3. Consent Agenda:
Approval of the minutes from the April 13, 2015 meeting.
ADM 15-5049: Administrative Item (EAST SHILOH DRIVE & REDSTONE
DR./HAWKINS HOUSE, 519): Submitted by BATES & ASSOCIATES for property located
at E. SHILOH DR & REDSTONE DR. The property is zoned R-PZD, RESIDENTIAL
PLANNED ZONING DISTRICT and contains approximately 13.38 acres. The request is for
a Phasing Plan for PPL 14-4929 (Hawkins House).
VAC 15-5020: Vacation (2288 N. HIDDEN CREEK DR./KENNEDY, 322: Submitted by
JEREMY KENNEDY for property located at 2288 N. HIDDEN CREEK DR. The property is
zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains
approximately 0.24 acres. The request is to vacate a portion of an existing 20' utility
easement.
VAR 15-5036: Variance (504 E. LAFAYETTE ST./BELDEN, 485): Submitted by DEMX
ARCHITECTS for property located at 504 E. LAFAYETTE ST. The property is zoned RSF-
4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 0.44
acres. The request is for a variance of the driveway width standards.
PPL 15-5032: Preliminary Plat (N. HARBOR ISLE DR. & ZION RD./WOODBURY
SUBDIVISION, 137): Submitted by BLEW & ASSOCIATES. for property located at N.
HARBOR ISLE DR. & ZION RD. The property is zoned NC -NEIGHBORHOOD
CONSERVATION and contains approximately 9.89 acres. The request is for a 38 lot single-
family subdivision.

Motion:
Commissioner Chesser made a motion to approve the consent agenda. Commissioner
Selby seconded the motion. Upon roll call the motion passed with a vote of 7-0-0.
4. Old Business:
RZN 15-4965: Rezone (SOUTH END OF RUPPLE RD./RUPPLE ROAD EXTENSION
CORRIDOR, 478): Submitted by PLANNING STAFF for property located at the SOUTH
END OF RUPPLE RD. The property is zoned R -A, RESIDENTIAL -AGRICULTURAL. RSF-
8, RESIDENTIAL SINGLE FAMILY EIGHT UNITS PER ACRE; RSF-4, RESIDENTIAL
SINGLE FAMILY FOUR UNITS PER ACRE; RSF-1, RESIDENTIAL SINGLE FAMILY ONE
UNIT PER ACRE and contains approximately 642 acres. The request is to rezone the
property to NC, NEIGHBORHOOD CONSERVATION, CS, COMMUNITY SERVICES, UT,
URBAN THOROUGHFARE, and R -A, RESIDENTIAL AGRICULTURAL.

Public Comment:
Chelsea Kross, UA graduate student, provided an exhibit to the Planning Commission
showing habitat areas. She stated agreement with the option of accepting parkland in lieu
of money as this property develops.
Megan Miller, owner in then Magnolia Crossing neighborhood. She asked about the
distance of neighborhood conservation between the neighborhoods and the proposed UT,
Urban Thoroughfare zoning.
No more public comment was presented.
Commissioner Chesser asked about the exhibit presented by Ms. Kross. He asked about
parkland dedication of the high quality habitat during development.
Garner discussed the parkland dedication ordinance and how it is applied during
development.
Commissioner Brown discussed placing these specific environmentally sensitive areas
onto the master plan map.
Commissioner Bunch asked about Commissioner Brown's integration into the future land
use plan map.
Garner discussed that it could be identified by amending the future land use plan map.
Commissioner Brown asked about the Enduring Green Network (EGN) map.
Garner discussed the EGN map.
Commissioner Chesser asked about the Environmental Action Committee.
Garner discussed the make-up and purpose of the Environmental Action Committee that
this rezoning was intended on being presented to that committee for their input prior to the
City Council making a final decision.
Commissioner Bunch said she has no problem passing this onto the City Council taking
into consideration of some of these areas. I would like to see some of the areas next to
Woolsey Wet Prairie in preservation.
Commissioner Autry discussed that this has been on the Master Street Plan for many
years. I like the idea of dedicated parkland. How that would be worked out would be
determined during development. I would be able to support the rezoning plan as proposed.
Garner discussed the distance of NC buffer between the Magnolia Crossing and Walnut
Crossing neighborhoods and UT.
Commissioner Hoskins asked about the process for parkland dedication when a
development was proposed.
Garner discussed the parkland dedication process.
Motion:
Commissioner Chesser made a motion to forward RZN 15-4965 to City Council with a
recommendation for approval; paying special attention to the environmentally sensitive
areas we have discussed tonight and at the previous meeting. In addition, a
recommendation that the council consider the possibility of a Future Land Use Plan
amendment and/or accepting parkland for these sensitive environmental areas discussed
and presented to the commission by the public. Commissioner Selby seconded the motion.
Commissioner Hoffman stated that it would be very good for us to create a new ordinance
for conservation development patterns in this area to preserve the prairie habitat.
Upon roll call the motion passed with a vote of 7-0-0
New Business:
CUP 15-5022: Conditional Use (4201 N. SHILOH DR./NWA MALL TEMPORARY
CARNIVAL, 134): Submitted by PRIDE AMUSEMENTS for property located at 4201 N.
SHILOH DR. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains
approximately 105.20 acres. The request is for a temporary carnival in the mall parking lot.
Jesse Fulcher, Senior Planner, read the staff report.
Bernie Yam applicant, agreed with the conditions.
No public comment was presented.
Commissioner Hoskins asked about the timing of the Washington County Fair.
Andrew Garner, City Planning Director, stated he wasn't sure.
Commissioner Bunch stated there has been previous carnivals on the mall property.
Motion:
Commissioner Chesser made a motion to approve CUP 15-5022 with conditions as
recommended by staff. Commissioner Selby seconded the motion. Upon roll call the
motion passed with a vote of 7-0-0.
CUP 15-5028: Conditional Use (INTERSECTION HISTORY DR. & DEADHORSE MTN.
RD./RIVERWALK SUBDIVISION POOL, 645): Submitted by JORGENSEN &
ASSOCIATES for property located at INTERSECTION HISTORY DR. & DEADHORSE
MTN. RD.. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UINTS PER
ACRE and contains approximately 0.39 acres. The request is for a neighborhood swimming
pool with associated parking in an RSF-4 zoned lot.

Dave Jorgensen, applicant, was present to answer questions.
No public comment was presented.
William Chesser, Commissioner, as if the pool hours could be further restricted by the
neighborhood POA [property owner's association], and asked if extended hours would
require an amendment to the Conditional Use Permit (CUP).
Thompson replied that yes, the hours could be reduced by the POA, and only expanded
by future amendment to the CUP. He added that it was expected that the POA would self -
police the pool.
Motion:
Commissioner Chesser made a motion to approve CUP 15-5028 with conditions as
recommended by staff. Commissioner Autry seconded the motion. Upon roll call the
motion passed with a vote of 7-0-0.
ADM 15-5035: Administrative Item (NORTH OF QUAIL DR. & RAVEN LN./CRYSTAL
SPRINGS S/D, PH. IV, 285): Submitted by MILHOLLAND ENGINEERS for property located
NORTH OF QUAIL DR. & RAVEN LN. The property is zoned RSF-4, RESIDENTIAL
SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 92.31 acres. The
request is for an amendment to the Master Street Plan.
Jesse Fulcher, Senior Planner, read the staff report.
Howard Davis, applicant, stated he had environmental concerns if the bridge were
constructed over Clabber Creek. He was involved in the first phases of Crystal Springs and
they gave the school district property and dedicated park land. The development will have
other ways out and the development may be restricted if there aren't other connections.
Mel Milholland, applicant, discussed the Master Street Plan locations
Public Comment:
Vicky Kelly, neighbor, doesn't want the bridge built because it will route traffic through their
neighborhood.
Jim Kimbrough, neighbor, owns property to the west and doesn't want a street through
their property. It's a good idea to table the request.
Kevin Smith, neighbor, asked about Gooseberry Lane being connected.
Bill Ogleby, neighbor, stated that the bridge needs to be built. Notification should be
provided to the entire neighborhood.
Joyce Thompson, neighbor, Gooseberry Lane is not built to City standards, no curb and
no sidewalks. Mt. Comfort road is busy and more traffic is a bad idea.
Burt Russell, neighbor, development will be detrimental to our neighborhoods.
Betty Patrick, neighbor, doesn't want the project to connect to Gooseberry Lane.
Dave Rowden, opposes the bridge connection. The traffic on Mt. Comfort is already really
bad.
Jon Palmranski, neighbor, there are no sidewalk on our street. The traffic on Mt. Comfort
is jam-packed and dangerous. Bridge needs to be built. They shouldn't destroy one
neighborhood to build another.
No more public comment was presented.
Commissioner Bunch asked about the notification requirements.
Andrew Garner, City Planning Director, stated there is no requirement, but we required the
developer to send notices to all adjacent land owners.
Commissioner Bunch asked about Gooseberry being extended.
Fulcher stated there isn't sufficient right-of-way to extend it north.
Commissioner Hoskins asked how many lots could be built before the bridge was
constructed — in the resolution.
Fulcher stated 77 lots could be built based on the previous project approval.
Commissioner Hoskins asked about bridge assessments and street connections.
Fulcher stated that the bridge construction and cost would be evaluated at the time of
development. A bridge assessment for each lot is also a potential. Ultimately, the number
of street connections to the east and west will have a big impact on the bridge requirements.
Commissioner Hoffman stated he would still be concerned with connections to the south
even if there are connections to the east and west.
Commissioner Chesser asked about staff's environmental concerns.
Fulcher stated there would be impacts to Clabber Creek if a bridge were constructed
Commission Chesser stated he felt that the bridge probably needed to be constructed.
Why is there a policy of connectivity.
Fulcher discussed connections between neighborhoods, dispersal of traffic, route options,
pedestrian connections, etc.
Commissioner Chesser stated he doesn't see how this subdivision is constructed without
a bridge connection.
Commissioner Brown stated that the development may look at phasing the development
and the timing of the bridge construction. A recommendation for denial was also indicated.
Garner asked the applicant if he wanted to project to be tabled or forwarded with a
recommendation from the Planning Commission for denial.
Davis stated he would prefer the request move forward even if it's with a recommendation
for denial.
Motion:
Commissioner Brown made a motion to forward ADM 15-5035 to Planning Commission
with a recommendation for denial. Commissioner Hoskins seconded the motion. Upon
roll call the motion passed with a vote of 7-0-0.
RZN 15-5033: Rezone (232 W. ASH ST./KOUTROUMBIS, 367): Submitted by TAYLOR
KOUTROUMBIS for property located at the 232 W. ASH ST. The property is zoned RSF-
4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains approximately 0.30
acres. The request is to rezone the property to RMF -12, RESIDENTIAL MULTI FAMILY, 12
UNITS PER ACRE.
Quin Thompson, Current Planner, read the staff report.
Taylor Koutroumbis, applicant, said that her goal was to add a modest duplex to the rear
of the recently remodeled existing single-family home. She said that she wants to continue
investing in the neighborhood. She added that dense foliage separates her property from
neighboring homes.
Public Comment:
Irene Pritchard, Neighboring property owner, said that she jointly owns the property next
door, and opposes the rezone request citing the stable single-family residential quality of
the neighborhood surrounding Woodland school. She said that appropriate infill has
occurred in recent years, and that no `transitional' zoning had been requested by the
neighborhood. She discussed lack of sidewalk in the area and said that it was not
appropriate to spot zone in order to suit a single land owner. She said that the proposal
would triple the allowed density on the lot and asked the Planning Commission to deny the
request in order to protect the neighborhood.

Tracy Hoskins, Commissioner, asked Ms. Pritchard if her property was a duplex unit.
Pritchard said that it was, and on a wide lot.
Hoskins asked staff why the applicant requested RMF -12 zoning instead of a lower density
zone.
Thompson replied that because of the lot area, the RMF -12 zone was the least dense zone
that would allow the applicant to construct a duplex in addition to the existing home.
William Chesser, Commissioner, asked staff if a duplex use is allowed by right in the RMF -
12 zone.
Thompson replied that the zone allows duplex use by right.
Sarah Bunch, Chair, asked staff how far the existing home was from the road
Thompson replied that he wasn't sure, and added that perhaps the distance from Master
Street Plan right-of-way is the better question.
Matthew Hoffman, Commissioner, said that he thought this was appropriate use of transect
planning, and noted that the residential areas called for a mix of housing types, such as
were proposed by the applicant.
Bunch said that she was in favor of the request, especially as a duplex already exists next
door, and added that she would feel differently if the adjacent property contained a single-
family home.
Motion:
Commissioner Hoskins made a motion to forward RZN 15-5033 to City Council with a
recommendation for approval. Commissioner Autry seconded the motion. Upon roll
call the motion passed with a vote of 6-0-1. Commissioner Brown recused.
