Call to Order: 5:30 PM, William Chesser 2. In Attendance: Thomas Brown, William Chesser, Janet Selby, Tracy Hoskins, Matthew Hoffman, Ryan Noble, and Kyle Cook Absent: Sarah Bunch and Ron Autry Staff: Andrew Garner, Quin Thompson, Corey Granderson, and Kit Williams 3. Consent Agenda: Approval of the minutes from the April 27, 2015 meeting. VAC 15-5037: Vacation (HARBOR ISLE & ZION RDS./WOODBURY S/D, 137): Submitted by BLEW & ASSOCIATES for properties located at the INTERSECTION OF HARBOR ISLE & ZION ROADS. The property is zoned NC, NEIGHBORHOOD CONSERVATION and contains approximately 0.74 acres. The request is to vacate portions of multiple utility easements within the subdivision. Motion: Commissioner Cook made a motion to approve the consent agenda. Commissioner Hoffman seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. Mailing Address: 113 W. CROSS AVE./ALEXANDER-GOODSPEED, 481): Submitted by PARKCO ARCHITECTS for property located at 391 N. CROSS AVE. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNIITS PER ACRE and contains approximately 2.24 acres. The request is for an accessory structure with square footage exceeding 50% of the primary structure. Quin Thompson, Current Planner, gave the staff report. Bret Park, applicant, was present for questions. No public comment was presented. Motion: Commissioner Selby made a motion to approve CUP 15-5041 as recommended by staff. Commissioner Hoskins seconded the motion. Upon roll call the motion passed with a vote of 7-0-0. RZN 15-5044: Rezone (4065 E. HUNTSVILLE RD./THE PLAZA, 569): Submitted by JORGENSEN & ASSOCIATES for property located at the 4065 E. HUNTSVILLE RD. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 16.02 acres. The request is to rezone the property to RSF-7, RESIDENTIAL SINGLE FAMILY, 7 UNITS PER ACRE, NS, NEIGHBORHOOD SERVICES, AND CS, COMMUNITY SERVICES. Andrew Garner, City Planning Director, gave the staff report. Clint McDonald, applicant, was present for questions. He discussed the recent improvements to highway 16. Public Comment: Hardin Hanks III. Lives on River Meadows Drive. Clint wanted to put in some storage units which has always wanted to be a concern. He discussed that this is near a four-star golf course. He discussed the Deadhorse Mountain outlet. The whole rest of the road (Deadhorse Mountain Road) is below the floodplain and floods during 100 year events. He discussed the challenges of using Roberts Road. Is this development going to be something that people living in a four-star golf course community would want to live near. He discussed the loss of real estate value because of the entrance into this subdivision. What we're concerned about is what it will look like and what will the homes look like. This is an extremely high water table. When we have the hundred years rains the county and city had to pay to pump Mr. McDonald's ponds and water issues on St. Andrews Circle. Linda Patterson 1106 St. Andrews Circle, adjacent to the subject property. I request that the zoning not be done. Within two miles of this neighborhood we have neighborhood services so these services are already being addressed. We have the amenities we need within five miles of our neighborhood. She discussed the traffic issues in this area are very difficult. It is a bit awkward to get out. You have to figure out what time you will try to get out. I don't think that this development is reasonable for the area. I think that the zoning is necessary to be changed at this point. Mary Willis. 1394 S. River Meadows Drive. Deadhorse Mountain Road with the traffic signal flooded with the rain from this weekend. She discussed the difficulty of getting out onto Highway 16 from Roberts Road. No more public comment was presented. Commissioner Hoffman discussed that he appreciated the staff report and City Plan 2030 that discussed a mix of housing types and uses. What is particularly exciting to me is to look at the issue of traffic is giving people an opportunity other than driving. This zoning is an alternative where people could use these services as an alternative to always driving. The comments about 2-5 miles from the neighborhoods are relevant because this rezoning would bring these services within a quarter mile of the neighborhoods. Commissioner Brown discussed traffic difficulty on highway 16. He referenced City Plan 2030 showing City Neighborhood at the intersection near Crossover Road. He discussed isolated commercial uses between Crossover Road and the subject property. The addition of a 2 -acre CS and a 2 -acre NS zone will add to additional congestion. They would add to the commercial strip center pattern discouraged by City Plan 2030. The residential development of this property is indicated on City Plan 2030. 1 will not be able to vote for this. Commissioner Cook discussed agreement with access to highway 16 being difficult. I agree with Commissioner Hoffman that we need more services in this area. I don't have an issue with the rezoning but I am having a heartburn with accessing highway 16. Roberts Road may be a better spot for a signal but it is not up to City standards. Motion: Commissioner Hoskins made a motion to forward RZN 15-5044 to City Council with a recommendation for approval. Commissioner Selby seconded the motion. Upon roll call the motion passed with a vote of 6-1-0. Commissioner Brown voted "no". CI Discussion Item: CPL 15-5058: Concept Plat (DOUBLE SPRINGS & SELLERS RDS., 513): Submitted by JORGENSEN & ASSOCIATES for property located at NE OF DOUBLE SPRINGS & SELLERS RDS. The property is zoned RSF-2, RESIDENTIAL SINGLE FAMILY, 2 UNITS PER ACRE and contains approximately 34.44 acres. The request is for a review of a concept plat consisting of 59 single family lots. Andrew Garner, City Planning Director, gave the staff report. Aaron Wirth, applicant, gave a presentation and discussed their intent. No public comment was presented. Commissioner Brown discussed that improvements along Sellers Road would not be necessary. I do like the entrances along the west. My concern is that the distance from the intersection distance from the road to the south should be reviewed. He said that the connections to the north and east look good. The block distances are a little long but the parcels are large so that looks okay with me. Commissioner Hoskins asked about the separation of the south street from Sellers Road. He also pointed out that all of the southern lots are double frontage lots. Garner confirmed that double frontage lots are discouraged in new subdivisions however given the existing condition of these streets staff would recommend they be allowed to be built in the location previously approved. Commissioner Cook asked about the streamside protection ordinance. Corey Granderson, staff engineer, discussed the streamside protection ordinance and stormwater detention. Commissioner Cook discussed that he is not a big fan of the southern road being too close to Sellers Road. I think over time it may be a problem. Commissioner Chesser asked about the streamside zone. Commissioner Hoskins asked about the floodway. Granderson discussed the floodway and the streamside protection zone. As this was a discussion item no motion or action was taken. 5.
