& Relief Fund and the Firemen's Pension& Relief Fund is 0.4 mils for real property and 0.4 mils for personal property, the
millage for the Fayetteville Public Library is 1.0 mil for real property and 1.0 mil for personal property. City Council is
requested to adopt real and personal property tax rates for 2007 for the City's General Fund. The rate requested for the
City's General Fund is 2.2 mils for real property and 2.2 mils for personal property.

SUBJECT: 2007 Millage Levy
Recommendation:
City staff recommends that City Council approve the millage levy ordinance approving the 0.4 mils
for the Policemen's Pension and Relief Fund, 0.4 mils for the Firemen's Pension and Relief Fund,
1.0 mils for the Fayetteville Public Library, and 2.2 mils for 2008 General Fund operations.
Background:
Each year the City must approve an ordinance to renew the levy of ad valorem taxes on real and
personal property within the City. This request will provide for such levy on property assessed
during 2007.
The total assessed value of real and personal property located within the city limits of Fayetteville,as
of August 1,2007,is approximately$1.163 billion. The assessed valuation is before the Washington
County Board of Equalization has made all the changes to the County Assessors Abstract. Based on
the preliminary assessments, the growth in real estate assessments is approximately 12.85%. The
change in assessed real estate value is due to newly discovered,newly constructed property 10.55%
Discussion:
A millage levy ordinance must be approved by City Council in order for the City to continue to
collect property taxes for the Policemen's Pension and Relief Fund and the Firemen's Pension and
Relief Fund. The millage levy for the Policemen's Pension and Relief Fund is 0.4 mils for real
property and 0.4 mils on personal property. The millage levy for the Firemen's Pension and Relief
Fund is 0.4 mils for real property and 0.4 mils on personal property as was approved by referendum.
A millage levy ordinance must be approved for the operation of the Fayetteville Public Library and
that was approved by the voters on October 1, 2002. The millage levy for the Fayetteville Public
Library is 1.0 mils for real property and 1.0 mils on personal property.

Finally,City staff is requesting that City Council approve a millage levy ordinance for General Fund
operations in the amount of 2.2 mils for both real and personal property. This represents an increase
of 0.9 mils over the 1.3 mils approved by City Council on October 10,2006 and is still 2.8 mils less
than the discretionary amount of 5.0 mils allowed by State statute.
The 2008 proposed property tax revenue amount based on the 2.2 mil levy is estimated to bring in
$2,432,000 in General Fund revenue. The 2008 Proposed Summary Budget for General Fund
Budget will be distributed to City Council on Saturday, September 29 at a Budget work session at
which time the need for a levy increase will be discussed in depth. Additional meetings during the
month of October to discuss the millage levy will be held as needed. A proposed calendar is shown

Budget Impact:
The 0.4 mils Police and 0.4 Fire is needed to fund the Pension plans for both areas. The 1.0 mils is
used to fund the operation of the Fayetteville Public Library. The 2.2 mils will be used to fund
General Fund operations.
Conclusion:
The millage levy must be at Washington County,November 1 to be included in their consolidated
levy ordinance which will be approved at the November 8, Quorum Court meeting. The City levy
will be added to the levies by Washington County,the various school districts,improvement districts
and other cities within the County when the Washington County Quorum Court adopts its millage
levy for 2007.

SUBJECT: Millage Request Update
I have reviewed the 2008 operating budget and discussed requests with pertinent departments and
believe at this time we have reduced the General Fund budget as much as practicable without
mandatory reductions which will affect the level of service provided and/or personnel. Attached
are schedules which show what additional reductions would be needed to achieve a$995,000
mandatory reduction necessary if allocated equally among divisions. The schedules are provided
to demonstrate the relative impact on each division. The first schedule shows the impact on the
total budget of each division. The second schedule shows the impact on each divisional budget if
the personnel accounts are not reduced.
The administration is not recommending a mandatory reduction. This information is for
consideration if this option is pursued.
The administration's recommendation continues to be the adoption of a 0.9 mil property tax
increase and an adjustment of the City's sales tax split from 50%operations and 50% capital to
approximately 57% operations and 43% capital. I believe this is the best long term option.
Between now and the time of final presentation, I will continue to review the proposed General
Fund budget for possible reductions. However, any adjustments are expected to be minor.
I would also like to bring to the Council's attention that in 2006, the City cut $97,946 from the
General Fund Travel &Training Budgets. In 2007, $321,528 in budget reductions were made
from Fire, Police, and Parks &Recreation. In 2008, $227,801 of prior year budget items were
initially cut. Also, the administration is not recommending a COLA for employees which would
be approximately$960,000.

The following key points need to be communicated regarding sales tax collections:
FAYETTEVILLE SALES TAX ACTIVITY
1. Sales tax collections remitted for sales tax subject to the 1 cent City tax in October,2007 were down $28,559
/ (2.09%) as compared to the same month prior year. These collections represent sales which occurred in
August, 2007.
2. Sales tax collections remitted to the City for the City's share of County tax collections October, 2007 were
down $40,255 / (4.06%) as compared to the same month prior year. These collections represent sales which
occurred in August, 2007.
3. When compared to budget for the month, sales tax collections were down a total of$151,307.
4. The year to date budget impact for the nine months of collections used to finance the 2007 budget is down a
total of $1,359,242.

RE: Deadline To Certify City's Millage Rate To County Clerk
The question has once again been raised as to whether the City
may be granted an extension of time in which to certify its millage
rate to the County Clerk.
Although this may have been a bit of an open question in years
past, and despite past practices to the contrary, the Supreme Court of
Arkansas has now made it clear that "the 'time fixed by law; [in
which to certify a city's millage rate to the County Clerk] is clearly
the regular November meeting of the county quorum court. More
importantly, the plain language of the extension statute does not
attempt to modify the time for cities to certify their rate of taxation."
