There are two existing 10' utility and drainage easements where an existing building was constructed. Currently, there are no utilities located within these easements. On May 14,, 2007 the Planning Commission approved a request for a conditional use permit (CUP 07-2539) to allow for hospital use, Use Unit 4, within the R -O' zoning district and a conditional use permit (CUP 07-2540) for off-site parking. On May 17, 2007 the Subdivision Committee approved a large scale development (LSD 07-2536), a 20,506 sq. ft. addition to the existing Physician's Surgery Center building. Request: The applicant requests to vacate 2,501 sq. ft. of the utility and drainage easements that are located on the subject property. The applicant has submitted the required notification forms to the utility companies and to the City with the result summarized below. Property Owner: PHILLIP/MARTIN DEVELOPMENT PARTNERS, LLC Planner' ANDREW GARNER BACKGROUND Property Description and Background: The subject property consists of approximately 11.66 acres located on the south side of Zion Road, approximately 0.3 miles west of Crossover Road. The site is zoned R-PZD 06-2190, Woodbury. The request for rezoning and development approval for an R-PZD with 67 single family dwellings and 45 multi -family dwellings was approved by the City Council on October 3, 2006. Prior to the rezoning, the land was zoned R -A and was developed for rural residential and pasture use. The applicant has obtained grading and drainage permits, recorded the easement plat, and the project is being constructed. Condition of approval No. 6 for this R-PZD requires all streets and infrastructure to be completed within one year of approval, and all building permits to be obtained within three years of approval. The one year requirement for the streets and infrastructure expires on October 3, 2007, however, the streets and infrastructure are scheduled to be completed in November 2007. Proposal.: The applicant requests to extend the approval of the streets and infrastrucuture development portion of the PZD for one year, to expire on October 3, 2008. Should this extension be granted, all streets and infrastructure are required to be completed, inspected, and approved before the one-year extended deadline. If the approval of the streets and infrastructure has not taken place prior to October 3, 2008, the development portion of the approved plans shall be rendered null and void, and the project would be required to go through Planned Zoning District approval again. In order to extend this approval, the applicant must: (1) request the extention prior to the one year time limit, and (2) show good cause why the tasks could not reasonably be completed within the normal one year. If the one year extension is granted, it is within this time that the applicant shall receive approvals by the City for the constructed streets and infrastructure. (1) The applicant has submitted the extension request to the Planning Division on September 11, 2007, prior to the one year time limit ending on October 3, 2007. (2) The applicant has been working this past year to fulfill the conditions of approval for this project and proceed with construction. However, the project has been delayed due to partner and financial arrangements changing, in addition to weather delays. As part of the approval of this R-PZD, all building permits for this development are required to be obtained by October 3, 2009. This requirement is not being changed with this request. Additionally, the UDC allows a three year period from the date of issuance of a building permit to the receipt of a final Certificate of Occupancy. RECOMMENDATION Planning Staff recommends approval of ADM 07-2755, the requested extension to the R-PZD 06- 2190, with the following conditions: 1. The applicant shall be allowed until October 3, 2008 to obtain inspection approval by the City Engineering Division for all streets and infrastructure. If all approval has not been received by this time, the development approval portion of the R-PZD shall be revoked. 2. All building permits for this development are required to be obtained by October 3, 2009. 3. All other conditions of approval for the project shall remain applicable. All trash enclosure locations and dimensions shall be fully reviewed and approved by the Solid Waste Division prior to issuance ofa building permit. Single family residential units may utilize residential cart service; location for placement of carts on trash pick-up day shall be coordinated with Solid Waste prior to building permit. Multi -family units must utilize dumpster service, and trash enclosures shall be fully screened with materials that are compatible with and complimentary to the architecture of the surrounding buildings. 8. Bicycle racks meeting city specifications shall be installed adjacent to the multi -family structures. 9. The Planning Commission, by conditional use permit, shall determine the appropriate size and magnitude of any non-residential uses within Planning Area 2. 10. No portion of any structure (i.e., porches, overhangs, etc.) shall encroach into building setbacks or utility easements. 11. Building separation shall meet all applicable building codes as mandated by the Building Safety Division. 12. Buildings shall be constructed to be consistent with the elevations and concepts depicted in the building elevations in the booklet as specified. Building permits will be based upon the submitted drawings. 13. All buildings shall be designed and constructed to be articulated without large blank wall surfaces as they are visible from public rights-of-way and private streets. Multi -family buildings shall be designed with a front facade facing Zion Road, Woodbury Drive, and the private street along the south side of the building. The single-family structures shall be designed with articulated facades facing both the public and private streets. For those structures without street frontage, the front shall face the pedestrian access. 14. Parks fees for 67 Single -Family Units in the amount of $64,320 and park fees for 45 Multi -Family Units in the amount of $30 600 are due prior to issuance of building permit_ 15.
