The property is zoned R-PZD and contains approximately 7.65 acres. The request is for an extension of the approved Residential Planned Zoning District, R-PZD 03-04.00 for 1 (one)year. Planner: JEREMY PATE BACKGROUND Project Description: The approved R-PZD is to construct a project with 112 multi-family residential units with 168 bedrooms and parking spaces and 15,400 SF of commercial/office space with 57 parking spaces proposed. Background: The original R-PZD for this site was recommended for approval to the City Council with a 7-1 vote by the Planning Commission in October of 2003, with all conditions as stated by Staff and an additional condition for signage requirements. Numerous determinations were made by Planning Commission as well, and are reflected in the attached staff report. The City Council approved R-PZD 03-04.00 on November 18, 2003, as reflected in the attached Ordinance No, 4528. The applicant has submitted all required fees and other initial items to gain building permit approvals for all of the multi-family units for the subject property. The building permits fonthe commercial structures, however,have not been obtained due to ongoing negotiations with potential tenants and reworking of the commercial spaces by the architect to accommodate these uses. Proposal: The applicant requests to extend the approval of the Planned Zoning District development plans for one year, to expire on November 18, 2005. As noted in the attached letter of request, the applicant has not been able to finalize designs on the three retail/commercial buildings as of yet to accommodate the potential tenants for the space. All permit are required to be obtained prior to the one-year deadline. If this is not possible, the Unified Development Code allows for a one-time extension request to be made to the Planning Commission, if submitted prior to this deadline. RECOMMENDATION Planning Staff recommends approval of ADM 04-1336, the requested extension to the R-PZD 03-04.00, approval with the following conditions: 1. The applicant shall be allowed until November 18, 2005 to receive all required building permits. If, at this time, all permits required have not been issued, appropriate actions to revoke the Planned Zoning District approvals shall be taken. 2. Prior to the issuance of additional permits for this project,the right-of-way for Razorback Road shall be dedicated by separate instrument. DISCUSSION The Unified Development Code gives the Planning Commission authority to extend approval of a planned zoning district one additional year if the applicant requests the extention prior to the one year time limit and shows good cause why the tasks could not reasonably be completed within the normal one year. It is within this time that the applicant shall receive all permits and approvals as required by City, State, and Federal regulations to start construction of the development or project. The applicant's representative states in the attached letter that due to architectural changes to accommodate potential tenants in the three retail/commercial structures on the property,all permits have not been requested.No ordinance amendments that would potentially affect this project have been passed since the City Council approvealof the subject R-PZD 03-04.00. This action will establish a unique zoning district for development of an 8.79 acre tract located on the west side of Razorback Road south of 6`h Street and north of Baum Stadium. The proposal is for the construction of 112 multi-family residential units with 168 bedrooms and 168 parking spaces and 15,400 s.f of office/retail space with S7 parking spaces. BACKGROUND The subject property is currently vacant land located on Razorback Road,between 6a' Street and 15d'Street. Surrounding land uses include commercial, manufacturing, and University of Arkansas student activities(Baum Stadium). The proposed R-PZD was heard at Technical Plat Review on August 27, 2003 and at Subdivision Committee on October 02, 2003. Discussion at the Subdivision Committee meeting included: building elevations, office/retail structure location, Commercial Design Standards,parking and street alignment. DISCUSSION The Planning Commission voted 7-1-0 in favor of this request on Monday, October 13, 2003. Approval of a planned zoning district requires City Council approval as it includes zoning(land use) as well as development approval (large scale development). Recommended conditions included in the attached staff report were approved by the Planning Commission with one addition: Signage for the commercial structures shall be wall mounted only and shall be in accordance with C district wall signage allowances as stated in Chapter 174 Signs of the Unified Development Code. All tree mitigation required is being planted on-site,providing for a significant amount of potential future canopy coverage. A draft of Covenants has been submitted for Planning Commission review. Proposal: The applicant requests to formally modify the submitted plans for the development associated with this project, to reflect corrected building setbacks that were presented in conjunction with the original Planned Zoning District. Evidently discrepancy in the Engineering and Architectural site plans caused the Engineering Site Plans to never be updated. As ultimately presented in the architectural drawings, the requested building setback along Cleburn Street was 8 feet; the submitted engineering site plan drawings indicated a 10-foot setback. A total of 2,718 SF of office space is proposed. Access: The development is proposed to have one means of vehicular access onto the site, from Pollard Avenue. All other access points are on-street or pedestrian-oriented. Buildings near the street, on-street parking, and the placement of appropriate landscaping in the development have been situated to create a desirable,pedestrian-oriented streetscape along the two street fronts of Pollard and Clebum. Parallel parking and sidewalks are incorporated with the development; and the on-site parking is located to the rear of the structures.Primary greenspace is located along College Avenue, with the addition of numerous plantings. The dangerous steps leading down onto College Avenue are proposed for removal, with the reconstruction of a pedestrian access in a safer configuration.
