Meadow) was submitted by Flint Richter, an adjoining property owner. The request is for the Planning Commission to review the conditional use permit issued in 1985 to allow the operation of an antique shop at 304 W. Meadow Street. RECOMMENDATION: Staff recommends that the Planning Commission conduct a public hearing in order to gather data and hear testimony from the property owners as well as affected neighbors. FINDINGS: Property description: The subject property is located at 304 W. Meadow Street. This residential structure has been used for many years for the purpose of selling and refurbishing antiques. The surrounding neighborhood is zoned R-O,Residential Office and contains small professional offices, single and multi-family residences and services such as beauty salons and bike shops. This area is within the Downtown Master Plan boundary. Background: In 1974, the current property owners of the subject property moved into this structure and began refinishing and selling antiques from this location. Later, this use was formally approved by the Fayetteville Planning Commission with the issuance of a conditional use permit to operate an antique shop.That action, as recorded in the Planning Commission minutes of October 28, 1985, was a"means of legalizing his antique operation."The owner's describe the current use of the properly as substantially the same as the use that was established in 1974. There is little documentation from this 1985 action. Minutes are brief and not detailed. There are statements in both the Planning Commission minutes and the Board of Adjustment minutes from a hearing on a request of the owner to vary a setback for an accessory structure that give some indication of the use of the property at that time. Locust Ave. Date: September 21, 2004 RE: Addendum to Conditional Use Variance Complaint @ 304 W. Meadow for Long Ago Antiques .......................memo..............a.....................m........8 Long Ago Antiques, located at 304 W. Meadow, is within the boundaries of the Downtown Revitalization District, and currently advertises its services in three local phone directories. In all three directories, Long Ago is listed as an Antiques Dealer, which adheres to their conditionally approved variance to operate a retail antique store. As you look further, Long Ago Antiques also advertises itself as more than a retail antique outlet, as evidenced by their listings under both the Antiques Repair&Restore and Furniture Repair&Restore, respectively,in all three directories. (Attached) Repairing and Restoring Furniture is mentioned in the UDC Unit 17 Furniture Repair, which is only allowed in C3, C-4(under conditional use)and I-1 zoning areas. This is not a new topic for the city planners. In 1981 Mr. Stiles appealed to the Board of Adjustment for a variance to reduce setbacks on his new workshop. When asked what the building would be used for"he stated he refinishes antiques. His insurance company will no longer insure him as he stores flammable materials in his present workshop, which is located in his garage. He stated he would like to store these types of materials in the proposed structure." Mr. Stiles' insurance company clearly recognized the dangers associated with such operations,as did the Board of Adjustments, which denied the appeal due to the fact that the use(refinishing antiques)would be non-conforming in R-O. This use is only reflected in UDC, Unit 31, Chemical and Allied Products,to wit: "any process likely to emit odor and/or have the potential for explosion". This use unit is allowed only as a conditional use in I-2. With these use units defined, Long Ago Antiques is clearly not compatible with a residential/office neighborhood that is destined for greater infill. When we took our concerns to the Dickson Street Neighborhood Association in 2002, we were told by our then-city councilor Cyrus Young that we should bring this issue to the Planning Commission right then. Instead,we spent two years of trying to mediate a resolution through a variety of resources: Code Compliance, Mr. Young(a personal friend of the Long Ago Antiques' owners)and City Planning. And, finally,that leads us to you. September 27,2004 Planning Commission ADM 04-1230(CUP Review for 304 W.Meadow) Page 1.5 With an eye to the future, our neighborhood is in the heart of the Downtown Revitalization District and our block is a perfect example of what mixed-use can mean...we have a magazine office, a hair salon,two state agencies, a dentist office, four older homes converted into rental units, an old house torn down for a 4-plex and, formerly, an antique shop. Quaint retail shops do not prohibit their neighbors from enjoying clean air. Industrial refinishing shops do. This is a great place to live and if the master plan is that we're going to live closer together downtown, let's do it under the common assumption that we are all smoke-free and fume-free in the Dickson Street neighborhood. Meadow for Long Ago Antiques ............................................................. ...........� Pursuant to previous conversations with City Planning staff,this letter is a formal complaint of conditional use changes at Long Ago Antiques. I have owned the home at 101 N. Locust for 9 years,which is adjacent to the north side of Long Ago Antiques. At that time,the business functioned primarily as an antiques retail shop, with some refinishing services provided. As the years have gone by,the retail side of the shop has decreased while the refinishing services have increased. Recently, there has been almost a total shift from retail to refinishing and it appears that the former retail space is now being used store pieces of furniture waiting for repair and/or refinishing. As a downtown homeowner, I support mixed-use development. My property is a home with a rental unit on the second floor and is surrounded by other small businesses, apartments and a dentist's office. The presence of an antique shop makes for a charming component of our neighborhood and I have no complaint against the retail distribution of repaired/restored furniture. However, the refinishing element of the antiques shop creates strong fumes from the lacquer thinner and other finishing solvents. The smell from these fumes is, at times, overpowering and, in general,unpleasant. We have had renters in the past who have filed complaints with City Code Enforcement,the Fayetteville Fire Department and the regional air inspection division of the Arkansas Department of Environmental Quality (ADEQ). Two of those renters moved out because they could not take the smell of the fumes. The neighbors on the west side of Long Ago Antiques live in a four-unit home and have also periodically filed complaints with Code Enforcement. Evidence of increasing chemical usage is document in two separate reports taken by the ADEQ Air Division Inspector: October 23, 1997—Written report states that, "Paint/solvent odors from facility are causing a nuisance and health concerns. ..Coatings and chemicals used at this location include lacquer/thinner and denatured alcohol. Mr. Stiles stated that he paints 8 hours/week and that annual usage of chemicals is <200 gallons/year. The coating area is<5 ft. from the property line...It is very likely that any solvent/painting can be detected off site. Wind movement would be restricted." August 24, 1998- Written report states that, "Paint/solvent odors from facility are causing a nuisance and health concerns. Coatings and chemicals used at this location include lacquer/thinner and denatured alcohol. Mr. Stiles stated that he paints—8 hours/week primarily during the day. Paint/solvent annual usage was estimated to be 500 gallons lacquer/thinner, 100 gallons denatured alcohol, 100 gallons stain, 180 gallons finish and 10 gallons of mineral spirits.The coating area is <5 feet from the property line. It is very likely that any solvent/painting can be detected off site. In less than one year's time,the Stile's stated chemical usage increased by 690 gallons. And that was in 1998. Other than just spraying that many chemicals in a dense area, the disposal of this product constitutes a hazardous waste. One of Mr. Siiles' disposal methods is by evaporation and his evaporation booth;which is not enclosed, on the West side of the property emits odors for extended periods of time. We have tried to discuss the situation and make suggestions with Bill Stiles, Owner of Long Ago Antiques,but we have not been able to come to any kind of amicable understanding. One such suggestion has been moving only the solvent-based element of their operation out to their other antique shop location on Hwy. 16(which has much more space and - fewer neighbors). This recommendation would still provide the neighborhood and visitors with a downtown antiques retail shop,without the associated fumes and odors. At each turn,Mr. Stiles has been hostile and convinced that our goal is to"shut him down", which is not true. We simply expect to have the same kind of clean air that the Smoke Free Coalition pressed for in the recent smoking ban.Ironically, Eric Stiles (son of Bill/resident and operator of Long Ago Antiques) actually wrote a published letter to the editor of the Northwest Arkansas Times expressing his unequivocal support for the Clean Air campaign. Although Antique Shops are not technically allowed in R-O zones, Mr. Stiles was granted a Conditional Use permit on October 28, 1985 to operate an antiques shop. However, according to the language of Conditional Use(Section 6, Article 9, Appendix A, pages 879-80),the refinishing element of the antiques shop seems, by definition,out of compliance in the following areas: September 27,2004 Planning Commission ADM 04-1230(CUP Review for 304 W.Meadow) Page 1.15 Richter Conditional Use Complaint Page 3 6.(b) The Planning Commission shall make a finding that it is empowered under the section of this ordinance described in the application to grant the conditional us and that the granting of the conditional use will not adversely affect the public interest. 6(c)(2) ...with particular attention to...the economic,noise, glare, or odor effects of the special exception on adjoining properties and properties generally in the district; 6(c)(5) Screening and buffering with reference to typed,dimensions, and character; 6(c)(8) General compatibility with adjacent properties and other property in the district. Although this written complaint addresses current conditional use changes, I submit that by performing any refinishing services in a densely populated,mixed-use, R-O downtown neighborhood,this small business does not meet the standards of compatible conditional use. This potential mixed-use conflict has been a long time coming and was actually foreseen by former members of the Planning Commission and Staff, as evidenced by the following selections from City correspondence and meeting minutes: September 14, 1981 —Appealed to Board of Adjustments to vary North and West setbacks from 10 feet to 2 feet for the construction of a"storage building" separate from the single-family home and workshop. Planning documents reflect that Mr. Stiles was required by his insurance company to remove his solvents/chemicals from around his house. To wit,"His insurance company will no longer insure him as he stores flammable materials in his present work shop which is located in his garage. He stated he would like to store these types of materials in the proposed structure." September 21, 1981 - Application denied by Planning Commission. Comments from commissioners include: "However, he was a little apprehensive about granting a variance for a use that does not appear to be allowed in the R-O. This is the site of an antique shop which has drawn complaints from neighbors due to chemical usage and odors. Actions considered by the City include: September 1981: Board of Adjustment heard a variance request to allow construction of a 20' x 20' workshop at the northwest corner of the property, 2' from property lines (10' side setbacks required/8' variances). The requested variance was denied. At the meeting of the Board of Adjustment on September 21, 1981, a board member asked how long the owner has been refinishing and selling antiques at this location. The answer was—seven years which was determined by the Planning Administrator to be an existing non-conforming use. Board members voiced concern with granting a variance to allow the expansion of a non- conforming use as well as the applicant's ability to construct the building within required setbacks. July 1984: Correspondence in the file from the Planning Division to City Attorney Jim McCord stated that the applicant wished to erect a sign for the antique/office furniture business that he operated from his home at the subject property. The sign could not be approved due to the non- conforming use of the property which would require conditional use approval in order to comply with current regulations. August 1984: Note in the file information states that the applicant met with staff and was "disappointed about the possibilities of getting a rezoning." October 1985: Planning Commission unanimously approved a conditional use permit to allow an antique shop at the subject property. All file information regarding the Planning Commission and Board of Adjustment actions is attached. Staff did locate a complaint file dated July 2002 at which time a complaint from an individual living at 101 N. Locust stated that the fumes from the subject property caused headaches, nausea etc. and that he had also complained to the Fire Dept., Code Compliance and ADEQ. As we discussed a couple of weeks ago, I am requesting that you review the facts of this situation. With that request, I guess I have a few questions: • Can the City revoke a conditional use permit unless there has been a violation of a condition of its issuance? • With no documentation and nothing stated in the PC minutes, do we make assumptions as to the conditions of this permit? • Is this a situation that merits or would require a hearing by the Planning Commission? • Does the City have the authority or ability to enforce Clean Air regulations? • If the issue of air quality were not attached to this site, would there be a question as to whether the antique shop was appropriate? ■ Is this a land use complaint or an air quality complaint? If we were to look at a similar request today, knowing what I know about this site, I would probably recommend that the PC require compliance with any applicable air quality regulation as enforced by ADEQ. But I would not know what levels of chemicals or which specific chemicals to prohibit or to allow. Q2: Has the refinishing become the predominant use on the property?(Think Industrial vs. Retail) There is nothing in the UDC that speaks directly to this issue, therefore, these are questions of fact that you and/or the P/C must answer. OR, 2)Mr. Richter can continue to pursue his environmental complaint through ADEQ; OR, 3) Mr. Richter could confer with his legal counsel about bringing a private nuisance action against the shop owner. regret that I cannot provide you with a more definitive answer.
