NOTE TO MEMBERS OF THE AUDIENCE
If you wish to address the Planning Commission on an agenda item please queue behind the podium when
the Chair asks for public comment. Public comment occursafter the Planning Staff has presented the
application and will only be permitted during this part of the hearing for each item. Members of the public
are permitted a maximum of 10 minutes to speak; representatives of a neighborhood group will be allowed
20 minutes. The applicant/representative of an application before the Planning Commission for
consideration will be permitted a maximum of 20 minutes for presentation.
Once the Chair recognizes you, go to the podium at the front of the room and give your name and address.
Address your comments to the Chair, who is the presiding officer. He/She will direct them to the
appropriate appointed official, staff member or others for response. Open dialogue will not be permitted:

contains approximately 2.97 acres. The request is to vacate portions of a utility and a

Background/Property: The project site is located north of Joyce Boulevard on parts of Lots
13 and 14, in the Physician's Surgery Center at Vantage Square, between Parkview Drive and
Park Oaks Drive. There are two existing 10' utility and drainage easements where an
existing building was constructed. Currently, there are no utilities located within these
easements.
On May 14,, 2007 the Planning Commission approved a request for a conditional use
permit (CUP 07-2539) to allow for hospital use, Use Unit 4, within the R -O' zoning
district and a conditional use permit (CUP 07-2540) for off-site parking. On May 17,
2007 the Subdivision Committee approved a large scale development (LSD 07-2536), a
20,506 sq. ft. addition to the existing Physician's Surgery Center building.
Request: The applicant requests to vacate 2,501 sq. ft. of the utility and drainage
easements that are located on the subject property. The applicant has submitted the
required notification forms to the utility companies and to the City with the result
summarized below.

This is a formal application for a utility and drainage easement vacation located in Lot 13 and Lot 14 of the Vantage
Square, Unit 2, a Subdivision to the City of Fayetteville, Arkansas. The purpose of this easement vacation is to vacate
the utility and drainage easement were the existing building was constructed in said easement, this vacation will also
allow the necessary planned building expansion. At present, no utilities exist within the easement.
We have obtained approval from all utility companies and city departments listed in the application check list. I am
certain that the public interest and welfare would not be adversely affected by the abandonment of the portion of the
above described 20 foot utility and drainage easement.
Your consideration in this matter will be greatly appreciated. If you have questions or concerns, please do not hesitate

BE IT KNOWN BY THESE PRESENTS that -Southwestern Bell Telephone LP, a Texas limited

BACKGROUND
Property Description and Background: The subject property consists of approximately 11.66 acres
located on the south side of Zion Road, approximately 0.3 miles west of Crossover Road. The site is
zoned R-PZD 06-2190, Woodbury.
The request for rezoning and development approval for an R-PZD with 67 single family dwellings
and 45 multi -family dwellings was approved by the City Council on October 3, 2006. Prior to the
rezoning, the land was zoned R -A and was developed for rural residential and pasture use. The
applicant has obtained grading and drainage permits, recorded the easement plat, and the project is
being constructed. Condition of approval No. 6 for this R-PZD requires all streets and infrastructure
to be completed within one year of approval, and all building permits to be obtained within three
years of approval. The one year requirement for the streets and infrastructure expires on October 3,
2007, however, the streets and infrastructure are scheduled to be completed in November 2007.
Proposal.: The applicant requests to extend the approval of the streets and infrastrucuture
development portion of the PZD for one year, to expire on October 3, 2008. Should this extension
be granted, all streets and infrastructure are required to be completed, inspected, and approved before
the one-year extended deadline. If the approval of the streets and infrastructure has not taken place
prior to October 3, 2008, the development portion of the approved plans shall be rendered null and
void, and the project would be required to go through Planned Zoning District approval again.

DISCUSSION
The City of Fayetteville Unified Development Code (UDC) Section 166.20(b) gives the Planning
Commission authority to extend approval of the development portion of a planned zoning district
one additional year from the original approval. In order to extend this approval, the applicant must:
(1) request the extention prior to the one year time limit, and (2) show good cause why the tasks
could not reasonably be completed within the normal one year. If the one year extension is granted,
it is within this time that the applicant shall receive approvals by the City for the constructed streets
and infrastructure.
(1) The applicant has submitted the extension request to the Planning Division on September 11,
2007, prior to the one year time limit ending on October 3, 2007.
(2) The applicant has been working this past year to fulfill the conditions of approval for this
project and proceed with construction. However, the project has been delayed due to partner
and financial arrangements changing, in addition to weather delays.
As part of the approval of this R-PZD, all building permits for this development are required to be
obtained by October 3, 2009. This requirement is not being changed with this request. Additionally,
the UDC allows a three year period from the date of issuance of a building permit to the receipt of a
final Certificate of Occupancy.
RECOMMENDATION
Planning Staff recommends approval of ADM 07-2755, the requested extension to the R-PZD 06-
2190, with the following conditions:
1. The applicant shall be allowed until October 3, 2008 to obtain inspection approval by the
City Engineering Division for all streets and infrastructure. If all approval has not been
received by this time, the development approval portion of the R-PZD shall be revoked.
2. All building permits for this development are required to be obtained by October 3, 2009.
3. All other conditions of approval for the project shall remain applicable.

CHAPTER 166: DEVELOPMENT
166.20 Expiration Of Approved Plans
And Permits
(A) Applicability. The provisions of this
section apply to all of the following plans
and permits:
(1) Prelnnmaryplats

(4) Large-scale developments;
(5) Lot splits;
(6) Physical alteration of land permits;
(7) Storm water, drainage, and erosion control
permits;
(8) Tree preservation plans;
(9) Sign permits; and,
(10) Floodplain development permits.
(B) One-year time limit.
(1) Tasks to be completed All of the above -
enumerated plans and permits are
conditioned upon the applicant
accomplishing the following tasks within
one (1) year from the date of approval:
(a) For any renovation or new
construction, receive a building
permit; and/or,
(b) For a lot split, record a deed or
survey at the Washington County
Circuit Clerk's Office,
stamped for recordation by the City
Planning Division; and/or,
(c) Receive a Certificate of Zoning
Compliance; and/or,
(d) Receive all permits and approvals
required by City, State, and Federal
regulations to start construction of
the development or project.
(2) Extensions. Prior to the expiration of the
one (1) year time limit, an applicant may
request the Planning Commission to
extend the period to accomplish the tasks
by up to one (1) additional year. The
applicant has the burden to show good
cause why the tasks could not reasonably

Expiration. If the required task(s) are not
completed within one (1) year from the
date of approval or during an allowed
extension period, all of the above -
enumerated plans and permits shall be
rendered null and void.
(C) Three-year time limit.
(1) Tasks to be complete. All of the above -
enumerated plans and permits are also
conditioned upon the applicant completing
the project and receiving final inspection
approval and/or a final Certificate of
Occupancy permit within three (3) years
from the date of issuance of a Building
Permit.
(2) Extensions. Prior to the expiration of the
three (3) year time limit, an applicant may
request the Planning Commission to
extend the three (3) year period to
complete the project by up to two (2)
additional years. The applicant has the
burden to show good cause why the
project could not reasonably be completed
within the three (3) year time limit.
(3) Expiration. If the applicant fails to meet
the requirements of subsection (C)(1)
within three (3) years from the date of
issuance of a Building Permit or during an
allowed extension period, all of the above -
enumerated plans and permits shall be
rendered null and void.

maintained as required, the City shall have the right (but shall not be required) to maintain said streets
and to charge the cost thereof to the property owners within the PZD on a pro rata basis according to
assessed valuation for ad valorem tax purposes and shall have a lien on the real property within the
PZ !, . nt the City the right to use all private streets for purposes of
providing fire and police protection, sanitation servic r - c . .the municipal functions. Said
covenants regarding maintenance of private streets shall not be amend-. an. . st terminate
without approval of the City Council (§166_06 (K.10.b.vii).
6. Project Phasing: Streets and infrastructure shall be installed within 1 year of approval, and building
permits for all structures shall be required to be issued within 3 years of approval, or the development
approval is voided.
7. All trash enclosure locations and dimensions shall be fully reviewed and approved by the
Solid Waste Division prior to issuance ofa building permit. Single family residential units may utilize
residential cart service; location for placement of carts on trash pick-up day shall be coordinated with
Solid Waste prior to building permit. Multi -family units must
utilize dumpster service, and trash enclosures shall be fully screened with materials that are compatible
with and complimentary to the architecture of the surrounding buildings.
8. Bicycle racks meeting city specifications shall be installed adjacent to the multi -family structures.
9. The Planning Commission, by conditional use permit, shall determine the appropriate size and
magnitude of any non-residential uses within Planning Area 2.
10. No portion of any structure (i.e., porches, overhangs, etc.) shall encroach into building setbacks or
utility easements.
11. Building separation shall meet all applicable building codes as mandated by the Building Safety
Division.
12. Buildings shall be constructed to be consistent with the elevations and concepts depicted in the
building elevations in the booklet as specified. Building permits will be based
upon the submitted drawings.
13. All buildings shall be designed and constructed to be articulated without large blank wall surfaces as
they are visible from public rights-of-way and private streets. Multi -family buildings shall be designed
with a front facade facing Zion Road, Woodbury Drive, and the private street along the south side of
the building. The single-family structures shall be designed with articulated facades facing both the
public and private streets. For those structures without street frontage, the front shall face the
pedestrian access.
14. Parks fees for 67 Single -Family Units in the amount of $64,320 and park fees for 45 Multi -Family
Units in the amount of $30 600 are due prior to issuance of building permit_
15. Signs shall be permitted in accordance with Chapter 174 of the Fayetteville Unified Development
Code, and shall be subject to signage requirements for residential multi -family

To Whom It May Concern:
Item number 6 in your Conditions of Approval states that streets and infrastructure be
completed within 1 year of approval on the above referenced project. I would like to
request an extension to this condition. We started improvements later than anticipated
and had some weather delay but we are on a schedule to complete infrastructure in
November 2007. The one year requirement expires on October 3, 2007. We started late
due to partner and financial arrangements changing Please extend for one year or
whatever is suitable given completion time.
