Findings:
Property and Background: The subject property contains approximately 5.91 acres at the southwest
corner of Old Missouri Road and Joyce Boulevard, and is zoned R -O, Residential Office. The site
contains a bank building at the northwest corner of the property and four other office buildings all
with associated parking areas. The applicant is processing a lot split to create an individual lot for
the existing bank on the northwest corner. Surrounding land uses are depicted,in Table 1.

Proposal: The applicant proposed to split the property into Tract A and Tract B containing 0.95 acres
and 4.96 acres respectively. The existing bank building and associated parking will be located on the 0.95
acre tract. An access easement will be platted over the existing drive aisle that connects Joyce Blvd. to
Old Missouri Rd.
Right-of-way Dedication: Adequate right-of-way for Old Missouri Road (35' from centerline) and Joyce
Boulevard (55' from centerline) should have been dedicated with the large scale development approval
for Commerce Park I. However, it does not appear that the there is sufficient right-of-way from
centerline at the northwest corner of the property. If necessary to meet Master Street Plan requirements,
additional right-of-way shall be dedicated by this plat.

Recommendation: Staff recommends approval of LSP 07-2619 with the following conditions:
Conditions of Approval:
1. Planning Commission determination of a waiver from Chapter 177.04 (D) (Perimeter
Landscaping Requirement). All parking lots shall have five feet (5') of landscaped area between
the property line and parking lot. Staff finds in favor of this request, since the amount of
greenspace between the parking areas was determined at the time of large scale development,
long before the request for a lot split. Additionally, while the lot split request does create the
need for a waiver, the request does not reduce the amount of greenspace existing on site.
6/14/07: THE SUBDIVISION COMMITTEE FOUND IN FAVOR OF THE REQUESTED
WAIVER.
2. If necessary to meet Master Street Plan requirements, additional right-of-way shall be dedicated

RESIDENTIAL OFFICE and contains approximately 6.00 acres. The request is to divide the
subject property into two tracts of 0.95 and 5.05 acres.
Jesse Fulcher, Current Planner, gave the staff report, describing the lot split request. The site is
already developed, and the split is to allow the current tenant of the building on the smaller lot to
purchase the property. One issue arises because of the lot split request, which is a waiver of
greenspace adjacent to the side property line. The greenspace between the two parking lots is eight
feet, which meets code. However, a parking lot is required to be a minimum of five feet from a
property line, which would require 10 feet to meet this requirement. No greenspace is changing with
the lot split request, the waiver is simply a result of the new lot line. Staff recommended forwarding
the request with a recommendation of approval, including the waiver.
No public comment was presented.
Shelly West (applicant) was present for the applicant and stated the intent to purchase the property.
Motion:
Commissioner Graves made a motion to forward the request with the conditions of approval as
recommended by staff, finding in favor of the waiver request. Commissioner Bryant seconded the
motion. Commissioner Lack concurred, the motion passed with a vote of 3-0-0.
The Committee recommended this item be placed on the Consent Agenda.

Findings:
June 14, 2007 Subdivision Committee: The Subdivision Committee forwarded this item to the
Planning Commission with a recommendation for approval, finding in favor of staff's
recommended conditions of approval, and recommending that this item be placed on the consent
agenda.
Background: The Planning Commission approved the preliminary plat for Cobblestone
Subdivision on the subject property on March 13, 2006 (PPL 06-1940). The preliminary plat
granted approval of 194 single-family lots. The City Council approved rezoning 17.22 acres of
the Cobblestone Subdivision from RSF-4 to RSF-8 on April I, 2007. The applicant now
proposes a revised preliminary plat for Cobblestone Subdivision with an additional 13 lots over
the previously approved plat.
Property Description: The overall Cobblestone Subdivision property contains approximately
60.28 acres located east of Salem Road, adjacent to Crystal Springs Phase I and Rockhaven
Subdivision to the west and Crystal Springs Phase III to the south. The property is zoned RSF-4
(43.03 acres) and RSF-8 (17.22 acres) and is bisected by two Collector Streets shown on the
Master Street Plan.
Proposal: The applicant request approval of a preliminary plat to create 207 single family lots.
The layout out of the original Cobblestone Subdivision has not changed with the exception of

smaller lots in the southern interior of the site that was recently rezoned to RSF-8.

Water and Sewer System: Water and sewer shall be extended to serve the proposed
development.
Adjacent Master Street Plan Streets: Raven Lane (Collector Street) bisects the property
extending from the south and terminating at the northwest corner of the property, and an East-
West Collector Street (Street "A") which extends through Rockhaven Subdivision.
Two Collector Streets are located through this subdivision. The approval of this subdivision and
a proposed subdivision to the south will create an alternative connection between Mount
Comfort Road and Salem Road. A direct connection to West Salem Road will be complete when
Raven Lane is extended north. The current proposal shows Raven Lane extending to the
northwest corner of the property.
Right-of-way to be dedicated: The applicant proposes dedication of right-of-way sufficient to
comply with the requirements of the Master Street Plan (MSP). Internal streets are shown as 50'
rights-of-way with 28' wide streets and 42' rights-of-way with 24' wide streets.
Street Improvements: It is city policy for all subdivisions greater than 100 lots to submit a traffic
study in an effort to better understand the overall impact that a proposed development will have
on surrounding street infrastructure, including off-site streets and intersections. However, as
traffic impacts for this subdivision have been previously analyzed and street improvements are
under construction as part of PPL 06-1940, a traffic study and additional traffic analysis is not
required for this proposal. The additional 13 lots allowed under this proposal would have
negligible traffic impacts.
The previously approved street improvements from PPL 06-1940 (Cobblestone Crossing) are
still recommended for this project and are included in the conditions of approval.
Connectivity: Street connectivity was evaluated as part of PPL 06-1940 (Cobblestone Crossing).
This proposal does not change the street layout and adequate connectivity is being provided as
approved under the original preliminary plat.
Street connection would be provided to the south by connecting onto Raven Lane. Connections
are provided to Gypsum Road and a planned Collector Street through Rockhaven Subdivision to
the west. Two street stub -outs are provided to the north, one being Raven Lane, which is
stubbed to property to the northwest. Per the recommendation of the Subdivision Committee, the
applicant has provided an additional street stub -out to the east to provide an opportunity for

connectivity to this large tract of property, regardless of how it is developed. Staff has discussed
and explained this recommendation to the School District, owner of the property to the east.
Though the property may be developed as a School in the future, creating a situation where
traffic could flow to the west from the school on only one street could create congestion at peak
hours. Additionally, allowing for another stub -out to the east, complete with sidewalks, would
provide a means of pedestrian access so that parents or children could walk to school in a
reasonable fashion.
Tree Preservation: This preliminary plat is coming through the City review process again due
to the rezoning allowing for a higher density in the interior of the project. Tree Preservation has
not changed from the original submittal. The tree preservation numbers are listed below:
Existing: 0.17%
Preserved: 0.01%
Required: 0.17%
Mitigation: Required; 12 two-inch caliper trees
Public Comment: Staff has not received public comment.
Recommendation: Staff recommends that the Planning Commission approve PPL 07-2612
with the following conditions:
Conditions of Approval:
1. Staff recommends similar street improvements approved with the original Cobblestone
Crossing Preliminary Plat (06-1940). The street improvements are listed below:
(A) The developer shall contribute to the City the estimated cost of the following
improvements:
• The cost of a traffic signal at the intersection of Mt. Comfort Road and Salem
Road, in the amount of $70,000.
• The cost of the required improvements to create a left turn lane on Salem
Road onto Mt. Comfort Road in the amount of $21,447.
• Assessments noted here shall be pro -rated over the 207 lots, and paid prior to
final plat recordation, depending upon the phases.
(B) The developer shall contribute to the following improvement:
• A left tum lane at Salem Road and "Street A", the Collector Street, to be
coordinated with the development of Rockhaven Subdivision. The applicant
shall contribute $2,622 to the City to be distributed to the party responsible for
construction of this improvement, prior to recordation of the Final Plat of
Phase I.
Total contribution by the developer, prior to Final Plat recordation, shall be $94.069.

2. Planning Commission determination of appropriate connectivity and compliance with the
Master Street Plan. On March 13, 2006 the Planning Commission found in favor of the
connectivity and street layout as currently proposed on this preliminary plat. Staff again
recommends in favor of the connectivity as depicted.
SUBDIVISION COMMITTEE DETERMINED IN FAVOR OF THIS CONDITION (07/14/07).
3. Staff recommends the following condition, in order to promote safe and orderly
pedestrian and vehicular circulation: for lots less than 70 feet in width, the maximum
curb cut width shall be 16 feet, as measured at the right-of-way line.
The applicant shall submit a guarantee (letter of credit, bond, or cash) of $1,000 per lot
prior to the recordation of the final plat for contributions to an interim solution to
wastewater capacity concerns in the Owl Creek/Hamestring Creek basin, if the
improvement is required. Final determination of the contribution shall be made by the
City Engineer.
5. Sidewalks along the detention lot shall be constructed (not guaranteed) prior to
recordation of the final plat.
6. The lot reserved for detention shall be an un -buildable lot and owned and maintained by
the P.O.A.
7. No lots shall access the east -west Collector Street or Raven Lane (a Collector Street) if an
interior street may be accessed. A note shall be included on the final plat to indicate this
requirement. Lots required to access these Collector Streets are encouraged to utilize
shared drives to decrease curb cuts on the Collector Street.
8. Payment of $114,885 for 207 single-family units in lieu of dedication of parkland shall be
contributed by the developer prior to final plat.
9. Mitigation will be required for this site in the amount of 12 (2) inch caliper large species
trees. On-site mitigation is recommended.
10. At time of Final Plat, an On -Site Planting Plan will be required for approval by the Urban
Forester and a 3 -year maintenance and monitoring bond in the amount of $3,000
submitted to the City.
11. On the construction plans submitted for review, the applicant shall identify on-site areas
for the delivery and storage of construction materials, on-site parking, cement truck

Please find the following submittal for a single family residential subdivision named
Cobblestone Subdivision — Phases I & II. This subdivision is currently under
construction and nearing completion. This property is east of Crystal Springs
Subdivision Phases I & II and north of Crystal Spring Subdivision Phase III.
This subdivision was initially approved by the Planning Commission at their March 13,
2006 meeting. Since then the construction plans have been approved and construction
has commenced. A portion of this property has also been rezoned from RSF-4 to RSF-8
since the initial preliminary plat approval. This area is now being reconfigured for the
smaller lots the meeting the RSF-8 zoning regulations. A phase line has also been shown
on this plat that was not in the original submittal.

PPL 07-2612: Preliminary Plat (COBBLESTONE CROSSING I & II, 246): Submitted by
JORGENSEN & ASSOCIATES for property located NE OF CRYSTAL SPRINGS S/D
PHASES I, II AND III. The property is zoned RSF-4, SINGLE FAMILY 4 UNITS PER ACRE
AND RSF-8, RESIDENTIAL SINGLE FAMILY 8 UNITS PER ACRE and contains
approximately 60.28 acres. The request is for a residential subdivision with 207 single family
lots in two phases.
Andrew Garner, Senior Planner, gave the staff report, describing the request. The preliminary plat
was previously approved on March 12, 2006 for 194 single family lots. Since then, 17 acres of the
property was rezoned to RSF-8. The plat presented has been slightly redesigned to add 13 Lots. The
only change is the additional lots that are slightly smaller than those surrounding. All else is the
same, including street connectivity and street improvements. One additional condition is being added
limiting curb cut width to 16 feet for the smaller lots. Staff recommended forwarding the request
with conditions as discussed and listed in the staff report.
No public comment was presented.
Chris Brackett (applicant) was present for the applicant and stated he was in agreement with all
conditions of approval.
Motion:
Commissioner Graves stated the project was essentially the same, except the added density, and
made a motion to forward the request with the conditions of approval as recommended by staff.
Commissioner Bryant seconded the motion. Commissioner Lack concurred, the motion passed
with a vote of 3-0-0.

Findings: Staff finds that vacating the requested portion of easement would not

Background/Property: The subject property contains 1.96 acres located at the northeast
corner of State Highway 62 (6`11 Street) and Lewis Street, south of Venus Street and west
of Eastern Avenue, and is split zoned C-2 and R -O. A large scale development was
approved by the Planning Commission in 2006 (LSD 05-1736) for a 3,378 square foot
Zaxby's restaurant and associated parking.
As part of the building permit review for this development, it was determined that a 15'
alley that was vacated by City Council in 1980 still contains a utility easement. The
location of the approved Zaxby's restaurant is bisected by this 15' utility easement. This
easement is not needed for this development as a new easement plat is being processed
dedicating new easements. Utility representatives have no objections to the requested
vacation.
Request: The request is to vacate the 15' utility easement (0.10 acre) bisecting the
property.
Public Comment: Staff has received one written comment from an adjacent property
owner in opposition to this request citing that he was denied the same request on his
property.

When I wanted to drive over an alley on my own property, the mayor (Coody), said there
would be no alleyway closures on his watch. So I was unable to build at that location.
