Findings:
Property: The subject property, located at 1400 Canterbury Road, contains approximately 8.85
acres and one single-family dwelling. A majority of the property is .located within the
Hillside/Hilltop Overlay District.
Proposal: The applicant requests preliminary plat approval to create 3 lots for construction of
two additional single-family homes. After utilities have been installed to serve each lot and the
proposed street has been constructed, the applicants will be able to proceed with a final plat
application.

frontage to the existing and proposed lots, the applicant proposes to dedicate sufficient right-of-
way to construct a public street ending in a hammerhead configuration (as opposed to a cul-de-
sac). Future division of the property will require extension of the proposed public street to serve
any additional lots.

Public Comment: Staff has not received any public comment.
Recommendation: Staff recommends approval of PPL 08-3103 with the following conditions:
Conditions of Approval:
1. Planning Commission determination of street improvements. The applicant proposes to
dedicate sufficient right-of-way to construct a public street ending in a hammerhead
configuration (as opposed to a cul-de-sac). Staff finds in favor of the proposed street
improvements, finding that the proposed configuration provides adequate access to the
existing and proposed single-family residential lots and would allow for future street
connection if the property iffurther subdivided.
10/02/08 SUBDIVISION COMMITTEE FOUND IN FAVOR
2. The applicant shall dedicate right-of-way, as shown on the plat, for the construction of
the proposed public street.
3. Payment of $1,920.00 for an additional two single-family units in lieu of parkland
dedication shall be contributed prior to final plat.
4. All public streets shall comply with the City's design standards.
5. Street lights shall be installed at all intersections and with a maximum separation of 300'
prior to signing the final plat.
6. Development of all the new lots shall comply with all City and State fire code
requirements and shall be reviewed at the time of building permit.
7. Development of all lots within the subject development shall be subject to the
requirements of the Hillside/Hilltop Overlay District (HHOD) and will be reviewed at the
time of development. Grading permits and tree preservation plans shall be required to be
submitted for approval for each lot development within the HHOD.
Standard Conditions of Approval:
8. All signage shall be reviewed and approved by the Planning Department prior to
installation. Freestanding signage is not permitted within utility easements, unless
otherwise approved by all utility companies.

9. All street names and addresses shall be approved by the 911 coordinator.
10. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives - AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
11. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private),
sidewalks, parking lot(s) and tree preservation. The information submitted for the plat
review process was reviewedfor general concept only. All public improvements are
subject to additional review and approval. All improvements shall comply with City's
current requirements.
12. All overhead electric lines under 12Kv shall be relocated underground. All proposed
utilities shall be located underground.
13. Impact fees for fire, police, water, and sewer shall be paid in accordance with City
ordinance.
14. Preliminary Plat approval shall be valid for one calendar year.

TREE PROTECTION CERTRIA: [Chapter 167.04 (B)J
1) The desirability of preserving a tree or group of trees by reason of age, location, size
or species.
• By the applicants calculations this site is greater than ninety one
percent covered in forested canopy. This development has a
minimum 30%tree canopy to be preserved.
2) Whether the design incorporates the required tree preservation priorities.
• Trees retained are grouped and fit the designated Canopies Slope and
Native Woodlands high priority designations.
3) The extent to which the area would be subject to environmental degradation due to
removal of the tree or group of trees.
Environmental degradation should not occur on this site.
4) The impact of the reduction in tree cover on adjacent properties, the surrounding
neighborhood and the property on which the tree or group of trees is located.
• For this phase of development the canopy removed is limited to the
hammerhead entrance and will have little effect on adjacent
neighbors due to the retained tree canopy buffer.
5) Whether alternative construction methods have been proposed to reduce the impact
of development on existing trees.
• Suggest re-routing 6'water line to 4o' access/UE easement.
6) Whether the size or shape of the lot reduces the flexibility of the design.
• The size and shape of this parcel does not affect the flexibility of
design.
7) The general health and condition of the tree or group of trees, or the presence of any
disease, injury or hazard.
• The general health of these trees is excellent to good with a few dead
or in poor health.
8) The placement of the tree or group of trees in relation to utilities, structures, and use
of the property.
By the developers calculations, overall approximately eight percent of
the trees on this site will be removed in the project.
9) The need to remove the tree or group of trees for the purpose of installing,
repairing, replacing, or maintaining essential public utilities.
Some trees will need to be removed for utility and access easements.

Staff is recommending APPROVAL of the Tree Preservation Plan with the
following Conditions;
1. That the only proposed construction with this preliminary plat is the
extension of the hammerhead entrance driveway to which tree
protection fencing is shown. Future construction of the access/UE
and waterline will need tree protection fencing and root pruning.
2. Place the tree canopy calculations in a table and include acres, square
feet and percent for all calculations.

4. Please supply an updated Analysis Report. In the report please specify

(driveway). My calculations for canopy removal do not match those
on the plan. The difference in the calculations does not drop the
percent minimum canopy below the required amount.

1. Attempt to coordinate the installation of electrical, water and other
utilities within the 4oR Access/Utility easement. If possible re-locate
the proposed 6ft water line form the existing gravel drive.Allow area
to re-vegetate.

contained within the project.

Findings:
Property Description: The subject property is located south of the. intersection of
Wedington Drive and Salem Road. The 0.33-acre sewer easement',is part of an
approximately 82.39-acre property that was rezoned to R-PZD 07-2793 Forest Hills by
the City Council on June 03, 2008. As part of the large scale development plan submitted
for Wal-Mart Neighborhood Market, the applicants have submitted three vacation
requests and a property line adjustment.
The 15' sewer easement contains an 8" sewer line both of which extend from the west
property through the north half of the property, bisecting the proposed Neighborhood
Market building. The easement must be vacated and the sewer line removed prior to
construction of the building.
Request: The applicant is requesting to vacate a portion of the existing 15' sewer
easement. The applicant has submitted the required notification forms to the utility
companies and to the City with the results summarized below.

Dear Jeremy,
On behalf of the property owner, Forest Hills Partners, LLC, we respectfully request to vacate a
portion of the existing 15' sanitary sewer easement located on the driving range portion of the
property being developed. The easement and sewer line serves two adjacent tracts, Thetford
Photography and Farm Bureau which will be removed with the proposed development. In
addition to the vacation request, a large scale development plan, public improvement package,
and lot line adjustment are being submitted to initiate the first phase of development on the 82
acre tract known as Forest Hills. Plans include abandoning a portion of the sewer and rerouting
it along the newly constructed public streets.
According to the vacation application we are to send out a public notice to all owners adjacent
to the easement to be vacated. The utility easement is located internally in the subject property
which is owned by Forrest Hills Partners, LLC. No other property owners are directly adjacent to
portion of easement in which we are requesting vacation. After talking with Jan Gamble we
were told that surrounding owners notifications do not need to be dispersed since the vacation
is located internally in the property.
If at all possible,we would like to keep the vacation request on the same schedule as the lot line
adjustment, large scale development plans, and public improvement plans which are being
submitting concurrently.
