Findings:
Property: The subject property, Lot 20 of CMN II Phase III, contains approximately 5.85 acres
located north of Van Asche Drive and Gregg Avenue. The property is zoned C-1 and has been
previously approved for site grading and retaining wall installation, which is nearly complete.
The subject property was previously a part of a larger 53.93 acres, collectively known as CMN II
Phase III. A lot split and concurrent plat approved by the Planning Commission in 2007 created
the subject property and Lots 19A, 19B, 19C immediately to the east. Lot 19C contains
approximately 16.17 acres and borders the entire eastern property line of Lot 20. This tract was
dedicated to the City of Fayetteville in 2007 to allow the continued extension of Scull Creek
Trail and to serve as a permanent tree preservation area for Lots 19 and 20.
Proposal: The applicant requests large scale development approval for four office buildings
totaling approximately 29,712 sq. ft.
Background: The subject request was reviewed at the Subdivision Committee meeting on
November 26, 2008 and at the Planning Commission meeting on December 8, 2008. The main
item of discussion was staff's recommendation for an off-site assessment for the future
construction of a traffic signal at the intersection of Van Asche Drive and Steele Boulevard.
Staff has met with the applicant and withdrawn the recommendation for a traffic signal
assessment for this development proposal.

Water and Sewer System: Water and sewer lines are currently available along Gregg and Van
Asche to serve the subject development. However,new water and sewer lines will have to be
installed to allow future subdivision and development along Greg Avenue.
Adjacent Master Street Plan Streets: Gregg Avenue (Minor Arterial).
Right-of-way to be dedicated: Sufficient right-of-way has been previously dedicated to meet the
Master Street Plan requirements for the adjacent street.
Street Improvements: Both Gregg Avenue and Van Asche Drive have been improved along the
property frontage.
Connectivity: Curb-cuts for the development are indicated on the site plan and are in compliance
with the City's recently adopted Access Management Ordinance. Staff will review internal
access as development occurs to ensure that an acceptable level of connectivity is provided.
Tree Preservation: As noted herein, Lot 19C was previously dedicated to the City of
Fayetteville to meet the tree preservation requirements for the lots in CMN II Phase III.
Recommendation: Staff recommends approval of LSD 08-3133 with the following
conditions:
Conditions of Approval:
1. Planning Commission determination of compliance with Commercial Design Standards
and Design Overlay District Standards. Staff recommends approval of the proposed
elevations,finding that the elevations submitted meet the criteria set forth for commercial
design standards.

2. Both drive aisles shall be located within access easements and dedicated by easement
plat.
3. A floodplain development permit and elevation certificates are required prior to building

included herein shall apply and shall be addressed prior to building permit approval (see

5. Trash enclosures shall be screened with access not visible from the street. The trash
enclosures shall be constructed with materials that are complimentary to and compatible
with the proposed building. A detail of the proposed screening shall be submitted and
approved by the Planning Division prior to issuance of the building permit.
Urban Forester Conditions:
6. An estimate of material and labor is required for 150%the cost of the required landscape.
Once this estimate is approved by the Urban Forester, a letter of credit, bond or check
will be held until installation. This is required prior to building permit approval.
7. Street trees are required to be bonded for a 3-year term before final certificate of
occupancy. This amount shall be held to ensure the maintenance of the required street
trees.
8. Provide a legible landscape plan prior to building permit approval.
9. Before construction document approval, the landscape plan must be stamped by a
Landscape Architect licensed within the state of Arkansas.
Trails Coordinator Conditions:
10. Show the 20' utility easement in the southeast corner of the site as a 20' multi-use trail
easement to allow for an interior trail connection. Contact staff for approved multi-use
trail easement language.
Standard conditions of approval:
11. Impact fees for fire, police, water, and sewer shall be paid in accordance with City
ordinance.
12. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives: AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
13. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private),
sidewalks, parking lot(s) and tree preservation. The information submitted for the plat
review process was reviewed for general concept only. All public improvements are
subject to additional review and approval. All improvements shall comply with City's
current requirements.
14. All exterior lights shall comply with the City lighting ordinance. Manufacturer's cut-
sheets are required for review and approval prior to issuance of a building permit.

15. All mechanical/utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. A note shall be
clearly placed on the plat and all construction documents indicating this
requirement.
16. All freestanding and wall signs shall comply with ordinance specifications for location,
size, type, number, etc. Any proposed signs shall be permitted by a separate sign permit
application prior to installation.
17.All existing utilities below 12kv shall be relocated underground. All proposed utilities
shall be located underground.
18. Large scale development shall be valid for one calendar year.
19. Prior to building pen-nit, a cost estimate for all required landscaping is to be submitted to
the Landscape Administrator for review. Once approval is gained, a guarantee is to be
issued (bond/letter of credit/cash) for 150% of the cost of the materials and installation of
the plants. This guarantee will be held until the improvements are installed and
inspected, at the time of Certificate of Occupancy.
20. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection
measures prior to any land disturbance.
c. Separate easement plat for this project that shall include the tree preservation area
and all utility easements.
d. Project Disk with all final revisions
e. One copy of final construction drawings showing landscape plans including tree
preservation measures submitted to the Landscape Administrator.
f Completion of all required improvements or the placement of a surety with the
City (letter of credit, bond, escrow) as required by Section 158.01 "Guarantees in
Lieu of Installed Improvements" to guarantee all incomplete improvements.
Further, all improvements necessary to serve the site and protect public safety
must be completed, not just guaranteed, prior to the issuance of a Certificate of
Occupancy.

Findings:
Background: On May 17, 2006, the Planning Division approved a building permit for the
construction of a 9,960 square foot industrial use structure with associated parking. The subject
property and the two adjacent lots are under common ownership, but development was only
proposed on one of the lots less than 1-acre, so large scale development approval was not
required. The applicant submitted a large scale development proposal in October 2006 for two
additional structures and associated parking; however, the large scale development application
was later withdrawn prior to Planning Commission approval.
Property: The subject property is located at the southwest corner of Willoughby Road,Hwy
156, and McCollum Road,
Proposal: The applicant requests large scale development approval for an approximately 24,250

Right-of-way to be dedicated: Sufficient right-of-way has been previously dedicated for
Willoughby Road. However, right-of-way in the amount of 25' from centerline for McCollum
Road is required to be dedicated by easement plat, as well as any right-of-way required with the
associated vacation request.
Street Improvements: Staff is recommending that McCollum Drive be improved 14' from
centerline with pavement, curb and gutter, storm drains and a 5' sidewalk. A 5' sidewalk shall
be constructed along Willoughby Road.
Setback Variance: On January 5, 2009, the Board of Adjustment granted a front setback
variance of 7' along Willoughby Road, permitting the building to be located 43' from the
existing state right-of-way line.
Landscape/Greenspace: The applicant requests a variance of the requirements of Chapter
177.04(D)(2)(a)to allow less than the required 15' of greenspace adjacent to the right-of-way. In
this case,there is substantially more right-of-way along Willoughby Road (HWY 156)than required
by the City's Master Street Plan. In the most recent Master Street Plan update,the designation of this
street changed from a Principal Arterial (110')to a Collector(70'). However,with previous actions;
the applicant had already dedicated the 55' of right-of-way from centerline,now resulting in an
undue hardship to the developer. Due to the excess right-of-way, and the approximately 40' of
greenspace between the proposed parking lot and the street, staff is supportive of the request.

Required Canopy: 13.26% - Off-site preservation proposed.
The Urban Forester recommended denial of the Tree Preservation and Protection Plan that was
reviewed at the December 17, 2008 Technical Plat Review meeting, as the applicant was
proposing to remove all existing trees from the site. Additionally, trees had been previously
removed from the site without development approval,a violation of the City's Tree Preservation
Ordinance. The property owner is proposing to utilize a 27,251 sq. ft property to the north of
Willoughby Road for off-site tree preservation, as permitted by Chapter 167. This tree canopy is
proposed to be permanently protected within a Tree Preservation Area.
Recommendation: Staff recommends approval of LSD 08-3167 with the following
conditions:
Conditions of Approval:
1. Planning Commission determination of a variance from Chapter 177.04(D)(2)(a) to allow

has supported greenspace waivers where unique circumstances exist and the variance will be
in harmony with the general purpose and intent of the landscape regulations. In this case,

4. Planning Commission determination of a variance of Chapter 167.04(D) Prior Tree
Removal. As stated herein,prior tree removal has occurred within the last five years, and
therefore the site must be reforested. The applicant is requesting off-site preservation in
lieu of on-site reforestation. Staff recommends in favor of the request to provide off-site
preservation, finding that this industrial site does not provide a favorable planting
environment for additional trees. The off-site preservation area contains high priority
trees, which are healthy, mature and established.
5. Right-of-way in the amount of 25' from centerline for McCollum Road is required to be
dedicated by easement plat, as well as any right-of-way required with the associated
vacation request at the corner of McCollum and Willoughby.
b. Engineering Division conditions of approval included herein shall apply and shall be
addressed prior to building permit approval (see attached memo)
7. The following revisions shall be made prior to Planning Commission review:
a. Correct Lot 2 legal description.
b. The sidewalk along Willoughby Road should be relocated so that it is within the
35' right-of-way.

Urban Forester Conditions:
8. Street trees are required to be bonded for a 3-year term before final certificate of
occupancy. This amount shall be held to ensure the maintenance of the required street
trees.
9. Provide a legal description and survey of the area proposed for off-site tree preservation.
These documents shall be filed of record prior to building permit approval.
10. Before construction document approval, the landscape plan must be stamped by a
Landscape Architect licensed within the state of Arkansas.

14. Trash enclosures shall be screened with access not visible from the street. The trash
enclosures shall be constructed with materials that are complimentary to and compatible
with the proposed building. A detail of the proposed screening shall be submitted and
approved by the Planning Division prior to issuance of the building permit.
15. All exterior lights shall comply with the City lighting ordinance. Manufacturer's cut-
sheets are required for review and approval prior to issuance of a building permit:

materials that are compatible with and incorporated into the structure. A note shall be

19. Large scale development shall be valid for one calendar year.
20. Prior to building permit, a cost estimate for all required landscaping is to be submitted to
the Landscape Administrator for review. Once approval is gained, a guarantee is to be
issued (bond/letter of credit/cash) for 150% of the cost of the materials and installation of
the plants. This guarantee will be held until the improvements are installed and
inspected, at the time of Certificate of Occupancy.
21. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection

Lieu of Installed Improvements" to. guarantee all incomplete improvements.
Further, all improvements necessary to serve the site and protect public safety
must be completed, not just guaranteed, prior to the issuance of a Certificate of
Occupancy.

Conditions of Approval:
i. Eight shrubs are required for every tree where adjacent to parking. The table lists
go shrubs, there are ioo shown on the plan. Code requires 8 shrubs per tree.
There are 17 perimeter landscape trees which requires 136 shrubs.
2. The minimum size for an evergreen such as red cedar tree is 6' tall at the time of
planting. Please reflect this comment in the plant list requirements.
3. A large species shade tree is required to be planted on either side of each entrance
drive. Please add one tree to the west side of the existing entrance.

Dear Planning Commission,
We are submitting a Large Scale Development for Mr. Joe Maynard known as Culls II.
He is expanding his business at 585 Willoughby by adding a new office and shop building on
his existing tracts.
Mr. Maynard intends to add 24,250 sq. ft of additional mixed use office and warehouse
space. The property is located in an industrial zoning district,but there is no other structures in
this area for two major reasons. The first being that the property to the South is occupied by the
airport and the property to the West and North are owned by the City of Fayetteville.
We are also requesting two minor variances. The first variance is the 50' building
setback along the front. We are requesting it be reduced to 40' to accommodate our proposed
building. We are asking for the variance to maintain the front fagade,which will help in the
construction of the proposed retaining wall. Also, according to the new Master Street Plan, the
City is reducing Willoughby's ROW from a 110' to a 70' so in essence we are more than 50'
from the City's future Master Street Plan's ROW.
The second variance we are asking for is the front landscaping along Willoughby. Due
to the location of the existing detention pond and the need to get access along the South side of
the property, we are very tight on frontage along Willoughby. Our proposal is to meet the
Landscape requirements along McCollum Drive, which is still considered a front setback. Our
reasoning for this is that it is more likely that the property to our East will be developed before
the City's property across the street.
As shown by the current structure's operation, this project will only compliment the
surrounding community. This project will bring much needed jobs to Fayetteville in the near
future with your blessings and support. If you have any questions or concerns,please don't

the NORTH SIDE OF CATO SPRINGS ROAD, WEST OF CLINE AVENUE. The property is
zoned R-PZD 05-1797, RESIDENTIAL PLANNED ZONING DISTRICT and contains
approximately 5.52 acres. The request is to modify condition of approval No. 19 from the final plat
approval regarding a vegetated buffer on the east property line. Planner: Andrew Garner
Findings:
Background: On August 30, 2007, the Planning Commission approved Final Plat 07-2678 for
development of the Bungalows at Cato Springs Subdivision consisting of 31 single family residential
lots on 5.52 acres. The property is zoned R-PZD 05-1797 (Bungalows at Cato Springs) and is
located on the north side of Cato Springs Road, west of Cline Avenue and east of Cato Springs
Branch. During the original PZD approval and at the request from adjacent neighbors to the east, a
vegetated buffer and fence along the east property line was included in the plans. Condition of
approval No. 19 from the final plat approval required a vegetated buffer on the east property line.
The applicant has installed a six-foot wood board privacy fence along the eastern property line.
Proposal: The applicant requests that the requirement for a vegetated buffer along the eastern
property line be waived,or if deemed necessary,to be allowed to be phased overtime as the units are
completed.
Discussion: Condition of approval No. 19 for FPL 07-2678 currently reads as follows:
"A vegetative buffer is required along the eastern property line. This landscape must be
planted before the first home in the development receives a final certificate of occupancy.
Please contact the Urban Forester for an inspection. "
Staff has conducted a site visit and verified that a six-foot wood board fence has been installed along
the eastern property line of the Bungalows at Cato Springs Subdivision. The required vegetated
buffer would have to be planted on the inside of the fence, and would not provide any additional
screening for the neighbors to the east. The intent of the original condition was to provide a
screenibuffer between the Bungalows at Cato Springs neighborhood and the single family homes on
Cline Avenue. Staff finds that the newly installed wood board fence meets the intent of the original
