The Fayetteville Planning Commission previously approved a waiver to create the subject 2.07 -acre lot with the existing 27 feet of frontage, when approving the Preliminary/Final Plat for Piper's Glen Subdivision. Property & Proposal.: The site is located east of Barrington Parke Subdivision, south of Fox Hunter Road at Lot No. 9 of the Piper's Glen Subdivision, just east of the City of Fayetteville. The property has approximately 27' of frontage onto Fox Hunter Road, on which an access easement exists to provide access to the subject property. The applicant requests to subdivide the 2.07 -acre tract into Lots 9A and 9B of 0.63 acres and 1.44 acres, respectively. This is the first lot split requested on the property. The property to the west is the Barrington Park subdivision within the City of Fayetteville. Properties to the north, east, and south are within the Planning Area. City ordinances require that each lot have access to public utilities. Typically, access is available adjacent to the properties within a right-of-way or easement. Any extension of the public water line to either of the tracts is required prior to recordation of the lot split. A septic system permit is not required to Lot 9A as it has access to City Sewer service, a septic permit has been issued by the Arkansas Department of Health for Lot 9B. Subdivision Committee: On May 03, 2007, the Subdivision Committee (SC) recommended approval of the proposal, with staff conditions, including a fmding in favor of the waiver request. No public comment was received. The SC also recommended the item be placed on the Planning Commission consent agenda. Recommendation: Staff recommends approval of LSP 07-2556 with the following conditions: Conditions to Address/Discuss: 1. Planning Commission determination of a waiver request of lot width requirements to allow a lot with 0' frontage on an improved public right-of-way where the ordinance requires 75' frontage. Staff recommends approval of the requested waiver finding that the addition of one single family dwelling adjacent to the Barrington Park and Piper's Glen Subdivision will not create a dangerous traffic situation or adversely increase the density of the subject property. Should the waiver of lot width requirements be approved, development on each lot shall be limited to one (1) single- family home with customary accessory structures as offered by the applicant, unless and until public street infrastructure is extended to serve future development. 5/3/07: THE SUBDIVISION COMMITTEE FOUND IN FAVOR OF THE REQUESTED WAIVER. 2. Each tract shall have legal access to a public water line of sufficient size for the proposed development prior to recordation of the lot split. Extension of a water line may be necessary to establish legal water service to each tract. This is required prior to recordation of the lot split document. Standard Conditions of Approval: 3. The division of this lot would create a Lot 9A - approximately 0.63 acres, and a Lot 9B — approximately 1.44 acres. The owner has opted to make lot 9A smaller than the minimum lot size because it is currently served and will retain service by the City of Fayetteville's sewer system and would not need the larger lot size for a septic field. Lot 9B would be serviced by a septic field. Before this larger tract of land was subdivided into Piper's Glen (which lot 9 is a part of), the access onto Fox Hunter road, serviced the existing house located on the proposed lot 9A and a house located just south of Lot 9B, so this division of land will not create more traffic onto Fox Hunter Road than previous traffic. A shared access easement has been proposed through Lots 9A and 9B to continue the shared access that all property owners currently enjoy. This proposal will have adequate utilities, drainage and other public services. We feel that this division of land is compatible with the surrounding areas: the lots lying just west of this parcel located in Barrington Park are slightly less than an acre and the lots to the south in Piper's Glen are roughly an acre. The establishment of the conditional use will not impede the normal and orderly development and improvement of the surrounding area for uses permitted in the zone, particularly because this division is a natural replication of the conditions that existed before the entire property was subdivided, with two house holds employing the access onto Fox Hunter Road. The portion of the sidewalk outside of the right-of-way shall be dedicated within a pedestrian access easement to the City for general maintenance and re -construction by the City as needed. All roof mounted utilities and mechanical equipment shall be screened by incorporating screening to the structure utilizing materials compatible with the supporting building. Smaller ground -mounted equipment may be screened with tall grasses or shrubs. A note shall be added to all construction documents indicating as such. 10. Trash enclosures shall be screened with access not visible from the street. The trash enclosures shall be constructed with materials that are complimentary to and compatible with the proposed building. A detail of the proposed screening shall be submitted and approved by the Planning Division prior to issuance of the building permit. The property is zoned I-1, HEAVY COMMERCIAL/LIGHT INDUSTRIAL AND I-2, GENERAL INDUSTRIAL, and contains approximately 6.57 acres. The request is for one office/warehouse building, two small office buildings, and a self -storage facility with office/living quarters with associated parking. Jeremy Pate, Director of Current Planning, gave the staff report. Staff stated a Conditional Use Permit had been approved by the Planning Commission for the proposed mini -storage use, and a different large scale was approved in the previous year by the Planning Commission. The current changes were from warehouse to mini -storage. A waiver request of Commercial Design Standards, due to the primarily metal buildings, required the item to go before the Planning Commission for final consideration. Staff recommended in favor of the waiver, finding it appropriate in the Industrial Park. Staff recommended forwarding the request with a recommendation for approval, with conditions. No public comment was presented. Sarah Patterson, Urban Forester, stated five trees are required for mitigation and that at the time of construction, she would like to be involved to determine if additional trees along the front could be saved to reduce the amount of street trees required to be planted. Mandy Bunch (applicant) stated the square feet of the building is a little different than that cited in the staff report, but everything else had been presented correctly. Commissioner Cabe stated he had not seen the project before, and requested to look at the materials sample board. A discussion of the metal paneling system ensued. Commissioner Lack stated the metal being used were likely architectural metal panels, as opposed to standard metal siding. Candy Clark (applicant) questioned if condition of approval number 11 should be modified to incorporate the more restrictive condition placed upon the project by the Conditional Use Permit, which only allows monument signs as freestanding signs. Pate explained the Conditional Use Permit would still be in effect, so it was not necessary, but it could be included. Clark thanked staff for allowing the sidewalk to meander around the trees. Patterson requested they contact staff at the time of construction Commissioner Lack stated this project was appropriate for the Industrial Park, and the design standards were fine.
