LSD 06-1971: Large Scale Development (C -QUAD, 642): Submitted by EB LANDWORKS,
INC. for property located at CITY LAKE ROAD (STATE HIGHWAY 156), LOT 11
FAYETTEVILLE INDUSTRIAL PARK. The property is zoned I-1, HEAVY
COMMERCIAL/LIGHT INDUSTRIAL and I-2, GENERAL INDUSTRIAL, and contains
approximately 6.56 acres. The request is for five warehouse buildings and one office building
with a total of 41,736 square feet of warehouse space and 8,284 square feet of office space.

Findings:
Property: The subject property is located on City Lake Road (State Highway 156) and is
identified as Lot 11 in the Fayetteville Industrial Park. The property is split zoned I-1 and I-2.
The property is currently undeveloped grassland with some trees mainly concentrated along the
property lines. Surrounding land use and zoning is depicted in Table 1.

Request: The request is for Large Scale Development approval of the submitted site plans for the
proposed office and warehouse buildings.
Right-of-way being dedicated: 35' from centerline right-of-way for City Lake Road (State
Highway 156) along the project frontage by warranty deed.
Adjacent Master Street Plan Streets: City Lake Road (State Highway 156), a Collector Street
Water/Sewer: Water and sewer are available to the site and will be extended to the facilities.
Access: The site would be accessed off of two new curb cuts onto City Lake Road with private
drives providing access to the new buildings.

a good transition and compatibility with surrounding industrial development, and will not be

highly visible from the public right-of-way because of a topographic situation that would help
shield the structure. The structure is dominated by metal siding in violation of the design
elements for commercial structures (UDC Section 166.14(D)(1)(c)). Planning Commission
approval to waive commercial design standards is required to allow for the proposed structure
dominated with metal siding.
SUBDIVISON COMMITTEE FOUND IN FAVOR OF THIS CONDITION (03/16/06).
2. Planning Commission determination of street improvements. Staff recommends that a 6'
sidewalk be constructed along the project's City Lake Road frontage at the City right-of-way
line. The portion of the sidewalk that meanders away from the right-of-way to avoid existing
trees shall be dedicated as a sidewalk easement and recorded as such on the easement plat.
SUBDIVISON COMMITTEE FOUND IN FAVOR OF THIS CONDITION (03/16/06).
3. The lot split to create the subject tract is required to be recorded prior to issuance of building
permits.
4. Incorporate the following plat revisions:
a. Delete the `Parking Ratio Block' and replace it with Table 2 included in this report.
b. ADA Parking Table and Bicycle Parking Table: change the `# Vehicle Parking
Required' column heading to `# Vehicle Parking Proposed', and change 56 to 58.
c. Along the northern property line of Lot 1 IA change the side building setback in the I-1
portion of the site to a 10' setback.
5. Right —of -way dedication in the amount of 35' from centerline along City Lake Road (State
Highway 156) by warranty deed prior to recording the lot split.
6. Based on the industrial zoning and development of the site the first 10' of depth of required
front setbacks and of required rear setbacks facing a street and the first 20' of width of a
required exterior setback shall be permanently maintained in suitable landscaping. Please
indicate landscaped greenspace along the perimeter of the property in conformance with this
requirement on the landscape plan.
7. Prior to building permit, a cost estimate for all required landscaping is to be submitted to the
Landscape Administrator for review. Once approval is gained, a guarantee is to be issued
(bond/letter of credit/cash) for 150% of the cost of the materials and installation of the plants.
This guarantee will be held until the improvements are installed and inspected, at the time of
Certificate of Occupancy.
8. Mitigation will be required to replace 1,759 square feet of canopy removed. This will equal 4
(2) inch caliper large species trees to be planted on-site.
9. Before final Certificate of Occupancy these 4 trees must be planted and a letter of credit, bond,
or check shall be deposited with the City of Fayetteville for $1000. This amount is held for 3
years and released after the Urban Forester has inspected the trees and found them to be 90%

healthy or better.
Standard Conditions of Approval:
10. All mechanical and utility equipment on the wall and/or on the ground shall be screened.
All roof mounted utilities and mechanical equipment shall be screened by incorporating
screening to the structure utilizing materials compatible with the supporting building.
Smaller ground -mounted equipment may be screened with tall grasses or shrubs. A note
shall be added to all construction documents indicating as such.
11. Trash enclosures shall be screened with access not visible from the street. The trash enclosures
shall be constructed with materials that are complimentary to and compatible with the proposed
building. A detail of the proposed screening shall be submitted and approved by the Planning
Division prior to issuance of the building permit. Any additional dumpsters located on site
shall be screened from the right-of-way.
12. All freestanding and wall signs shall comply with ordinance specifications for location, size,
type, number, etc. Signs are not allowed to be placed in utility easements.
13. All exterior lighting is required to comply with the City's lighting ordinance. A lighting plan
and cut -sheets of the proposed exterior light fixtures shall be required to be approved by
Planning Staff prior to building permit.
14. Plat Review and Subdivision comments (to include written staff comments provided to the
applicant or his representative, and all comments from utility representatives: AR Western Gas,
SWBT, Ozarks, SWEPCO, Cox Communications).
15. Provide a CD containing the proposed Large Scale Development drawings in AutoCad or
similar digital format.
16. Staff approval of final detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks, parking
lot(s) and tree preservation. The information submitted for the plat review process was
reviewed for general concept only. All public improvements are subject to additional review
and approval. All improvements shall comply with City's current requirements.
17. All existing utilities below 12kv shall be relocated underground. All proposed utilities shall be
located underground.
18. Large scale development shall be valid for one calendar year.
19. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree
protection measures prior to any land disturbance.

approve the building elevations. It is standard practice for staff to review and approve
commercial building elevations of this size. If staff believes further interpretation of the
standards is necessary. we can submit the elevations to the Planning Commission as a
modification to the Large Scale at a later date.
The proposed office building is intended to be a professional office for an architectural design

VAC 06-2005: Vacation (Alt/Herget, pp 295) was submitted by Sheree Alt for property

request is to vacate a portion of the utility easement along Township St.
Findings:
Property description: The subject property is located within Covington Park Subdivision
on E. Township St., east of Crossover Rd. There is an existing 25' building setback and
utility easement running east and west along Township St.
Background: The easement encroachment was discovered after a survey of the property
was completed for a pending sale of the property. The applicant has also requested a
setback variance from the Board of Adjustment for the setback encroachment. The
general utility easement along Township Street has water and sewer lines located
adjacent to the right-of-way.
Request: The request is to vacate approximately 27.8 sq. ft. of the southern portion of the
utility easement.

UNITS/ACRE and contains approximately 19.99 acres. The request is for a residential
subdivision with 55 single family lots.

• Findings:
Property: The subject property contains approximately 20 acres located west of George
Anderson and south of Albright Road. This property was annexed into the City from Springdale
and rezoned RSF-4. The applicant proposes to create a 55 single-family lot subdivision, a
density of 2.8 units per acre.
Background: A similar proposal was submitted under the name Craig Harper Preliminary Plat in
2004. This plat was approved by the Planning Commission of December of 2004. It has since
expired and the property has changed hands. The proposal under consideration, though similar
to the original proposal, has smaller lot sizes, increasing the overall lot yield by 8 lots and has
alternative street connections on the adjacent streets. The property to the south is under
construction as Copper Creek Phase 3, and the property to the southwest was once approved for
development, though this project has also expired.

connection north to Albright Road, one connection to the west that will be stubbed out for future
connectivity, and a street connection onto George Anderson Road, as recommended by the
Subdivision Committee.

Conditions of Approval:
1. Planning Commission determination of appropriate street connectivity. Stafffinds that
the proposed street connections are adequate. The Subdivision Committee forwarded
this project with a recommendation that a street connection be provided to George
Anderson Road through Lot 15. The applicant has provided a connection north of
Lot 15 to avoid the creation of a long, straight street.
2. Planning Commission determination of street improvements. Staff recommends widening
George Anderson Road to 14'from centerline including storm drains, curb and gutter,
pavement and sidewalks. The east side of the roadway will be in the county, and will
need to be improved to current County standards. Albright Road will need to be
improved to 14' from centerline including storm drains, curb and gutter, pavement and
sidewalks. The Subdivision Committee determined in favor of these improvements.
3. Sidewalks adjacent to Albright Road, George Anderson Road, the detention pond, and
the lift station shall be constructed, not guaranteed, prior to recordation of the final plat.
4. The lift station and force main located in the Stonewood Subdivision shall be upgraded to
accommodate the existing flows as well as the additional flows from this development.
A filed deed for the property on which the lift station is located shall be submitted to the
City Engineering Division prior to recordation of the final plat.
6. Payment of $30,525 for 55 single-family units in lieu of dedication of parkland.
7. Mitigation in the amount of 20 (2) inch caliper large species trees will be required to
replace 5,804 square feet of canopy removed on this site. Staff recommends on-site
planting as the mitigation option.
8. A 3 -year maintenance and monitoring bond, letter of credit, or check shall be deposited in
the amount of $5000 with the City of Fayetteville before signature of Final Plat. After

the 3 year period the Urban Forester will inspect the trees. Finding 90% healthy, the
bond will be released.
At the time of Final Plat, an On-site Mitigation Planting Plan shall be submitted for
approval by the Urban Forester.
10. Street lights shall be installed or guaranteed with a maximum separation of 300 feet along
all streets (including Albright and George Anderson Rd.) prior to final plat.
11. Subdivision area signage shall be permitted in accordance with applicable city codes.
12. Signs shall be installed at each street stub -out to indicate the future extension of the right-
of-way prior to recordation of the final plat. (Coordinate with the Transportation
Division.)
13. All existing structures and driveways shall be removed prior to recordation of the final
plat.
14. The detention pond shall be owned and maintained by the P.O.A.
15. The lift station shall be screened from the right-of-way with a 6' wood board privacy
fence and evergreen vegetation prior to the application of signatures on the final plat.
16. The final plat submission shall reflect the following revision:
a. Modify the street table such that the street width, greenspace, and sidewalk
together will total the proposed right-of-way; greenspace for Streets "A" through
"E" should be modified from 6' to 7'.
b. Submit a survey of the property, stamped and signed by a licensed surveyor.
Standard Conditions of Approval:
17. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives - AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications)
18. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private),
sidewalks, parking lot(s) and tree preservation. The information submitted for the plat
review process was reviewed for general concept only. All public improvements are
subject to additional review and approval. All improvements shall comply with City's
current requirements.
19. All overhead electric lines under 12Kv shall be relocated underground. All proposed
utilities shall be located underground.
20. All street names shall be approved by the 911 coordinator.
