BACKGROUND
Property Description: The subject property is located at 3484 Wedington and contains a church and
parking lot on approximately 2.24 acres. The surrounding land use and zoning is listed in Table 1.

Background: On April 12, 2010 the Planning Commission granted approval of CUP 10-3501
Shoppes at Wedington for a church, Use Unit 4. The church was constructed and a final certificate of
occupancy permit was issued on April 6, 2011. The certificate of occupancy permits a maximum of
706 people in accordance with building code.
Proposal: The conditional use permit was approved with a condition of approval (No. 3) that
specified that the maximum occupancy shall not exceed 344 persons. However, the church has had
more people attending services than originally intended and the City received some complaints from
an adjacent property owner regarding the church's operations. To address the issue with more people
attending services than originally approved, the applicant has submitted a request to modify the
conditions of approval for CUP 10-3501 to permit up to 704 persons during peak hours. All of the
other conditions of approval from the original large scale development and conditional use permit

have been met.
Public Comment: In September 2011, City Planning staff received complaints about Cross Church
from the president of the Chevreaux POA (adjacent to the north of Cross Church) in person and via
email. The complaints have been related to various development regulations such as landscaping and
drainage, and concerns with parking, access, and the overall intensity and number of patrons
attending the Cross Church services. The complaints where also concerned that the public
notification for the original conditional use permit did not require written notification to every
property owner within their development. Only the property owner of the parent parcel number as
listed on the County Assessor's website received written notification, not the individual
condominium owners. Although not required by ordinance, to address this concern Cross Church has
sent written letters to each of the individual condominium owner's of the Chevreaux Court
development for the March 26, 2012 Planning Commission meeting.
RECOMMENDATION
Staff recommends in favor of the applicant's request to permit a maximum of 704 patrons during
peak church service hours. The church has shared parking agreements, that when combined with the
on-site spaces, provide 202 parking spaces. This exceeds the minimum required number of 176
spaces (1 per 4 people). Staff has conducted drive-by site visits during peak church services on
Sunday mornings. The church parking attendants combined with traffic and pedestrian control appear
to bring the church attenders safely in and out of the church building, in staff's opinion, without
traffic hazards. There are a fairly large number of vehicles and pedestrians walking from the various
parking lots that Cross Church uses under shared parking agreements. Initially there were some
issues with pedestrians crossing Salem Road at unmarked locations, and issues with cross access and
access for Chevreaux Court residents being constrained by the church operations. However, staff has
been in communication several times with Cross Church to address these issues and the church has
been responsive to the neighbors and staff's concerns. The safety and access issues have been
resolved to staff's satisfaction. The modification to allow for 704 patrons (instead of 344) does not
change staff's original finding that the use is compatible and appropriate in this busy mixed-use area
along a state highway. The church has been receptive and easy -to -work with in staffs opinion, which
is critical in these types of conditional uses with surrounding residents.
Recommended Motion: Staff recommends approval of ADM 12-4062 Cross Church Conditional
Use Permit Modification with the following conditions of approval:

1. CUP 10-3501 is hereby amended to allow for a maximum of 704 people attending seryices as
proposed by the applicant and indicated in the attached letter and documents.
2. All conditions of approval from CUP 10-3501 still apply, with the exception of condition of
approval No.3 to allow for a larger number of persons originally approved.

Dear Staff and Commissioners:
For the reasons described below, Cross Church Fayetteville (Church) (Applicant)
respectfully request an administrative modification of Conditional Use Permit CUP 10-
3501 (CUP) granted at the April 12, 2010 Planning Commission Meeting.
The CUP includes the following condition:
The maximum occupancy shall not exceed 344 persons as indicated on the
enclosed floor plan unless otherwise approved by the Planning
Commission.
Applicants request that the Commission modify this condition to allow a maximum
occupancy of 704 during any one service or event, which is the actual occupancy of the
building noted on the current Life Safety Plan. A floor plan depicting a Life Safety Plan
for occupancy of 704, prepared by Miller, Boskus, and Lack (Architects) is attached as
Exhibit A. This Life Safety Plan was prepared before the building was finished and
occupied. The Architects are currently reviewing the Life Safety Plan to determine
whether the occupancy noted on the Life Safety Plan should be revised upward.
Applicant requests that the condition be amended to read as follows:
The maximum occupancy shall not exceed 704 persons unless otherwise
approved by the Planning Commission.

The proposed amendment will not adversely affect the public interest and will not result
in the Church's use of the property being incompatible with adjacent properties and other
property in the district.
In the original CUP application, it was incorrectly stated that the maximum number of
anticipated patrons will be 344 during peak hours. In reality, this was the number of
patrons anticipated for the Sanctuary area of the building and did not allow for the
number of simultaneous occupants in other areas of the building.
The Church held its first worship services on January 16, 2011. Initial attendance and
subsequent growth has been much greater than anticipated, and the Church is now
conducting 4 services weekly, all on Sundays at 8:30 a.m., 10:00 a.m., 11:30 a.m., and
6:00 p.m. Average weekly attendance at each worship service is shown on Exhibit B.
Services held at irregular times around Easter and Christmas are not included. The 10:00
a.m. service is the highest attended with average attendance currently at 665 since the
fourth service was added. The Church anticipates that the 10:00 am service will continue
to be the highest attended service for the foreseeable future. The attendance numbers
include approximately 70 church staff and volunteers who arrive prior to and depart after
peak traffic flow and park off site at Harps on North Colorado Drive.
The Church utilizes a traffic control plan staffed by 2 law enforcement officers and 10
volunteers per service, during the two peak hours of services, to maintain safe traffic
conditions, to keep traffic flowing as smoothly as possible, and to minimize any
inconvenience for nearby residents. Exhibit C is an aerial photo showing traffic flow to
the various parking lots, the location of traffic control personnel, and designated
pedestrian crossing areas. The church monitors the effectiveness of its traffic control plan
and makes adjustments when appropriate and when larger than normal attendance is
expected.
The church as a total of 251 parking spaces, on site and pursuant to written agreements,
to adequately accommodate the 704 people attending during the peak service. The offsite
parking agreements were previously approved as part of the CUP by the Planning
Commission. In addition, the Church has recently reached an oral agreement with
Airways Freight, located west of the Church at 3489 West Wedington Drive, for 117
additional spaces, which is in the process of being documented. The church also has
access to in excess of 100 spaces at Harps on North Colorado Drive under an oral
agreement. Our total number of 251 parking spaces on site and under written agreements
complies with the City's parking ratio that requires at least 123 spaces. The City's parking
ratio for a church is 1 per 4 seats in the main auditorium or 1 per 40 sq. ft. of assembly
area
To accommodate growth, the Church has added services when attendance pushed us to
do so. The Church began operations with two services, added a third service on February
20, 2011, and added a fourth service on August 21, 2011. The church is considering
continuing this method of managing growth in the near term. Under the hours of
operation approved in the CUP, one additional service could be added on Sunday

afternoon. Before adding additional services, the Church has and will continue to
encourage attendees to shift from services that are near capacity to lesser -attended
services. However, such requests generally have only limited effect due to strong
preferences for particular worship times and difficulties with worshipers rearranging their
schedules.
For the longer term, if and when appropriate to accommodate additional growth, the
Church will consider the following alternatives:
1. Asking people to move to less crowded services;
2. Adding services on days other than Sunday and Wednesday;
3. Relocating to a location in the vicinity that world accommodate more people
during prime worship times;
4. Move small groups (Sunday School classes) to available space in a nearby
building; and
5. Launching one or more additional locations somewhere beyond the
immediate drawing area of the current location, and anchored by core groups
from the membership of the current location.
The Church is not requesting authorization for any of these alternatives now. Any such
requests requiring approval of the Commission will be brought before the Commission if
and when the Church decides to pursue them.
The much faster than anticipated growth of the Church indicates that there is a very high
demand for the services the Church offers to the citizens of Fayetteville. Cross Church
Fayetteville desires to continue to grow and provide these services under safe, orderly
conditions that will enable us to cavy out our mission most effectively and provide
economic benefits to nearby businesses, while minimizing any inconvenience to our
neighbors. It is our sincere desire to be a blessing to the people around us.
Therefore Applicants respectfully request that the Commission modify the CUP to allow
a maximum occupancy of 704 as described above.

of the assigned areas first leaving the bulk of the center open for the longest
time...basically fill Handicap from the ends to the center.
• Position three is also responsible for moving North to South across the
driveway to move keep "NON DROP TRAFFIC" around the drop-off zone and
keep traffic flowing rapidly
• WHEN IT I5 TIME TO CLEAR TRAFFIC BETWEEN THE SERVICES THIS JOB

BACKGROUND:
February 8 and 22"d 2010 Planning Commission Meetings. This item was tabled at the February
8, 2010 and February 22, 1010 Planning Commission meetings while the applicant was
compiling all of the necessary shared parking agreements with surrounding property owners. The
applicant has obtained signed shared parking agreements providing enough parking to meet City
ordinance and re -notified the public for the April 12, 2010 Planning Commission meeting.
Property description and history: The subject property is located northwest of the Salem
Road/Wedington Drive intersection. A large scale development for the Shoppes at Wedington
(LSD 08-2903) was approved by the Planning Commission on April 14, 2008 for construction of
a 15,750 s.f commercial building with 68 parking spaces on the site. The request to extend the
approval of that development is also on the April 12, 2010 Planning Commission agenda.

Request: The applicant requests a conditional use permit to operate a church (Use Unit 4) in the

to 8 pm and Wednesdays from 4 pm to 8 pm. In addition, the building would be used for church
offices and other small group meetings during regular weekday business hours.
Public Comment: To date staff has received no public comment.
Parking: Fayetteville Unified Development Code Chapter 172: Parking and Loading requires a
parking ratio of I parking space per 40 square feet of assembly area. With the applicant's
proposal for a 4,908 square foot assembly area/sanctuary, this calculation would require 123
spaces, although only 68 are provided on site. The applicant proposes to provide off-site parking
through shared parking agreements with adjacent banks, and anticipates bringing forward minor
changes to the parking lot on-site to add more spaces. With the shared parking agreements the
overall number of parking spaces meet the minimum requirements. The approval of shared and
off-site parking is allowed only by conditional use, and is a part of the subject request.

RECOMMENDED MOTION: Staff recommends approval of CUP 10-3501 with the
following conditions of approval:

1. Planning Commission determination of compatibility with adjacent properties. Staff
finds the church use to be compatible in this area given that the property is located on a busy
commercial district along a state highway. The proposed church would be complimentary
and compatible with the surrounding commercial and multi family uses.

2. Planning Commission determination of shared parking agreement and off-site parking.
Staff finds the proposed shared parking with the adjacent banks to be an appropriate use of
otherwise vacant parking lots during peak church use on weekends and after business hours.
All of the required parking spaces for the church are within the required 600 feet of the
proposed site. There are some parking spaces on the Bank of the Ozarks property at 1170
North Salem Road that will be available to the church and are greater than 600 feet.
Pedestrians will be required to cross Salem Road, a Collector, to walk to the church.
However, given the shuttle service proposed by the church and flat grade of the surrounding

area staff finds that the shared parking agreements will function safely and adequately for
the proposed church.
a. To ensure pedestrian and traffic safety, shuttle service and other pedestrian safety
measures such as crossing guards, as indicated in the attached letter from the
applicant, shall be required as part of the church operation when the parking lot at
1170 Salem Road is used.
b. The three shared parking agreements submitted with this application shall be required
as part of the church use at this property. Should the shared parking agreements be
terminated or revised the church use on the property may be voided. With any
modification to the shared parking agreement, the church shall contact the Planning
Division for approval.
PLANNING COMMISSION DETERMINED IN FAVOR OF THIS CONDITION (04-12-10).
3. The maximum occupancy shall not exceed 344 persons as indicated on the proposed
floor plan, unless otherwise approved by the Planning commission.
4. The hours of operation shall be limited as follows:
a. Primary church services: Sunday 8 a.m. to 8 p.m.; Wednesday 4 p.m. to 8 p.m.
b. Regular office hours 7 a.m. to 6 p.m. weekdays.
c. Special activities and accessory church use or events based on ministry needs.
5. Conditions of approval for LSD 08-2903 Shoppes at Wedington apply to the
development of this site. Modification to the site or building plans already approved
shall be reviewed in compliance with the Unified Development Code.
6. The exterior elevations for the building on this property shall be required to comply
with the City's Commercial Design Standards. This applies to any revisions to the
exterior elevations of the previously approved LSD 08-2903 Shoppes at Wedington that
may be needed in the future.
7. The proposed church use shall be in compliance with the noise ordinance.
8. Any proposed outdoor lighting or those which may be installed in the future shall meet
the requirements of the Outdoor Lighting Ordinance. A lighting plan and details shall
be required for review prior to installation.
9. All trash receptacle(s) utilized by this structure shall be screened on all sides with access
not visible from the street or adjacent properties, in accordance with City ordinance.
10. Any proposed signs for the church shall be in conformance with the Sign Ordinance
and permitted prior to installation.

163.02. AUTHORITY; CONDITIONS; PROCEDURES.
B. Authority; conditions. The Planning Commission shall:
1. Hear and decide only such special exemptions as it is specifically
authorized to pass on by the terms of this chapter.
2. Decide such questions as are involved in determining whether a
conditional use should be granted; and,
3. Grant a conditional use with such conditions and safeguards as are
appropriate under this chapter; or
4. Deny a conditional use when not in harmony with the purpose and intent
of this chapter.
C. Procedures. A conditional use shall not be granted by the Planning Commission
unless and until:
1. A written application for a conditional use is submitted indicating the
section of this chapter under which the conditional use is sought and
stating the grounds on which it is requested.
Finding: The applicant has submitted a written application requesting a conditional
use permit to operate a church (Use Unit 4) in the C-1 zoning district and for
shared and off-site parking.
2. The applicant shall pay a filing fee as required under Chapter 159 to cover the
cost of expenses incurred in connection with processing such application.
Finding: The required filing fee has been paid.
3. The Planning Commission shall make the following written findings before a
conditional use shall be issued:
(a.) That it is empowered under the section of this chapter described in
the application to grant the conditional use; and
Finding: The Planning Commission is empowered under §161.17(B)(2) to grant a

conditional use permit to allow for Use Unit 4. The Planning Commission is
also empowered under §172.05(C)(3)(d) and §172.06(C) to grant a
conditional use permit to allow shared and off-street parking that can not be
provided on the same lot as the principal use due to existing buildings, but
not more than 600 feet distant.
(b) That the granting of the conditional use will not adversely affect
the public interest.
Finding: Granting the conditional use will not adversely affect the public interest. The
property is zoned commercial, is located on a busy commercial thoroughfare
and surrounded by commercial and multi -family development, including several
immediately adjacent banks, a grocery store, restaurants and other mixed
commercial uses with varying hours of operation. Under the current C-1 zoning,
the property could be used for a variety of commercial uses including a grocery
store, video rental store, gas station, drive-in restaurant, which would likely
generate more traffic, noise, odor and glare than the proposed use as a church.
The hours of operation for these permitted facilities would not be limited. As
outlined in the staff report, the church facility would operate under typical
church service hours with primary peak hours on Sundays mornings and
Wednesday evenings. The proposed church use would be compatible with and
complimentary to the surrounding mix of uses and would provide a valuable
service to the neighborhood and community as a whole.
The applicant proposes to provide a majority of their required parking on-
site (68 out of 123 required spaces will be onsite), and for some of their
required parking off-site (55 out of 123 required spaces will be offsite),
utilizing shared parking agreements with the adjacent banks. Copies of these
shared parking agreements have been attached to this staff report. Staff finds
that with these shared parking agreements and the proposed on-site parking
adequate parking for the church will be provided and church users can
easily walk or be shuttled by the church to the building as indicated in the
letter provided by the applicant. The exact parking numbers are provided in
Finding No. 3(C)(ii)(b). Shared parking between intermittent uses with non -
conflicting parking demand is encouraged by City ordinance. City ordinance
makes specific makes reference to shared parking between a church and a
bank, as proposed in the subject application. The proposed shared and off-
site parking meets the intent of the ordinance and will not adversely affect
the public interest.
(c) The Planning Commission shall certify:
(i)
Compliance with the specific rules governing individual
conditional uses; and
Finding: The applicant has complied with specific rules governing these conditional
use requests.

(ii) That satisfactory provisions and arrangements have been
made concerning the following, where applicable:
(a.) Ingress and egress to property and proposed
structures thereon with particular reference to
automotive and pedestrian safety and convenience,
traffic flow and control and access in case of fire or
catastrophe;
Finding: The subject property will contain two access drives from Wedington Drive
that were approved as part of the recent large scale development (LSD 08-
2903), and will meet the minimum driveway design standards of the Unified
Development Code. The two adjacent banks at 3430 and 3474 Wedington
where shared parking is proposed are immediately adjacent to the subject
property. These sites are easily accessible from the proposed church by
pedestrians walking across parking lots or along the sidewalk adjacent to
Wedington Drive. The proposed shared parking at 1170 Salem Road is a
little more challenging for a pedestrian as it is located across Salem Road and
would require a pedestrian to either cross Salem at the signalized crosswalk
at Wedington and Salem Roads, or by a mid -block non -signalized crossing.
However, the church proposes a shuttle service from this remote parking
area to the church, and pedestrian safety measures such as crossing guards
to safely guide pedestrians across the street. With the incorporation of these
provisions, staff finds that this third site is also suitable and safe for
pedestrians. The eastern portion of the 1170 Salem Road site are beyond 600
feet of the church, however, the minimum required number of spaces are
within 600 feet. It is not uncommon to see churches in the downtown utilize
parking areas across streets, even College Avenue, during peak times on
Sunday.
(b.) Off-street parking and loading areas where required,
with particular attention to ingress and egress,
economic, noise, glare, or odor effects of the special
exception on adjoining properties and properties
generally in the district;
Finding: As discussed in finding 3(b) staff finds that off-street parking and loading is
adequate for the proposed use. As shown in the parking chart below, with the
three shared parking agreements there are more then enough parking
spaces.
Staff does not find that the proposed use would result in adverse impacts to
economic, noise, glare, or odor to surrounding properties in this busy
commercial district along a state highway.

Finding: Solid waste service will be required to be provided in accordance with City
code. Dumpster enclosures will be required to be screened when visible from
public right-of-way in accordance with ordinance.

Finding: Water and sewer lines would be extended at the time of development to serve
the subject property.

Finding: The proposed parking lot would be required to comply with the screening
and buffering requirements of Chapter 177.04 Site and Parking Lot
Landscape Standards at the time of development.
