the Chair asks for public comment. Public comment occurs after the Planning Staff has presented the
application and will only be permitted during this part of the hearing for each item. Members of the public
are permitted a maximum of 10 minutes to speak; representatives of a neighborhood group will be allowed
20 minutes. The applicant/representative of an application before the Planning Commission for
consideration will be permitted a maximum of 20 minutes for presentation.

As requested by the Chair of the Planning Commission, Commissioner James Graves and I have
discussed options for consideration by the Planning Commission pertaining to guidelines for
applicants that wish to give a digital presentation to the Planning Commission. Attached are
recommendations for these guidelines, for your review. It is the intent of this guide to educate
applicants and members of the public on how to conduct a digital presentation utilizing the
equipment the City of Fayetteville currently has available, and to do so in an effective and time -
efficient manner. Further, it is the not the intent to add these guidelines to the Planning
Commission's bylaws; rather, this guide would be published on the City's website and available to
all applicants and neighborhood organizations through our Neighborhood Coordinator.

Guidelines for Digital Presentations (Room 219)
Planning Commission of the City of Fayetteville
(Draft 01/29/07)
The City of Fayetteville offers applicants the ability to present a land use or development
project by way of digital media in Room 219 of City Hall. Digital presentations, which
primarily consist of Powerpoint or similar presentation software, may be used to better
illustrate development plans and communicate planning concepts to the Planning
Commission and the viewing public.
The following guidelines are intended to best utilize the facilities that are available and to
provide procedures for applicants to follow to create an efficient and effective presentation:
1) Applicants should notify Planning Staff of their intention to make a digital
presentation prior to the meeting. Staff will provide information about setup of
laptops or utilizing the hard -wired network and projector in the room.
2) Keep in mind that technology does not always work as expected. It is
recommended that presenters bring a backup, conventional presentation in case of
failure of the digital version.
3) Applicants have a maximum of 20 minutes to present a project, including all
verbal and digital presentations. If you use more than your allotted time, the
Planning Commission Chair has the right to terminate the presentation.
To present your project effectively in this limited time, do not attempt to cover too
much material. Discuss only the major points of your project.
a) A useful rule of thumb for slides is to use no more than one (1) for each
minute of your presentation. The content of a single slide should be easily
comprehended in 20 seconds.
b) Keep the data on slides simple. Please do not read each slide to the
Commission.
4) Keep in mind that the Commission has been provided a full packet of information
about your project several days preceding the meeting. There is no need to begin a
digital narrative as though the project is being seen for the first time.
5) Quoting ordinances with which the Commission is already familiar is unnecessary.
6) Use large, legible letters for any text presented. If you can read 35mm/2" x 2"
slides without magnification, people in the rear of the room can probably read them
on the screen.
Also, be advised that the view to the projection screen is obstructed from some seats
on the dais

Findings:
Property Description and Background: This property is located north of Joyce Boulevard, west
of Vantage Drive, on either side of Stearns Street. The Bellafont II Large Scale Development
(LSD 06-1939) was approved on March 27, 2006 by the Planning Commission for development
on the subject property, though the proposed subdivision encompasses only that portion of the
devleopment west of Vantage Drive. The approved development is for a mix of uses with
restaurant space, retail space, office space, and condominium towers. As depicted in Table 1, the
site is surrounded by developed and developing commercial property.

The original Bellafont II LSD approval (LSD 06-1939) consisted of property both east and west
of Vantage Drive. This subdivision is only for that portion west of Vantage, on which there is
currently construction occurring and building permits issued. However, the entire project was

reviewed for traffic generation and street improvements determined based on the overall impact.
One of the improvements is to extend Stearns Street to Vantage Drive, on the east side of
Vantage. Because it is all of the buildings within Bellafont II that generates traffic warranting
the street improvements tied to this development, the City will not issue any occupancy permits
until: (1) all improvements are constructed including the extension of Stearns Street; or (2) a
bond or surety is put in place to guarantee traffic improvements that are not necessary for the
buildings, but are required for the overall development.
Proposal: The applicant requests concurrent plat (preliminary and final plat) approval for a
commercial subdivision with seven commercial lots ranging in size from 0.42 acres to 3.68
acres. A shared parking and access agreement has been provided and will be filed of record.
Right-of-way being dedicated: Fifty feet (50') right-of-way for Stearns Street and 55' from
centerline along Joyce Boulevard, 70' right-of-way for Vantage Drive has been previously
dedicated to the City by easement plat.
Street Improvements: Street improvements have been evaluated as part of the Bellafont Large
Scale Development. This subdivision does not affect those original street improvements, and all
conditions thereof remain applicable.
Adjacent Master Street Plan Streets: Joyce Boulevard, Principal Arterial; Vantage Drive
Collector; Stearns Street, Local Street.
Parkland Dedication: Parkland dedication is not applicable for this commercial subdivision.
Parkland fees were assessed for the multi -family development included as part of the Bellafont II
Large Scale Development. The multi -family development portion of Bellafont II is located east
of Vantage Drive, and is not located within the subject property.
Tree Preservation: Existing canopy: 56.4%
Preserved canopy: 14.0 %
Required: 15%
Mitigation: 48 two-inch caliper trees
Recommendation: Subdivision Committee recommended approval of this Concurrent Plat.
Staff recommends approval of CCP 06-2389 with the following conditions of approval:
Conditions of Approval:
1. Sidewalks shall be installed or guaranteed in accordance with Ch. 158.01 prior to signing
the concurrent plat. This plat only affects the subject property west of Vantage. Any
sidewalk not constructed and not already guaranteed with the building permits shall be so
prior to the City signing the final plat.
2. Subdivision area signage shall be permitted in accordance with applicable city codes. No
structures, including area signage, shall be erected within utility easements unless
otherwise approved by utility companies.

3. Address the following comments on the concurrent plat:
a. Include the parking garage as part of the shared parking and access agreement
referenced in Note No. 11. Provide staff with a copy of the signed parking and
access agreement. These agreements will need to be filed with the concurrent
plat.
b. Show the location of street lights on Vantage Drive and Stearns Street in
accordance with City ordinance requiring a maximum spacing of 300' apart.
Receipts from the electric company for installation of required new street lights
shall be provided to the City prior to signing the concurrent plat.
4. All structures including dumpster pads and transformers shall be located outside of the
building setbacks and will be reviewed in detail prior to issuance of building permits.
5. Any future or existing building permits on this property shall meet the zoning
requirements as established by the subject Concurrent Plat, including building setbacks.
This may result in slight adjustments to the approved LSD plans, prior to construction.
Tree Preservation Conditions:
6. With this concurrent plat, lot 1 will be set into a Tree Preservation Area to ensure the
preservation and protection of the remaining trees.
7. Mitigation was required with the approval of phase 2 A and B. A planting plan has been
submitted and approved with this concurrent plat. The removal of canopy warrants 48
(2) inch. caliper large species trees. Seven (7) of these mitigation trees will be planted on
phase 2A and will be associated with the certificate of occupancy for lot 2.
These 7 (2) inch caliper large species trees must be bonded for a 3 -year term: for
monitoring and maintenance. A bond, letter of credit, or check must be ;deposited with
the City before the final certificate of occupancy.
Landscape Plan Conditions:
9. A landscape plan was approved with this development. Prior to building permit for the
associated lot, a cost estimate for all required landscape is to be submitted to the Urban
Forester for review. Once approval is gained, a guarantee is to be issued (bond/letter of
credit/cash) for 150% of the cost of the materials and installation of the plants. This
guarantee will be held until the improvements are installed and inspected, at the time of
Certificate of Occupancy.

10. Plat Review and Subdivision comments (to include written staff comments provided to

Per The City of Fayetteville's Concurrent Plat Checklist, this letter is hereby
being submitted as the `correspondence in the form of a written letter to Planning Staff
describing the scope, nature and intent of the proposal'.
This Concurrent Plat is being submitted in order to subdivide the existing 14.01
acre tract of land into 3 separate tracts of land. The project site is currently under
construction as the Procter & Gamble office building and is located to the immediate east
of First Security bank on East Joyce Boulevard. The site has been addressed as 1303 E.
Joyce Boulevard. The current property owner is The Procter & Gamble Company.
Per a telephone conversation with Mr. Andrew Garner, there are several items
which have been omitted from this application since they were completed on the previous
Verus Partners Large Scale Development permitting. These items are the. Grading and
Drainage Fee, the Tree Preservation Fee, the Parks and Recreation Advisory Board
decision regarding land dedication, the Tree Preservation information and the signed
Grading and Drainage Applications. If it is decided that any of these items need to be re-
submitted, please let me know and I will forward that information immediately.

zoned MAIN STREET CENTER and contains approximately 6.02 acres. The request is
to vacate a utility easement and alley on the subject property.

Findings:
Property Description and Background: On January 22, 2006, the Planning Commission
approved Large Scale Development 06-2300 for Central United Methodist Church. The
development included a parking garage which was to be constructed over a platted alley
and utility easements. Conditions of approval for the development included the
following:
The existing, unconstructed alleys and utilityeasements on the property, in
which the proposed buildings encroach, shall be vacated prior to issuance
of a building permit on the property.
Request: The applicant requests vacation of a total 0.13 acres of alley and easement on
the subject property, located south of Lafayette Street. For some time, the property
owner has coordinated the relocation of the gas lines and other utilities from these alleys
and easements.
The applicant has not included a portion of the alley which is located between CUMC
property and the post office. Since this alley is adjacent to two property owners,
notification is required to be given to all adjacent property owners. According to the
applicant, the adjacent owners have not been responsive; therefore, because the
development did not encroach upon this portion of the alley, it was not requested to be
vacated. What would result is a landlocked 128' alley that will not be maintained by the
city or utilized by the public. Staff recommends that the applicant modify the vacation
petition to include this portion of the alley. An easement can be dedicated in its place

should there be any existing or future utilities that locate in this area. Staff has discussed
this recommendation with the applicant and the Church is willing to modify the legal
description to include the remaining portion of alley.
The applicant has submitted the required notification forms to the utility companies and
to the City with the result summarized below.

proposed parking garage and student ministry building, to provide public access
between Highland Avenue and St. Charles Avenue.
3. The applicant shall dedicate a 20' utility easement adjacent to Lafayette Street.
4. if the Planning Commission determines in favor of staff's recommendation to vacate
the remaining portion of the north -south alley, the applicant shall modify the legal
description to include this portion of the alley. A utility easement shall be dedicated
in its place and the adjacent owner shall be notified of this vacation.
