Six (6) projects have been completed; most of the other projects are underway and are in various stages of design or construction. A summary of the status of these projects follows. 1) Wilson Park/Washington Willow Area Traffic Calming a. Project Summary/Status • Complete. Original Budget: $384,000 Final Cost: $205,000 2) Intersection improvements at Gregg Ave. and North Street a. Project Summary/Status • Complete. Original Budget: $1,082,000; Final Cost: $690,000 3) Zion Road (N. College to Vantage) a. Project Summary/Status • Complete. Original Budget: $2,540,000; Final Cost: $2,272,000 4) College Avenue (Rock to Maple) a. Project Summary/Status • Complete. Original Budget: $1,740,000; Final Cost: $1,841,000 5) Mount Comfort Road (1540 to Rupple Road) a. Project Summary/Status • Complete. Original Budget: $10,413,000; Final Cost: $10,220,000 6) Cato Springs Road (U of A Technology Corridor) a. Project Summary/Status • Project consists of reconstruction and widening to 2 and 3 lanes, with curb and gutter and sidewalks, from Hwy 7 1 B to Razorback Road. • Total Project budget: $6.02 million • Federal funding expected: $2.88 million • Construction Contract: $3,815,172 with Dean Crowder Construction b. Recent Actions: • The pedestrian bridge installation is complete. • The railroad crossing upgrade including new signal is complete as well. c. Upcoming Activities: • Installation of storm drainage piping, including installation of the box culvert drain crossings. Project Summary • Federally funded project that is intended to provide better access to the retail centers and restaurants in the Northwest Arkansas Mall area and to Washington Regional Hospital and adjacent medical park. • Federal Funds expected: $8 million • Total Project Budget: $10 million • 3 projects have been selected for funding in the project area by the Street Committee and City Council: Extension of Van Asche Drive from Gregg Avenue to Hwy 112, westbound "flyover" from Hwy 71B to Fulbright Expressway, and intersection improvements at Fulbright Expressway/Shiloh/North Hills Blvd. b. Roundabout Project: • The roundabout project is under construction by Sweetser Construction of Fayetteville. The Notice to Proceed was issued effective May 29th. The contract length is 8.5 months for final completion. Current and upcoming activities include: o Construction of the inner circle of the roundabout is complete. Traffic is currently using one lane of the roundabout, as construction continues. o The contractor is currently working on the Fulbright Expressway off-ramp, and on the "slip ramp" onto Futrall to Gregg Avenue. When completed, the slip ramp will provide access to Gregg Avenue via Futrall, bypassing the roundabout altogether. o Completion of the roundabout is expected in January, contingent on suitable weather conditions to allow asphalt paving and striping. c. Flyover Project: • The Highway 71B Flyover Project is under design by Jacobs Engineering of Fayetteville. Design is complete, and on October 8th, the City received Authorization To Advertise the project for bids. Current and upcoming activities include: o The construction contract with Emery Sapp and Sons has been approved, and work on the project is set to begin in January 2013. This will be an 18 month construction contract. d. Van Asche Drive: • Van Asche Drive is under design by City staff. Current and upcoming activities include: o Development of preliminary plans is nearing completion. o Property owners along the project have been contacted in preparation for beginning of easement and right of way acquisition. 8) Rupple Road (6th St. to Persimmon) a. Project Summary • Extension of Rupple Road as a 4-lane boulevard from south of Owl Creek School to 6th Street. • Total project budget: $8.155 million • Review of the conceptual alignment and cross sections is underway. • Property research is underway as well. 9) Garland Avenue(I540 to Howard Nickell Road) a. Project Summary/Status • Project includes widening to 5 lanes, with curb and gutter and sidewalks. Design firm: Jacobs Engineering • Estimated Project Cost: $3.66 million. Preliminary discussions have been held with the AHTD on this project regarding partnering opportunities to reduce the City's cost and possibly extend the project. Federal funding is also being pursued for the project. 10)Maple and Lafayette Street Historic Bridges a. Project Summary/Status • Funding in the amount of$1 million through the Federal-aid bridge program administered by AHTD has been secured. The project is in the design consultant procurement phase. b. Recent Actions: • Selection of McClelland Consulting Engineers of Fayetteville as the design consultant • A proposed scope and fee has been developed by the consultant and is being reviewed by City and AHTD staff. c. Upcoming Activities: • Review of the proposed contract with the City Council and AHTD. The following projects in the Bond Program will be designed, contracted, and administered by AHTD or its consultants/contractors. The schedules for these projects are established by AHTD based on their workloads and available funding. 11)Crossover Road (Hwy 265)-Mission to Joyce • Estimated construction cost was $15.4 million, City's share is 50% of cost,up to $7.7 million • AHTD letting date: September 2011; low bid received was $12,612,320.32. Change Orders to date reduce the contract amount by $257,000. Work on the roadway is continuing by the contractor for AHTD:. 12)Hwy 16 Improvements-Armstrong to Stonebridge Rd. • AHTD letting date: September 2012 • Current agreement with AHTD for 50% of project costs to be paid by the City, up to $5 million. • Edwards Design and Construction is the contractor on the Water and Sewer Relocation Project. • Installation of water lines is underway on the project. • Sweetser Construction is the roadway construction contractor for the AHTD, and has begun working in the Armstrong to Happy Hollow area. 13)Garland Avenue (North to Melmar) • Total project cost originally estimated at $6.7 million • City Share originally estimated at$5.2 million, current estimate is $ 4.04 million • Water and sewer relocations is complete, with the exception of final cleanup, topsoil, and seeding. • Relocation and adjustments of other utilities by the various utility companies is continuing. • Sweetser Construction will be the contractor on the roadway; work is set to begin in early 2013. This request is for closure only during the fall and spring semesters, between the hours of 7 am to 5:30 pm Monday through Friday. The UA proposes to restrict access by use of a staffed security station and temporary removable barriers, initially to be located west of Harmon Avenue, and then to be moved to Duncan Avenue in 2015, as a new classroom building at the southwest corner of Duncan and Dickson is completed. Dickson Street(between Arkansas Avenue and Garland Avenue) is designated as an institutional drive by the Arkansas State Highway and Transportation Department. The Institutional Drive system was formalized by a 1961 Minute Order of the Arkansas State Highway Commission. The AHTD provides "preservation and upkeep" of institutional drives; however, they are not considered part of State Highway System. The AHTD does not own the right of way of Dickson Street; rather, portions of Dickson Street appear to be under the ownership of the UA as part of the original campus property, and there remains right of way dedicated to the City from owners on the south side of Dickson, prior to purchase of those properties by the UA. Therefore, all three entities-the UA, AHTD, and the City have an interest in various aspects of ownership, operation, and maintenance of this segment of Dickson Street. The administration has reviewed this request, and is in support of the concept as proposed, provided the following stipulations are met: 1) Bicycle traffic will not be restricted, and will be allowed at all times through the restricted area of Dickson Street. 2) Access restriction will be limited to west of Duncan Avenue, to allow Duncan to continue to operate as a City Street. The City Attorney's office has also reviewed this request. A memo from Jason Kelley, Assistant City Attorney, is attached. As noted in the memo, their opinion is that the only method of allowing this specific request is by vacation of the right of way, so that the Street would become the property of the UA. Mr. Kelley does note that the City could regulate the traffic on this street as it sees fit, but could not allow the UA to physically block traffic. We do not at this point have confirmation from the UA as to whether they wish to proceed with the request to vacate the right of way; however, staff requests a recommendation from the Street Committee regarding this request,up to and including the step of vacation of the City right of way and allowing the right of way to revert to the UA. CITY ATTORNEY CC: KIT WILLIAMS, CITY ATTORNEY DATE: DECEMBER 6, 2012 RE: DICKSON STREET PARTIAL CLOSURE/U OF A REQUEST I have been reviewing the agenda request pertaining to the partial closure of Dickson Street between Duncan Avenue and Garland Avenue which has been made at the request of the University of Arkansas. My understanding of the request is that Dickson Street would be closed to general motor vehicle traffic between 7 a.m. to 5:30 p.m., Monday through Friday, during the Fall and Spring semesters, but that the street would remain open at all times for pedestrian and bicycle traffic. Additionally, the University desires the right to physically block traffic on Dickson through a temporary structure or structures (a security station with gates or something similar) initially at Harmon Avenue and eventually at Duncan Avenue through to Garland Avenue, once certain currently planned University construction projects are completed. The University desires to retain the right to indefinitely control access on Dickson Street between Duncan Avenue and Garland Avenue. Our office has researched the City's rights and obligations pertaining to public streets in light of this request. It is our opinion that the law simply does not envision or permit the type of arrangement the University is suggesting in its request. Simply put, the City can vacate the street with the University (as owner of both sides of the street)taking ownership and control of it as the University deems fit, or the City can retain the street and regulate traffic. The City's retention would, in my opinion, preclude the University from maintaining any physical barrier across the City's right-of-way. The City has the right to regulate traffic on its streets and cannot contract that right away. Risser v. City of Little Rock, 225 Ark. 318, 320, 281 S.W.2d 949, 950-51 (1955). The City has the obvious right to control traffic on streets, even possibly to the point of restricting certain traffic to certain times of day and certain days of the week or times of year. The City has the ability to temporarily close a street due to safety concerns or other permitted activity (i.e. a parade), or to temporarily close a street to create "safety zones" during a construction project. Fayetteville, Ark. Code Chapter 70, generally. The law permits these temporary actions, but not permanent closures short of vacating the right-of-way. It appears that the University may not desire Dickson Street to be permanently vacated due to issues regarding the University's future cost for maintenance. Based on my understanding, if the street is closed and blocked, the Highway Department may change its designation of the street from an institutional drive to a service drive and stop maintenance. Such maintenance responsibility would fall on the University. This was the situation with the closing of Garland Avenue from Maple Street to Dickson Street. However, it is my opinion that a permanent vacation is the only way to accomplish the University's desired goal. By law, the City can vacate Dickson Street in the affected area without waiting the normal five (5) year period for non-use, since both sides of the street are owned by an educational institution. Ark. Code Ann. § 14-301-301(b). It is important to note that the City will need to retain easements through the area to protect the City's right of access to the public utilities in the vacated area to provide necessary access for emergency vehicles and possibly other concerns unknown at this point. Mountain Fayetteville, AR 72701 Dear Mayor Jordan and Alderman- As you know, the University continues to experience unprecedented growth in our number of students, faculty and staff. We expect to exceed 24,500 students this coming fall and reach the vicinity of 28,000 within 3-4 years. While this is consistent with the goals of our state and our University and good for the business climate and economic vitality of the City of Fayetteville, it presents some safety-related concerns and other challenges that we must work together to meet. Much of the recent growth these past 4-6 years has been accommodated by constructing buildings south across Dickson Street from the traditional core campus, which has exacerbated the long-time issue of automobile-pedestrian conflicts on the crosswalks at the western end of Dickson Street, (specifically, the Mcllroy Avenue-Dickson Street intersection and Garland Avenue-Dickson Street intersection). The new Hillside Auditorium building, with a total of 777 seats in two auditoriums more than doubling the capacity of the building it is replacing, will open in late September near the Harmon Avenue-Dickson Street intersection. A large general classroom / lab building is being planned for the southwest corner of Dickson Street and Duncan Avenue, which will in the future increase the number of pedestrians crossing Dickson Street between Duncan Avenue and Harmon Avenue on campus, estimated to be complete in spring semester, 2015. In addition to the higher pedestrian load in this section and the inherent conflict with vehicular traffic there are horizontal sight line concerns at the hilltop where Duncan Avenue meets Dickson Street. In the interest of primarily public safety, particularly the safety of thousands of our students, faculty, staff, visitors, and city residents, the University seeks your initial approval regarding the controlled weekday closing of Dickson Street west of Harmon Avenue to Garland Avenue to through traffic between the hours of 7:00 a.m. and 5:30 p.m., Mondays through Fridays of the two academic semesters.This would require the University to construct and staff a gate and security station at these intersections. When the future general classroom/lab building becomes fully operational in the spring of 2015 we would seek to move this control point east one block to the intersection of Duncan Avenue-Dickson Street while also controlling northbound traffic on Harmon Avenue at William's Street. The preservation and upkeep of the publicly traveled access roads and drives at State institutions is a logical responsibility of the State Highway Department , although such roads and drives are not statutory components of the State Highway System. 2. The maintenance and improvement of service, drives, ,parking areas, and other non public roads are not considered a responsibility of the Highway Department , but are deemed to be an institutional obligation. 3 . The initial construction or major reconstruction of roads and drives to serve new, additional, or expanded facilities or improvement of existing roads to higher standards at any institution is considered a legitimate charge against the budget of the institution, and such future work will only be undertaken by the Highway Department on a cost-reimbursable agreement with the institution. 1+. Two bond issuances have occurred, one in 2006, and one in 2009, totaling approximately $34.2 million of the $65.9 million approved by voters in 2006. The remaining bond issue of approximately $31.75 million is planned for 2014. After the recent receipt of bids, the status of the Bond Program, and availability of funds in the third bond issue for additional projects is better know. A summary of the financial status is as follows: Transportation Bonds-Phases 1 and 2 $ 34,214,963.66 Transportation Bonds-Phase 3 $ 31,750,000.00 Transportation Bonds-Interest Income $ 1,575,600.00 Less: Bond Issuance Costs (Phase 3) $ (693,300.00) Total Transportation Bond Fund Proceeds $ 66,847,263.66 Total Cost of Current Projects-Estimated $(52,475,615.00) Unallocated Funds (Proceeds-Total Project Costs)* $ 14,371,648.66 * Includes $8.8 million set aside for cost sharing projects. As noted above, available funds for additional projects are estimated at$14.4 million. The attached map depicts 9 projects that potentially could be added to the program. These projects are presented for purposes of discussion and review by the Street Committee, and are compiled from priorities previously expressed by the Street Committee and by the Administration. The projects are also listed on the attached spreadsheet, along with additional projects which may be considered. If any Committee member has other priorities that do not show up in either of these lists, please be prepared to present those projects for discussion at the Street Committee meeting.
