1. Call to Order: 5:30 PM, Tracy Hoskins

3. Approval of the minutes from the July 28, 2014 meeting.
CCP 14-4787: Concurrent Plat (4124 E. MISSION BLVD./VENEMA, 610): Submitted by
KIMBERLY PUCKETT for property located at 4124 E. MISSION BLVD. The property is in
the FAYETTEVILLE PLANNING AREA and contains approximately 8.35 acres. The request
is to re -plat 1 existing lot into 4 single lots approximately 2.36, 2.30, 2.31, and 1.45 acres
each.
Motion:
Commissioner Chesser made a motion to approve the consent agenda. Commissioner
Winston seconded the motion. Upon roll call the motion passed with a vote of 7-0-0

4. New Business:
LSP 14-4804: Lot Split (LOT 14 — INDUSTRIAL PARK WEST/PACIFIC VET GROUP, 447):
Submitted by CITY STAFF for property located at LOT 14 IN INDUSTRIAL PARK WEST. The
property is zoned 1-2, GENERAL INDUSTRIAL and contains one tract totaling approximately
37.06 acres. The request is to split the property into two tracts containing approximately 24
and 13.06 acres each and for a variance to create a lot without frontage on a public water line.

No public comment was presented.
Kit Williams, City Attorney, stated that keeping the land separate will allow the City to protect
it from development.
Motion:
Commissioner Chesser made a motion to approve LSP 14-4804 as recommended by
staff. Upon roll call the motion passed with a vote of 7-0-0.
LSD 14-4791: Large Scale Development (3500 W. BLACK FOREST DR./STARBUCKS
CENTER, 440): Submitted by MORRISON-SHIPLEY ENGINEERS for property located at
3500 W. BLACK FOREST DR. The property is zoned R-PZD, RESIDENTIAL PLANNED
ZONING DISTRICT, and contains approximately 1.19 acres. The request is for construction
of a 6,176 square foot building and associated parking.

No public comment was presented.
Motion:
Commissioner Winston made a motion to approve LSD 14-4791. Commissioner Cook
seconded the motion. Upon roll call the motion passed with a vote of 7-0-0.
CUP 14-4699: Conditional Use (EAST MISSION BLVD./MISSION BLVD DEVELOPMENT,
370/371): Submitted by ECOLOGICAL DESIGN GROUP for property located at E. MISSION
BLVD. The property is zoned NC, NEIGHBORHOOD CONSERVATION, CS, COMMUNITY
SERVICES, AND RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains
approximately 15.94 acres. The request is for a conditional use permit to create seven tandem
lots and six townhouse lots (two, three-family dwellings) within the development.
PPL 14-4698: Preliminary Plat (EAST MISSION BLVD./MISSION BLVD
DEVELOPMENT, 371): Submitted by ECOLOGICAL DESIGN GROUP for property located
on E. MISSION BLVD. The property is zoned NC, NEIGHBORHOOD CONSERVATION,
CS, COMMUNITY SERVICE, AND RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER
ACRE and contains approximately 15.94 acres. The request is for a 63 lot residential
subdivision.
Jesse Fulcher, Senior Planner, read the staff report for both projects
Laurence Fine, applicant, stated that the density has been reduced from the Ruskin Heights
project, but that it's still a very walkable neighborhood. A covenant has been added to protect
trees on private lots as discussed at Subdivision Committee.
Ken Eastin, Urban Forester, stated that canopy on the north side of street will be impacted
by this phase. Mitigation is required in this phase of development.
Commissioner Cook stated that they discussed trees and street condition at the Subdivision
Committee meeting.
Commissioner Winston stated they discussed the detention pond at the Subdivision
Committee meeting.
Glenn Newman, Staff Engineer, stated that the detention pond didn't need to be redesigned
from Subdivision Committee.
Commissioner Hoskins stated that the Bill of Assurance is still in place from the rezoning.
Public comment:
Joann Kvamke, neighbor, stated she wanted to see the next phase of the development, the
whole project needs to be determined now to allow proper detention design, asked if the
tree analysis plan was based on current tree canopy or pre -Ruskin Heights. Mayor Coody
stated during the Ruskin Heights project that the road to Greenview would be a right turn
only.
Fred Sherman, neighbor, stated that it's very difficult to access Mission and that a traffic
light should be looked at.
Don Conner, neighbor, stated they don't know if this project is less dense or not without
seeing the rest of the development plan, the road to Greenview needs to be right turn only.
The schools in the area are full. What plans are there for the houses? Did they conduct a
new traffic study?
Jonelle Booth, neighbor, asked how tall the houses can be? Concerned about drainage.
Cynthia Parker, neighbor, stated she was happy with the density over the last project.
James Sledge, neighbor, asked about the size of the second detention pond, for
clarification on tandem lots and to clarify the connection to Greenview.
Daniel O'Donnell, neighbor, stated he would like to see full project, there are drainage and
sewer problems up the hill, no curb or gutters on their streets. Would like to know if retaining
wall construction is review, Concerned with cutting into the hillside below their properties.
Latrie Sherman, neighbor, would like to know about on -street parking, phase two of project
and use of greenspace.
Ron Whorton, neighbor, stated that property is ill-suited for development, no one wants
commercial on the property by Mission, homes should all be owner -occupied.
No more public comment was presented.
Commission Hoskins asked Urban Forestry to discuss the trees.
Eastin stated that a new inventory was taken for this project. Some canopy has grown up
since the Ruskin Heights projects. Is unaware of any past mitigation requirements.
Commission Hoskins asked if Rusking Heights was over five years old.
Newman stated that the project is over five years old and expired.
Commission Hoskins stated that the Commission is only looking at phase one at this time
and asked Engineering about detention.
Newman stated that the ponds are designed for all future phases, based on planned
development pattern. The engineers for the project are going back to the original drainage
patterns prior to Ruskin Heights to determine appropriate detention design for this project.
Commissioner Hoskins asked staff to address the traffic study and turn lane questions.
Newman stated that this phase of development is much less dense than the same area
proposed in Ruskin Heights. No additional street improvements are being recommended at
this time, given what improvements have already been completed.
Commission Hoskins asked staff to address the retaining walls.
Newman stated that all retaining walls over 4 feet in height must be designed by an
engineer. All homes within the Hillside/Hilltop District will have an engineered foundation
and grading permits.
Commissioner Hoskins asked about home height.
Fulcher stated that the maximum height is 45 feet.
Commissioner Chesser asked about allowing a traffic signal on Mission.
Newman stated that it's a state highway and approval must be granted by AHTD for a new
traffic signal. The Ruskin Heights project, which was much more dense, did not warrant a
traffic signal on Mission.
Commission Chesser discussed the use of tandem lots in the development. The layout
and use of them in this case are unique. Can staff address ownership and design of homes?
Fulcher stated that the city can't require the homes to be owner -occupied or control the
number of bedrooms.
Commissioner Chesser asked about on -street parking.
Newman stated that some of the streets are designed to allow on -street parking and all
streets must meet the minimum fire code requirement of 20 feet. The engineer provided an
auto -turn analysis and provided some roll-over curbs for the fire department.
Commissioner Chesser stated he would like more density in this location.
Commissioner Bunch asked about the sidewalk on Mission.
Newman stated the sidewalk in front of the project will be widened to 12 feet as a trail
segment.
Commission Winston noted asked about the detention pond being used by the
neighborhood.
Fine stated that the pond is for detention, but it's designed so it can be used as a passive
recreation area for the neighborhood.
Commission Chesser clarified that he's had no involvement in the project, since it was
Ruskin Heights, which he worked on.
Motion:
Commissioner Chesser made a motion to approve CUP 14-4699 and PPL14-4698 as
recommended by staff. Commissioner Autry seconded the motion. Upon roll call the
motion passed with a vote of 7-0-0.
RZN 14-4794: Rezone (NORTHEAST CORNER OF TREADWELL STREET AND
DUNCAN AVENUE/HARVEY'S HILL, 522): Submitted by SPECIALIZED GROUP for
property located at NORTHEAST CORNER OF TREADWELL STREET AND DUNCAN
AVENUE. The property is zoned RMF -40, RESIDENTIAL MULTI FAMILY, 40 UNITS PER
ACRE and contains approximately 1.54 acres. The request is to rezone the property to DG,
DOWNTOWN GENERAL.
Jesse Fulcher, Senior Planner, the applicant would like to table this request.
Seth Mims, applicant, asked the commission to table the request until the next meeting.
Motion:
Commissioner Winston made a motion to table RZN 14-4794. Commissioner Chesser
seconded the motion. Upon roll call the motion passed with a vote of 7-0-0.

RZN 14-4793: Rezone (SW CORNER OF N. STEELE BLVD. AND W. JOYCE BLVD./CMN
BUSINESS PARK, 173): Submitted by SPECIALIZED GROUP for property located at SW
CORNER OF N. STEELE BLVD. AND W. JOYCE BLVD. The property is zoned C-2,
THOROUGHFARE COMMERCIAL and contains approximately 14.01 acres. The request is
to rezone the property to C-3, CENTRAL COMMERCIAL
Quin Thompson, Current Planner, read the staff report.
No public comment was presented.
Seth Mims, Applicant, said that his company was planning a development on the site
comprised of multi -family housing and some commercial use. He said that he believes in
Urbanism, and strives to include urban design principles in his projects, but that in this case a
form based code such as CS [Community Services] would not be feasible due to large existing
easements and challenging topography as noted by staff.
Kit Williams, City Attorney, made the applicant aware that the City of Johnson would also
have to approve the request before the rezone would be effective.
Mims indicated that the request was on an upcoming City of Johnson agenda already.
William Chesser, Commissioner, said that he supported the request, finding that more
residential use in the area was supported by the City Plan 2030, and that currently there was
no significant pedestrian traffic in the area, a condition which he hoped that residential
development would improve.
Tracy Hoskins, Chair, asked staff if a Conditional Use Permit was still available if the City of
Johnson denied the request.
Jesse Fulcher, Senior Planner, said that in fact multi -family residential was not a use allowed
by CUP in the C-2 zone, but it is allowed as an accessory use alongside commercial
development, and limited to 50% of the square footage of the overall commercial
development.
Motion:
Commissioner Chesser made a motion to forward RZN 14-4793 to City Council with a
recommendation for approval. Commissioner Honchell seconded the motion. Upon roll
call the motion passed with a vote of 7-0-0.
