A meeting of the Fayetteville Planning Commission will be held on June 28, 2010 at 5:30 PM in

SUBJECT: Coverage of meetings by The Fayetteville Government Channel
As a member of a City of Fayetteville Board, Commission or Committee, we appreciate tremendously
the time, effort, and commitment you provide for the City of Fayetteville. It is citizens like you that help make
our City as great as it is, and we thank you for your service. It is also service like yours that has helped make
Fayetteville a state -recognized Volunteer Community of the Year. Thank you!
As you are probably aware, The City of Fayetteville operates The Fayetteville Government Channel,
which provides television coverage of the meetings of City of Fayetteville Boards, Commissions and
Committees for the citizens of Fayetteville.
While not every meeting receives coverage, most likely there will be a time when you will be in a
meeting that is being covered by The Fayetteville Government Channel. I wanted to provide you with a few
pointers and some information that can make your participation in these filmed meetings better for both those
attending the meetings in person and those viewing at home . The ability for audiences in the meeting room,
watching on TV, or viewing the meeting on the City's website www.accessfayetteville.org to hear and see all
that is taking place in the meeting is of prime importance to The City of Fayetteville and a major part of the
initiatives of assuring open government and an informed citizenry. Below are a few broad recommendations
that will assist in these goals:
1. Be aware of your audience. Remember there are people there in the room, and there are people watching
on television. When you talk, speak loudly enough that the people in the room can hear you clearly.
2. Some rooms have microphones on the tables. If there are microphones on the tables, please use one. If
you do not see microphones on the tables, they are mounted somewhere else. Just speak in a way that
everyone in the room can hear you clearly and the television audience can hear your comments as well.
3. When using a microphone, place it about a foot away and pointed at you, and talk in a normal tone of
voice. If it is too close to your mouth, your voice will sound overly loud and distorted. If it is too far
away, your voice may not be heard at all. If you are the Chair, or serving as the Chair, of the
Commission, Board, or Committee; please ask non -committee members who are speaking during any
public comment periods during the meeting to come to the microphone (if in room 219 or 326) to speak,
or if the Chair prefers that audience members speak from the audience then please help assure they are
audible for everyone in the room and for the camera so that the viewing audience will have the benefit
of their insights. Room 111 provides mics in the ceiling that should pick up clear voices from any place
in the room.

4. Do not address the camera directly when in a meeting. The camera is there as an observer. FGC
coverage of meetings is direct, non -editorial programming regarding the operations and deliberations of
the City government. The Fayetteville Government Channel should not serve as a mechanism for
building support for a particular policy, program or issue. If you would like to present information to the
television audience directly, the FGC can assist you in producing an information program that can be
telecast on the Channel.
5. You may be on camera, whether you are speaking or not. It is not our intention to make you
uncomfortable, but to make you aware. The audience in the room may be paying attention to the person
speaking, but the camera may be on a wider shot and see you as well.
6. If a meeting is not called to order by the Chair within 15 minutes of its scheduled start time, the
Fayetteville Government Channel staff may leave and not provide coverage for the meeting. This is to
help minimize costs associated with having city staff waiting to film a meeting that will not take place
for reasons such as lack of a quorum.
7. The Fayetteville Government Channel may not cover meetings in which no business is conducted.
We appreciate your involvement in helping make our City great. If you have any questions about the

3.2 acres and is zoned C-2, Thoroughfare Commercial. The request is for a variance of Fayetteville
Unified Development Code Section 166.14(C) (7) to permit a chain link fence in front of the

Findings:
Background and property description: The subject property is located at 2035 N. College Avenue
and contains approximately 3.2 acres. The site contains a building and parking lot that was
previously used for the Razorback Theatre, and is under renovation for World Gym.
The Commercial Design and Development Standards, Fayetteville Unified Development Code
(UDC) Chapter 166.14(C), prohibit chain link fence if closer to the street than the front of the
building.
Proposal: The applicant has requested a variance to permit a 10 -foot high, black, vinyl -coated chain
link fence adjacent to the east side of the building. The fence is proposed between the building and
College Avenue. The fence is proposed around an outdoor basketball court and general exercise area
for World Gym. A site plan indicates the location of the fence.
Discussion: The chain link fence is needed to accommodate the unique sports and exercise use
proposed for World Gym on the property. The main factors discussed by the applicant as a need for
the fence include safety to the users and security for the facility after hours. A 10 -foot fence is
desired to contain basketballs and other objects that may be used in the exercise/court area, and to
provide user safety from vehicles. The chain link material is proposed over other materials as it has a
certain amount of "give" or flexibility which is desired by the users of such an area. The only other
fence that would be permitted by City code in this location is a wrought -iron fence which is not
appropriate given the unique nature of this use. The applicant's letter also discussed that there is
precedent for chain link fence in public settings where athletic events take place such as schools,
parks, tennis courts, and other recreational facilities.
Staff Recommendation: Staff recommends in favor of the variance finding that it would be an undue
hardship pursuant to Fayetteville Unified Development Code Section 156.03(A)(1) to place the chain
link fence behind the building or to require a different type of fence. If this were a new development
staff would recommend that the fenced court be located behind or internal to the building away from
the street, however, as this is a retro -fit of an old movie theatre site with a Targe parking lot, there is

not space for a basketball court behind the building. Staff also recommends the variance given the
unique nature of the business and finding agreement with the reasons stated by the applicant. The
proposed use of the site for a gym/health club is a unique use where an outdoor basketball court may
be expected. The proposed chain link fence is the most reasonable, safe, and functional solution for
the court on this existing site. As indicated by the applicant, the use of chain link fence around
outdoor athletic courts is common in the City. However, because the variance is requested for a
commercial health club on a commercially -zoned property, staff recommends that vegetative
screening be required to soften the appearance of the chain Link fence from the public right-of-way,
and to meet the intent of the Commercial Design Standards.
Recommendation: Staff recommends approval of ADM 10-3611 based on the findings herein
and subject to the following conditions of approval:
Conditions of Approval:
I. Planning Commission determination of appropriate buffer/screening. The proposed
basketball court is in a very visible location along the College Avenue commercial
corridor. In order to soften the appearance of the chain link fence around the 64 -
foot by 60 -foot basketball court staff recommends landscaping around the eastern
and southern perimeter of the fence. Specifically, staff recommends the following:
• Plant type: minimum 50% evergreen plantings.
• Plant spacing: minimum five feet on center (59.
• Planting details: The plantings may be placed in a standard mulched bed, large
planters/pots or a raised landscape bed to provide additional height for plantings,
and to reduce the cost of pavement removal.
• Plant size: At planting, shrubs shall be a minimum 5 gallon size and ornamental
plantings shall be a minimum of three feet height measured from existing grade to
the top of the plant.
Prior to installation the proposed plantings shall be submitted to the Planning Division
for review and approval.
2. Should the property ever develop for a different use, in contrast to the applicant's
proposed gym/health club use, the chain link fence will be evaluated by staff for
compliance with UDC Chapter 166.14, which may require removal of the fence.

156.03 Development
Certain variances of the development regulations may be applied for as follows:
(A) General requirements.
(1) Undue hardship. If the provisions of Development, Chapter 166, are shown by the developer to
cause undue hardship as they apply to this proposed development (including, but not limited to
financial, environmental, or regulatory) and that the situation is unique to the subject property, the
city Planning Commission may grant a variance, on a temporary or permanent basis, to the
development from such provision, so that substantial justice may be done and the public interest
secured; provided that the variation will not have the effect of nullifying the intent and purpose of
the development regulations. No variance shall be granted for any property which does not have
access to an improved street.
(2) Conditions and safeguards. In granting variances, the Planning Commission may prescribe
appropriate conditions and safeguards to secure substantially the objectives of the standards or
requirements so varied.
166.14 Commercial Design And Development Standards
(7) Fences. The following types, height, and location of fences shall be prohibited:
(a)
Razor and/or barbed wire. Razor and/or barbed wire fences are prohibited if visible from the
street right-of-way or a residence, unless and except barbed wire fences are used for
agricultural purposes.
(b) Chain Zink. Chain Imk/fence is prohibited if closer to the street than the frons of the;tiuilding.
Residential. Usesa'r exempt from this requirement.
(c) Height of fences in front buildings. Fences located in front of the primary structure may be
solid up to 30 inches in height. Any part of a fence which exceeds 30 inches in height shall
not obstruct the view of the primary structure from the right-of-way.

AS THE APPLICANT WISHES TO CONSTRUCT AN OUTDOOR

BASKE TBALLS AND OTHER OBJECTS THAT MAY BE USED IN
THE EXERCISE AREA. WHILE A 10' FENCE MAY NOT RETAIN
ALL BALLS AT ALL TIMES IT IS THE APPLICANT'S EXPERIENCE
THAT THE 10' HEIGHT WILL RETAIN 99% OF THE BALLS. THE
IMPORTANCE OF RETAINING THE BALLS IS NOT ONLY THE
OBVIOUS INCONVENIENCE ISSUES BUT ALSO, WITH THE
CLOSE PROXIMITY TO COLLEGE AVE., A VEHICULAR SAFETY
CONCERN. A 10' HIGH FENCE OF A SOLID MATERIAL MAY BE A
GREAIER DETRIMENT TO THE AESTHETIC THAN THE CHAIN
LINK IN MANY PEOPLES OPINION.

Property. The subject property is the southern portion of the Fayetteville High School campus that is
bounded by Martin Luther King Boulevard to the south, Stone Street to the north, Garland Avenue to
the west, and Buchanan Avenue to the east. The site is zoned P-1, Institutional and contains
approximately 18.07 acres. This portion of the Fayetteville High School campus contains the main
educational building, tennis courts, a number of outbuildings, and the former Bates Elementary
School building. Surrounding land use and zoning is depicted on Table 1.

Proposal: Phase I. The applicant requests large sca e development approval to expand the
Fayetteville High School on its existing site with a total new square footage of approximately
300,000 square feet that will .accommodate 2,400 students and 200 employees. The proposed
improvements are indicated on the submitted development plans. Many of the existing structures on
the site, including Bates Elementary, part of the existing high school, and associated parking, will be
removed to accommodate the expansion. The improvements will consist of the construction of three
structures and associated parking. Major off-site improvements to the water distribution system is
planned to meet projected fire flow demands and on-site sewer main upgrades are also required. The
northeast portion of the site will remain as -is.

Phase 11. The school plans to demolish the remainder of the existing high school in the northeast
portion of the site at a later date and construct a fourth new structure in its location. This
development is not included as part of this large scale development.
Water and Sewer System: The property has access to existing public water and sewer service. A
major improvement to the water distribution system on and off-site is required to meet projected fire
flow demands, and an on-site sewer main extension/re-construction is required to serve the expanded
high school.
Right-of-way to be dedicated: Right-of-way is required to be dedicated for Martin Luther King
Boulevard (Principal Arterial) in the amount of 48.5 feet from centerline and 25 feet from centerline
for Garland Avenue, Stone Street, and Buchanan Avenue.
Street Improvements: Staff recommends that the surrounding street system be improved to meet the
City's Master Street Plan standard with pavement, curb, gutter, storm drainage, greenspace, and 5 -
foot sidewalk along the entire property frontage, in accordance with Fayetteville Unified
Development Code Section 166.04(B)(3). The street improvements in the portion of the site not
being developed at this time (the northeast portion of the site) may be delayed until construction of
Phase II to prevent these improvements from being damaged. However, this recommendation is
dependent on Phase II being completed in the immediate future. If Phase II is not approved for
development by the time Phase I is completed, staff recommends that street improvements be
completed around the entire site, including the northeast portion. Specifically, staff recommends the
following:
Phase I:
• Martin Luther King Boulevard. Install new 5 -foot sidewalk at the Master Street Plan right-of-
way line along the entire property frontage.
• Garland Avenue. Minimum 14 -feet pavement from centerline, curb, gutter, storm drainage,
6 -foot greenspace, and 5 -foot sidewalk at the Master Street Plan right-of-way line along the
entire property frontage. Extend the tum Iane north along Garland from Martin Luther King
Boulevard to provide at least 150 feet of stacking from the intersection. The new curb should
be designed with landscape bump -outs that define the parking lane on the east side of the
road and appropriate transition from the intersections. The on -street parallel parking spaces

applicant has indicated that the existing school building in this area will be demolished and
this entire portion of the site be reconstructed with a fourth quad in the near future under a
separate Large scale development. Therefore, staff recommends that street improvements not
be constructed in this area of the site until this area of the site is reconstructed. There is an
existing 8 -foot sidewalk on Stone Street in this area at the back of the curb adjacent to a
hatched bus drop-off. Staff recommends at a minimum 14 -feet from centerline pavement,
curb, gutter, storm drainage, and that the existing 8 -foot sidewalk be reconstructed to meet

street trees. Similar to the staff recommendation on street improvements, staff recommends
these improvements be delayed until Phase II. However, should an approved large scale
development not be approved by Final COO for Phase I, these improvements shall be
required to be completed with Phase I.
4. Water and sewer infrastructure upgrades shall be completed as required by the City Water
and Sewer Department to meet the demand for this project.
5. All tree preservation, landscape, and fire department conditions included in the tech plat
comments and herein shall apply.
6. The following revisions to the plans shall be completed on the plans submitted for
construction review and building permit:
a. Label the Master Street Plan right-of-way on Stone Street from centerline.
b. Pedestrian access should be provided from all adjacent streets to the entrance of the
structure by way of designated pathway or sidewalk (UDC 172.04.B). Revise the
plans to provide such access from Buchanan. This could be provided with a short
sidewalk extension connected to the street crossing and pedestrian hatching on the
pavement across the drive aisle.
c. Revise the dumpster enclosure location to address the comments at tech plat and
subdivision committee from the City Solid Waste Division.
d. Garland Avenue: remove all excess ROW lines and show the City's Master Street
Plan right-of-way from centerline and the new sidewalk at the back of the Master
Street Plan right-of-way (25 feet from centerline).
e. Garland Avenue: show landscape bump -outs and on -street parallel striping, and no
parking signage/striping in accordance with the approved conditions of approval.
£ Revise the parking chart to reflect the maximum number of students and employees
that would be accommodated.
7. Conditions of approval included in the memorandum from the City Engineering Division
attached to this report are included in the official conditions of approval, herein.

review and approval. All improvements shall comply with City's current requirements.
11. All exterior lights shall comply with the City lighting ordinance. Manufacturer's cut -sheets
are required for review and approval prior to issuance of a building permit.

12. All mechanical/utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. A note shall be
clearly placed on the plat and all construction documents indicating this requirement.
13. Trash enclosures shall be screened on three sides with materials complimentary to and
compatible with the principle structure. Elevations of the proposed dumpster enclosure shall
be submitted to the Planning and Solid Waste Divisions for review prior to building permit.
14. All freestanding and wall signs shall comply with ordinance specifications for location, size,
type, number, etc. Any proposed signs shall be permitted by a separate sign permit
application prior to installation.
15. All existing utilities below 12kv shall be relocated underground. All proposed utilities shall
be located underground.
16. Large scale development shall be valid for one calendar year.
17. Prior to building permit, a cost estimate for all required landscaping is to be submitted to the
Landscape Administrator for review. Once approval is gained, a guarantee is to be issued
(bond/letter of credit/cash) for 150% of the cost of the materials and installation of the plants.
This guarantee will be held until the improvements are installed and inspected, at the time of
Certificate of Occupancy.
18. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection measures
prior to any land disturbance.
c. Separate easement plat for this project that shall include the tree preservation area and
all utility easements.
d. Project Disk with all final revisions
e. One copy of final construction drawings showing landscape plans including tree
preservation measures submitted to the Landscape Administrator.
£ Completion of all required improvements or the placement of a surety with the City
(letter of credit, bond, escrow) as required by Section 158.01 "Guarantees in Lieu of
Installed Improvements" to guarantee all incomplete improvements. Further, all
improvements necessary to serve the site and protect public safety must be
completed, not just guaranteed, prior to the issuance of a Certificate of Occupancy.

To whom it may concern,
The current school houses 1800 students and 150 faculty. The new facility is being designed under the
idea that the new school will have 2400 students and 200 faculty. This is an increase of 600 students
and 50 faculty, or 33% and 33% respectively. Coupled with the improved traffic plan and additional drop
off locations, traffic congestion should be minimized.
Please see the attached diagrams to explain the proposed traffic flows on the site.
A traffic study was not required by the City of Fayetteville for this development. Traffic congestion
should be reduced for the entire site, including Martin Luther King, due to the introduction of additional
drop off points and the separation of bus traffic and car drop off locations. With the proposed design,
students can be dropped off at Stone Street as well as the southwest parking lot while bus traffic will be
confined to the southeast parking lot.

RE: Fayetteville School District #1 — Large Scale Development Submittal
Dear Mr. Pate:
The Fayetteville School District is seeking Large Scale Development approval to expand the
Fayetteville High School on its existing site located at 1001 West Stone Street. The site is zoned
P-1 and totals 18.07 acres.
Bates Elementary, part of the existing high school, and associated parking will be removed to
make way for the expansion. The improvements will consist of the construction of three
structures and associated parking. Major improvements to the water distribution system is
additionally planned to meet projected fire flow demands.

Plat Review Comments (June 17, 2010 Subdivision Committee Meeting)

General Conditions:
1. All designs are subject to the City's latest design criteria (water, sewer, streets and drainage). Review
for plat approval is not approval of public improvements, and all proposed improvements are subject to
further review at the time construction plans are submitted.
2. Detailed phasing documents will be required at construction level review for constructability if the
future phases are not constructed prior to the completion of the first phase. (IE grading, utilities, etc)
3. All existing public sidewalks to remain shall be brought up to current city code.
4. Coordinate sidewalk access ramps a the intersection with the ADA administrator and the AHTD as
required to meet both city and state codes.
5. Revegetation of disturbed areas shall be in accordance with § 169.06.f of the City of Fayetteville Grading
Ordinance. (Include actual notes on the plans)
6. Any retaining wall more than four feet in height shall be designed by a registered professional engineer
in the state of Arkansas and shall be field inspected by the design engineer.
7. Safety railings are required on any retaining wall greater than 30" in height. The safety railing shall be
built in to the more stringent requirements of the SBCC or AASHTO.
8. Prior to engineering approval of the building permit, either the required public improvements must be
installed and accepted, or performance bonds in the amount of 150% of the construction cost for all
public improvements must be submitted, accompanied by a unit price estimate approved by the
Engineering Division.
9. Prior to grading and drainage permit, bonds in the amount of 100% of the total cost to install the
approved erosion and sediment control plan to ensure the continuation of the proper maintenance of
the plan. The bond shall remain in place until permanent stabilization has been achieved for the
development site.
Plan Comments:
1. Provide roadway improvements 14 ft from centerline including curb and gutter, storm drainage, and
sidewalk at the City of Fayetteville's master street plan right of way along Garland Ave (specifically
along the northern quadrant where no improvements are shown.).
2. Provide sidewalk improvements at the right of way along the south side of Stone Street in the NW
quadrant. Remove existing sidewalk at back of curb.
3. Sidewalks shall be continuous through driveways. Existing driveways may need to be reconstructed to
current standards based on the proposed realignment of existing or new sidewalks.
