It' you wish to address the Planning Commission on an agenda item please queue behind the podium when
the Chair asks for public comment. Public comment occurs after the Planning Staff has presented the
application and will only be permitted during this part of the hearing for each item. Members of the public
are permitted a maximum of 10 minutes to speak; representatives of a neighborhood group will be allowed
20 minutes. The applicant/representative of an application before the Planning Commission for
consideration will be permitted a maximum of 20 minutes for presentation.

Findings:
Subdivision Committee: On January 3, 2008 the Subdivision Committee forwarded this item to the
full Planning Commission with a recommendation for approval.
Property: The subject property is located north of Wedington Drive, west of Highway I-540 along
Shiloh Drive, and is adjacent to Steamboat Drive in the northwest comer of the site. The property is
zoned C-2, Thoroughfare Commercial. On August 16, 2007 the Fayetteville Planning Commission
approved Large Scale Development 07-2681 (Homewood Suites) for development of a 96 -room
hotel and associated parking on the subject property. The property is adjacent to the existing Holiday
Inn Express hotel to the east. Surrounding land use and zoning is depicted in Table 1.

Proposal.: The applicant requests concurrent plat (preliminary and final plat) approval for a
subdivision with three lots containing 1.89, 2.87 (the Homewood Suites site), and 3.45 acres. The
existing parent tract was originally created by a lot split, therefore there are not enough lot splits

remaining to create the three new parcels.
Right-of-way being dedicated: Adequate right-of-way exists along Shiloh Drive.
Street Improvements: Street improvements have been evaluated as part of the approved large scale
development on the property. This subdivision does not affect those original street improvements.
With future development, street improvements will be evaluated.
Adjacent Master Street Plan Streets: Shiloh Drive, Collector.
Tree Preservation: Tree preservation areas required as part of the Homewood Suites Large Scale
Development are not being affected by this Concurrent Plat.
Recommendation: Staff recommends approval of CCP 07-2859 with the following conditions of
approval:
Conditions of Approval:
1. Planning Commission determination of a waiver of Fayetteville Unified Development Code
166.03(I)(1) to allow for the creation of a new lot prior to the extension of required sewer line
to Lot 1. Staff is in favor of this waiver finding that it is appropriate for the minor sewer
extension (approximately 80 feet) to take place prior to development.
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (01/03/08).
The plat should be revised to address the following comments with the revisions submitted
for Planning Commission:
a. Should the applicant desire, this plat can also serve as the easement plat for the
Homewood Suites LSD. If that is the case, the title should be changed to "Easement
Plat/Concurrent Plat"
b. Change the eastern building setback line for Lot #1 to zero feet as it is a side setback.
c. Change the western building setback line for Lot#3 to 20 feet as it is a rear setback.
d. Remove the 50' building setback off of the private drive as it is not public right-of-
way and a front setback does not apply.
3. All applicable conditions of approval of the original LSD 07-2681 Homewood Suites remain
in place.
4. The plat shows an access easement across APN 765-21704-001 owned by Horizant
Properties, LLC. Horizant Properties should either be listed as an owner and should sign the
plat, or a separate easement document should be completed, and the document number
referenced on the concurrent plat.
5. Submit one copy of the revised plat to the Planning Division for review prior to obtaining
signatures.

6. The City of Fayetteville Alternative Transportation and Trails Master Plan identifies a multi-

use trail along the west side of I-540 from Hwy 112 south to Cato Springs. Parts of this trail,
named Shiloh Trail, have been constructed and as development occurs along the corridor
more segments are added.
7. When Lots 1 & 2 of Palak Addition are submitted for large scale development, a 12' multi-
use trail will need to be constructed instead of the required 6' sidewalk along the frontage
with Shiloh Drive. This trail will connect to the soon to be constructed trail segment in front
of the Holiday Inn Express.
8. Please coordinate the design and location of the trail with the Trails Coordinator @ 444-3416
to insure the City of Fayetteville standards are met.
9. A trail easement will also be necessary for any parts of the trail located outside of the Shiloh
Drive right of way.
Tree Preservation Conditions:
10. Please revise the Final Plat to have the. shorter signature block and Urban Forester as title.
11. This is a Non -Residential Subdivision. Chapter 167 allows the applicant two options to
either preserve canopy for the entire subdivision or to preserve canopy for infrastructure only.
The Urban Forester has recommend tree preservation for infrastructure only as the best
option for the City and applicant.
12. The Non -Residential Subdivision option of Tree Preservation for Infrastructure only requires
that all canopy removed be paid as a monetary amount into the City of Fayetteville's Tree
Escrow Account. The applicant has determined approximately 9,501 square feet of canopy
will need to be mitigated for. As money in lieu, this will be $5,500.
13. The money in lieu shall be submitted to the City of Fayetteville before signature of Final Plat.
The amount is placed into the Tree Escrow Account used by the City to plant trees. If
possible, trees will be planted within this subdivision once it has built out. Otherwise the
money is used within a one mile radius of the project.
Standard Conditions of Approval:
14. Plat Review and Subdivision comments (to include written staff comments provided to the
applicant or his representative, and all comments from utility representatives - AR Western
Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
15. Staff approval of final detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review process
was reviewed for general concept only. All public improvements are subject to additional
review and approval. All improvements shall comply with City's current requirements.
16. All overhead electric lines 12kv and under shall be relocated underground. All proposed
utilities shall be located underground.
17. All new exterior lighting shall comply with the City's lighting ordinance.

TRAIL COMMENTS
1. The. City of Fayetteville Alternative Transportation and Trails Master Plan
identifies a multi -use trail along the west side of I-540 from Hwy 112 south to
Cato Springs. Parts of this trail, named Shiloh Trail, have been constructed and
as development occurs along the corridor more segments are added.
2. When Lots 1 & 2 of Palak Addition are submitted for large scale development, a
12' multi -use trail will need to be constructed instead of the required 6' sidewalk

To Whom It May Concern:
Please accept this letter as our official request for Concurrent Plat approval for the
proposed Palak Addition commercial subdivision located along Shiloh Drive and
contiguous to the existing Holiday Inn Express. The intent of this application is to
develop three commercial parcels out of the existing 8.20 acre tract, which is zoned C-2.
The existing 8.20 acre tract was originally created by a lot split; therefore, there are not
enough splits remaining to create the three new parcels.
The proposed concurrent plat will result in three commercial tracts. Lots 1 and 3 will
have frontage on Shiloh Drive and access to water and sewer. Lot 2 will accommodate
the previously approved Homewood Suites LSD, which is currently under development.
No additional infrastructure improvements are needed to serve the new parcels. Lots 1
and 3 will be required to accommodate planning requirements, engineering requirements,
and tree/landscape requirements at the time of future development.

acres. The request is to vacate a portion of an alley on the subject property.

Findings:
Property Description and Background: The subject property is located at 220 N. College
Avenue, just south of the Washington County Courthouse and is zoned Main Street
Center. There is an existing alley bisecting the site that varies in width from 5' at the east
end of the property to 10' at the west end of the property. The south side of the existing
church building encroaches into the alley right-of-way.
Request: The applicant is requesting to vacate the length of the alley within the subject
property, in order to allow improvements to the parking lot and church grounds. The
applicants have submitted a conditional use request to allow for a shared parking
agreement with the Washington County Courthouse, which is scheduled to be on the
January 28, 2008 Planning Commission agenda. In addition to the proposed
improvements to the property, the vacation will also resolve the building encroachment in
the alley right-of-way. The applicant has submitted the required notification forms to the
utility companies and to the City with the result summarized below.
