application and will only be permitted during this part of the hearing for each item. Members of the public
are permitted a maximum of 10 minutes to speak; representatives of a neighborhood group will be allowed
20 minutes. The applicant/representative of an application before the Planning Commission for
consideration will be permitted a maximum of 20 minutes for presentation.

CCP 07-2489: Concurrent Plat (RUBLE, 436): Submitted by ALAN REID for property

Findings:
Property Description and Background: The subject property contains two separate tracts totaling
2.11 acres, located on 54th Street, just south of W. Tackett Drive. Research on the property
revealed that the maximum number of lot splits had been granted and thus a preliminary and
final plat must be approved for further subdivision of the property. At this time the applicant is
requesting to adjust the property lines and re -divide the subject properties into tracts of 0.90, 0.64
and 0.57 acres (Tracts A, B and C respectively). To do so, the applicant has requested approval
of a Concurrent Plat. The Concurrent Plat process may be utilized if no right-of-way dedication
or public improvements are required with the requested subdivision of land. A lot split was
approved by the Fayetteville Subdivision Committee on January 16, 2003 at which time
sufficient right-of-way was dedicated.
The Subdivision Committee voted 3-0-0 to forward this item with a recommendation for
approval on March 01, 2007.
The following description of a Concurrent Plat is from Chapter 166 of the Unified Development
Code:
166.01 Subdivision Approval
(C) Concurrent Plat. When a property owner wishes to transfer one or more parcels, each of
which contains more than five (5) acres, or wishes to transfer parts of recorded Lots that do not
require replatting dedications vacations reservations, changes in alignments of easements or
right-of-way, or the extension of utilities, the Planning Commission may waive the preliminary
plat and approve the final plat (a concurrent plat) for filing with the county recorder.

review process was reviewed for general concept only. All public improvements are
subject to additional review and approval. All improvements shall comply with City's
current requirements.
4. All overhead electric lines 12kv and under shall be relocated underground. All proposed
utilities shall be located underground.

SINGLE FAMILY - 4 UNITS/ACRE and contains approximately 0.33 acres. The
request is to vacate 12.5' of a 25' utility easement.

Findings:
Property Description: The subject property is Lot 46 of Brookbury Woods Addition. It
is located south of Old Wire Road / Skillern Road and zoned RSF-4. The property was
platted in July 1995. A designated floodplain abuts the lot's west property line.
Easements platted on the property include a 25' utility easement along the west/rear
property line, a 10' utility easement along the side/south property line, and a 25' utility
easement along the right-of-way.
Request: The applicant requests vacation of 12.5' (1,277 square feet) of the existing 25'
west/rear utility easement to make improvements to the rear yard. These improvements
include the installation of a pool as well as a patio and a fire place with brick ledge. The
pool itself will not encroach within the easement, but the fire place and brick ledge will.
If the vacation is approved, a 12.5' utility easement will remain, which is greater in width
than the 10' utility easement adjacent to the west property line of Lot 45 to the north and
one-half the size of the 25' utility easement to the south.
The applicant has submitted the required notification forms to the utility companies and
to the City with the result summarized below.

We, the undersigned, being all the owners of the real estate abutting the /easement) hereinafter
sought to be abandoned and vacated, lying in (lot 46 Brookbury Woods), City of Fayetteville,
Arkansas, a municipal corporation, petition to vacate the east half (12.5') of the 25' easement on
the west side of said Lot 46 and being described as follows:
Commencing at the SW Corner of said Lot 46 thence N73°08'44"E 12.65 Feet to the P.O.B.

That the abutting real estate affected by said abandonment of said easement in Lot 46 of
Brookbury Woods Subdivision City of Fayetteville used by the public for a. period of many years,
and that the public interest and welfare would not be adversely affected by the abandonment of
the portion of the above described (easement).
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above
described real estate, and that the above described real estate be used for their respective benefit
and purpose as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting property
owners as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City
of Fayetteville, Arkansas, abandon and vacate the above described real estate, and that title to said
real estate sought to be abandoned be vested in the abutting property owners as provided by law,
