Meeting Minutes
March 13, 2007
A meeting of the Fayetteville City Council Water & Sewer Committee was held on March 13,
2007 at 6:30 p.m. in Room 326 of the City Administration Building located at 113 West
Mountain Street, Fayetteville, Arkansas.
MEMBERS PRESENT: Alderman Kyle Cook, Chair; Alderwoman Adella Gray;
Alderman Robert Ferrell; Alderman Lioneld Jordan

Alderman Cook called the meeting to order.
1. Approval of the Minutes
Alderman Jordan moved that the minutes of the February 27, 2007 Water and Sewer
Committee Meeting be approved as submitted. Alderwoman Lucas seconded the motion and it
passed unanimously.
2. WSIP Update
David Jurgens said there have not been many changes since the last update. The Committee was
presented with an outline of each project and percentage of completion.
a. Subproject EP -1, Noland WWTP Wet Weather Improvements
David Jurgens said bids were opened on this subproject but issues were found that would cause
the bids to be rejected. Staff resealed the bids and will rebid the project. Advertisement for the
rebid will be Thursday, March 15. He explained that an item was eliminated from the project that
was helpful but not essential, saving an estimated $80,000 to $100,000. This item should come
back to the Committee at the next meeting.
Alderman Cook asked how long this would delay the project.

David Jurgens said it might delay the project a month but no more. He said the timeline he has
worked out puts the project coming before the Committee the first part of April
b. Beaver Lake Watershed Nutrient Reduction Study
David Jurgens said there has been no change in this project.
c. Subproject WL -7, Gregg Avenue Lift Station
David Jurgens said bids will be opened on this project on March 20. He will submit a shell
packet on this project to the Council. If the bids come in as expected, he will walk-on the
completed bid packet at the Council meeting. If there are any problems, the item will be pulled
until staff has had time to evaluate the bids.
Alderman Cook asked a question not pertaining to this agenda item. He said he was asked today
about the status of the line work along the Mudd Creek Trail and wondered when that would be
completed.
David Jurgens said there are two parts to the contract for work along Mudd Creek Trail.
Everything west of College Avenue has been completed. One part of the contract is between
Gregg and College Avenues, behind Wal-Mart; the second is between College Avenue and Old
Missouri Rd. The trail behind Wal-Mart has already been reopened. They should be finished
laying the pipe on the portion near the trail between College Ave. and Old Missouri Rd. within a
week and a half. They will then be doing the cleanup on that portion and it will probably be three
to four weeks before that part of the trail will be open. A crew is working across the gold course
right now because of the tight time constraint to get across that area. Another group is working
on the tunnel going under the creek in the vicinity of Hwy. 265 near Old Wire Rd. The entire
contract should be at substantial completion by the end of April or first week of May.
Another item mentioned that was not on the agenda involved OMI. David said he sent out the
monthly report from OMI on Friday. The numbers for percentage of design flow did come down
in February. We are still over design capacity at 110% but that is a lot less than the 126% in
January.
d. WSIP Farmington Area Work
David Jurgens said Farmington has submitted their application to Arkansas Natural Resources
Commission. Mr. Jurgens spoke with officials at ANRC today and they are expecting no
problems. We are waiting for approval of the contract and Farmington has a referendum
occurring in May to discuss financing options. The design is proceeding. The wetlands person
walked all the lines today to determine what, if any, changes would have to be made to the Corps
of Engineers permit. Mr. Jurgens said there are actually two fewer creek crossings than were on
the original design done in 2001. This will require a small amendment to the Corps permit but
staff is not expecting that to be a problem.
3. Sanitary Sewer Rehabilitation Project Update

a. Basins 1-5, 18 & 19 Sewer Rehab
David Jurgens said there is no functional change on this project.
b. Farmington Area
David Jurgens said we did get the approval of Arkansas Natural Resources on the Farmington
area sewer rehab.
4. 36" Water Transmission Main Rehabilitation
David Jurgens said we are getting ready to cut this in next week. We will be shutting the line
down and cutting in a valve to isolate the area where the work is taking place. The contractor is
working very closely with the Water & Sewer Division to make sure things are as smooth as they
can be. Old Wire Road will be closed for periods of time while this is being done. The water line
runs along Old Wire Rd. from Old Missouri Rd. to where Old Wire runs into Mission and then
all the way to Gunter. Staff will issue a press release about these potential road closings.
In response to a question from Alderman Cook, David Jurgens said staff reviewed the work
that needed to be done on the surge tank. They determined that it will be best to use a thick,
epoxy type coating on the inside of the tank, coating the bottom 18" of the sides of the tank as
well as the floor. We are receiving bids this week on this project. The tank will be structurally
sound with that repair. The project should be executed within three weeks. He said this is a
permanent solution. There will be water in the tank at all times so the lower portion should
always be underwater.
5. Farmineton Wastewater Service Aereement
David Jurgens said the last version of this agreement was sent out to all parties on Friday,
March 9. The agreement was reviewed by the Farmington City Council last night (March 12).
From that meeting it was determined that there was one item they wanted to eliminate. He said
we are happy to make this change. The change is in Section 8. He said we will cut refund checks
to Farmington customers who are currently on the system and those will be the only checks cut.
We will then advertise and do everything we can to make contact with any customers who have
been on the system but have discontinued that service.
In response to a question from Alderman Jordan, David Jurgens said the total amount for the
Farmington customer refund is roughly $350,000. When divided by number of customers, the
amount of refund per customer should be around $200. This will go back to Feb. 9, 2004 which
is the date these rates came into affect. He said that the refund process for all outside -the -city
customers will be executed simultaneously.
In response to a question from Alderman Ferrell, David Jurgens repeated that refund checks
will be cut at the same time for all the customers who are classified as outside -the -city
customers. The agenda for this meeting outlined the tentative schedule for this item. The contract
will need to go to the full Council for approval.
In response to a further question from Alderman Ferrell, David Jurgens said HDR is now
working through the final details on the new rates. He has to get some information on capital

improvements for water to them and he hopes to get that done this week. They are expecting to
have semi-final information in April. Because of David's military duty schedule, the plan is to
bring this information forward in May and have final decisions made in June or early July.
David Jurgens said the section of the Farmington contract that will be changed is in section 8 of
the contract. He said the second paragraph on page 21 will be changed to apply to Fayetteville
instead of Farmington. The first sentence of the first paragraph will remain and the remaining
two sentences of the paragraph will be deleted. Essentially Fayetteville will send checks out to
all the customers who are currently Fayetteville customers who reside outside the city limits and
will make a good -faith effort to inform any previous customers of this refund. Staff will make
sure we are complying with the Unclaimed Property Act and any other applicable laws. Mr.
Jurgens requested that the Committee move this contract, with change mentioned, forward to the
City Council.
Alderman Jordan moved that the Farmington contract be forwarded to the City Council for
approval. Alderman Gray seconded the motion and it passed unanimously.
6. Greenland Sewer Issues
David Jurgens said Greenland would like for Fayetteville to purchase their system. As stated at
the last meeting, Mr. Jurgens told them we would not consider taking ownership until the system
is out of debt and is capable of handling adequate flows, etc. There has not been much change
except that there was a great deal of discussion at the meeting held in Greenland last night
regarding a moratorium. Greenland also approved the large Greenland Hills development on the
hilltop south of Greenland on Napier as it was presented to them (with a STEP system). This
development has not yet received ADEQ or Health Department approval.
In response to a question from Alderman Ferrell, David Jurgens clarified an item on the OMI
monthly report regarding septic haulers' application package. He said these are haulers that
pump out septic systems. That load is delivered to the Noland Plant and they pay us for the
service of disposal.
7. Sehedulina the Next Rater/Sewer Committee Meeting
The next meeting of the Water and Sewer Committee is scheduled for April 10, 2007.
