1. RZN 14-4864 Koutroumbis Appeal: An ordinance rezoning that property described in
Rezoning Petition RZN 14-4864, for approximately 0.26 acres, located at 232 West Ash
Street from RSF-4, Residential Single Family, 4 units per acre, to RMF-24, Residential
Multi-Family, 24 units per acre. This Ordinance was left on the First Reading at the
January 6, 2015 City Council Meeting. This ordinance was left on the Second Reading
at the January 20, 2015 City Council meeting.

2. Repeal and Replace Title V Public Works and Amend Chapter 51 and Chapter 10:
An ordinance to repeal and replace Title V Public Works, Article III Discharge and

Definitions Pertaining to Water and Sewer Rates; to Amend § 51.999 Penalty; and to
Amend § 10.99 General Penalty of the Fayetteville Code. This ordinance was left on the

Below is a portion of the Rules of Order and Procedure of the Fayetteville City
Council pertaining to City Council meetings:
Agenda additions. A new item which is requested to be added to the agenda at a
City Council meeting should only be considered if it requires immediate City
Council consideration and if the normal agenda setting process is not practical.
The City Council may only place such new item on the City Council meeting's
agenda by suspending the rules by two-thirds vote. Such agenda addition shall be
heard prior to the Consent Agenda.
Consent Agenda. Consent Agenda items shall be read by the Mayor and voted
upon as a group without discussion by the City Council. If an Alderman wishes to
comment upon or discuss a Consent Agenda item, that item shall be removed and
considered immediately after the Consent Agenda has been voted upon.

Old business and new business.
Presentations by staff and applicants. Agenda items shall be introduced by the
Mayor and, if an ordinance, read by the City Attorney. City staff shall then present
a report. An agenda applicant(city contractor, rezoning or development applicant,
etc.)may present its proposal only during this presentation period, but may be
recalled by an alderman later to answer questions. Staff and applicants may use
electronic visual aids in a City Council meeting as part of their presentation.
Public comments. Public comment shall be allowed for all members of the
audience on all items of old and new business and subjects of public hearings. No
electronic visual aid presentations shall be allowed, but the public may submit
photos,petitions, etc. to be distributed to the City Council. If a member of the
public wishes for the City Clerk to distribute materials to the City Council before its
meeting, such materials should be supplied to the City Clerk office no later than
9:00 a.m. on the day of the City Council meeting.Any member of the public shall
first state his or her name and address, followed by a concise statement of the
person's position on the question under discussion. Repetitive comments should
be avoided,this applies to comments made previously either to the City Council or
to the Planning Commission when those Planning Commission minutes have been
provided to the Aldermen. All remarks shall be addressed to the Mayor or the City
Council as a whole and not to any particular member of the City Council. No
person other than the Aldermen and the person having the floor shall be permitted
to enter into any discussions without permission of the Mayor. No questions shall
be directed to an Alderman or city staff member except through the Mayor.
Courtesy and respect.
All members of the public, all city staff and elected officials shall accord the utmost
courtesy and respect to each other at all times. All shall refrain from rude or
derogatory remarks, reflections as to integrity, abusive comments and statements
about motives or personalities. Any member of the public who violates these
standards shall be ruled out of order by the Mayor, must immediately cease
speaking and shall leave the podium.

WHEREAS, on April 1, 2014, the City Council approved Resolution No. 67-14 supporting the
inclusion on separated bicycle and pedestrian trails at the Interstate 49 interchanges at Garland Avenue,
Wedington Drive and Martin Luther King,Jr. Boulevard; and
WHEREAS, pursuant to its policy, the Arkansas Highway and Transportation Department has
incorporated bike lanes rather than separated trails in the initial design of the interchanges because the
separated trails are not included in the City's current Alternative Transportation and Trails Master Plan
or the current Master Street Plan; and
WHEREAS, the plans must be updated in order for the Arkansas Highway and Transportation
Department to consider incorporating separated bicycle and pedestrian trails in the final design of the
interchanges.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE,ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby amends the Fayetteville
Alternative Transportation and Trails Master Plan as shown in Exhibits A-2, B-2 and C-2, attached
hereto and made a part hereof, to clarify that separated bicycle and pedestrian trails are planned for the
Interstate 49 interchanges at Garland Avenue (Highway 112), Wedington Drive (Highway 16) and
Martin Luther King,Jr. Boulevard(Highway 62).
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby amends the Master Street
Plan to add a typical cross section for separated bicycle and pedestrian trails as shown in Exhibit D,
attached hereto and made a part hereof.

SUBJECT: Request for Walk-On Item — 1-49 Interchange improvements
Attached is an agenda packet prepared by staff related to on-going designs that the
Arkansas Highway and Transportation Department has indicated is time-sensitive. Staff is
requesting the City Council permit this item to be added at the agenda session in order to be
considered for approval at the meeting of February 03, 2015.
As you are aware, the Arkansas Highway & Transportation Department (AHTD) has
been in the process of preparing concept designs for interchange improvements at the Hwy 16,
Hwy 62, and Hwy 112 interchanges within the city limits. In April of 2014, staff presented
comments related to concept designs to the City Council and through Resolution 67-14, these
comments were sent to the AHTD by Mayor Jordan. We recently received feedback related to
one specific interchange, Hwy 112, in which the accommodation for pedestrians and cyclists as
a separated facility (multi-use trail) would not be permitted, because our master plans show "on-
street linkages" and bike lanes instead. Rather, bike lanes would be installed; additional
sidepaths or a separated facility would be considered, but only at the cost of the City. Because
of the important safety considerations of this matter, staff visited with the AHTD Director and his
staff on Wednesday, Jan 21 in Little Rock to discuss. It was recommended that the AHTD would
review the Council and staff's request for a separated facility rather than bike lanes for a short
distance within the interchange area if our master plans were modified to reflect this desired
improvement. Attached to this memo is a request to amend the City's Alternative Transportation
and Trails Master Plan and the Master Street Plan, accordingly.
Staff is respectfully requesting this item be added to your agenda due to the timeliness in
the AHTD's preparation of plans. We received this guidance on Wednesday of last week and
were told that 60% complete design drawings for at least the Hwy 112 interchange have been
completed, therefore any changes at this point would need to made swiftly.

BACKGROUND:
On January 21st 2015, City staff met with Scott Bennett, Director of the Arkansas State Highway
Department (AHTD) regarding the proposed interchange improvements along 1-49 with regard
to bicycle and pedestrian connectivity. The 2009 Fayetteville Alternative Transportation and
Trails Master Plan proposes street linkages across 1-49 at Garland Ave. (Hwy 112) and
Wedington Dr. (Hwy 16). At the interchange of I-49 and Martin Luther King Jr. Blvd. (Hwy 62),
both a street linkage and a separated trail are shown —see Exhibits A-1, B-1 and C-1. The
designation of"street linkage" has been widely interpreted as bike lanes, but in some cases with
high vehicular volume and speed, a separated bicycle and pedestrian trail is recommended
instead of an on-street facility. In addition, the adopted street cross section in the Master Street
Plan further indicates the planned provision of bike lanes through these interchanges on the
State highway system, which are classified as principal arterials. On April 1 st, 2014 the City
Council approved resolution 67-14 supporting the inclusion of a separated bicycle and
pedestrian trail instead of the proposed bike lanes at all three interchanges and a letter was sent
by Mayor Jordan to AHTD expressing the City Council's desire.
AHTD has a policy to include bicycle facilities on their projects if the local municipality has the
facility included in an adopted master plan. Since the most current City trails master plan shows
.,street linkage" and the Master Street Plan cross section indicates bike lanes, AHTD has
followed their policy and included the bike lanes. A separated bicycle and pedestrian trail

cannot be considered a substitute to bike lanes, therefore the pedestrian trail would only be
included if the City pays the additional cost.
DISCUSSION:
In order to clarify and provide more guidance to AHTD on the type of facility preferred by the
City, staff proposes modifying the Trails Master Plan and Master Street Plan in the three
interchange project areas to indicate the planned infrastructure more specifically. Due to the
high traffic volume at these three intersections, staff proposes removal of the street linkage
designation and replacement with a separated bicycle and pedestrian path/trail through each of
the interchanges as shown on exhibits A-2, B-2, C-2 and the proposed typical cross section
shown in exhibit D. As we continue to evaluate the usage of our alternative transportation
system by our residents, we are finding that the separated trail along the side of major roadways
provides a more comfortable facility and receives higher usage than bike lanes in many
cases. In each of these locations, there are sections of existing trails that are either planned for
construction within the next 2-3 years (so that they will be done by the end of construction of the
interchanges), along with sections that have not been scheduled due to the lack of connections
across 1-49, therefore a separated facility for bicycles and pedestrians is safest and most
appropriate at these locations.
