2. Walker Park Cell Tower: A resolution to approve a twenty-five year lease with
Callahan Tower Joint Venture for a small lot in Walker Park for a monopine cell tower at
an annual rent of between $12,000.00 and $54,000.00, plus a $20,000.00 contribution to
the Walker Park Mural Project. This resolution was Tabled at the May 1, 2007 City
Council meeting to the June 5, 2007 City Council meeting. This resolution was Tabled

of the City of Fayetteville; and adopting the Associated Master Development Plan. This

southwest corner of Razorback Road and 15th Street, east of the Crowne Apartments;
containing approximately 4.42 acres; amending the Official Zoning Map of the City of
Fayetteville; and adopting the Associated Mater Development Plan.

2. VAC 07-2568 (Mathias Shopping Centers, Inc.): An ordinance approving VAC 07-
2568 submitted by Crafton, Tull, Sparks and Associates for property located at 1267
North Steamboat Drive to vacate utility easements across the subject property as the
utilities have been relocated to allow development on the site.

3. Amend Chapter 161: Zoning Regulations: An ordinance amending Title XV: Unified

located in the Main Street Center Zoning District.

RE: $70,000.00 insurance payment for Clyde Randall
Missy Leflar, Human Resources Division Manager, has succeeded in
getting Reliance Standard Life Insurance Company to agree to pay Clyde
Randall's widow the face value of his life insurance policy even though the
change in life insurance carriers last fall appeared to make him ineligible.
Reliance agreed to make this payment if the Council agreed to at least a one
additional year extension of coverage (2009-2010).
Since this City Council cannot absolutely bind a future City Council,
the City would have to repay this $70,000.00 to Reliance if a future City
Council decided to change carriers or otherwise not renew the policy with
Reliance before the end of 2010. The City of Fayetteville has historically
changed insurance carriers infrequently and would likely independently
choose to remain with Reliance through 2010 as long as it is providing good
service and competitive rates. Therefore, this Memorandum of Agreement
which will get the $70,000.00 to Clyde Randall's widow promptly and
without court action should be approved by the City Council.
I would like to thank Missy for her leadership and efforts on this
matter. I was initially concerned that litigation, with its delays and uncertain
results, would be inevitable. Missy's persistence and negotiating skills
helped avoid litigation and will likely result in payment to Clyde Randall's
widow without cost to the City of our taxpayers.

MEMORANDUM OF AGREEMENT
This agreement is made on the_day of June 2007, by and between Reliance Standard
Life Insurance Company("RSL")and City of Fayetteville.("Policyholder").
WHEREAS,Policyholder holds Group Policy Number GL-141373 (the"Policy"),a group
life policy issued by RSL effective as of November 1,2006;and
WHEREAS,Clyde Randall(the"Employee")was an Employee of the Policyholder,and who
died on December 31,2006;and
WHEREAS,the Employee was not actively at work at the time the Policy became effective;
and
WHEREAS, the Employee did not return to work for one full day prior to the date of his
death;and
WHEREAS,the Employee was not eligible for benefits under the terms of the Policy;and
WHEREAS, the Policyholder is seeking payment to the Employee's beneficiary in the
amount of$70,000.00,even though no such benefit is payable under the terms of the Policy.
NOW THEREFORE, in consideration of the mutual covenants and promises contained
herein,RSL and Policyholder do hereby agree as follows:
1. RSL shall pay to the Employee's beneficiary the sum of$70,000.00. The
payment check may bear the legend"extra contractual payment".
2. The Policyholder will ensure thatthe existing Policy remain in force with RSLat
the current rates until the renewal date,November 1,2009 (the"Initial Policy
Period")
3. The Policyholder shall thereafter renew the Policy for an additional term ofeither
one or two years. at the Policyholder's option, (the "Renewal Term") at the
applicable rate determined by actuarialy reasonable underwriting guidelines and
the experience during the Initial Policy period. The renewed Policy shall remain
in effect through the Renewal Term.
4. In the event that Policyholder breaches any term of this agreement,including but
not limited to the obligation to pay premiums during the Initial Policy Period and _
the Renewal Term,Policyholder shall reimburse RSL the sum of$70,000.00„ 1 Deleted:plus interest
within 15 days of Policy termination.
5. Policyholder shall be responsible for any legal fees and costs incurred by RSL in

recovering the$70,000.00 payment.
6. It is agreed and understood that any payments made pursuant to this Agreement
by RSL shall be made as an accommodation to Policyholder, and shall not
constitute a waiver of any of the Policy provisions or defenses available to RSL
under the Policy,nor shall any changes constitute an admission of liability on the
part of RSL under the Policy.
7. It is agreed and understood that RSL makes no representation as to the nature of
any payments for federal or state income tax purposes.
8. Policyholder hereby releases and forever discharges RSL, its predecessors and
successors and assigns,agents,employees,officers,directors,consultants and any
other person whatsoever from all claims,demands,damages,liabilities,expenses,
damages and causes of action of any kind,with respect to any oblieation under Deleted:knownornnknown,which
the Policy on the life of Clvde Randall could now or may in the future arise
against RSL,or the others identified

9. Policyholder agrees to indemnify RSL from any and all claims whatsoever this agreement with respect to my

10. This agreement constitutes the entire agreement between RSL and Policyholder
with regard to the payment of any benefits for or on behalf of Employee as set
forth herein, and supersedes any prior oral or written agreements between the
parties relating to the payment of benefits for or on behalf of Employee.
11. This agreement is governed by the laws of the State in which the Policy was
issued. No changes to this agreement shall be valid or binding unless in writing
and jointly signed by authorized representatives of both RSL and Policyholder.

Summary:
This project booklet is for the Housing Facility located in north Fayetteville. The project
is located '/ mile east of Highway 265 along Ivey Rd. The format for this booklet will
follow the outline set by the "Master Development Plan: Planned Zoning District"
guidelines.

b) The proposed project is to provide a Shelter / Rehabilitation Home on Ivey Lane,
east of S. Old Missouri Road, in the City of Fayetteville. We are proposing a two
story building that has a maximum 28 bedrooms with room for office space. The
building foot print will be 14,365 sq ft. The first floor will contain 9,201 sq ft. of
bedroom space and 5,164 sq ft. of office space. The second floor will contain
2,806 sq ft. and will only contain future space for additional bedrooms. A future
addition to the building will incorporate 2,800 sq ft to be added at a later time. A
septic field east of the property will be leased from the City of Fayetteville until
such time that the building can connect to city sewer. The property is currently
zoned R-A, with R-A and City of Springdale to the north, R-O to the west and R-A
to the east and south. The city is providing a buffer lease area that surrounds
our project site. Due to this buffer area our building set backs will not meet the
set back requirements for R-A zoning. A PZD will allow us to meet building set
back requirements.
c) General project concept
i. Street Lot Layout: This PZD is a single building with parking as
required by the UDC.
ii. Site Plan: See site plan.
iii. Buffer Area: PA 2 is a buffer area.
iv. Tree Preservation Area: See site and Tree Preservation plan.
v. Storm Water Detention Area and Drainage: Drainage runoff sheet
flows from the north side of the property to the south side and is
collected by the proposed storm sewer system and routed through
the detention pond.
vi. Undisturbed Natural Area: PA 2 is undisturbed area except for
areas which will require grading. See site plan.
vii. Existing and Proposed Utility Connections and Extensions: An 8"
water line is located north of the property that is maintained by the
Springdale Water Utility. This water line will be utilized to supply
water to the proposed building. A septic area east of the property
will be utilized to handle the proposed buildings sanitary needs.
viii. Development and Architectural Designs Standards: The proposed
building is designed to have the feel of a inviting home and a place
of safety.

d) Construction to begin in May 2007 and consist of one phase of construction.
e) Two Proposed Planning Areas (PA). PA-1 encompasses the site that the housing
facility occupies. PA-2 encompasses the area that surrounds the housing
facility.(See Zoning & Development Standards Plan)
f) PA-1
The PA consists of a single building that will house 28 beds for
occupants, office space, and treatment space.
Permitted uses will be City wide uses by right (Use Unit 1), Public
protection and utility facilities (Use Unit 3), Cultural and recreational
facilities (Use Unit 4), Government Facilities (Use Unit 5), Offices,
studios and related services (Use Unit 12), Professional offices
(Use Unit 25), Multi-family dwellings (Use Unit 26).
Conditional uses will be City wide uses by conditional use (Use Unit
2)
The residential unit density will be 19 units per acre. The office
space will be 5,164 sq ft. located on the 1St floor. The living space
will be 9,201 sq ft located on the 1St floor and 2,806 sq ft located on
the 2nd floor. Front setbacks will be a 0 ft, side setbacks will be 8 ft,
and rear setbacks will be 5 ft. Height restrictions will be 32 ft.

The PA consists of green space. No structures will be allowed to
be built with in the area.

Building Area
h) Lake Fayetteville Park surrounds the property to the west, south, and east.
Copper Creek Park is approximately one mile south of the project site.
i) A request for a zoning change to this piece of property is being made because
the property does not follow any of the cities current front building set back
distance for any of the available zones. The reason the building is not within the
front building set back is due to an agreement between the City and the
Developer concerning the parcel of land the building .is proposed to be built on
and the buffer lease area that surrounds the project. The agreement calls for 1 .5
acres of land to be developed with an additional 1 .5 acres of land to surround the
project as a buffer lease area. At some time when the City sells the parcel to the
south the developer of that parcel will then give the 1 .5 acre buff lease area to
the Housing Facility. Once the buffer lease area is turned over to the Housing
Facility all set backs will be in compliance with current Fayetteville city R-A
zoning ordinances.
j) The surrounding land uses coincide with what the facility will offer to the public.
i. A United Way Facility is located to the west. The Richardson
Center is located to the north-west. A residential house is located
to the north-east. And to the south and east the land is primarily
pasture.
ii. The proposed project should have a minor effect on the current
traffic conditions.
iii. The buildings appearance is house-like. This is in-line with the
surrounding buildings. Also, a tree buffer blocks view of the
building from Ivey Rd.
iv. Signs will follow city sign code.
k) The project appears to be in compliance with the Fayetteville city Plan 2025.
1) No traffic study has been done. The proposed project should have a minor effect
on the current traffic conditions.
m) City services utilized with this project will include fire, police and solid waste
services. Water will be from Springdale Water Utilities. And the Sewer will be
handled by a septic system until such time that the access can be provided to
City of Fayetteville's sewer system.
n) Statement of Commitments
L No dedication is proposed for this project.
ii. An offsite drive will be constructed within an access easement.
This drive will connect the facility to Ivey Rd.
iii. Trees on site will only be removed due to construction and grading
as needed. All other trees will remain intact.

v. Fire protection shall be provided by the City of Fayetteville.
vi. PA-2 shall not have any permanent structures built on it

o) Conceptual Description of Development Standards, Conditions and Review
Guidelines
L The lease buffer area contains trees that will provide screening
from Ivey Rd.
ii. Traffic shall be kept to a minimum by only having one entrance/exit
with gates to control who can and who can not enter.
iii. 50 parking spots are proposed. This number is in compliance with
the parking ordinance. The parking lot will be designed and
constructed in accordance with the standards found in Section 172
of the Unified Development Code.
iv. No Perimeter treatment is required.
v. No Sidewalks are planed
vi. Street lights will be designed and constructed in accordance with
the Unified Development Code.
vii. Water lines will be designed and constructed in accordance with
the Springdale Water Department. A 16" water line is located North
of Ivey Rd that we will be tapping.
viii. Sewer lines will be designed and constructed in accordance with
the City of Fayetteville Water and Sewer Specifications. A septic
field east of the property will be utilized till such time that city sewer
is within reach.
ix. Streets and drainage will be designed and constructed in
accordance with the Unified Development Code.
x. Materials to be similar to the proposed housing facility.
A. Tree preservation and Protection will be implemented in
accordance with Section 167 of the Unified Development Code.
xii. Architectural Design Standards to be similar and followed through
out the property
