A meeting of the Fayetteville Transportation Committee will be held on November 12,
2013 at 6:15 pm or after the Equipment Committee in Room 326 of the City
Administration Building located at 113 West Mountain Street, Fayetteville Arkansas.

SUBJECT: STP-A Funded Transportation Projects for FY2014
The Northwest Arkansas Regional Planning Commission (NWARPC) has issued a 2"d CALL FOR PROJECTS to be
submitted for consideration for NWARPC FY2014 STP-A (Surface Transportation Program — Attributable) funding for
design and construction projects that are consistent with the 2035 NWA Regional Transportation Plan and address
improvements to major routes that improve access, reduce crash rates, and/or relieve traffic congestion, as well as other
eligible projects that increase capacity. Applications must be received no later than January 3rd, 2014. The STP-A is a
federally funded, 80%Federal/20% Local, reimbursable program. STP-A funds must be used for eligible projects that are
submitted by eligible entities and chosen through a competitive process with surrounding cities in our Transportation
Management Area(TMA), e.g. Springdale,Rogers, etc.
The City submitted 4 projects during the first round of project submittals; two of the 4 were approved by the Regional
Planning Commission:
• Old Wire Road/Mission Intersection Improvements-Approved for$850,000
• Highway 112 (Maple Street)Razorback Road-Garland Ave.-Approved for$2.4 million
• Fulbright Expressway Overpass-Pulled from by consideration by City staff due to concerns with availability of
funds for construction.
• Sain Street Extension-Pulled from consideration by Regional Planning staff due to a technicality related to the
status of the project on the regional Functional Classification Map.
Staff from the Regional Planning Office and the City are working on revisions to the Functional Classification Map to
clear up the issue on the Sain Street Extension. Therefore, it is recommended that the Sain Street Extension be
resubmitted in the 2nd call for projects.
The Fulbright Expressway overpass is estimated to be a $10 million project, which exceeds the project size that could be
funded under the STP-A program, and there is no other source of funding identified for this project. Once a project begins
using federal aid funding, it must be completed, or the federal aid must be re-paid. Therefore, staff recommends that this
project be held for future years until additional funding sources may be identified.
No other projects are recommended for submittal under this round. If the Sain Extension Project is approved, Fayetteville
will have received 50% of the available funds for the region for 2014, which is the maximum that any entity may be
allocated in any one year.

SUBJECT: Van Asche Drive Improvements-Property Acquisition Status
The City Council Agenda item that follows this memo will approve acquisition by condemnation of 4 tracts on the Van
Asche Project. City staff is continuing to negotiate with these property owners, and will have updated information to
provide at the Agenda Session and the Transportation Committee. It appears likely that we will be able to negotiate
settlements with at least two of these property owners without needing to use condemnation.

Subject: Approval of a Resolution authorizing the City Attorney to seek condemnation and orders of possession of

Revocable Trust and Tomlinson Asphalt Company necessary for the Van Asche Drive Construction
Project.
PROPOSAL:
The Van Asche Drive project includes construction of a four lane arterial roadway from the intersection of Highway 112
(Garland Ave)to the east under Interstate I-540. On the east side of I-540, the proposed roadway transitions into a four
lane divided roadway with a 15' wide center median. These improvements will extend to Gregg Ave. where it will
connect to the recent improvements at the intersection of Gregg Ave. and Van Asche Drive. This project is scheduled to
biA November 26,2013 and begin construction in early 2014.
The owners of the attached properties have expressed various concerns and have refused to sign right-of-way and
easement documents as based on their concerns. These properties represent 4 of the total 15 properties to be acquired.
Staff will continue to negotiate with these property owners to avoid condemnation whenever possible. However it is
imperative that the right of way be acquired in a timely manner so as not to delay the construction of the project.
RECOMMENDATION:
Staff recommends approval of a Resolution authorizing the City Attorney to seek possession by condemnation of portions
of properties along Van Asche Drive.
BUDGET
The payment for land acquisition will be made from the project budget allocated for the Van Asche Drive Project, which
is funded by the Transportation Bond Fund. The agenda item staff review form indicates $28,800 as the cost of this
request. It should be noted that this is an estimate,based on the appraised values of the properties, and that the final cost is
subject to negotiation with the property owners or by court order. The appraised value will be deposited into the Registry
of the Circuit Court as just compensation when the condemnation complaint is filed for each property.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO SEEK
CONDEMNATION AND POSSESSION OF CERTAIN LANDS OWNED BY
DALE & MARTHA BENEDICT, DAVID CLARK MCCLINTON, THE
KIMBROUGH FAMILY REVOCABLE TRUST AND TOMLINSON
ASPHALT COMPANY NEEDED FOR THE VAN ASCHE DRIVE
CONSTRUCTION PROJECT
WHEREAS, the City of Fayetteville and certain property owners have been unable to
agree on a fair price for the portions of property owned by each of them which is needed for
easements to the Van Asche Drive Construction Project; and
WHEREAS,the City of Fayetteville needs to gain possession of these property promptly
to begin work on these public improvement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE,ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby authorizes
the City Attorney to file suit to seek court-ordered possession of property located on or near the
planned Van Asche Drive Construction Project and owned by Dale & Martha Benedict that is
needed for right-of-way or other easements for the Project, and to pay into the registry of the
Circuit Court just compensation therefor.
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby authorizes
the City Attorney to file suit to seek court-ordered possession of property located on or near the
planned Van Asche Drive Construction Project and owned by David Clark McClinton that is
needed for right-of-way or other easements for the Project, and to pay into the registry of the
Circuit Courtjust compensation therefor.
Section 3. That the City Council of the City of Fayetteville, Arkansas hereby authorizes
the City Attorney to file suit to seek court-ordered possession of property located on or near the
planned Van Asche Drive Construction Project and owned by the Kimbrough Family Revocable
Trust that is needed for right-of-way or other easements for the Project, and to pay into the
registry of the Circuit Court just compensation therefor.
Section 4. That the City Council of the City of Fayetteville, Arkansas hereby authorizes
the City Attorney to file suit to seek court-ordered possession of property located on or near the
planned Van Asche Drive Construction Project and owned by Tomlinson Asphalt Company that
is needed for right-of-way or other easements for the Project, and to pay into the registry of the
Circuit Court just compensation therefor.
