6. FPL 03-05.00: Final Plat (Legacy Point Phase I, pp 435/474) was submitted by
Jorgensen and Associates on behalf of Charles Sloan Properties,.Inc.for property located
east of Double Springs Road and south of Owl Creek. The property is zoned R-1, Low
Density Residential and RMF-6, Low Density Multi-family Residential and contains
approximately 36.53 acres with 66 single family and 24 duplex lots proposed.
7. ADM 03-15.00: Administrative Item (Zoning Map): An ordinance adopting a new
official zoning map and incorporating the renamed zoning districts on the new official
zoning map as adopted in Title 15 of the Unified Development Code of the Fayetteville
Code of Ordinances. Three copies of the new official zoning map have been filed in the
office of the City Clerk located at 113 W. Mountain Street, City Administration Building
and are available for public examination prior to the passage of the ordinance adopting
the new official zoning map. A copy of the new official zoning map is also available for
review and examination in the Planning Division located at 125 W. Mountain Street.
8. ADM 02-28.00: Administrative Item (Hillside/Zoning Study): A progress report on
the Hillside Study which is being prepared in response to City Council Resolution
No.130-02. The Resolution directed the Planning Commission and the Planning staff to
consider looking at areas zoned R-2 that have slopes over 15% and those areas that have
a recorded,platted subdivision where the infrastructure has not been built.
9. ADM: Administrative Item (2003 Work Program): In February, the Planning
Commission prioritized items for the 2003 Work Program. These items have been
compiled by order of importance for Planning Commission approval. The Work Program
is a list of tasks that are in-progress or anticipated for the upcoming year for the Planning
Division and Planning Commission. The tasks stem from the guiding policies and
implementation strategies in General Plan 2020, adopted by City Council on December
17,2002.
All interested parties may appear and be heard at the public hearings. A copy of the proposed amendments and
other pertinent data are open and available for inspection in the Office of City Planning(575-8267), 125 West
Mountain Street,Fayetteville,Arkansas. All interested parties are invited to review the petitions. Interpreters or

BACKGROUND:
Property description` The subject property is vacant and the configuration of this request is a
flag lot surrounding an existing single family home. The property is adjacent to the city limits
along the eastern boundary where the Clabber Creek subdivision is under construction.
Proposal: The applicant proposes to develop a church on the subject property. An associated
request for P-1 zoning has been submitted for consideration.
Request: The request is to annex the subject property into the city of Fayetteville.
Recommendation: Staff is unable to recommend approval of this request at this time. Street,

sewer and fire protection systems in this area need to be improved in order to adequately serve
the subject property. After completion of improvements to the Hamestring Creek lift station,
construction of fire station#7 on Rupple Road, and the acceptance of a city-wide traffic study
which is currently being conducted, annexation requests in this portion of the city's growth area
will be more appropriate. These studies and improvements will provide staff a better means of
analyzing current conditions with regard to provision of services for proposed annexations.

INFRASTRUCTURE:
Streets: Access and the only available street frontage is on Mt. Comfort Rd. along the
south boundary of the site. Mt. Comfort Rd. in this location is classified a minor
arterial on the master street plan. It is not built to that standard.
If development occurs on this site, Mt. Comfort Road would need to be improved to
a minimum of 14'from centerline including pavement, curb and gutter, storm
drains and sidewalk.
Water: The property currently has access to a 4"and 8"waterline along Mt. Comfort
Road. The Clabber Creek Phase II subdivision to the east also has 8"lines
proposed.
Sewer: Sewer is not currently available to this property.
The nearest sewer main is located to the south of Mt. Comfort Road. This area of
town has been identified as an area of concern for sewer service. The Hamestring
Creek lift station is currently being upgraded to handle existing flows and any
development proposed at the time of the study earlier this year. This upgrade
should be completed this summer.
Fire: The subject property is located 3.4 miles from Fire Station#2.Normal driving
time is 5 min. 9 seconds. Water supply will be necessary for this property to
develop.
LAND USE PLAN: General Plan 2020 designates this site as Residential.

FINDINGS:
11.6 ANNEXATION GUIDING POLICIES
BOUNDARIES
11.6.a Annex existing islands and peninsulas and do not annex areas that would create an
island or peninsula.
Finding: The requested annexation will create an island or peninsula. The configuration
of this proposal is not consistent with the City's adopted policy for annexations.
The creation of an island is undesirable and causes conflicts in the provision of
services.
11.6.b Proposed annexation area must be adjacent, or contiguous,to city limits.
Finding: The proposed annexation area is adjacent and contiguous to the City Limits.
11.6.c Areas should either include or exclude entire subdivisions or neighborhoods, not
divide.
Finding: This area does not consist of defined'subdivisions or neighborhoods,however an
adjacent property which will become an island within an unincorporated area
is not proposed to be annexed at this time.
11.6.d Boundaries for annexed areas should follow natural corridors.
Finding: Proposed boundaries follow property lines or desired property lines and not
existing roads, streams or other natural corridors.
11.6.e Timing of services within annexation areas should be considered.
Finding: Annexation at this time would require extension of sewer lines. Current
conditions result in a response time of just over 5 minutes for fire protection.
The installation of a new fire station on Rupple Road in the future,as planned
would reduce response time. Any development in this area would necessitate
installation of hydrants to provide for fire protection. A turn lane and other
improvements to Mt. Comfort Road would be likely should this property
develop. Sewer service is not currently available in this location. Upgrades to
the Hamestring Creek lift station were recently approved and should be
completed this summer.
ENVIRONMENTALLY SENSITIVE AREAS

utilize appropriate development regulations to protect those areas.
Finding: N/A
EMERGENCY AND PUBLIC SERVICES
11.6.g Public services must be able to be provided efficiently in newly annexed areas.
Finding: Improvements are necessary to adequately serve the area with regard to fire
protection. The police department reports that current levels of service would
not be compromised and that coverage in this area can be provided.
11.61 Annexed areas should receive the same level of service of areas already in the city
limits.
Finding: With the pending installation of a new fire station in the general area, service
will be able to be provided at a more appropriate level of service with a shorter
response time than what can be provided to the site currently. Sewer
improvements to the area are needed for existing and already approved
developments.
11.6.i The ability to provide public services should be evaluated in terms of equipment,
training of personnel, number of units and response time.
Finding: These factors were taken into consideration in the responses and
recommendations for the various staff reviews which are attached.
INFRASTRUCTURE AND UTILITIES
11.6j Areas currently served by utilities and other public services should be annexed.
Finding: Water and police protection are currently provided in this area.
11.61 Proposed annexation areas should not require the upgrading of utilities to meet the
demands of development unless there is a threat to public safety.
Finding: Improvements to sewer and street systems and installation of fire hydrants
would be made necessary by the annexation.
11.6.1 Phased annexation should be initiated by the City within active annexation areas
based on planned service extensions or availability of services.
Finding: The proposed annexation is not part of a phased annexation initiated by the
City.

INTERGOVERNMENTAL RELATIONS

ADMINISTRATION OF ANNEXATIONS
11.6.o Designate zoning districts for the property during the annexation process.
Finding: Annexations are automatically zoned A-1, Agricultural. The applicant is
requesting to rezone to P-1,Institutional. This zoning designation is compatible
with the Residential classification of the area on the City's adopted Future Land
Use Plan. Public or institutional uses serve the residential population and are
commonly located within residential areas.
11.6.p An annexation study should be completed on all annexation proposals.
Finding: Planning staff has asked the Public Works Department, Fire Department and
Police Department to study this annexation request to determine if facilities and
services are available to serve this request.
11.6.q Development proposals require a separate review from the annexation proposals.
Finding: The development of the subject property will be required to go through the
development review process.
11.6.r Residents should be fully informed of annexation activities.
Finding: Adjoining neighbors have been notified of the annexation request. A legal ad
and display have both been submitted with a local newspaper prior to the
Planning Commission meeting for which this item is scheduled.
11.6.w Encourage larger annexations to create acceptable boundaries.
Finding: This annexation is only one parcel which is carved out from surrounding
properties. A more comprehensive annexation would be to the benefit of the
City.

This document is in response to the request for a determination of whether the
proposed annexation ANX 03-02.00 Shiloh Community Church and ANX 02-01.10
James Coger submitted by Keystone Consultants, Inc. would allow public services to be
provided efficiently and at the same level of service of areas already in the city limits.
It is the opinion of the Fayetteville Police Department that we must return a
determination in support of the annexation based on the criteria placed before us. In
response to the question, "Would the annexed area receive the same level of service of
areas already in the Fayetteville city limits?" We find the proposed annexed area is
immediately adjacent to the Fayetteville city boundary and in fact there is a residential
subdivision within the city limits one quarter mile west of this proposed site. There is a
Middle School immediately adjacent to this site as well. We should be able to provide
the same level of service to this proposed site as we would the school and the
subdivision.
The factors considered to arrive at our determination included our ability to
provide public services with existing equipment, training of personnel,number of units
and response time. There should be no more additional requirements for equipment,
training of personnel or patrol units to handle calls for service at this proposed site. The
response time should be greater for this area than the school or the subdivision west of
this location.

for Rezoning Proposals
The Planning Commission bylaws identify five findings that the Planning Commission must make in
order to determine the appropriateness of proposed zoning.Two of those findings pertain to other
departments. The Fayetteville Planning Division is requesting your assistance in making those findings.

on these proposals with regard to the services you provide. Please address the findings provided in
italics.

3. RZN 03-19.00: Rezoning(Broyles,PP 599) was submitted by Crafton, Tull and Associates on
behalf of Tom Broyles for property located east of Beechwood Avenue and south of 15"' Street.
The property is currently zoned C-2, Thoroughfare Commercial and R-2, Medium Density
Residential. The request is to move the current zoning line to a new configuration with the
subject property being rezoned to R-2.
• A determination as to whether the proposed zoning would create or appreciably
increase traffic danger and congestion.
• 15'' Street,Beechwood Avenue & 18'h Street are collector streets which border the
subject property. The streets may need left turn lanes added to accommodate the
increased traffic generated by the site. The existing geometry(horizontal curves) should
be evaluated by the consultant engineer to determine if the curves need to be increased
to meet collector street standards including sight distance. Beechwood Avenue going
north from the site is a local street. This development may need to look at construction
some traffic calming measures to insure that site generated traffic does not impact this
local street.
4. RZN 03-20.00: Rezoning(Broyles,PP 599) was submitted by Crafton, Tull and Associates on
behalf of Tom Broyles for property located east of Beechwood Avenue and south of 15a' Street.
The property is currently zoned C-2, Thoroughfare Commercial and R-2, Medium Density
Residential. The request is to move the current zoning line to a new configuration with the
subject property being rezoned to G2.

Residential. The request is to move the current zoning line to a new configuration with the
subject property being rezoned to R-2.

provision of adequate services must be considered as this site is at the
outskirts of the city and located on a street which needs improvement.

3. A determination as to whether the proposed zoning would create or appreciably increase

Finding: The proposed zoning would create additional traffic for Mt. Comfort which
is currently not built to the city's master street plan standard. The
improvement of property adjacent to the street would be minimal due to the
undesirable configuration of the flag lot which is proposed to be annexed and
rezoned. Additional improvements would likely be necessary in order to
provide safe access to this site.
4. A determination as to whether the proposed zoning would alter the population density
and thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning would not alter population density.
5. If there are reasons why the proposed zoning should not be approved in view of

This document is in response to the request for a determination of whether the
proposed annexation ANX 03-02.00 Shiloh Community Church and ANX 02-01.10
James Coger submitted by Keystone Consultants, Inc. would allow public services to be
provided efficiently and at the same level of service of areas already in the city limits.
It is the opinion of the Fayetteville Police Department that we must return a
determination in support of the annexation based on the criteria placed before us. In
response to the question, "Would the annexed area receive the same level of service of
areas already in the Fayetteville city limits?" We find the proposed annexed area is
immediately adjacent to the Fayetteville city boundary and in fact there is a residential
subdivision within the city limits one quarter mile west of this proposed site. There is a
Middle School immediately adjacent to this site as well. We should be able to provide
the same level of service to this proposed site as we would the school and the
subdivision.
The factors considered to arrive at our determination included our ability to
provide public services with existing equipment, training of personnel, number of units
and response time. There should be no more additional requirements for equipment,
training of personnel or patrol units to handle calls for service at this proposed site. The
response time should be greater for this area than the school or the subdivision west of
this location.
