1. Call to Order: 5:30 PM, Tracy Hoskins

3. Consent Agenda:
Approval of the minutes from the January 12, 2015 meeting.
VAC 14-4935: Vacation (N. RAVEN LN./COBBLESTONE SUBDIVISION, PH. 4, 207):
Submitted by JORGENSEN & ASSOCIATES for property located at NORTHERN END OF
RAVEN LN. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER
ACRE and contains approximately 0.09 acres. The request is to vacate a portion of an
existing utility easement.
VAC 14-4936: Vacation (2269 N. HENBEST DRJADVENTURE SUBARU, 325):
Submitted by JORGENSEN & ASSOCIATES for property located at 2269 N. HENBEST DR.
The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains approximately
4.78 acres. The request is to vacate a portion of an existing utility easement.
VAC 14-4933: Vacation (PERSIMMON & MTN. RANCH BLVD./PARKHILL AT MTN.
RANCH SUBDIVISION, 478/479): Submitted by JORGENSEN & ASSOCIATES for
property located at PERSIMMON & MTN. RANCH BLVD. The property is zoned R-PZD,
RESIDENTIAL PLANNED ZONING DISTRICT PARK HILL AT MOUNTAIN RANCH and
contains approximately 2.72 acres. The request is to vacate a portion of an existing utility
easement.
Motion:
Commissioner Cook made a motion to approve the consent agenda. Commissioner
Chesser seconded the motion. Upon roll call the motion passed with a vote of 8-0-0.

4. New Business:
LSD 14-4940: Large Scale Development (3600 W. PLAYER LANE/THE LINKS AT
FAYETTEVILLE PHASE 2, 361/400): Submitted by BLEW & ASSOCIATES for property
located at 3600 W. PLAYER LANE. The property is zoned R-PZD, RESIDENTIAL PLANNED
ZONING DISTRICT, and contains approximately 19.83 acres. The request is for construction
of a 456 unit apartment complex consisting of 24 structures and associated parking.
Andrew Garner, City Planning Director, gave the staff report.
Buckley Blew, applicant, stated agreement with the conditions of approval.
Ken Eastin, Urban Forester, discussed the tree preservation numbers required for the project
and conditions of approval.
Commissioner Chesser asked the applicant about the Urban Forester's comments.
Buckley Blew, applicant, discussed that they were aware of these issues and happy to meet
these conditions.
Commissioner Chesser discussed that this seemed to be a pretty straightforward project.
No public comment was presented.
Motion:
Commissioner Chesser made a motion to approve LSD 14-4940 with conditions as
recommended by staff, including conditions from the Urban Forester distributed at the
meeting. Commissioner Autry seconded the motion. Upon roll call the motion passed
with a vote of 8-0-0.
PPL 14-4865: Preliminary Plat Plan (1898 MISSION BLVD.1WHISTLER WOODS
SUBDIVISION, 370): Submitted by RANDY RITCHEY for property located at 1898
MISSION BLVD. The property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS
PER ACRE and contains approximately 8.56 acres. The request is for a 19 lot single-family
subdivision.
Jesse Fulcher, Senior Planner, explained why the applicant had tabled the project.
Public comment:
Benjamin Kobash, neighbor, stated that there were lots of trees on the eastern property line
that have grown through their fence line and asked the applicant to take caution during
construction.
No more public comment was presented.
Motion:
Commissioner Chesser made a motion to table PPL 14-4865 to the 02-09-15 meeting.
Commissioner Cook seconded the motion. Upon roll call the motion passed with a
vote of 8-0-0.

CUP 14-4937: Conditional Use (SPRING ST. BETWEEN EAST & COLLEGE
AVE./SPRING STREET OFFICE, 484): Submitted by BLEW & ASSOCIATES for property
located at SPRING ST. BETWEEN EAST & COLLEGE AVE. The property is zoned MSC,
MAIN STREET CENTER and contains approximately 0.12 acres. The request is for off-site
and shared parking.
Quin Thompson, Current Planner, read the staff report.
Brant Barnes, owner of the property, said that the goal was to improve downtown Fayetteville
and added that the project was going to be awesome.
Andrew Henson, applicant, said that he wants to build a small office in which locate his
business.
No public comment was presented.
Derek Linn, Urban Forester, gave his opinion on the variances necessary to construct the
project as submitted, indicating that the variances were justified in this case.
William Chesser, Commissioner, asked the applicants if they accepted the conditions of
approval as recommended by staff.
Jorge DuQuesne, applicant's representative, said that his clients were ok with the conditions.
Tracy Hoskins, Chair, asked staff if the alley on the east is a public or private alley.
Thompson replied that it is a platted public alley with right-of-way.
Hoskins asked if the project was required to meet parking lot design standards.
Andrew Garner, City Planning Directory, said that the off-site parking lot is not being
developed but is rather an existing use and is not required under the Unified Development
Code (UDC) to meet parking lot design standards.
Duquesne said that the intention is to improve the parking lot.
Hoskins asked the applicant if he was saying the plan was to bring the entire project into
compliance with the UDC.
Duquesne responded that the project will make improvements as required by the SIP (small
site improvement plan) review process.
Hoskins asked the City Attorney if the Planning Commission is allowed to impose conditions
of approval as a part of a CUP.
Kit Williams, City Attorney, replied that the Commission may ameliorate the impacts that a
requested use will cause. He added that in this case, if the two parcels in question were under
the same ownership, then the parking lot would be required to be brought into full compliance
with UDC, so it is confusing to imagine why improvements would not be required simply
because the lots happen to be under different ownership.

Chesser said that staff appeared to be comfortable with the recommended improvements,
and indicated his support.
Motion:
Commissioner Chesser made a motion to approve CUP 14-4937 as recommended by
staff. Commissioner Selby seconded the motion. Upon roll call the motion passed with
a vote of 8-1-0. Commissioner Hoskins voted "no".
VAR 14-4939: Variance Request (SPRING ST. BETWEEN EAST & COLLEGE
AVE./SPRING STREET OFFICE, 484): Submitted by BLEW & ASSOCIATES for property
located at SPRING ST. BETWEEN EAST & COLLEGE AVE. The property is zoned MSC -
MAIN STREET CENTER, and contains approximately 0.12 acres. The request is for a
variance to the 15' greenspace requirement between the parking lot and Spring Street and
a variance of the 5' greenspace requirement between the parking lot and eastern property
line.
This item was discussed concurrently with CUP 14-4937 above.
Motion:
Commissioner Chesser made a motion to approve VAR 14-4939 in favor of both variances
with conditions as stated by staff. Commissioner Autry seconded the motion. Upon roll
call the motion passed with a vote of 9-0-0.
Commissioner Bunch arrived during the discussion of these items.
RZN 14-4938: Rezone (N.W. OF CROSS & MAINE INTERSECTIONIWEST END
ADDITION, 520): Submitted by BATES & ASSOCIATES for property located N.W. OF
CROSS & MAINE INTERSECTION. The property is an expired R-PZD, RESIDENTIAL
PLANNED ZONING DISTRICT and contains approximately 2.54 acres. The request is to
rezone the property to RMF -24, RESIDENTIAL MULTI FAMILY, 24 UNITS PER ACRE.
Quin Thompson, Current Planner, read the staff report.
Andrew Henson, applicant, said that he is seeking zoning for the property to allow
development.
Public comment
Tom Brown, neighbor, said that Maine Street is comprised of single-family and duplex
development. He said that he felt the requested zoning would be incompatible with the area,
citing topography and narrowness of the streets.
No more public comment was presented.
Sarah Bunch, Commissioner, asked staff when the previous RMF -24 zoning was applied to
the area.
Thompson responded that it was likely in the late 1960's or 1970's.
Tracy Hoskins, Chair, said that he was not comfortable with the proposed zoning
Kyle Cook, Commissioner, said that he felt the RMF -24 zoning was not appropriate, adding
that he had supported higher density with the guarantees provided by the now expired PZD,
but that he could support RSF-8 in this area.
William Chesser, Commissioner, said that the felt torn, in part because of the surrounding
RMF -24 zoning, however ultimately felt RMF -24 was inappropriate.
Kit Williams, City Attorney, said that the Commission should make a zoning recommendation
to the council, as the land is currently without zoning and development rights. He added that
the applicant would have time to discuss their proposal with staff before the Council meeting.
Craig Honchell, Commissioner, said that his concern was with future traffic impact as a result
of the proposed zoning.
General discussion of implications of denying or forwarding with a different zoning
recommendation followed.
Motion #1:
Commissioner Cook made a motion to deny RZN 14-4938. Commissioner Selby
seconded the motion. Upon roll call the motion passed with a vote of 7-2-0.
Commissioners Noble and Chesser voted "no".
Motion #2:
Commissioner Cook made a motion to forward RZN 14-4938 to City Council with a
recommendation of RSF-8. Commissioner Autry seconded the motion. Upon roll call
the motion passed with a vote of 7-2-0. Commissioners Noble and Chesser voted
"no".
