PPL 12-4225:Preliminary Plat(3018&2980 N.ALTUS LNJALTUS SUBDIVISION,258): Submitted
by NATHAN HARRIS for properties located at 3018 AND 2980 NORTH ALTUS DRIVE.The property is in
the PLANNING AREA and contains approximately 3.29 acres. The request is for a residential subdivision
with three single family lots.
Andrew Garner, Senior Planner, gave the staff report.
Nathan Harris,applicant,asked about the condition of approval requiring utilities to be placed underground.
Garner responded that was not sure of the application of that ordinance on this project because it is outside
the city and these are existing homes, etc.
Jason Kelley, Assistant City Attorney, discussed that he would recommend removing that condition of
approval because if it is an ordinance requirement anyway it does not need to be included as a condition of
approval.
Motion:
Commissioner Chesser made a motion to approve PPL12-4225, striking conditions #2 and#13 that
were recommended by staff. Commissioner Cook seconded the motion. Upon roll call the motion
passed with a vote of 8-0-0.

LSD 12-4194: Large Scale Development(1967 W.TRUCKERS DR./CLARITY POINTE,247):
Submitted by GBS ENGINEERING for property located at 1967 WEST TRUCKERS DRIVE. The
property is zoned C-PZD, COMMERCIAL PLANNED ZONING DISTRICT, and contains a total of 4.96
acres. The request is for an assisted living facility.
Quin Thompson, Current Planner, gave the staff report.
Hunter Haynes, applicant, discussed his efforts to design the site to meet City Ordinances. He provided
reports from two (2) independent arborists detailing conditions of the trees currently stalling development.
The trees were not considered to be in good health.
William Chesser,Planning Commissioner, asked the Urban Forester if her recommendation for denial had
changed due to the newly presented reports.
Megan Dale, Urban Forester, said that staff had not had time to review the tree condition reports, that
according to the ordinance, tree preservation should be preferred, but that the mitigation numbers are
sufficient to cover the removal of the mature trees should the PC choose to approve the project.
Tracy Hoskins, Planning Commissioner, commented that the City has a tree reforestation policy, that
sometimes the resulting project is better than what is given up. He noted that he had concerns about the
survival of existing trees during and after construction.
Chesser Asked if it was the case that these trees would likely not survive as long as two years after
development of the site.
Haynes responded that two independent assessments have indicated that the proposed Landscape Plan would
improve the property by increasing diversity of species.
Jason Kelley, Assistant City Attorney, commented that according to the tree preservation ordinance,
preservation was the number one goal. Where preservation is not possible,then mitigation is allowed.
Hoskins noted that the applicant is providing a significant amount of reforestation.
Chesser responded, saying that the primary goal is preservation of existing canopy. He noted that there is
very little canopy on site, and not in a location that would prevent development of the site. He stated that in
his opinion,the site could be designed such that tree removal would not be necessary.
Matthew Cabe,Planning Commissioner,stated that he was concerned about the design,but that two arborists
had graded the trees and found them less than completely healthy.
Motion#1:
Commissioner Hoskins made a motion to approve LSD 12-4194, disagreeing with staff on condition#1
and determining in favor of the tree preservation plan on 42 and that the landscaping plan be installed as
proposed and the plantings bonded/guaranteed. Commissioner Honchell seconded the motion. Upon
roll call the motion passed with a vote of 5-3-0,with Commissioners Chesser,Honchell and Cook
voting no.
There being no further business, the meeting was adjourned at 6:30 PM.

Lori Boatright,applicant, stated that there is no location for a winter market,this site will be operated year
round.
Commission Cabe made a motion to approve the request.
Commission Honchell seconded the motion.
Commission Hoskins asked if the vendors were charged.
Boatright state there is a daily commission rate, same as the square.
Commission Hoskins asked if there was a lease rate on the market.
Boatright said there are in-kind services provided for the Botanical Gardens.
Commission Hoskins asked if the grass would die below the tent and about ruts.
Boatright stated that the Botanical Gardens maintain the property.
Commission Hoskins asked if the City Council knew there would be a tent on the property when they
approved the updated agreement with the Fanners Market.
Kit Williams,City Attorney,stated that Condition#4 gives the City authority to end the arrangement if there
are problems created by the tent being on the property.
Commission Hoskins stated that the property will be tom up by vehicles and he has an issue with a semi-
permanent use of the City's property for private enterprise, and can't support the request.
Williams reminded the applicant and the commission that five votes are required to approve the request and
with only five members present, it might be best to table the request to the next meeting.
Commission Honchell asked about the streamside area north of the site.
Fulcher stated that the activities are located outside of the 50' buffer.
Williams stated the commission should include a condition about the streamside buffer.
Commissioner Winson asked about bathrooms.

BACKGROUND
November 13. 2012 Planning Commission meeting:This item was tabled at the November 13,2012
Plannine. Commission meeting with some discussion about the location of parking and vehicular
traffic in relation to the streamsideprotection zone of the adjacent creek.To address these discussion
items the applicant has submitted a more detailed site plan (attached).
Property Description: The subject property is located in northeast Fayetteville at 4703 North
Crossover Road. The site is zoned R-A,Residential Agricultural and is developed for the Botanical
Gardens of the Ozarks.The 6.4-acre site is part of the overall 468-acre City-owned Lake Fayetteville
Park. The surrounding land use and zoning is listed in Table 1.

Botanical Gardens Farmer's Market: On April 12, 2012 the Planning Commission approved a
conditional use permit for the Fayetteville Farmer's Market to operate at the Botanical Garden's site
at 4703 North Crossover Road. A full copy of the permit (CUP 10-3551) is attached.
Proposal: The Fayetteville Farmer's Market proposes to modify CUP 10-3551 to change the days
and hours of operation and to allow a large tent to be permanently installed on the Lake Fayetteville
Park property.As indicated on the attached aerial photo provided by the applicant,the market would

be south of the Botanical Gardens of the Ozarks in the meadow south of Hilton Creek.The area east
of the trail would remain as parking for the market,parks and garden users.The tent is a tent similar
to those used for selling fireworks. The tent would be a 48-foot by 135-foot oval, roughly 5,000
square feet. The days and hours of operation are proposed as follows:
■ Year-round on Saturdays from 7 a.m. to 12 p.m., Sundays from 9 a.m. to 2 p.m. and
on another day of the week from 4 p.m. to 7 p.m.
• Other days and hours of operation for special events throughout the year to be held at
the tent site by the Fayetteville Farmer's Market or the Botanical Gardens of the
Ozarks.
Public Comment: No public comments have been received.
RECOMMENDATION
City Planning and Parks staff along with the Park and Recreation Advisory Board recommend in
favor of the applicant's request. Staff finds that the proposal will be consistent with the previous
conditional use permit and the expanded days and hours of operation would allow a wider number of
people to access the farmer's market. The expansion of the market is compatible with the
surrounding parks land and Botanical Gardens uses.
There is the potential for the large permanent tent to adversely impact parks and trail users.The tent
could compromise the aesthetics of the park or result in safety or maintenance issues because the tent
will be left unsupervised a majority of the time. In order to ensure that this is not a problem staff
recommends that the tent be permitted on a trial basis from November 2012 to March 2013.If there
are complaints from the public or issues noted by staff this request may be brought back to the
Planning Commission for full consideration.
Recommended Motion: Staff recommends approval of ADM 12-4260 Botanical Garden's
Farmer's Market Conditional Use Permit Modification with the following conditions of
approval:

2. The modification to CUP 10-3551 is for a trial period from November 14, 2012 through
March 31, 2013. During that trial period City staff will evaluate the public reaction to the
tent and how it affects trail and park patrons. If staff determines that the tent results in
park or trail user conflicts, issues with graffiti, trespass, maintenance, or any other
adverse impacts, staff may bring this request back to the Planning Commission for full
consideration. If the trial period expires and staff does not bring this request back to the
Planning Commission, the conditional use permit is permanently modified and approved
as described herein.
3. Prior to use of the tent the applicant shall coordinate with the City Fire Marshall's office
to ensure that the tent meets all applicable fire codes.
4. If the City Parks Department withdraws their consent for the tent at any time, during or
after the trial period, the tent shall be removed in a timely fashion by the applicant.
5. To ensure that direct impacts in the streamside protection zone do not occur, the applicant
shall install appropriate signage or other barrier as approved by the City Parks
Department to delineate the perimeter of the streamside protection zone and indicate that
no vehicles are permitted in this area.

The FFM requests amendments to our current Conditional Use Permit to provide additional
opportunity to the FFM vendors and added convenience to the public.
We are no longer operating at the Mill District location.
We would like to erect a tent on BGO property allowing both FFM and BGO use of this semi-
permanent structure. The tent would remain in place,but without permanent foundation.
The tent would be erected by FFM volunteers with supervision from the manufacturer. This
tent is to be maintained by the FFM.
We would like to add additional days and hours of operation at the BGO location to our
Conditional Use Permit including Saturday,Sunday and one weekday as approved by City
Council October 2,2012. (Ordinance 97.086)
Other days/hours of operation outside of these listed would allow for special events to be
held at the tent site by FFM or BGO.

CERTIFICATE INFORMATION
for
MIAMI MISSIONARY TENTS
The Miami Missionary Tent Co. Inc. utilizes ARCHITENTIWIDESIDEO
HD 14 oz. in the manufacturing of their tents. ARCHITENT WIDESIDE HD
14 oz. is a superior tent fabric incorporating the use of virgin vinyls with a
specialized polyester textile reinforcement.
ARCHITENT WIDESIDE HD 14 oz. fabric is manufactured to meet rigid
specifications of the California State Fire Marshal Small Scale Test, and is
registered with the California State Fire Marshal as a flame resistant product,
the registration number being FA-12216. In addition to test results,
California State Fire marshal certificates are on file for our materials.
Although the California State Fire Marshal test has very stringent require-
ments, we realize that specific counties or regions may require additional
information or a different flame test method. For this reason we have also
tested ARCHITENT WIDESIDE HD 14 oz.against the NFPA 701 Large
Scale Test.ARCHITENT WIDESIDE HD 14 oz.complies with NFPA 701
Large Scale as documented by independent laboratory test report No. 2-
43515-0.
ARCHITENTWIDESIDE HD 14 oz. is tested in Herculite Corporation's
testing laboratory by qualified lab technicians in accordance with Federal
Test Method Standard 191 A.
