
economic, noise, glare, or odor effects of the special
exception on adjoining properties and properties
generally in the district;
Finding: It's not expected that the small parking area will generate any economic,
noise, glare or odor effects on adjoining properties, given the hours of
operation, relatively low traffic volumes and landscaping being provide
between the street and parking area.
(c.) Refuse and service areas, with particular reference to
ingress and egress, and off-street parking and loading,
Finding: The applicant shall comply with the requirements of the Solid Waste Division
for service to this property.

(d.) Utilities, with reference to locations, availability,
and compatibility;
Finding: Public water and sewer service is available to the subject property.
(e.) Screening and buffering with reference to type,
dimensions, and character;
Finding: The applicant has stated in their submittal that landscaping will be provided
to help buffer the site from adjoining properties. Staff supports the
landscaping being proposed, but is recommending that some screening be
provided between the street and parking lot pursuant to the landscape code.
Landscaping in this area will block views of the vehicles and vehicle lights
from residential properties across Government Street. A picket fence will
also be constructed around the leasing area to clearly delineate this area
from the construction activities occurring on the remainder of the site.
(f.)
Signs, if any, and proposed exterior lighting with
reference to glare, traffic safety, economic effect,
and compatibility and harmony with properties in
the district;
Finding: Signage shall be reviewed and approved by a separate sign permit
application.
Finding: NA.
(g.) Required yards and other open space; and
(h.) General compatibility with adjacent properties and
other property in the district.
Finding: Staff fmds that temporary buildings for sales and leasing are generally
compatible with surrounding properties, if they are used as part of an overall
construction project, and are removed when construction is completed.

Dear Planning Staff,
Please find enclosed a Conditional Use Application for a temporary leasing facility to be placed on the
Sale Barn property located near the north property line on Government Avenue. The facility will allow
Campus Crest Development to market their upcoming student housing development during the
construction of the project. A Large Site Improvement Plan was recently submitted to your office for the
overall development. The leasing facility will be removed once the applicant receives a certificate of
occupancy for the planned club house (estimated around August 2012). A site plan and vicinity map is
included with this letter while the following information addresses Item #3 in the Conditional Use
Application:
