The property located at 1326 S. China Berry Lane,Fayetteville, Arkansas, had a survey performed and it was discovered that the dwelling encroached onto/over a utility easement along the South side of the property. The dwelling was built approximately 2000;however, a survey had not been requested prior to March, 2007. Since the encroachment has been discovered, we are making application to vacate that portion which the dwelling is built over/onto the existing easement. I have had the surveyor locate the encroaching area,notified all surrounding owners, utility companies and city officials required with no objections for any of the above. With said application being submitted, we are requesting that the vacation of the encroached area be granted as it has been this way for approximately 8 years and current owner inherited the issue. The city inspectors' office did not notate an encroachment at the time the dwelling was under construction and inspected, as all inspections were passed and approved prior to the Certificate of Occupancy being granted.
