The area was platted in 1975 and because of that the approval under which he is building, allows the construction of 12 individual driveways that connect to Old Wire road. This particular road carries a great deal of traffic and in addition in this location there are sight distance concerns relating to ingress and egress on to Old Wire. The situation relative to safety concerns has been discussed at length internally among key city staff as well as with the developer. Current Situation The development of the houses is nearing completion. Both the developer and city staff are in basic agreement that final completion of this area allowing separate ingress and egress to this road is not in the best interest of the developer or the public. Because of that concern, the engineer of record for the developer has prepared a drawing showing a private access road with points of access on Old Wire Road and Colette Ave. A copy of the referenced drawing has been provided with agenda materials for this item. Recommendation Because of the unusual circumstances surrounding this subdivision, I have taken the initiative in applying on behalf of the developer for an Amendment to the final plat that shows the installation of a private drive serving the 14 lots. Both city staff and the developer have met with the adjoining neighbors. Screening of adjoining properties,proper control of runoff coupled with the layout and construction of the access drive have been discussed and recommendations are reflected in the attached staff report from the Planning Division. The request is to allow a private drive through the subdivision in order to improve the safety along Old Wire Road. RECOMMENDED MOTION: Staff recommends approval of the administrative request subject to the following conditions: 1. The common access drive shall be private and shall be maintained by the developer or the property owner's association to be established for the Shadow Hill subdivision. 2. Access drive shall be a minimum of 20' in width in order to comply with state fire code requirements. 3. Access drive shall be constructed of concrete which is a minimum of 6" deep in order to withstand the weight of solid waste collection vehicles. The owner shall sign a waiver relieving the City of any responsibility for damage to the private drive caused by solid waste vehicles utilizing the access to provide collection services to the homes in this subdivision. 4. No parking shall be permitted along the private access drive. No parking signs shall be installed by the owner. 5. In addition to the 16'wide driveways to be constructed for each single family home, an additional concrete parking pad (16' x 181) shall be installed beside each driveway. 6. A total of nine additional parking spaces for guests and overflow parking shall be located within the development in four different areas along the private access drive. An 18" berm shall be installed along the south side of the development from the southeast corner of the house pad for lot#14 angling to the south property line of lot 13 and running generally along the south property line to its intersection with the ditch along Colette Ave. This berm shall be sodded. 8. A 6' tall wood board fence shall be installed along the south property line of the subject property where it adjoins the north property line of the Hutchinson property. 9. An 8' tall wood board fence with steel support posts shall be installed along the south property line of the subject property adjoining the Phillips' north property line. The smooth face of this fence shall face south. 10. The developer shall dig out and regrade the ditch 10' north of the culvert providing access to this private drive and shall also grade the ditch on south side of the culvert to create a better drainage system. 11. Culverts and drainage improvements to be installed in order for the common access drive to be installed shall be reviewed and approved by the City Engineering Division. 12.Vegetation along Old Wire Road shall be removed or trimmed back to provide adequate sight distance at the intersection with this private drive. Page 2.3 BACKGROUND: The Shadow Hill Subdivision is a 14 lot residential subdivision located along the east side of Old Wire Road at the point where it intersects Old Missouri Road. This subdivision was created in 1975 and all infrastructure and utilities that were required at the time were installed. In November of 2001,permits were issued for the development of single family homes on each of the lots within the subdivision in accordance with current zoning regulations. Traffic patterns within the City have changed since the approval of this development in 1975. The amount of traffic and the configuration of streets adjacent to Shadow Hill at this time make evident the dangerous situation that could occur should eleven individual driveways be constructed to intersect Old Wire Rd. in this location. Staff and the developer agree that a common access drive through the subdivision would ameliorate the problem. In order for this change to occur, staff felt it necessary for the Planning Commission to review the proposed common drive as an amendment to the final plat that was approved in 1975. This change will effect property owners adjoining the subdivision, specifically owners to the south and those along Colette Ave. All adjoining property owners have been notified. Planning and Engineering staff and the developer " have met with concerned property owners to better understand the impact,that this change will have on their properties. With fourteen rental houses on this piece of land and an estimated four occupants per house and four cars per house,this driveway is going to have a large amount of traffic plus a lot of on-street parking.The drive will also serve frequent runs of garbage-recycling trucks plus heavy moving vans by necessity.Therefore,I hope the Planning Commission considers requiring them to construct a drive of substantial strength. And where the drive will enter Colette Avenue,they have already put in a substandard size culvert. This,they said, was merely temporary,but I draw it to your attention because the two pipes they threw in the ditch and covered with chat is totally inadequate to carry the water in the ditch..The upper north end of these pipes have been mostly stopped up since they were emplaced. Also,the ditch Hunting east along the south edge of Old Wire Road that is supposed to empty into the ditch running south along the west side of Colette Avenue is so filled with brush,trash,and soil that it needs grading and deepening so that it serves the purpose for which it was intended.The runoff,it appears to me,from Old Wire Road into this ditch now runs mostly across the land in Shadow Hill Subdivision. Finally,before these red-clay pads were placed on this subdivision and the houses were built on the pads much of the rainfall there was absorbed by the soil.Now,there is increased nlnoff from the housetops onto these pads that results in red silt draining across my property and into my pond,which is being killed by silt. And since I have a system of French detains around my house,I fear this silt could be stopping up the whole works. I started last November talking to Schmitt and Sevadjian about my concern over this drainage problem.They promised me they would grade the area along their south line,which affects my neighbors to the West and East as well as myself,and would build a berm along the north side of their south line so as to divert the runoff to the east into the ditch along the west side of Colette Avenue.It is now late April and the grading and berm have not been done.Likewise the silt fence they put up was totally useless;the bottom of it was never buried and the silt flows freely under it and across their south line. It rained all night on the twenty-second--twenty-third and we all received another deluge of Silt. An after thought: since their worksite is so boggy,they have been parking on Colette and other streets in the neighborhood. Could the city not prohibit this? Dear Sir, Thank you for your letter of January 15, 2002 concerning the drainage and Mr. Schmidtt's houses. The Shadow Hills Subdivision was platted as 14 lots in 1975 and the infrastructure required at that time either installed or available. Representatives from Planning (Hugh Earnest,Dawn Warrick and Tim Conklin), Engineering (Jim Beavers) and the City Attorney's office(Kit Williams)met with Mr. Schmidtt and his attorney Rick Osborne on November 16, 2001. At this meeting it was confirmed that the subdivision plat was valid and that the construction of individual homes upon individual platted lots did not constitute new development. As a result of this finding, the Engineering Division has no authority to impose the City's Drainage or Grading ordinances at this location. At this same meeting the City requested that Mr. Schmidtt present a common drive to improve the safety on the curve on Old Wire Road. If this common drive is approved by the Planning Commission, (the meeting is tentatively set for February 11, 2002) then Engineering will review the driveway plan (only) and strive to use this drive to improve the subdivision drainage. At the November 16, 2001 meeting, Mr. Schmidtt was in agreement to try and use the common drive to assist with the drainage concerns. The plan has not yet been presented and thus the extent of the drainage to be cutoff and/or improved by the common drive is unknown at this time. Your own personal agreements with Mr. Schmidtt may be included in the Planning Commission discussions and I urge you to be present at the meeting tentatively set for February 11, 2002, or make your comments to the Planning Commissioners by letter or phone. Please note that the City does not regulate drainage from single family house construction. The drainage from the adjacent new houses onto your property is a private matter between you and the adjacent property owner(s). If you believe that you have been damaged then your recourse is directly with the other private party including private legal recourse. Soon after their development began, I talked to Schmitt and Servadjian about my concern over this drainage problem. They told me they would grade the area along this line and divert the water runoff to the east along their south line into the ditch along the west side of Colette Avenue. Originally, there was to have been a concrete private drive along this line to serve the tandem lots 12, 13, and 14 that were landlocked along their south line. They are now requesting that the Planning Commission approve abandoning construction of this southeast private drive and move it north between Lots I 1 and 12. If approved, I am concerned about where this leaves their agreement to grade along my north line and divert the runoff to Colette at their southeast corner. Accordingly, I would like to request that the Planning Commission and Engineering Division protect my property rights by supervising the grading and preparation of this drainage system. Meeting) SUBJECT: Hamstring Basin Sewer Assessment Refund LS 97-30 (Airways Freight Lot Split) Project: AD 01-49A: Administrative Item (Airways Freight Refund, pp 439)was submitted by City Staff on behalf of Airways Freight Corporation for property located at 3849 Wedington Drive. The request is to refund the assessment for the offsite sewer improvements in the amount of$200.00 plus interest that was assessed for a lot split to create a 5.24 acre lot. Findings: A lot split(LS 97-30)was approved administratively by the Planning Division that created a 5.24 acre lot that was purchased by Airways Freight. The project was heard at the September 2, 1997 Technical Plat Review to collect comments from City Staff and the public utility companies. One of the comments stated that "as with other subdivisions in the area- a $200.00 fee will be assessed for improvements to the Hamstring Creek Basin." This assessment was collected on September 30, 1997. Find attached a copy of the minutes from the September 2, 1997 Technical Plat Review. Staff Recommendation: Approval of the full refund in the amount of$200.00 plus interest. §158.05 OFFSITE IMPROVEMENTS/DELAYS A. Proportionate Share. 2. If the off-site improvement is not constructed within five years from the date of the first payment into the escrow account by a developer,the Planning Commission shall hold a public hearing, after notification to all affected property owners,to determine the disposition of all money in the escrow account. Following the public hearing,the Planning Commission may: a. Determine that the off-site improvement is still necessary and feasible and can be built within a reasonable time,in which case the escrow account shall be continued for a period specified by the Planning Commission: or b. Ms. Little explained if Rupple Road was not constructed within five years the Planning Commission would look at the item. If the roads construction was imminent then the money would be refunded. She noted interest would be paid on the money until the money was refunded or the sidewalk was built. Mr.Alexander questioned the amount of the contribution required for Rupple Road. Ms. Little stated the staff was working on the estimate. She noted there was a subdivision developing to the west that was also contributing to the construction cost of Rupple Road. Mr. Merryship asked if the applicant could property line adjust with Airways and not do a lot split. Ms. Warrick stated there were problems with lot frontage. Ms. Little stated the 6' sidewalk had been required along Wedington with the Airway addition. The sidewalk would have to installed. The new lot needed frontage for an A-1 lot. Mr. Alexander asked if they could use some of Airways frontage. Ms. Little replied Airways was zoned R-O. The frontage needed to be A-1. She explained the purpose of subdivision review was to review lot layout the make sure orderly circulation could occur in the future. The tract they were wanting to create was next to a Master Street Planned street. The city needed to receive right-of-way. If they were to property line adjust his frontage would be 200'. Mr. Alexander asked if the property could be adjusted to have all the property become one lot. Ms. Little thought they could lot line adjust the property as an accessory use. Ms. Warrick stated the plat would need to be revised to show both the parent tract and the Airways tract before and after the adjustment. Mr. Mer yship asked if they would be able to access Rupple Road when it was constructed. He questioned the difference between the lot split and lot line adjustment. Ms. Little replied he would be able to use Rupple Road,however, he would not be able to sell the home separately without going through lot split.
