VAC 04-1324: Vacation (Elder/Salem Townhouses, pp 401) was submitted by C&K
Properties for property located on the north side of Highway 16 and the west side of Salem Road.
The property is zoned R-O, RESIDENTIAL OFFICE, and contains approximately 4.77 acres.
The request is to vacate a portion of a utility easement on the subject property for the
construction of a residential structure.
Findings: Vacating the portion of the utility easement would not adversely affect access to the
remainder of the easement.
Background: In August of 2004, the Planning Commission granted approval of a Large Scale
Development(LSD 04-1149) for the subject property, consisting of condominium-style
development with 58 two-bedroom units. One of the buildings in the southwest corner is
proposed to be situated within an existing 20' utility easement. This 20' utility easement is
currently utilized by Ozarks Electric and Cox Communications and contains overhead power and
television cable. A condition of approval of the Large Scale Development, approved by a vote of
8-0 by the Planning Commission, states that the subject easement shall be formally vacated, with
overhead lines to be relocated underground. The subject request is to comply with this condition
of approval.
Request: The applicant requests to vacate a portion of an existing utility easement to allow for
construction of a residential structure.
The applicant has submitted the required notification forms to the utility companies and to the
City. The results are as follows:

Public Comment: The applicant has submitted the required notification forms to the adjacent
property owners. One adjacent property owner has requested additional information regarding
the relocation, especially with regard to the existing trees and how the utilities will be rerouted.
No other adjacent property owners have responded with concerns.
Water/Sewer Response: The requested vacation does not affect water and sewer lines,
easements, or operations. The requested condition for looping the system is appropriate at the
time of Large Scale Development review/development review, and has no bearing on the
subject request.
Recommendation: Staff recommends approval of the proposed utility easement vacation 04-
1324 with the following conditions:
1. At the cost of the developer,the overhead electric lines and Cox Communications lines
shall be relocated underground. The existing utilities shall remain in service until their
relocation is complete.

The property is in the City of Fayetteville and the Planning Area and contains approximately
7.47 acres. The request is to divide the subject property into two tracts of 5.67 and 1.80 acres

Findings:
Proposal: The subject property is located south Huntsville Road and west of Robert's Road.
The applicant proposes to subdivide the almost 7.47 acre tract into Tracts A and B of
approximately 5.67 and 1.80 acres respectively. Tract A is located within the City and Tract B is
within the Planning Area. Tract B does not have frontage on any right-of-way. The applicant
has submitted a request to waive the County requirement for a lot width requirement of 75'.
Background: The subject property was part of an annexation and rezoning request submitted by
Ms. Jones in 2004. Upon discovering that annexing the entire 7.47 acre parcel would create an
island of unincorporated property within the City limits, staff recommended that the applicant
reconsider the annexation request. The second annexation request consisted of annexation of
only a portion of the property—the proposed Tract A-so that an island would not be created.
The City Council approved the annexation of property in August 2004, resulting in a 7.47 acre
tract both in the City and Planning Area.
Subsequently, the new owner of the property, Mr."McDonald, applied for approval of a
preliminary plat for Bridgedale Subdivision on the newly annexed property. The Planning
Commission approved the preliminary plat on October 29,2004. The plat designated a 25'
access easement north from the extension of Eastpointe St. to access the 1.8 acres, part of which
was designated as a drainage easement for the subdivision. Staff recommends that the lot split
not be filed until such time that a final plat for Bridgedale Subdivision is approved and the use of
the lot is established. (See Condition#3)
This requested lot split was heard at the Subdivision Committee meeting on December 03, 2004
at which time it was forwarded to the Planning Commission. No public comment was taken.

Access: The proposed Tract A currently has access to a stubbed out road,Eastpointe Dr.,which
is proposed to extend east with the development of Bridgedale Subdivision. Tract B,however,
has no frontage on an improved public street. The only means of access is by way of a proposed
25' access easement from the extension of Eastpointe Dr. The applicant's representative has
submitted a letter to the Planning Commission requesting a waiver of lot width requirements.
Although the configuration of the property meets the definition of a tandem lot,the Planning
Commission is hearing this as a waiver request and not a conditional use for a tandem lot
because there is no zoning designation in the County. (See Condition#1)
Development: Staff recommends that the proposed Tract B should be restricted from
development of any residential, commercial or accessory structure until appropriate
infrastructure is provided for the following reasons (See Condition#2):
1. The use of much of the property is designated for a detention pond to serve
Bridgedale Subdivision, and because the City requires that each subdivision detain
water run off,it is important that this property, or at least the portion designated for
detension,remains as such.
2. Lack of infrastructure to sustain any development.
3. Access to the property is by way of a 25' access easement located on two lots within
Bridgedale Subdivision. It is inappropriate to establish a driveway on these lots.
4. The property is within the Planning Area and without zoning. The City cannot
regulate the type or amount of possible future development on the property.
5. The preliminary plat for Bridgedale Subdivision could have included a stub-out to
this property for future development to provide adequate street frontage,but no such
stub-out was made.
Water/Sewer: Water and sewer is to be extended to the property approved for Bridgedale
subdivision.

2. No residential, commercial, or accessory structures may be constructed on Tract B until
such time as sufficient right-of-way and infrastructure are provided. A note shall be
placed on the lot split and final plat for Bridgedale Subdivision reflecting conveying this
restriction.
3. The lot split shall be filed with the final plat of Bridgedale Subdivision and noted as an
outlot on the final plat document. Approval of this condition gives an automatic
extension of the one-year expiration of this lot split as required by Ch. 166.20.
4. Washington County approval of the proposed lot split shall be obtained prior to filing the
lot split.

lot without frontage on a right-of-way. The Planning Commission and City Council have
reviewed and approved annexation, zoning,and the establishment of the represented lot split in

This lot split was created so that in practice an island of county would not be created within City
Limits.
Access, by private drive to the split lot is provided by easement between proposed Bridgedale
Lots 21 &22. The access is provided for maintenance of the proposed detention facility and for
future use of the lot. Use is not determined at this time.

The following responses are provided from comments received at Tech Plat review,Wednesday,
November 10h.
Planning Division:
2.a. The proposed lot is within the City's Planning Area and designated as an off-
site detention pond accessible via an access easement south to the proposed
Eastpoint Dr.
This is incorrect. Being, only a portion of the Lot Split area is going to be designated as a
drainage easement,as has previously been indicated. The boundary of the drainage
easement determined based on final drainage.need calculations.
2.b. This lot shall be an unbuildable lot. Please include a note on the plat
designating Tract B as unbuildable.
This may also be incorrect. There is an access easement provided and as only a portion of
the lot is to be designated as a drainage easement. The remaining portion maybe
buildable. Also, at some future point as land development occurs to the north,the
detention facility may be relocated or greatly reduced and a large portion of the current
proposed'drainage easement vacated. The lot may be developable via a private drive
along the current designated access easement or from another location- Our client does
not wish to label the lot,Tract B, as unbuildable.
This is the second lot split for the parent tract 001-10699.

RECOMMENDED MOTION: Staff recommends approval of the conditional use subject

1. Development on this tandem lot shall be limited to one single-family home and
appropriate accessory structure(s).
2. A new access drive shall be paved a minimum of 25 feet in length from the
intersection of the drive and Ray Avenue and comply with City standards to provide
safe and adequate emergency service access.
3. No vehicles shall be parked at any time on that portion of a tandem lot utilized as a
private drive.
4. Complete building and site plans compliant with City regulations shall be submitted
to the City to secure a building permit.
5. Prior to issuance of a Certificate of Occupancy the applicant shall.coordinate with
the Solid Waste Division for appropriate solid waste disposal. Any solid waste
containers shall be stored in a screened location except on collection days. Staff
recommends the use of a residential cart that may be wheeled to an appropriate
location on collection day only.
6. Minimum building setbacks shall be 20' from all property lines and 25' from the
right-of-way of Ray Avenue as dictated by the Master Street Plan.
7. Sidewalk construction along the right-of-way of the 1.56-acre subject property. Mr.
Rutherford,Sidewalk Coordinator, has recommended construction of sidewalk due to
the proximity of adjacent sidewalks and nearby elementary school that would generate
substantial pedestrian traffic. Staff is in support of this recommendation.

into two tracts of 0.44 and 1.12 acres respectively(shown as Tracts B and C on the survey). The
property is located north of Huntsville Road and west of Ray Avenue and is south of Bassett
Subdivision. Creation of this parent tract of 1.56 acres is subject to the approval of LSP 04-
1312. The subject property has just less than 135' of lot width, is very deep and has an unusual
rear lot lines leaving substantial area of land without direct access to Ray Avenue. Development
on the property consists of a single family home at this time. The applicant is proposing to
subdivide 1.12 acres for development of an additional single family home. The proposed lot has
a 25' lot width on Ray Avenue;less than the required 70' within the RSF-4 zoning district, and is
located behind the proposed 0.44 acre tract. As such,this lot may be approved as a tandem lot,
defined in the Unified Development Code as: A lot which does not have required frontage on a
public street and which is located behind a lot or a portion of a lot which does have frontage on
a public street.
Proposal: The applicant is requesting a tandem lot in order to develop the rear portion of the
property for single family use. A letter from the applicant's representative stating the intentions
for this lot has been attached.
Recommendation: Staff is in support of the creation of a tandem lot located on Ray Avenue.
The result of this action will be that this property will be the development of an additional single
family lot within a residential neighborhood.
