The property is zoned R-O, RESIDENTIAL OFFICE and contains approximately 2.68 acres.The request is a second extension of the approved Large Scale Development, LSD 07-2574. Planner: Jesse Fulcher BACKGROUND Property Description: The subject property is located at the northwest comer,of Joyce Boulevard and Vantage Drive. The 2.68-acre tract is zoned R-O, Residential Office. Background: The original Large Scale Development request was approved by the Planning Commission on July 23,2007 for the construction of a 21,613 sq. ft.bank building with 76 parking spaces. However, a conditional of approval restricting direct access to Joyce Blvd.was appealed to the City Council. Therefore, the final approval date was August 07, 2007. The Planning Commission granted a one-year extension(ADM 08-3066)to August 07,2009 to obtain all required permits to begin construction. However,the applicant has stated that conditions in the economy and market have caused the project to be delayed on the bank's construction schedule. . Proposal: The applicant requests a final extension for the approval of the Large Scale Development for one year, to expire on August 07, 2010. The Planning Department received the applicant's extension request on August 5,2009,within the required one year time limit. Should this extension be granted, all permits necessary for construction are required to be issued before the one-year extended deadline. If the permits are not issued prior to August 07,2010,all of the approved plans for the project shall be rendered null and void. RECOMMENDATION Staff recommends approval of ADM 09-3411, the requested extension to LSD 07-2574 (Liberty Bank), with the following conditions: 1. The applicant shall be allowed until August 07, 2010 to receive all permits and approvals required to complete construction of the development or project. If all permits have not been received by this time, the Large Scale Development approval shall be revoked. All other conditions of approval LSD 07-2574 shall remain applicable. DISCUSSION The City of Fayetteville Unified Development Code(UDC)Section 166.20(B)(4)gives the Planning Commission authority to extend approval of a large scale development prior to the expiration of any allowed extension period (maximum of two years from the date of original approval). In order to extend this approval,the applicant must: (1)request the extension prior to the one year time limit, and (2) show good cause why the tasks could not reasonably be completed within the normal one year. If the one year extension is granted, it is within this time that the applicant shall receive all permits and approvals as required by City, State,and Federal regulations to start construction of the development or project. Extensions beyond three (3)years from the original date of approval shall not be permitted. (1) The applicant has submitted the extension request to the Planning Division on August 05, 2009, prior to the one year time limit ending August 07, 2009. (2) The applicant has stated that conditions in the economy and market have caused the project to be delayed on the bank's construction schedule. Prior to the expiration of the one(1)year time (A) Applicability. The provisions of this section limit,an applicant may request the Zoning and apply to all of the following plans and permits: Development Administrator to extend the period to accomplish the tasks byup to one(1) (1) Preliminary plats; additional year. The applicant has the burden to show good cause why the tasks could not (2) Planned zoning district developments; reasonably be completed within the normal one (1) year limit. Extensions that are not (3) Conditional uses; permitted administratively may be requested of the Planning Commission within ten days of (4) Large-scale developments; the final administrative decision. Planner:Andrew Gamer BACKGROUND Property Description and History: The subject property contains 14.36 acres and is located at the southeast corner of Mount Comfort and Salem Road. Salem Road is shown on the Master Street Plan as a Collector Street to extend south through the subject property. On July 3,2008 the Subdivision Committee approved LSP 08-3025 to subdivide the 14.36-acre tract into Tracts of 2.21 and 12.15 acres respectively. Proposal: The applicant requests to extend the approval of the Lot Split for one year, to expire on July 3, 2010. The Planning Division received the applicant's extension request on July 10, 2009, within the required 18 month time limit. Should this extension be granted,the lot split is required to be recorded before the one-year extended deadline. If the lot split is not recorded prior to July 3, 2010, the lot split approval shall be rendered null and void, or the applicant may apply for a final extension. RECOMMENDATION Planning Staff recommends approval of ADM 09-3412, the requested extension to LSP 08-3025 (Pathway Baptist Church), with the following conditions: 1. The applicant shall be allowed until July 3,2010 to to record the lot split. If the lot split has not been recorded by this time, the approval shall be revoked; the applicant does have the ability to apply for one additional extension within that time frame. 2. In order to extend this approval,the applicant must: (1) request the extension prior to the one year time limit, and (2) show good cause why the tasks could not reasonably be completed within the normal one year. If the one year extension is granted, it is within this time that the applicant shall receive all permits and approvals as required by City, State, and Federal regulations to start construction of the development or project. (1) The applicant has submitted the extension request to the Planning Division on July 10,2009, prior to the 18 month time limit ending on January 3, 2010. InJune 2002,a 15' Water and Sewer Easement was conveyed from the University of Arkansas to the City(Right of Way Grant filed at 2002-097867). The University of Arkansas is now planning a project on the property at 10 N. Garland Ave and is requesting to reduce the size of the Easement from 15'to 10'. At a meeting with Andrew Garner and Matt Casey on July 6,2009 it was determined that a IO'Easement would be sufficient,except where at the northernmost end where it would need to be wider to maintain a minimum of 10'from the centerline of the existing sewer line. A 10'Utilities Easement will be conveyed along the Easterly line of Garland Ave(the northerly end of this new Easement will be larger than 10'to maintain a minimum distance of 10'from the centerline of the existing sewer line) to replace the vacated 15'Easement and to clean up the discrepancies in the prior Easement reservations and conveyance.
