Property Owner: COLLINS HAYNES Planner: ANDREW GARNER BACKGROUND Project Description: The project site contains approximately 20.29 acres located at 3081 North Highway 112. The approved Large Scale Development for this site consists of the construction of a 136,300 square foot Sam's Club retail store, a 6,458 square foot Liquor Box liquor store, a car wash, and Sam's Fueling Station, with associated parking, stormwater detention and bioswales, and off-site street improvements. Background: The original Large Scale Development for the project was approved on August 8, 2005. The construction of the project has been delayed due to litigation regarding the liquor liscence. The applicant has submitted and obtained comments from the Engineering Division as the first phase of the construction plan review process. Proposal: The applicant requests to extend the approval of the Lie Scale Development for one year, to expire on August 8, 2007. Should this extension be granted, all permits are required to be issued before the one-year extended deadline. If the permits are not issued prior to August 8, 2007, all of the approved plans for the project shall be rendered null and void. RECOMMENDATION Planning Staff recommends approval of ADM 06-2166, the requested extension to the LSD 05-1611, with the following conditions: 1. The applicant shall be allowed until August 8, 2007 to receive all required building permits. If all permits have not been received by this time, the Large Scale Development approval shall be revoked. The proposed development shall comply with the recently adopted Lighting Ordinance for the City of Fayetteville. 3. All other conditions of approval for the project shall remain applicable. DISCUSSION The City of Fayetteville Unified Development Code (UDC) Section 166.20(b) gives the Planning Commission authority to extend approval of a large scale development one additional year from the original approval. In order to extend this approval, the applicant must: (1) request the extention prior to the one year time limit, and (2) show good cause why the tasks could not reasonably be completed within the normal one year. If the one year extension is granted, it is within this time that the applicant shall receive all permits and approvals as required by City, State, and Federal regulations to start construction of the development or project. (1) The applicant has submitted the extension request to the Planning Division on June 30, 2006, prior to the one year time limit ending on August 8, 2006. (2) The applicant has been working this past year to fulfill the conditions of approval for this project and proceed with construction. However, the project has been delayed due to litigation regarding the liquor liscence, which is necessary for the operation of the liquor store. An ordinance amendment adopting an outdoor lighting ordinance has been adopted since the Planning Commission approval of this project on August 8, 2005. Appropriate conditions have been added to ensure compliance with this new ordinance requirement. The UDC allows a three year period from the date of issuance of a building permit to the receipt of a final Certificate of Occupancy. The provisions of this section apply to all of the following plans and permits: (1) Preliminary plats; (2) Planned zoning district developments; (3) Conditional uses; (4) Large-scale developments; (5) Lot splits; (6) Physical alteration of land permits; (7) Storm water, drainage, and erosion control permits; (8) Tree preservation plans; (9) Sign permits; and, (10) Floodplain development permits. (B) One-year time limit. (1) Tasks to be completed. All of the above - enumerated plans and permits are conditioned upon the applicant accomplishing the following tasks within one (1) year from the date of approval: (a) For any renovation or new construction, receive a building permit; and/or, (b) For a lot split, record a deed or survey at the Washington County Circuit Clerk's Office, stamped for recordation by the City Planning Division; and/or, (c) Receive a Certificate of Zoning Compliance; and/or, (d) Receive all permits and approvals required by City, State, and Federal regulations to start construction of the development or project. (2) Extensions. Prior to the expiration of the one (1) year time limit, an applicant may request the Planning Commission to extend the period to accomplish the tasks by up to one (I) additional year. The applicant has the burden to show good cause why the tasks could not reasonably be completed within the normal one (1) year limit. Expiration. If the required task(s) are not completed within one (I) year from the date of approval or during an allowed extension period, all of the above - enumerated plans and permits shall be rendered null and void. (C) Three-year time limit. (1) Tasks to be complete. All of the above - enumerated plans and permits are also conditioned upon the applicant completing the project and receiving final inspection approval and/or a final Certificate of Occupancy permit within three (3) years from the date of issuance of a Building Permit. (2) Extensions. Prior to the expiration of the three (3) year time limit, an applicant may request the Planning Commission to extend the three (3) year period to complete the project by up to two (2) additional years. The applicant has the burden to show good cause why the project could not reasonably be completed within the three (3) year time limit. (3) Expiration. If the applicant fails to meet the requirements of subsection (C)(1) within three (3) years from the date of issuance of a Building Permit or during an allowed extension period, all of the above - enumerated plans and permits shall be rendered null and void. At the time of the planning commission approval, Sam's Club had obtained a liquor license for operation of the liquor; store. The granting of the liquor license has since been appealed in court by groups opposed to the granting of the license. Due to the ongoing litigation of the liquor license, which is necessary for the operation of the liquor store, all permits necessary for commencement of construction of the commercial development have not been obtained. Due to the unavoidable events that have transpired since said Planning Commission approval, we are respectfully requesting a one-year extension to the Large Scale Development approval granted August 08, 2005. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately 20.29 acres. The request is to approve a 142,898 s.f. commercial development including a wholesale club and liquor store with a car wash and fueling station on the subject property. Property Owner: COLLINS HAYNES Planner: JEREMY PATE Findings: Property: The subject property is bordered by Trucker's Drive to the north, Hwy 112 to the east and the springwoods C-PZD Lot 8 (wetland preservation lot) to the south and west. The majority of the developed site is zoned C-2, while a lot in the springwoods development is also being utilized for the creation of stormwater detention and wetland areas before discharging the runoff from the site into the adjacent Clabber Creek. The site was formerly developed with a large warehouse, and contains a great deal of pre-existing concrete and other remnants associated with the previous development. Tree canopy is minimal, and is primarily in poor condition. Surrounding Land Use/Zoning: The site is adjacent to properties zoned I-1, C-2, R -A and C- PZD. Proposal: The applicant proposes to construct a Sam's Club retail outlet store consisting of 136,300 SF, a Liquor Box liquor store consisting of 6,458 SF, a car wash and Sam's Fueling Station on the subject property, with associated parking, stormwater detention and bioswales and off-site street improvements. Request: The request is for Large Scale Development approval of the submitted site plans for the proposed commercial development. Parking Ratio: As shown in Table I, parking for the proposed commercial development is consistent with City requirements. Proposed improvements include the expansion of Trucker's Drive to a 36 -foot wide Collector Street section with turn lanes along the property frontage, the relocation of the Landers entry drive across Hwy 112 to align with Truckers Drive, the widening of Hwy 112 to include three 12 -foot lanes along the site frontage, installation and synchronization of three traffic signals (Truckers/112 and at the northbound and southbound ramps to I-540 both north and south of the overpass), and the widening of Shiloh Drive to 36 feet in width to include a turn lane along the site frontage. Water/Sewer: Water and sewer are available to the site, and will be extended internally as required. Parks: The frontage along Hwy 112 is identified as a trail corridor linkage. Staff is recommending an assessment for the required 6 -foot sidewalk, to be utilized with city monies to construct a trail, once designed, along the street frontage. Adjacent Master Street Plan Streets: Trucker's Drive (Collector); Shiloh Drive (Collector); Hwy 112 (Principal Arterial) Design Overlay District: The site is partially located within the Design Overlay District. • Greenspace: The applicant has complied with the 25'greenspace requirement along all rights-of-way within the Design Overlay District • Signage: A monument sign is proposed at the corner of Hwy 112 and Truckers. Wall signs are depicted in the attached elevations. The number and size of all signs shall be permitted according to the Design Overlay District requirements. A variance is requested to utilize the slogan "We are in Business for Small Business and "It's a Big Deal" incorporated into the overall sign. • Curb Cuts: The applicant has complied with this requirement for entries onto Trucker's Drive. Cut sheets have been submitted for the proposed lighting. All lighting shall meet current City of Fayetteville lighting ordinance criteria, and will be reviewed at the time of building permit. Elevations have been submitted for all four sides of the building. Planning Commission determination of architectural treatment of fronts, along with Commercial Design Standards, is required. A materials sample board has been submitted for review. The plat indicates 37% open space. Tree Preservation: Existing: 7.4% Preserved: L86% Mitigation: Required, 143 trees on-site Recommendation: Staff recommends approval of LSD 05-1611 with the following conditions of approval: Conditions to Address/Discuss: 1. Planning Commission determination of a variance request for the distance between an intersection and curb cut (250 feet). Staff recommends in favor of the proposed curb cut onto Shiloh Drive at 150 feet from Hwy 112, finding that with the removal of one of the two and the manner in which Shiloh is constructed in this location, it will not pose a dangerous traffic situation. Additionally, this access will allow traffic to move south without accessing Hwy 112. PLANNING COMMISSION VOTED IN FAVOR OF THE VARIANCE. Planning Commission determination of a waiver request for parking stall .dimensions. PLANNING COMMISSION VOTED IN FAVOR OF THE WAIVER. 3. Planning Commission determination of the requested waiver for location of bicycle racks within 50 feet of the entrance. The applicant is requesting a waiver of 20 feet, in order to locate all of the required bicycle racks in a common area 70 feet from the main entry to the Sam's Club. Staff is in support of this request. PLANNING COMMISSION VOTED IN FAVOR OF THE WAIVER. 4. Planning Commission determination of the requested variance for sign content in the Design Overlay District, to utilize the slogans "It's a Big Deal" and "We Are In Business For Small Business," incorporated into the monument and wall signs. Staff supports this request, finding it compatible with similar requests that have been recommended and approved in the Design Overlay District. The name of the business is prominently displayed, and the slogans are secondary in nature, do not detract from the overall signage and are not advertising. PLANNING COMMISSION VOTED IN FAVOR OF THE VARIANCE. 5. Planning Commission determination of Commercial Design Standards. Stafffinds that elevations presented meet the required commercial design standards. All street fronts (Trucker's Drive and Hwy 112) have been articulated with a variety of colors and materials, and include elements that avoid the box -like appearance of typical large retail centers. The south elevation faces a large tree preservation area; however, it will likely be somewhat visible from Hwy 112, therefore staff has recommended the use of common materials and elements to break up this facade, as well. The west elevation faces into Lot 6 and Lot 8 of the springwoods C-PZD, some of which is planned for commercial development, and some of which is preserved (Lot 8). The associated fuel station and car wash has also utilized materials and colors to create a unifying theme for the overall development. It should be noted that the Subdivision Committee asked the developer to better incorporate the design theme into the gas station and the car wash, and to better dress the west wall elevation with column features or other materials. PLANNING COMMISSION VOTED IN FAVOR OF THE LATEST REVISIONS SUBMITTED. i. Planning Commission determination of street improvements. Staff recommends the improvements as indicated on the site plans to be the sole responsibility of the developer, including the expansion of Trucker's Drive to a 36 foot width with turn lane along the property frontage with a six-foot sidewalk, the realignment of Lander's entry drive across from Trucker's Drive, improvements to Hwy 112 as indicated on the site plans to include three 12 foot lanes, signalization at the three indicated intersections, along with associated lane additions/expansions and improvement along the Shiloh frontage, all to include with curb, gutter, pavement and storm drains. PLANNING COMMISSION VOTED IN FAVOR PROPOSED STREET IMPROVEMENTS. A minimum of 55 feet from centerline shall be dedicated (if not already present) along Hwy 112. Street lights shall be installed along all public rights-of-way (Shiloh, Trucker's and Hwy 112) with a maximum spacing of 300 feet. Planning Commission determination of a sidewalk assessment in the amount of $9.990 along Hwy 112. Staff recommends the developer pay money -in -lieu of a 6 -foot sidewalk along Hwy 112 and Shiloh, with a total length of 555 feet. This particular corridor is on the trails master plan, and coordination to create a safe and adequate trail connection is desirable. The money -in -lieu would be utilized to construct a trail in the area by the City of Fayetteville once designed and approved for construction. The developer shall coordinate with the Trails Coordinator to ensure proper crossings and approaches to entry drives and streets are installed with the project. PLANNING COMMISSION VOTED IN FAVOR OF THE ASSESSMENT. 10. For those trees proposed to be planted in smaller tree pits, a structural soil mix shall be utilized, as provided in the submitted details. 11. Landscape plantings shall be installed as indicated and approved with the Large Scale Development, prior to the receipt of a certificate of occupancy. Trees shall be planted with a maximum spacing of 30 feet along all street frontages, and shrubs (min. 50% evergreen) shall screen the parking areas. 12. All freestanding and wall signs shall comply with Design Overlay District, Commercial Design Standards and other sign ordinance specifications for location, size, type, number, etc. The number of signs within the Design Overlay District is limited to below that which is permitted in the C-2 zoning district outside of this overlay district. We are showing parking stalls with a depth of 18 feet for both the 60° and 90° parking stalls. We feel that this reduction in depth is justified in that we are providing 9.5 fcct of width as opposed to the minimum requirement of 9 feet, and we also are providing an extra foot of aisle width for all two-way aisles, and an extra 2 feet of aisle width for all one-way aisles. We feel that given the extra stall width and aisle depths there is more than adequate space available for a car to safely and easily maneuver into the provided parking spaces. • The City of Fayetteville Unified Code of Development stipulates on page 172:14 that bicycle parking racks be located within 50 feet of a public entrance. We are providing bicycle racks within 50 feet of the proposed liquor box, but the bicycle racks are approximately 70 feet from an entrance to the Sam's Club building. Given the layout of the Sam's Club and liquor box entrances, it is not possible to provide shared bicycle parking within 50 feet of both entrances, and we feel that the shared bicycle racks provide for the best use of the space available on the site. • The City of Fayetteville Unified Code of Development stipulates on page 161:16 that within the Design Overlay District, curb cuts shall not be allowed within 250 feet of any intersection. We are proposing utilizing an existing entrance on our site location that is approximately 150 from the intersection of Shiloh Drive and Highway 112. Currently our site is comprised of two entrances near this intersection, one that is approximately 110 feet from the intersection and one that is approximately 150 feet from the intersection. In our improvements we will close the closer of the two entrances, but utilize the existing entrance that is approximately 150 feet from the intersection. • The City of Fayetteville Unified Code of Development stipulates on page 161:17 that within the Design Overlay District lighting shall utilize sodium lighting fixtures. For areas outside of the Design Overlay District lighting that is energy equivalent to high pressure sodium is allowed. In designing the lighting layout to provide for the safest environment for the parking areas of the store, it was determined that the use of high pressure sodium lighting fixtures would not allow a reduction in either the number of lighting fixtures required or in the wattage per fixture. We will be providing lighting fixtures with flat glass, full cutoff, and perimeter shielding, and we feel that the use of metal -halide lighting provides for the safest environment in the parking areas of the site. • The City of Fayetteville Unified Code of Development stipulates on page 161:16 that within the Design Overlay District the content of monument signs shall be limited to the name of the business. We are requesting that a waiver be granted allowing for the inclusion of the logos "We Are In Business For Small Business" and "It's a Bid Deal" in addition to the name of the store.
