MEMBERS PRESENT: Alderman Kyle Cook, Chair; Alderman Robert Reynolds; Alderman Lioneld Jordan MEMBERS ABSENT: Alderman Robert Ferrell STAFF PRESENT: Ron Petrie, Tim Conklin, David Jurgens, Chairman Kyle Cook called the meeting to order. This meeting was rescheduled from November 30, 2006 due to the weather and that agenda was used for this meeting. Alderman Reynolds explained that Alderman Ferrell is out of town on business and will not be present. 1. WSIP Update a. Subproject WL -5 David Jurgens said the WL -5 project is substantially complete. Arkansas Natural Resources finished their final inspection last week. They passed the project with no punch list items. We are now completing the final paperwork. The project will come in slightly under the budgeted amount. Mr. Jurgens informed the Committee that a tour of the Westside WWTP is scheduled for Thursday, December 7, 2006. The van will be leaving City Hall at 1:30 p.m. b. Beaver Lake Watershed Nutrient Reduction Study David Jurgens said we received seven proposals on this study. Staff met and came up with a short list of three. Property Sale to Ozarks Electric David Jurgens said Ozarks Electric has been talking to the City for over a year about purchasing four acres of the Westside WWTP property and a permanent access easement to the property. He said they have a large transmission line coming through our site and they would like to hook the four acres onto part of that transmission line. The parcel is immediately adjacent to the wetlands but does not encroach on the wetlands. The amount being discussed is $35,000 an acre which, given the proximity to the WWTP, is probably the best price we will get. The land immediately south of this acreage is being retained for future plant expansion as necessary. Alderman Cook asked if there is an issue with timing on this since the appraisal process has taken longer than two months to complete. David Jurgens said he doesn't believe there is an issue of time. The question is, given the fact that the amount being discussed is higher than the appraisal done a year ago for another sale, do we want to spend the $1,500 to $2,000 to have another one done or do we want waive the ordinance and not do the appraisal. In response to a question from Alderman Reynolds, David Jurgens said this acreage has not yet been surveyed and marked off. The question is do we want to go ahead and get an appraisal and then have this area surveyed, or do we just want to recommend to the Council that the ordinance be waived and move forward with the sale of the property. Alderman Reynolds said with the price quoted he would recommend that we proceed but he thinks they need to negotiate with the aldermen from Ward 4. Alderman Jordan said he would like to meet with them. David Jurgens said he would set up a meeting with Alderman Jordan, himself and a representative of Ozarks Electric before the Council Agenda setting session next Tuesday. The discussion will then come back to the Committee. d. East Side Line Rork Construction Phase Engineering David Jurgens brought forward a change order with Garver Engineers for the last of the major engineering construction contracts involving construction phase services for the line work on the east side. These are the lines that go by gravity to the Noland plant. This contract is for $999,857 and the total dollar value of the project is a little over $23 million. Staff and Garver Engineers have discussed the contract and scope of work. Mr. Jurgens feels this is a good value and a necessary contract. In response to a question from Alderman Cook, David Jurgens said this amount is a little higher that what was originally estimated due to some redesign that was done because the original designs were done over a year ago. The original estimate, including contingency, was around $950,000. Alderman Jordan moved that contract change order #2 with Garver Engineers be forward to the City Council for approval. WSIP Farmington Area Work David Jurgens said the value engineering for the Farmington area work is happening now. Some very interesting ideas are being discussed and we may see some proposed changes to how we do business on this. Farmington also has representatives in the value engineering process and we should have some recommendations by tomorrow afternoon (Wed., Dec. 6, 2006). In response to a question from Alderman Reynolds, David Jurgens said there will probably be some money savings. He said with the recommendations being discussed we will either save money of get added value for the money spent. f. Easement Update David Jurgens presented an update on the status of easements being obtained on the east side. EL -2 is the first item on which we will go out to bid. There are 20 easements remaining out of the total of 51. Most of these are widening of existing easements as opposed to acquiring new easements because we are going parallel to the existing gravity line. 2. Sanitary Sewer Rehabilitation Proiect Update a. Basins 1-5, 18 & 19 Sewer Rehab David Jurgens said he had brought forward a change order several weeks ago for a re-route around Doc Murdocks. The Committee gave approval to send it to the Council and it is on the agenda for the second meeting in December. He explained that the sewer line that passes under Doc Murdocks was built around 1907. We want to get the sewer line rerouted so it doesn't run under the buildings to avoid problems should the sewer line need to be repaired. In researching this, they could find no existing recorded easements to this line. Staff is attempting to get the easements for free in order to install the sewer line. The line itself is 100 years old and all the sections to the left and right of it have been replaced or lined with Insituform. He explained the route staff has proposed and the request made by the owner of the property to put in an additional bend to allow room for placement of a future building. Staff agreed to this as long as the owner pays for the extra $40,000 the change will cost. Owner and staff are still negotiating. He requested authorization from the Committee to take this change order for T -G Excavating to the Council for the entire contract, including the extra $40,000 for the owner's requested reroute. We would then be reimbursed by the owner for that amount. The change order would be approved pending an agreement from the owner for the reimbursement and pending easements being recorded. Alderman Reynolds moved that the change order be forwarded to the City Council with approval being contingent on receiving agreement from the owner for reimbursement of the actual cost of construction, not to exceed $40,168.30 and receiving recorded easements. Alderman Jordan seconded the motion and it passed unanimously. b. Farmington Area David Jurgens said the preliminary design report and the categorical exclusion request have been sent to the State agencies and USEPA. We have not received the approval from EPA Region 6. We expect to bid the Farmington rehab project in February. 3. 2007 Water & Sewer Budget David Jurgens said the Water & Sewer Budget for 2007 was presented at the budget meeting on Saturday (Dec. 2). 4. Water Transmission Surge Tank Painting David Jurgens updated the Committee on this project. He said the contractor who is doing the painting is not interested in doing the work on the floor. Therefore, we will go out with a separate bid for this repair. The steel floor of the tank has pits that are deeper than was expected and that created a structural weakness in the integrity of the floor. We are expecting to just weld another floor over the existing floor. In response to a question from Alderman Reynolds, David Jurgens said that painters who work in this sort of environment have a special kind of expertise. The people we have used in the past for this kind of job have been out of Little Rock or Conway. He doesn't know if there are any local companies. The welding of the floor will have to be done in conjunction with the painting. He does believe we can find someone local to do the welding. 5. Sewer Service to Van Asche/Gregg Ave. Area in Johnson David Jurgens said a couple of years ago we received a request to provide sewer service to this area in Johnson. The area is south of Clear Creek and is in our water service territory. They were sent a letter by then -Water & Sewer Director Greg Boettcher stating the actions they must take in order to be able to bring this request to the Water & Sewer Committee. They have taken those actions and Mr. Jurgens is therefore bringing the item to the Committee. He submitted information to the Committee regarding the request. Dave Jorgenson of Jorgenson Engineers said the property in its entirety is 39 acres. The first part consists of around 10 acres on top of the hill. Van Asche runs east and west and intersects Ball Street. This land is just to the east of that intersection. There is a 6" Fayetteville water line on Ball Street. The request would be that the owner would pay for all expenses to bore under the tracks and under Gregg Ave. over to the line which leads directly the pump station located at Mud Creek. Alderman Cook said the City has had some problems in the past in approving this sort of request. Dave Jorgenson said the owners are going to do this project. The question is whether or not they tie onto the sewer line that links to the Fayetteville system or install a decentralized septic system. He reminded the Committee that impact fees will come into play on this development if it is tied to City sewer. In response to a question from Alderman Jordan, Dave Jorgenson said the development would consist of small offices and storage. 113 West Mountain 72701 (479) 521-7700 (479) 575-8257 (Fax) accessfayetteville.org City Council Water & Sewer Meeting Minutes December 5, 2006 Page 5 of 5 In response to a comment from Alderman Jordan, David Jurgens said the City of Fayetteville would have no control over the development other than water and sewer control. Alderman Jordan said he doesn't think he can make a decision on this without time to think it over. It was agreed that the item would be brought forward again at the next Water & Sewer Committee meeting for discussion. 6. Scheduling the Next Water/Sewer Committee Meetine.
