Recommendation: Finding that adequate easement for service will exist to serve existing utilities, to provide new utilities, and to preserve the required percentage of existing trees, staff recommends forwarding VAC 10-3662 to the City Council with a recommendation of approval with the following conditions: Conditions of Approval: 1. An easement plat or final plat depicting the easements needed to serve the Oakbrooke project, as required by all utility representatives shall be dedicated and filed or record. The vacation of all easements shall not be accepted until this requirement has been met. 2. Any relocation of existing utilities shall be at the owner/developer's expense prior to recordation of the easement vacation. WEDINGTON DRIVE. The property is zoned R -A, RESIDENTIAL - AGRICULTURAL and contains approximately 1.95 acres. The request is a variance from the parking lot paving requirements of Chapter 172, Parking & Loading, of the UDC, Unified Development Code. Planner: Dara Sanders Findings: Background.. The subject property is located at the northwest corner of the Wedington Drive/Broyles Avenue "T" intersection and was annexed into the Fayetteville city limits in 1983. The 1.95 -acre tract is zoned R -A, Residential Agricultural and contains an unoccupied single-family dwelling, which was constructed in 1995 according to the Washington County property data. In 2005, the Arkansas State Highway Commission acquired 0.05 acre of right-of-way from the property owner to widen Wedington Drive/Highway 16 at this location. The surrounding land use and zoning are included in Table 1. A condition of approval associated CUP 10-3644 required that the applicant receive administrative approval of a Site Improvement Plan (SIP) application prior to installing the off-street parking lot required to meet the parking needs of the business. The applicant unknowingly installed a gravel parking lot containing 9 parking spaces prior to submitting the SIP application, which was communicated to staff after the applicant became aware of the violation of the condition of approval.
