Roll Call The following items will be considered: Approval of minutes from the August 25, 2003 meeting. New Business: 1. PPL 03-13.00: Preliminary Plat(Lot 17, Steele Crsg.) was submitted by James Koch, P.E. of CEI Engineering Associates, Inc. on behalf of James S. Irwin, Irwin Saviers Company for property located in Steele Crossing, Lot 17. The property is zoned C-2, Thoroughfare Commercial and contains approximately 18.25 acres. The request is to develop the property into 5 commercial lots (lots 17C-G) of 1.82, 2.03, 2.04, 5.75 and 5.1 lacres with 1.50 acres for Phase I and II of Van Asche Drive. 2. LSD 03-21.00: Large Scale Development(Jones Motor Cars, pp 213) was submitted by Mandy Bunch, P.E. of EB Landworks, Inc. on behalf of Mr. Mike Jones of Whitfield Motor Co. /Jones Motorcars for property located at 3535 N. College Avenue. The property is located in the Design Overlay District, zoned C- 2, Thoroughfare Commercial and contains approximately 6.57 acres. The request is to construct a 4,678 s.f. Mercedes-Benz Center and a 13,009 s.f. Collision Center with 48 parking spaces proposed. 3. VAC 03-10.00: Vacation (Brickey,pp 409) was submitted by Charles Brickey on behalf of Tamara Breland Brickey for property located at 1765 Applebury Rd. The property is zoned RSF-4, Residential Single-family, 4 units per acre. The request is to vacate a 10' utility easement along lots 23, 24 and 25 of the Jackson's First Addition. 4. ADM 03-22.00: Administrative (Sloan Petition for Tree Ordinance Variance, Legacy Pointe Subdivision) Mr. Charles W. Sloan, the Developer of Legacy Pointe Subdivision off Double Springs Road, has requested an alternate method of compensation to the City of Fayetteville's Tree Escrow Account for the removal of trees on the above mentioned property. All interested parties may appear and be heard at the public hearings. Page 1.1 PPL 03-13.00 Page 2 Right-of-way being dedicated: Van Asche Drive requires 70 feet of right-of-way as a Collector Street. Street Improvements Proposed: Extension of Van Asche Drive as a collector street(70 feet of right-of-way, 28-foot street with six-foot sidewalks on both sides). A cul-de-sac is proposed for the end of Van Asche, with curb, gutter and sidewalks to be constructed to City standards. Recommendation: Staff recommends approval of the proposed preliminary plat subject to the following conditions: Conditions to Address/Discuss: 1. Planning Commission consideration of a variance request for a cul-de-sac which is longer than 500 feet. Applicant proposes a cul-de-sac of approximately 910 feet in length. 2. Cross access between each lot shall be required. 3. No additional curb cuts onto Van Asche Drive other than those indicated on the plat shall be allowed without Planning Commission approval. For those lots on the cul-de-sac, one curb cut per lot shall be allowed. Shared access is recommended. 4. The cul-de-sac shall be constructed in accordance with City Code,with a paved surface. Curb/Gutter, storm drains, and sidewalk construction around the cul-de-sac shall occur along with the development of this subdivision. 5. Van Asche Drive shall be dedicated as a public street at the time of Final Plat. Construction of said street shall be in accordance with City Ordinances for a Collector Street. 6. Those lots fronting the West Mud Creek trail shall provide visual and physical pedestrian connections at the time of development. 7. The legend of the Preliminary plat shall reflect a coordinating hatched area and title that corresponds to the preservation area shown on the drawing. 8. The removal of trees on the proposed Lot 17D shall be prohibited. The existing grove shall be saved with protective measures in place until future development plans demonstrate that their removal is essential to the project's design. 9. The Trails and Greenways Coordinator shall approve the design and location of the drainage pipe and outflow structure for the detention pond prior to approval. 10. A floodplain development permit shall be required prior to any construction within the floodplain, in addition to grading and drainage permits. College Avenue. The property is located in the Design Overlay District, zoned C-2, Thoroughfare Commercial and contains approximately 6.57 acres. The request is to construct a 4,678 s.f. Findings: Proposal: The applicant is requesting to construct a new Mercedes-Benz Center and a detached Collision Center to the north of the existing Jones MotorCars automobile dealership on College Avenue. This particular site lies within the Design Overlay District. The proposal limits additional site development to the north of the existing dealership, at approximately the existing north entrance. Surrounding Land Use/Zoning: Direction Land Use Zoning North Merrill Lynch, Proctor& Gamble C-2, Thoroughfare Commercial South Jones MotorCars, Lewis Ford C-2, Thoroughfare Commercial East Webster University, Commercial C-2, Thoroughfare Commercial West Vacant C-2, Thoroughfare Commercial Right-of-way being dedicated: Currently 40 feet of right-of-way from centerline exists on College Avenue (Hwy 71B). An additional 15 feet of right-of-way to reach the 55 feet from centerline is required by the Master Street Plan for a Principal Arterial. The applicant is requesting no additional right-of-way be dedicated with this proposal(see attached letter). Staff is not in favor of this request. Street Improvements: Staff is recommending that the developer install a 6-foot sidewalk for the entire length of the property frontage along College Avenue. Specific sidewalk location will need to be coordinated with the Sidewalk Administrator due to existing constraints. Design Overlay District Sec. 161.24. Design Overlay District(I-540 Highway Corridor). (D)Nonresidential site design and development standards. (1) Greenspace. A minimum of 25 feet of landscaped greenspace exclusive of right-of-way shall be provided along the highway right-of-way and any public street to which the development has frontage. Parking lots shall not encroach into the greenspace and shall be screened when abutting a required greenspace area. Trees shall be planted at the interval of one tree per 30 linear feet of greenspace area when practicable. Finding- The applicant has indicated the required 25 feet of greenspaces landscaped in accordance with City regulations for the Design Overlay District. This 25 feet, however, is measured from the existing right-of-way line, without the required dedication amount. Staff is not in support of this request. The project location is currently vacant, and a number of opportunities are available within the proposed structures,parking/drive aisle arrangements, and site boundaries to meet this minimum requirement without undue hardship being placed upon the developer. Staff is recommending the minimum 55 feet from centerline right-of-way be dedicated as required, with 25 feet of landscaped greenspace exclusive of the right-of-way, as the City ordinance dictates. (2) Signage. (a) Nonresidential free-standing signs. (i) Each separate nonresidential lot will be allowed a single ground-mounted (monument) sign located on the building site. In the case of lots with double frontage,two ground-mounted(monument) signs shall be allowed. (ii) The sign shall be a maximum of six feet high, 75 square feet in area, and setback a minimum of 10 feet from the property line. (b) Wall signs. One wall sign maybe installed per business. Sign area shall not exceed 20% of that wall area or 200 square feet,whichever is less. A second sign may be allowed if it is determined that the structure has more than one front facing a street or highway right- of-way. (c) Illumination. Only indirect lighting may be used for illumination of all signs. (d) Multiple tenants. The owner of the building shall be responsible for the provisions of one monument sign with sign area for multiple tenants. Content of monument and wall signs shall be limited to the name of the business. Advertising shall not be permitted on the structure,wall sign or monument. Finding: The applicant is currently proposing two wall signs, a Mercedez-Benz logo with "Jones" text and a sign along the east elevation stating "Mercedez-Benz Center." The Mercedez-Benz dealership is permitted one wall sign for the structure's frontage onto Hwy 71B, in accordance with Design Overlay District requirements. Any variance from this requirement requires Planning Commission approval and review/approval by the Board of Sign Appeals. The applicant is currently indicating one monument sign to be utilized, in accordance with all size and area requirements as regulated by the Design Overlay District. A pylon sign currently exists on-site, to the south of the proposed development. Staff is recommending that a single ground-mounted(monument) sign a maximum of six feet high, 75 square feet in display surface area, be allowed on the site, a minimum often feet from the right-of-way line. If the monument sign option is utilized, the pylon sign must be removed. Pylon signs are not allowed within the Design Overlay District. The existing pylon sign is a non- conforming structure; the sign is allowed to remain in its current state without any considerable alterations. Should the applicant retain the use of the pylon sign, Staff recommends that the monument sign not be permitted. (3) Curb cuts. One curb shall be allowed per 200 feet of frontage. No curb cuts shall be allowed within 250 feet of any intersection. Finding: An existing curb cut is proposed to be utilized to serve the new development. No additional curb cuts along College Avenue are requested by the applicant. (4) Lighting. Parking lot lighting shall be designed and located in such a manner to preserve the scenic appearance of the corridor. Lighting shall be shielded and directed downward to the parking lot and light spread shall not reflect into the adjacent neighborhood. Lighting shall not exceed 35 feet in height and shall utilize sodium lighting fixtures. Finding: The applicant is requesting a waiver to allow for the use of metal halide lighting fixtures, as opposed to the sodium lighting fixtures required by ordinance. Staff is in support of this waiver request,finding that it is consistent with the approved lighting for automobile dealerships within the City. All lighting shall meet the IESNA standards for illumination of automobile display areas and shall be a maximum of 35 feet in height, shielded and directed downward, utilizingfull cut-offfzxtures. (5) Exterior appearance. All structures shall be architecturally designed to have front facades facing all street and highway right-of-way. An elevation drawing shall be submitted for each side of the building that faces a street or highway. Staff is in support of the proposed elevations, finding that the elevations submitted indicate a well-articulated structure facing the street right-of-way. The Planning Commission must also make a determination of compliance with Commercial Design Standards with regard to these particular structures. (6) Building material. Buildings shall be constructed of wood, masonry, or natural looking materials. No structures shall be allowed that have metal side walls UNLESS such metal siding is similar in appearance to wood, masonry, or natural looking material. Finding: The applicant has submitted a materials sample board indicating the color and materials to be utilized for the proposed buildings. Primary materials include red brick, stucco, split face block and pre-cast concrete. (7) Site coverage. Twenty-five percent (25%) of the site shall be left in open space. Eighty percent(80%)of the open space shall be landscaped which may include ponds and fountains. Finding: The applicant has complied with this requirement. (8) Optional fencing. All fencing shall be constructed of wood, masonry, or natural looking materials. No optional fencing shall be located within the greenspace required by Section (13)(1). No metal fencing shall be allowed except in the following cases: (a) Wrought iron fencing. (b) If other types of metal fencing are necessary, for security purposes,they may be used if the area is first fenced off with a view obscuring natural or natural looking fencing material. The metal fencing shall be placed inside the view obscuring fencing, and the view obscuring fencing shall be at least the height of the metal fencing. Finding: The applicant has complied with this requirement. (9) Outdoor storage of material and equipment. All outdoor storage of material and equipment shall be screened with natural vegetation. Finding: The applicant has complied with this requirement. Pedestrian access shall be provided from the street to the entrance of the structure by way of a designated trail or sidewalk. (b) Multi-modal. Multi-modal access may be required on nonresidential sites within the Design Overlay District. (For example: The provision of bus stops, bicycle racks, parking stalls for car pools, and bicycle and pedestrian walks and trails). Finding: The applicant proposes providing two bicycle racks for the new development. The . recommended sidewalk construction along College Avenue will also accommodate pedestrian traffic in a more accessible manner. (E) Nonresidential developments and multiple building sites. In the case of nonresidential development involving multiple building sites,whether on one or more platted lots,the above- described regulations shall apply to the development as an entire tract rather than to each platted lot. Finding: The applicant is proposing to construct new structures on a portion of a site currently developed as Jones MotorCars. All of the structures will be located on one common platted parcel of land. City Ordinance thus requires that the development be reviewed for the site in its entirety. The existing Jones MotorCars parking lot is a non- conforming structure, in that it does not comply with current City codes for interior landscape islands,parking lot screening from adjacent right-of-way, and greenspace requirements, and sidewalks. The Unified Development Code requires that a percentage of the existing dealership must be brought into compliance with current City Ordinance requirements with regard to parking lot landscaping (§172.08). This is based upon the percentage ofnew structure added to the existing dealership structure, on a graduated scale. When the houses were built in this sub-division, during the late 50's and early 60's, different easements were used to lay the water and sewer lines. This house was built in 1963, by the orginal developers of the re-plat. We believe the easement, not just across the property, but almost through the center of the house, should of been vacated before this house was built. When Tamara bought this house the former owners did not mention the easement, nor did the abstract company or the realators. We want to make improvements to our home, perhaps a small addition, but cannot because of this easement.
