1. Call to Order: 5:30 PM, Tracy Hoskins

3. Consent Agenda:
Approval of the minutes from the December 8, 2014 meeting.
ADM 14-4928: Administrative Item (617 N. COLLEGE AVE./NATURAL STATE
SANDWICHES, 445): Submitted by AMBER CAFOUREK for property located at 617 N.
COLLEGE AVE. The property is zoned C-2, THOROUGHFARE COMMERCIAL and
contains approximately 0.42 acres. The request is for a Mobile Vendor Annual Permit.
ADM 14-4930: Administrative Item (3600 W. PLAYER LANE/THE LINKS AT
FAYETTEVILLE, 400): Submitted by HUGH JARRETT, ESQ. for property located at 3600
W. PLAYER LANE. The property is zoned R-PZD, RESIDENTIAL PLANNED ZONING
DISTRICT LINKS AT FAYETTEVILLE (R-PZD 07-2452) and contains approximately 152.23
acres. The request is to repeal the phasing plan for the Links at Fayetteville PZD and bring
the project under the current ordinance that separates zoning from the development.
Motion:
Commissioner Cook made a motion to approve the consent agenda. Commissioner
Selby seconded the motion. Upon roll call the motion passed with a vote of 8-0-0.
Commissioner Chesser arrived after the consent agenda.

4. New Business:
PPL 14-4847: Preliminary Plat (NORTHEAST CORNER RUPPLE RD. AND N. GOLF
CLUB DR./FAYETTEVILLE ROW HOMES, 400): Submitted by BLEW & ASSOCIATES for
property located at NORTHEAST CORNER OF RUPPLE RD. AND N. GOLF CLUB DR. The
property is zoned R-PZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains
approximately 5.00 acres. The request is for a 39 lot single family subdivision.
Andrew Garner, City Planning Director, gave the staff report.
Kit Williams, asked the applicant about the condition of approval recommended by staff
regarding the City retaining the money for a few more years and to be able to use the money
potentially for a round -a -bout on Rupple.
Kim Fugitt, applicant, discussed that they did have some concerns with the City retaining
the money and would like to have the money back if they could, but they would be agreeable
to the conditions.
No public comment was presented.
Commissioner Chesser discussed the Subdivision Committee report. I would prefer the
city hold the money until we figure out what we will do. I think it is possible that a rounda-
bout may be able to be used in the future.
Williams discussed that prior to spending any of the money the City will consult with the
developer to make sure they are agreeable with the street improvements.
Motion:
Commissioner Winston made a motion to approve PPL 14-4847 as recommended by
staff. Commissioner Chesser seconded the motion.
Commissioner Hoskins asked about City Engineering staff about a round -a -bout.
Jonathan Ely, City Engineering, discussed the feasibility of a round -a -bout. At this point we
haven't made any decisions but that is an option to consider.
Commissioner Hoskins asked about it being too close to other signals.
Garner discussed the desire to discuss the signal further with the state highway department
in the future and that there may be other information that could be presented to the state to
potentially gain approval for this signal.
Upon roll call the motion passed with a vote of 9-0-0.
CUP 14-4898: Conditional Use (4253 N. CROSSOVER RD./PINEY RIDGE HOSPITAL
PARKING, 138): Submitted by INGRAM CIVIL ENGINEERS for property located at 4253 N.
CROSSOVER RD. The property is zoned P-1, INSTITUTIONAL and contains approximately
1.00 acre. The request is for additional parking.
Quin Thompson, Current Planner, read the staff report.
Jerry Barber, representing the applicant, explained that the facility was growing and that
parking was required in order to achieve that growth.
No public comment was presented.
Motion:
Commissioner Chesser made a motion to approve CUP 14-4898 as recommended by
staff. Commissioner Autry seconded the motion. Upon roll call the motion passed with
a vote of 9-0-0.
CUP 14-4918: Conditional Use (940 WEST MAPLE ST./CHI OMEGA HOUSE, 444):
Submitted by DEVELOPMENT CONSULTANTS, INC. for property located at 940 WEST
MAPLE ST. The property is zoned RMF -40, RESIDENTIAL MULTI FAMILY, 40 UNITS PER
ACRE and contains approximately 0.80 acres. The request is for off-site parking.

Jay Young, applicant, discussed the historic nature of the building, the greenspace variance
along Oakland, the patio function and that the project was about adding better spaces within
the building. We need clarification on item #4 and 5 regarding bonding the street trees along
Maple; item #8 concerning the greenspace adjacent to the parking at the rear; and item #9
concerning the urban tree wells.
Sonia Jones (former Chi Omega member/Housing Committee), discussed the background
and how the building and landscape plans were developed.
Jamie Sims (former Chi Omega member/Housing Committee), discussed efforts to design
around the existing trees.
No public comment was presented.
Commissioner Hoskins asked the commission to address the conditional use permit first.
Motion:
Commissioner Chesser made a motion to approve CUP 14-4918 as recommended by
staff. Commissioner Autry seconded the motion. Upon roll call the motion passed with
a vote of 9-0-0.
LSD 14-4919: Large Scale Development (940 WEST MAPLE ST./CHI OMEGA HOUSE,
444): Submitted by DEVELOPMENT CONSULTANTS, INC. for property located at 940
WEST MAPLE ST. The property is zoned RMF -40, RESIDENTIAL MULTI FAMILY, 40
UNITS PER ACRE and contains approximately 0.80 acres. The request is to reconstruct
14,700 square feet and add 12,155 square feet to an existing sorority house.

Commission Selby stated the smaller trees required by the Fire Department warrant a
smaller greenspace.
Commissioner Hoskins stated the patio was expanded out to accommodate gatherings.
Don't see any reason to add tree wells in this location.
Fulcher clarifies the requirements concerning items mentioned by applicant.
Derek Linn, Urban Forester, stated that tree wells weren't recommended.
Andrew Garner, City Planning Director, discusses the differences between greenspace
requirements between single-family and multi -family development.
Linn stated that smaller trees can be permitted, but the greenspace is still needed.
Commissioner Chesser stated that the trees along Maple will be worked out with staff,
okay with the shrub screen on Oakland and 10' of greenspace, but disagrees with the
greenspace variance along the patio; don't see a hardship.
Commissioner Hoskins asked staff about the applicant's "notching" of the building around
the tree.
Linn stated that the tree is not counted as preserved due to compaction.
Commissioner Hoskins asked staff if they were okay with them cutting down the tree.
Linn stated that it won't change their calculations.
Kit Williams, City Attorney, told the commission to think about "why" the City Council has
passed the ordinances we are discussing. The owner maintains a beautiful property and
should get the benefit of the doubt.
Commissioner Autry, discussed the improvements along Oakland and stated that he
supported the variances.
Commissioner Hoskins asked to vote on item #8 separately. The applicant stated they
would preserve the tree by the patio, but there's no condition to require it.
Linn stated that they've volunteered to place tree protection fencing around the tree.
Commissioner Hoskins asked about root pruning.
Young stated that they will save the tree and take necessary measures to ensure it's
survival.
Motion #1:
Commissioner Winston made a motion to approve condition #8 for LSD 14-4919 in favor
of the variance as requested. Commissioner Selby seconded the motion. Upon roll call
the motion passed with a vote of 7-2-0. Commissioners Chesser and Cook voted `no'.
Motion #2:
Commissioner Winston made a motion to approve LSD 14-4919 finding in favor of all
variances as requested (no tree wells required under any circumstance). Commissioner
Selby seconded the motion. Upon roll call the motion passed with a vote of 8-1-0.
Commissioner Chesser voted 'no'.

RZN 14-4916: Rezone (956 RAY AVENUE/NODOUS, 565): Submitted by KIM HODOUS for
property located at 956 RAY AVENUE. The property is zoned RMF -24, RESIDENTIAL MULTI
FAMILY, 24 UNITS PER ACRE and contains approximately 0.32 acres. The request is to
rezone the property to NS, NEIGHBORHOOD SERVICES.

Kim Hodous, applicant, had no comments.
No public comment was presented.
Kit Williams, City Attorney, asked if the building will meet the setbacks in the new zoning
district. Just want the applicant to realize that the building may be nonconforming.
Fulcher stated that the building is already a nonconforming structure and they may not
change with the zoning change. The real issue being addressed is the nonconforming use of
the building, which is much more restrictive than the nonconforming structure regulations.
Commissioner Honchell asked the applicant if they had any questions.
Hodous asked if the nonconforming structure code would be a problem for selling the
property.
Andrew Garner, City Planning Director, stated that it depends on the buyer of the property.
Motion:
Commissioner Chesser made a motion to forward RZN 14-4916 to City Council with a
recommendation of approval. Commissioner Honchell seconded the motion. Upon roll
call the motion passed with a vote of 9-0-0.

R-PZD 14-4924: Residential Planned Zoning District (SOUTH SHILOH DR./HAWKINS
HOUSE AT SHILOH VILLAGE, 519): Submitted by BATES & ASSOCIATES for property
located at SOUTH SHILOH DR. The property is zoned RMF -24, RESIDENTIAL MULTI
FAMILY, 24 UNITS PER ACRE and contains approximately 10.73 acres. The request is to
rezone the property to R-PZD, Residential Planned Zoning District.
Jesse Fulcher, Senior Planner, read the staff report.
Geoff Bates, applicant, had no comments.
No public comment was presented.
Commissioner Chesser asked if this would be required if they were public streets.
Fulcher stated that it wouldn't. They could subdivide the property under the current zoning
designation if the streets were public.
Kit Williams, City Attorney, asked if they streets could be public.
Fulcher stated they were not built to City standards and we would not accept them as City
streets at this point.
Motion:
Commissioner Chesser made a motion to forward R-PZD 14-4924 to City Council with a
recommendation of approval. Commissioner Autry seconded the motion. Upon roll call
the motion passed with a vote of 9-0-0.
PPL 14-4929: Preliminary Plat Plan (SOUTH SHILOH DR./HAWKINS HOUSE AT SHILOH
VILLAGE, 519): Submitted by BATES & ASSOCIATES for property located at SOUTH
SHILOH DR. The property is zoned RMF -24, RESIDENTIAL MULTI FAMILY, 24 UNITS PER
ACRE and contains approximately 10.73 acres. The request is for 91 townhouse lots.

Commissioner Chesser made a motion to approve PPL 14-4929 as recommended by
staff. Commissioner Selby seconded the motion. Upon roll call the motion passed with
a vote of 9-0-0.

RZN 14-4883: Rezone (HWY. 112 NORTH OF TRUCKERS DRIVE/PARKWEST, 208/209):
Submitted by PLANNING STAFF for property located at HWY. 112 NORTH OF TRUCKERS
DRIVE. The property is zoned R-PZD 05-1796, RESIDENTIAL PLANNED ZONING
DISTRICT PARK WEST and contains approximately 93.13 acres. The request is to rezone
33.40 acres to RSF-8, RESIDENTIAL SINGLE FAMILY, 8 UNITS PER ACRE and 59.73 acres
to CS, COMMUNITY SERVICES.

Commission Chesser stated he had no problems with the proposal. It gives development
rights back to the owner and they can always ask to rezone the property in the future.

Commissioner Chesser made a motion to forward RZN 14-4883 to City Council with a
recommendation of approval. Commissioner Selby seconded the motion. Upon roll call
the motion passed with a vote of 9-0-0.

RZN 14-4882: Rezone (EAST SIDE OF RUPPLE RDMESTSIDE VILLAGE, 439):
Submitted by PLANNING STAFF for property located ON THE EAST SIDE OF RUFFLE RD.
NORTH OF THE BOYS AND GIRLS CLUB. The property is zoned R-PZD 06-1884,
RESIDENTIAL PLANNED ZONING DISTRICT WESTSIDE VILLAGE and contains
approximately 21.63 acres. The request is to rezone the property to NS, NEIGHBORHOOD
SERVICES.
