Denial of the easement vacation will require the applicants to request a major modification to the approved large scale development. Request: The applicant requests vacating a 15' utility easement to allow the existing canopy located within said easement to count as preserved canopy for purposes of the approved large scale development. The historic Dickson Street and Downtown Master Plan area have a main street or urban feel with many buildings built at or very close to the right-of-way line adjacent to the sidewalk and minimal curb radii into and out of most driveways. The subject property is surrounded entirely by mixed commercial development in the MSC zoning district. The City recently constructed the intersections of Dickson Street and Powerhouse Avenue with a curb return radius of 10'. Proposal: The applicant has applied for a building permit to construct the parking garage portion of the Lofts at Underwood Plaza development. The new parking garage was approved with an entrance onto Powerhouse Avenue. The building permit submitted for this parking garage shows the entrance into the parking garage with the north curb radius at 20' and the south curb radius at 14' when 25' is required. It is staff's opinion that for a private, commercial driveway in the downtown area, the 25' radius is excessive and reduces pedestrian safety by creating unnecessary curb width. The applicant has therefore requested a waiver of UDC Section 172.04(2)(a)(iv) to allow for curb radii of 20' for the north curb and 14' for the south curb for the driveway onto Powerhouse Avenue. The UDC is generally written to provide the minimum standards for development that applies in city-wide, as opposed to area -specific settings. The subject waiver request is located in downtown Fayetteville in the Downtown Master Plan Neighborhood Area. A 25' curb radius is not appropriate in this urban setting where slow vehicle speeds are desired and a high density of pedestrian activity occurs. Staff recommends in favor of the requested waiver requesting finding it appropriate in this urban, downtown setting. Recommendation: Staff recommends approval of the applicant's request for a curb radii waiver with the following conditions of approval. Conditions of Approval: 1.
