VAC 06-2045: (BELLAFONT II, 175): Submitted by H2 ENGINEERING, INC. for
property located NORTHWEST OF JOYCE BOULEVARD AND VANTAGE DRIVE.
The property is zoned C-3, CENTRAL COMMERCIAL and contains approximately 0.28
acres. The request is to vacate a utility easement located within the subject property.
Property Owner: The Barber Group Planner: Andrew Gamer
Findings: Staff finds that vacating the portions of easement would not adversely affect
access to the utilities serving the property or any other adjacent property.
Background/Property: The subject property is located northwest of Joyce Boulevard
and Vantage Drive. The Bellafont II Large Scale Development (LSD 06-4939) was
approved on this overall approximately 26 -acre property on March 27, 2006 by the
Fayetteville Planning Commission. The approved LSD is a 26 -acre mixed use
development with restaurant space, retail space, office space, and condominium towers to
hold a maximum of 99 residential units.
The subject 20' utility easement traverses east -west through the approved development
bisecting several of the structures as depicted on the drawing attached to this report. The
overall 20' easement was originally platted on this undeveloped property for general
utility use. Utility representatives have no objections to the requested vacation. New
utility easements will be provided and dedicated with the development and construction
of the Bellafont II project.
Request: The request is to vacate 0.28 acres of the existing utility easement.
The applicant has submitted the required notification forms to the utility companies and
to the City. The results are as follows:

Dear Staff,
This correspondence is a written description of the petition to vacate a portion of
an existing utility easement lying on Washington County Parcel # 765-15681-004 in
Fayetteville, Arkansas. The current owner of the property is The Barber Group. A Large
Scale Commercial Devleopment, currently in the city review process, will be placed on
this property and the properties adjoining it to the north and east. The presence of the
utility easement splits the combined property in half on the west side and creates some
design challenges which could be resolved by rededicating utility easement throughout
the development as needed to serve the various buildings planned to be constructed. We
have provided the utility companies with assurances that new utility easements will be
dedicated with the proposed development and the owner will incur the cost of relocating
any existing utilities within the easement.

AGRICULTURAL, and contains approximately 3.70 acres. The request is for a 4 -story, 42,620
square foot hotel with 120 parking spaces and 120 guest rooms.

Property: The subject property contains 3.70 acres, located on the north side of Old Farmington
Road, east of Shiloh Drive, and is zoned C-2, Thoroughfare Commercial. The site consists of
undeveloped pasture, with an access easement and paved 10' wide driveway along the eastern
boundary of the site. Surrounding zoning and land use is depicted in Table 1.

Request: The request is for Large Scale Development approval of the submitted site plans for the
proposed commercial development, Value Place Hotel.
Right-of-way Dedication: Right-of-way would be dedicated in the amount of 35' from centerline
along Old Farmington Road.
Adjacent Master Street Plan Streets: Old Farmington Road (a Collector Street).
Street Improvements: Staff recommends improving the north side of Old Farmington Road to Master
Street Plan standards along the project frontage for a Collector Street with an 18' from centerline
street section, curb, gutter, storm drains, and 10' concrete trail at the right-of-way line, extending the
street section without the trail from the project frontage approximately 195' east to Shiloh Drive.
Water/Sewer: Water and sewer are available to the site and will be extended to the facility.
Design Overlay District:
• Greenspace: The applicant has complied with the 25'greenspace
requirement along all rights-of-way.
Signage:
Curb Cuts:
Free Standing Sign: The only permitted free standing signs
shall be monument signs. Only indirect lighting may be
used for illumination of all signs.
Wall Sign: The applicant is allowed four (4) wall signs for
the entire building. All four signs may be placed on one
wall, but the signs shall not to exceed 20% or 150 square
feet of the area of the wall on which they are located,
whichever is less.
The proposal utilizes an existing curb cut on Old
Farmington Road. The curb cut does not meet the
minimum distance between curb cuts (200'), or minimum
distance from an intersection (250') as required by
ordinance. The proposed driveway is approximately 110'
from the adjacent curb cut to the east, and approximately
220' from the intersection with Shiloh Drive. Planning
Commission determination of waivers to allow for this curb
cut is required.
• Lighting: Lighting would be required to comply with the Lighting
Ordinance and would be reviewed at the time of building
permit.
Exterior Appearance:
Elevations have been submitted depicting all sides of the
structure. Planning Commission determination of
architectural treatment of fronts, along with Commercial
Design Standards, is required.

Public Comment: Staff has received one phone call and an email from a property owner to the
north of this site concerned with slope stability and erosion of the hillside that has been a
problem with the adjacent hotel property to the north.
Recommendation: Planning staff recommends approval of LSD 06-2036 with the following
conditions of approval:
SUBDIVISION COMMITTEE FORWARDED THIS ITEM WITH A RECOMMENDATION TO BE PLACED ON
THE CONSENT AGENDA (04-27-06).
1. Planning Commission determination of Commercial Design Standards and compatibility with
the surrounding commercial developments. Staff finds that the proposed building elevations
and material samples board are well -articulated and meet architectural design standards for
commercial structures.
SUBDIVISION COMMITTEE DETERMINED IN FAVOR OF THIS CONDITION (04-24-06).
2. Planning Commission determination of street improvements. Staff recommends improving
the north side of Old Farmington Road to Master Street Plan standards along the project
frontage for a Collector Street with an 18' from centerline street section, curb, gutter, stonn
drains, and 10' concrete trail at the right-of-way line, extending the street improvements only
from the project frontage approximately 195' all the way to Shiloh Drive. These street
improvements should be conceptually depicted on the plans submitted to the Planning
Commission, if determined appropriate by the Subdivision Committee.
SUBDIVISION COMMITTEE DETERMINED IN FAVOR OF THIS CONDITION (04-27-06).
3. Planning Commission determination of a waiver for distance between curb cuts and distance
between curb cut and an intersection in the Design Overlay District. The applicant proposes

to utilize an existing nonconforming driveway off of Old Farmington Road for the hotel
entrance. This driveway is approximately 110' from the adjacent curb cut on Old
Farmington Road when 200' is required, and is approximately 220' from the intersection
with Shiloh Drive when 250' is required. Staff recommends in favor of both of these curb cut
finding that the use of the existing driveway with an already recorded access easement
utilized by the existing hotel would not create an adverse or undesirable traffic condition at
this site.
SUBDIVISION COMMITTEE DETERMINED IN FAVOR OF THIS CONDITION (04-27-06).
4. Revise the site plan to address the following items:
a. Dimension the front setback from the edge of the 35' from centerline right-of-way
along Old Farmington Road.
b. Depict the street improvements extending all the way east to Shiloh Drive, and west
all the way to the western property line.
c. Locate and call -out 4 bike racks on the site plan within 50' of a public entry.
Tree Preservation Plan Conditions:
5. The tree near the building is not supported by staff for preservation. Please revise the Tree
Preservation Plan and Landscape plan to show this tree removed and replaced with an
October Glory red maple to meet landscaping requirements.
6. Removal of the tree referred to in condition 1 must be mitigated for appropriately. Please
increase the mitigation required number on the Tree Preservation Plan and Landscape Plan
and indicate which of the trees in the Plant Schedule will meet this additional requirement.
7. All revisions required with these conditions of approval must be made on the construction
plans before the issuance of a grading permit.
8. Mitigation will be required in the amount of 14(2) inch caliper large species trees. The
project is proposing on-site mitigation.
9. A 3 -year maintenance and monitoring bond will be required in the amount of $3,500. This
shall be deposited with the City of Fayetteville in the form of a letter of credit, bond, or check
before Final Certificate of Occupancy.
Standard Conditions:
10. Plat Review and Subdivision comments (to include written staff comments provided to the
applicant or his representative, and all comments from utility representatives: AR Western
Gas, SWBT, Ozarks, SWEPCO, Cox Communications).
11. All mechanical/utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. Ground
mounted equipment separate from the structure may be screened using large grasses or
shrubs. A note shall be added to all construction documents stating as such.
12. All lighting will be reviewed for compliance with the City's lighting ordinance at the

time of building permit. A lighting plan and manufacturer's cut -sheets of the proposed
fixtures shall be submitted by the applicant and approved by Planning Staff.
13. Trash enclosures shall be screened with access not visible from the street. The trash
enclosures shall be constructed with materials that are complimentary to and compatible with
the proposed building. A detail of the proposed screening shall be submitted and approved
by the Planning Division prior to issuance of the building permit. Any additional dumpsters
located on site shall be screened from the right-of-way. A note shall be added to all
construction documents stating as such.
14. All freestanding and wall signs shall comply with ordinance specifications for location, size,
type, number, etc. Signs are not allowed to be placed in utility easements.
15. Staff approval of fmal detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review process
was reviewed for general concept only. All public improvements are subject to additional
review and approval. All improvements shall comply with City's current requirements.
16. All existing utilities below 12kv shall be relocated underground. All proposed utilities shall
be located underground.
17. Large scale development shall be valid for one calendar year.
18. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection
measures prior to any land disturbance.
c. Separate easement plat for this project that shall include all utility easements.
d. Project Disk with all final revisions.
e. One copy of final construction drawings showing landscape plans including
tree preservation measures submitted to the Landscape Administrator.
f. Completion of all required improvements or the placement of a surety with
the City (letter of credit, bond, escrow) as required by Section 158.01
"Guarantees in Lieu of Installed Improvements" to guarantee all incomplete
improvements. Further, all improvements necessary to serve the site and
protect public safety must be completed, not just guaranteed, prior to the
issuance of a Certificate of Occupancy.
