Call to Order: 5:30 PM, Tracy Hoskins 2. Consent Agenda: Approval of the minutes from the March 23, 2015 meeting. VAC 15-5001: Vacation (4301/4331 N. WATERSIDE CT./SIMS-RENNER OFFICE BUILDING, 135): Submitted by BATES & ASSOCIATES for properties located at 4301/4331 N. WATERSIDE CT. The properties are zoned R -O, RESIDENTIAL -OFFICE and contain approximately 0.95 acres. The request is to vacate a portion of an existing 24' access easement contained within said properties. Motion: Commissioner Cook made a motion to approve the consent agenda. Commissioner Selby seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. Mailing Address: 113 W. MISSION BLVD./EASTERN PARK S/D., 296): Submitted by USI ENGINEERS for property located at 4436 E. MISSION BLVD. The property is in the FAYETTEVILLE PLANNING AREA and contains approximately 7.66 acres. The request is for Planning Commission determination of street connectivity for a new subdivision. Andrew Garner, City Planning Director, gave the staff report. Ferdie Fourie was present for the applicant. No public comment was presented. Commissioner Cook asked about Trough Springs Drive. Garner indicated it is a private drive. Commissioner Cook discussed that he tended to agree with staffs recommendation. Motion: Commissioner Cook made a motion to approve ADM 15-5023 agreeing with staff's recommendation. Commissioner Selby seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. CUP 15-5000: Conditional Use (4301/4331 WATERSIDE CT./SIMS-RENNER OFFICE BUILDING, 135): Submitted by BATES & ASSOCIATES for properties located at 4301/4331 WATERSIDE CT. The properties are zoned R -O, RESIDENTIAL -OFFICE and contain approximately 0.95 acres. The request is for additional parking on the property. Andrew Garner, City Planning Director, gave the staff report. Elissa Sims, applicant, discussed the need for additional parking spaces for their business. No public comment was presented. Commissioner Autry asked about tree plantings. Ken Eastin, Urban Forester, stated agreement with the tree plantings. Motion: Commissioner Cook made a motion to approve CUP 15-5000 agreeing with staff's recommendation. Commissioner Selby seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. CUP 15-5015: Conditional Use (4420 N. WATERSIDE COURVESCH OFFICE, 096): Submitted by SWOPE CONSULTING ENGINEERS for property located at 4420 N. WATERSIDE COURT. The property is zoned R -O, RESIDENTIAL -OFFICE and contains approximately 0.77 acres. The request is for a reduction in parking space requirements. Andrew Garner, City Planning Director, gave the staff report. Phil Swope, applicant, was present for questions. No public comment was presented. Commissioner Cook asked about the process for adding more parking spaces if a future business needs them. Garner discussed the process for a parking lot permit. Commissioner Chesser discussed proximity to the trail and that he is in favor of this. Motion: Commissioner Chesser made a motion to approve CUP 15-5015 agreeing with staff's recommendation. Commissioner Hoffman seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. E1. LSD 15-4970: Large Scale Development (NORTHWEST CORNER OF MLK BLVD. & GOVERNMENT AVE./WALMART NEIGHBORHOOD MARKET, 522): Submitted by CEI ENGINEERING for property located at the NORTHWEST CORNER OF MLK BLVD. & GOVERNMENT AVE. The property is zoned C-2, THOROUFARE COMMERCIAL and contains approximately 6.10 acres. The request is for a 43,101 square foot grocery store with associated parking. Jesse Fulcher, Senior Planner, read the staff report. Tom Burry, applicant, had no additional comments. No public comment was presented. Commissioner Autry asked about the material and height of the retaining walls. Burry stated that the maximum height is 10 feet and the walls will be modular block. Commissioner Cook noted the addition of the sidewalk from Hill Avenue and asked about the changes to the west building elevation. Commissioner Selby stated that there are windows on the west elevation now. Commissioner Cook discussed the Subdivision Committee meeting and comments. Commissioner Hoskins stated that the west elevations was much improved, but the east elevation could still be improved with more glass. Commissioner Hoffman asked about street trees. Eastin stated that they are 2" caliper trees planted on 30 foot center. Commissioner Hoffman stated he would prefer a more consistent street edge. Commissioner Chesser stated he would have preferred an urban zoning district for this project. Commissioner Autry stated that this project will be an improvement over the existing conditions. Commissioner Hoskins asked why the trees were on two sides of the sidewalk on MLK. Commissioner Chesser asked if the sidewalk could be moved back. Burry stated that they would look at the sidewalk location. Commissioner Hoskins stated that additional right-of-way is not required. The sidewalk could be placed in a pedestrian access easement. I Commissioner Bunch asked if they would add reflective markers to the raised trail crossing. Fulcher stated he would ask the trails coordinator. Motion: Commissioner Chesser made a motion to approve LSD 15-4970 agreeing with staff's recommendation. Commissioner Autry seconded the motion. Upon roll call the motion passed with a vote of 9-0-0. RZN 15-5004: Rezone (SOUTH END OF PUMPKIN RIDGE DR./FALLING WATERS, 646): Submitted by JORGENSEN & ASSOCIATES for property located at the SOUTH END OF PUMPKIN RIDGE DR. The property is zoned R -A, RESIDENTIAL -AGRICULTURAL and contains approximately 17.37 acres. The request is to rezone the property to RSF-2, RESIDENTIAL SINGLE FAMILY, 2 UNITS PER ACRE. Jesse Fulcher, Senior Planner, read the staff report. Dave Jorgensen, applicant discussed the request and surrounding land uses. Clay Carlton, applicant, discussed the plan for the development. Water and sewer mains were extended to this area back in 2005/2006. We build in several types of markets and this is a market area with demand. Public comment: Casey Weathers, neighbor, discussed concerns with ingress/egress through Pumpkin Ridges and traffic issues in the area. Jay Ray, neighbor, discussed traffic problems in the area and the poor condition of Roberts Road. Larry Altman, neighbor, discussed concerns with drainage. There are drainage problems already. The golf course already floods. Just building street will result in a lot of tree removal. How will construction traffic access the property? Wanda Altman, neighbor, discussed drainage issues and flooding. This development will drastically change the look of the mountain side. Gregory Parker, neighbor, stated that he agreed with the other neighbor's comments. The development will create traffic problems and decrease property values. No more public comment was presented. Commissioner Hoskins asked about the density proposal. Fulcher discussed various development densities. Commissioner Hoskins stated that the traffic will double over existing density. Commissioner Chesser discussed the Future Land Use designation for the property and guiding policies. The request will put suburban density in a rural area and quadruple the density. Commissioner Brown stated he was impressed with environment comments from neighbors. The slopes in the area range from 8-40%. The site is tree covered and it will be difficult to preserve trees at this density. Are there any concerns with 250 foot street length. Andrew Garner, City Planning Director, stated the street length is an item to be reviewed at the time of development. Commissioner Hoffman stated he agreed with everyone's comments tonight and recommended denial of the project. Commissioner Hoskins stated that residential use taxes the City. However, there are limited areas to develop. The Hillside Regulations should control the development footprint on this property. Commissioner Cook reiterated that the property was located in a Rural Area on the Future Land Use Plan. Motion: Commissioner Hoffman made a motion to deny RZN 15-5004. Commissioner Chesser seconded the motion. Upon roll call the motion passed with a vote of 8-1-0. Commissioner Hoskins voted "no". RZN 15-4965: Rezone (SOUTH END OF RUPPLE RD./RUPPLE ROAD EXTENSION CORRIDOR, 478): Submitted by PLANNING STAFF for property located at the SOUTH END OF RUFFLE RD. The property is zoned R -A, RESIDENTIAL -AGRICULTURAL. RSF- 8, RESIDENTIAL SINGLE FAMILY EIGHT UNITS PER ACRE; RSF-4, RESIDENTIAL SINGLE FAMILY FOUR UNITS PER ACRE; RSF-1, RESIDENTIAL SINGLE FAMILY ONE UNIT PER ACRE and contains approximately 642 acres. The request is to rezone the property to NC, NEIGHBORHOOD CONSERVATION, CS, COMMUNITY SERVICES, UT, URBAN THOROUGHFARE, and R -A, RESIDENTIAL AGRICULTURAL. Andrew Garner, City Planning Director, gave the staff report. Public Comment: Chelsea Cross, Grad student at U of A. I work at Woolsey Wet Prairie. She passed out a map showing prairie habitat on this site. She discussed that this area maintains connectivity to riparian areas. She discussed that 24 reptiles and amphibians exist on this property. Two of these are'species of greatest concern'. I am here because I want to stress the importance of this type of habitat. Connectivity between suitable habitat is key. Megan Miller, lives in Magnolia Crossing. My concern is with the Urban Thoroughfare. I enjoy having the field behind my home. I am concerned with noise behind my home. If we could extend NC a little bit further then the homes on Magnolia Crossing. My main concern is the flood zone and what will happen to the properties on Jasmine Lane. Jeff Nichol, I wanted to add the highlights of the environmental benefits of this area. The RZN area is the origin of three local streams: Owl Creek, Goose Creek, and Double Springs Creek. These water bodies may be small enough where they are not designated as streams. He discussed the prairie mounds that play together to make possible many diverse plant communities. Over 450 native plants documented in Woolsey Wet Prairie. Throw out the idea of educational opportunities of this area between Owl Creek Elementary School, Boys and Girls Club, and Pop Warner Elementary. A continuous corridor throughout the property for an outdoor living classroom. The last consideration is the close proximity of Woolsey Wetlands. It would be worth keeping in mind that the re -introduction of potentially invasive species is damaging. Charlie Sloan, one of the owners of property being rezoned. We have been working on this project for 10 years. The original design of Rupple Road, supporting the multi-million dollar treatment plant, development of Owl Creek School. This area was always what we anticipated for residential development. He discussed the plan trail along Owl Creek. We agree with what they are doing. Not that we will build that dense. We plan on keeping this greenbelt out there. This has been hayfields that have been mowed for ages. Phil ?, citizen of Fayetteville. This property shares the same seed bank as Woolsey Wet Prairie. This property is originally tall grass prairie. We have destroyed more wetland acres. I think that the potential for this property is so great environmentally because of the amount of biodiversity. This has the same variety of species as rainforest. However if it is developed I ask the city to develop the property with a conservation perspective. The approach for previous developments does not address this. I believe that between the UA there is an opportunity for cutting edge sustainable development. 9 Gerald Teague. We support the rezoning. We have used this land for 50 years. The mounds have been plowed for 50 years. We leveled the fields for farming. Matthew Wright, lives in Walnut Crossing. He discussed access into the property. I am for the Rupple Cut through. I agree with the environmentalist that it would be great to keep the western half undeveloped. No more public comment was presented. Commissioner Chesser asked the first person who spoke what they want. Chelsea Cross discussed that she wanted to present information for their recommendations. I am fine with a lot of what you are proposing. I would like for more area to be preserved and for connectivity between this site and Woolsey Wet Prairie. Commissioner Chesser requested she go meet with city planning office to discuss the issues further. Commissioner Cook asked about UT along MLK where it is not. Commissioner Brown discussed that there may need to be fine tuning and tweaking and take a closer look at the comments. Commissioner Hoffman discussed that NC may not be appropriate for a conservation development pattern. Motion: Commissioner Chesser made a motion to table RZN 15-4965 to the 4-27-15 meeting.
